ANCHORAGE RECORDING DISTRICT
A RESOLUTION APPROVING THE MODIFICATION OF NOTE 8 ON PLAT
2005-152, FOR DENALI VUE SUBDIVISION, LOTS 1-8.
WHEREAS, a petition has been received from Michael E. Anderson,
P.E. representative, and MM&M Contracting, Inc., owner, for
modification of Note 8 on Plat 2005-152, for Denali Vue Subdivision, Lots
1-8; and
WHEREAS, notices were published, posted and mailed and a
public hearing was held on November 6, 2013.
that: NOW, THEREFORE, BE IT RESOLVED by the Platting Authority
I. The Platting Board makes the following findings of fact:
a. The Board heard testimony from the petitioner's
representative and was provided with information in the staff
packet from Michael Anderson Engineering, Inc. which
supported the use of individual wells or a Class C well
system.
b. The Chugiak Community Council was notified and provided
no response.
C. The On -Site Water and Wastewater Services Division has no
objection to the service from a well or a Class C system.
d. This modification to Note 8 will allow homeowners to obtain
water from the existing Class C well and water system of drill
a single family well.
e. Onsite Water and Wastewater section and the Alaska
Department of Natural Resources have reviewed the request
and stated no objections.

2. The Platting Board APPROVES the modification of Note 8 on Plat
2005-152 for the aforementioned property to state:
"Each lot owner in the subdivision shall have the
option of drilling and obtaining water from a single
family well or obtaining water from a Class C well and
water system currently in place in the subdivision that
is designated to service that lot owner's lot, as long as
either option utilized is done in accordance with the
Alaska Water Use Act (AS 46.15) and regulations
thereunder (11 AAC 93)."
APPROVED by the Anchorage Platting Authority this day of
July 2020.

Dear Ms. Wockenfuss:
This letter is in response to Mike Anderson's (Anderson Engineering) July 16, 2013 and
subsequent supporting email requests that the Alaska Department of Natural Resources; Division
of Mining, Land and Water; Water Resources Section issue a letter of non -objection to the
proposed change to the wording of the above referenced plat note that was contained within
Mike Anderson's August 11, 2013 email. The wording of the proposed plat note no. 8
contained in Mike Anderson's August 11, 2013 email is: "Each lot in the subdivision shall have
the option of drilling a single family well which meets the current requirements of the State of
Alaska Department of Natural Resources (DNR) or obtaining water from a Class C Well and
Water System currently in place with services to each lot.".
The DNR Water Resources Section suggests a slightly different wording to the proposed change
to plat note no. 8 as follows: "Each lot owner in the subdivision shall have the option of drilling
and obtaining water from a single family well or obtaining water from a Class C Well and Water
System currently in place in the subdivision that is designated to service that lot owners lot, as
long as either option utilized is done in accordance with the Alaska Water Use Act (AS 46.15)
and regulations thereunder (11 AAC 93).". With this slightly different proposed wording, the
DNR Water Resources Section does not object to changing the current Note No. 8 on Denali Vue
Subdivision Plat 2005-152, Anchorage Recording District. However, this non -objection letter
does not represent any assurance that adequate water supply (as to water quantity or water
quality) can be obtained from any current or future water well (Class C, single family, or other
category of well) installed within or in the vicinity of the Denali Vue Subdivision.

Pursuant to Alaska Administrative Code Section 11 AAC 93.03_5, a person must submit an
application for water right or an application for temporary use of water before constructing
works for an appropriation and before diverting, withdrawing, impounding or using a significant
amount of water. This non -objection letter does not represent any assurance that, after
adjudication of any such application related to the Denali Vue Subdivision, a permit to
appropriate water, certificate of appropriation, or temporary water use authorization will be
issued.
Pursuant to Alaska Administrative Code Section 11 AAC 93.930(a), a person who proposes to
make any of the water intake, water use, or water discharge changes described therein must first
apply in writing for permission to make the change and be issued the necessary change permit,
amended permit to appropriate water, and/or amended certificate of appropriation before making
the change. This non -objection letter does not represent any assurance that, after adjudication of
any such change request related to the Denali Vue Subdivision, the requested change will be
approved. Similarly, this non -objection letter does not represent any assurance that a requested
amendment to any temporary water use authorization issued, or that may be issued, in connection
with the Denali Vue Subdivision will be approved. Please let me know if you have any questions
