of Record of Lot 49 Block 1~ Eaglebrook Subdivisionr hereinafter
called the Grantees known as Jack White Company.
WITNESSETH: That for in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration9 the receipt
whereof is hereby acknowledged9 the Grantor does hereby grant unto
the Grantees the right9 to maintain a drainage facility and to do
what is ; necessary and useful in the performance of installation
and construction and maintenance within or on the property described
as follows:
A twenty foot wide drainage easement along
the west side of lot 3r block lr Eagelbrook
Subdivision as shown on Exhibit Ir attached
as part of this Easement9
and that only such right in the land above described shall be
necessary for the operation and maintenance9 of said facility9
reserving unto the property owners the right to use said property in
any way and for any purpose not inconsistent with the rights hereby
acquired: provided that the Grantees shall have the right without
prior institution of any suit or upon said property for the purposes
herein described~ without incurring any legal obligation or
liability therefore; provided that such work shall be accomplished
in such a manner that the private improvements and landscaping
existing in said easement area shall not be disturbed or destroyed~
or in the event that they are disturbed or destroyed~ they shall be
replaced in as entered upon by the Grantees,
This Easement shall be a covenant running with the land and shall be
binding on the Grantor9 their heirsr ~xecutorsr administrators and
assigns forever.

AGREENiENT
This agreement is made to resolve potential problems relative to
the use of an existing drainage ditch and pipe across Tract
Eaglebrook Subdivision Addition No. 1o The owners of Lots 1 ,
through 4~ Block 1, Eaglebrook Subdivision require continued'use
of the drainageway to ensure adequate drainage of their property
for approval of septic sewer systems° The owners of Tract A-1
wish to allow continued use of the drainagewayv without
responsibility for maintenance
The owners of Tract A-1 agree to provide a legal easement for
the drainagewayt and will record the proper document, a copy of
which is attached to this agreement.
The owners of Lots 1~2,3, & 4, Block ], Eaglebrook Subdivision~
agree to the following conditions.
e
Owners of Lots 1 through 4 shall install and bury a
6 inch perforated pipe within the easement. This pipe
will connect the existing perforated pipe within Tract
A-1 to the existing pipe at the east end of the ditoh~
Material used to bury the pipe shall be taken from the
existing berm located on the west side of the ditcho No
other material on Tract A-1 will be used as backfill,
Equipment used for backfilling of the ditch shall be
limited to a backhoe.
4o Construction activities shall be confined between the
existing easterly ditch bank a'nd the westerly berm edge°
5. Construction equipment shall be allowed access along the
westerly side of the existing ditch beginning at the
easterly property line of Tract A-1. Access will not be
allowed across Tract A-1 from Andover Circle.
6. Cleanouts. shall be place~il at all pipe angle points and
and the north end of the existing pipe on Tr
7o Maintenance of the pipe shall be the total
responsibility of Lots 1~2~3 & 4. The Owners of Tract
A-1 assume no liability for the existing or proposed
pipe. "
8o Owners of Tr. A-1 shall be notified if future
maintenance of the pipe requires excavation on Tro A-1.
The above Conditions are accepted and acknowledged.

Subject: Drainage Block 1 Eaglebrook Subdivision
The following is a list of the terms of agreement reached by
Mr. Sanderson, Mr. Corwin and Mr. Shore and Mr. Grenier at our
June 5, 1987 meeting concerning Lots 3, 4 and Tract A-1 Block
1 Eaglebrook Subdivision.
Removal of the remaining perforated pipe on Lot 4o
Locking caps to be provided for the monitoring tubes on
Lots 3 and 4, with groundwater levels monitored thru
September 30, 1987 by Corwin and Associates.
Design a new drain, in the current location. Record said
drainage as a private use and maintenance easement.
Easement work to be completed within thirty (30) days.

Dear Ms. Oswalt:
As a follow up to our letter dated April 21, 1987, we are
writing to advise you that the solid pipe portion of curtain
drain which we had origianlly questioned has been verified to
be as shown on our original submittals to your office.
The verification took place shortly
correspondence and was as follows:

1o The curtain drain located between Lots 2 and 3 was
exposed.
2o The perforated pipe was removed~
A solid pipe was replaced in the original location to
the ditch°
We have been unable to monitor ground water due to the fact
that no drainage is occuring and the drain line from the ditch
to the southwest is completely plugged°

Dear Ms. Oswalt:
We have discovered that the information provided to us
pertaining to the curtain drains on the above referenced
property was in error° Since these drains were already
installed prior to our inspections, we were not able to verify
the construction techniques or materials used° This is not an
unusual case as there are no current regulations for
inspections of curtain drains during construction. We are very
concerned about this matter and we are in the process of having
the drains exposed for final verification°
Our concerns center around the solid drain pipe which was to be
between Lots 2 and 3° We plan to ensure that this is the case
and inspect the installation of solid pipe° We also plan to
monitor the groundwater level on both lots after our inspection
is complete. We will keep your office completely informed of
all work on the referenced property and advise you of the
outcome.
We recommend that your department not issue any further permits
b~ approve any inspection reports on the subject property until
we are able to report back to your office.
It is our hope that you realize that 'we are making every effort
to perform all our work to ensure that there are no problems in
the future with these lots and the subsequent homeowners.
