The permit for the construction of a well and septic system on Lot 12, Harmany Ranch-Eaglet
Aerie, has expired. A site visit was conducted and there have been no substantial changes to this
lot or to the surrounding area since the permit was originally issued.
Since that time, however, we have discussed the project with the client and the decision is to adjust
the design to specify Cat III Advanced Treatment, due to the variable soils and high groundwater.

Special Provisions:
1. Two test holes are required prior to construction of the absorption field, in the locations shown on the site
plan, to confirm minimum separation to impermeable soil and seasonal high groundwater, as well as
percolation rate. Construction may proceed at your own risk prior to 7 -day groundwater monitoring. If
results require a design change, construction shall stop pending approval of a change order. Please
submit results with the inspection report (or change order, if required).

Septic system design
Dear On-Site Services Engineer:
The owner of the above lot intends to build a 4-bedroom home on the property, so we are
submitting this permit application for the construction of a new well and septic system. The
attached site plan identifies the location of the home as well as the proposed well, septic location
and alternate site. No conflicts exist between this proposed system and any other well or septic
system, whether on this lot or adjacent lots.
The ground surface on the lot slopes toward the south, in some areas at greater the 46%. The
proposed septic system is in an area where slopes are much milder, however, the it is within 100’
upgradient of those slopes greater than 46%. Please refer to the attached slope cross section for
demonstration of the worst-case scenario of effluent travel given the existing grade of the property.
We expect no daylighting of effluent. Elevations are shown on the site plan showing the grade and
direction of flow. Stormwater drainage will not impact this septic system. The new trench will be
constructed parallel to the slope as much as possible.
Due to the groundwater depth in Test Hole #9A in conjunction with the depth of receiving soils
found onsite in Test Hole #1, ERS may be necessary in order to utilize the receiving soil strata
while meeting separation to groundwater. MOA Wastewater Code allows this for CAT III nitrate
reducing systems. We would like to propose the use of ERS in this proposed design given the
following justification:
ERS Justification - The well log for Lot 10 to the east records a clay layer between 69’ and 320’
before drilling to a total depth of 472’. Additionally, a clay layer was encountered in Test Hole #1
at 18’ within 60’ of the proposed septic location. We expect this clay layer to be impervious or
nearly impervious, and if effluent should ever reach this depth, it will simply run across the top of
the clay strata horizontally and continue downhill rather than intermingle with local aquifers. The
property to the south belongs to the State of Alaska Dept. of Natural Recourses and is a part of the
Eagle River Greenbelt. There are no private properties downslope of this lot, and so there is no

potential of any adverse effects from this proposed design on any neighboring lots downslope. We
therefore request a variance for the allowance of use of ERS in a conventional septic application.
Lot 12 has shown varied consistencies of material throughout historical test holes in various
locations on the property. Additional percolation tests will be performed on either side of the
proposed septic location in order to confirm consistent soil conditions adequate for this design.
Wells on this and adjacent lots are shown. The new system will be a minimum of 50’ from all
wells and surface water, and more than 5’ away from the septic tank. The alternate site is located
more than 6’ away from the primary.
Please refer to the attached test hole logs, slope cross section, plan and profile pages for the septic
design. If this design is followed, there will be no adverse impacts to adjacent properties.

MIAINTENANCE AND REPAIR ACS REEINKENT
THIS MAfNTENA-.NICE AND REPAIR AGRFEMENT, herein the -AGREEMENT" made and
entered into as of this 'A Day of Z:50AJof 20 by and between

Anchorage. herein the "MUNICIPALITY". in accordance with Anchorage Municipal Code
(AMC) 15.65.365. In consideration of the mutual covenants contained herein, the pay -ties to this
Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. The 1\1unicipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS).

(Owner is required to read, understand and initial each section,)
ThroucTliout the terns of this A&rreement. the Owner shall enter into a service agreement
with an AWTS seiidee and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performingas designed and producing treated septic effluent in

accordance with the equipment's approval for operation in the Municipality.
It shall be the responsibility of the Owner during the term of this Aggry-eement to pay for all

repair(s), maintenance, ad ustment(s), replacement costs, and inspection costs. This
includes ananhUal maintenance fee (typically $400 to $600).
W Owner agrees that only maintenance and repair Personnel approved by the Municipality
or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.
Owner acknowled,,es that regular maintenance of an AWV7S reduces the potential

failure of the systern, Nvii1ch could include sewage backup and costly repairs or drainfield
replacement.
Owner acknowledges that the Municipality may request records of maintenance and

repairs from the manufacturer -s representative or maintenance provider.
Owner acknowledaes that the fine for failing to maintain and repair an Aw"WTS Irlay be
M Owner agrees to grant the Niumcipality reasonable access to test and inspect the
.AWWTS. The Municipality will give at least 2=f -hour notice.
Owner agrees that an -v sale or transfer of title of the property xvill not occur without a new

Certificate of On -Site Systems Approval.
Owncr agrees that the AW`ITTS installation and maintenance requirements as provided
by the AWWTS vendor/Installer and approved by the Municipality are the governing
guidelines for the construction, maintenance and repair of the Owners AWWTS.
Owner agrees to maintain remote monitoring of the AWWTS as required by the

AWWTS approval.
Term. The term of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions. nor in any way affect
the validity of the Agreement or any part hereof, or the right of the Municipality
thereafter to enforce eveii, provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be
brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the
parties under this Agreement.
7. Severabilitv. Any provisions of this Agreement decreed invalid by a court of competent
jurisdiction shall not invalidate the remaining provisions of the :"agreement.
