this department.

Ladies and Gentlemen:
We request a separation distance waiver for a proposed septic system to the lot line of (0.0’). The field was
found to be installed over the lot line. Granting this waiver is not likely to affect the health and safety of this
lot or the surrounding lots now or in the future. Additionally, the owner of L1 is the same owner as L2. An
egress/ingress easement will be recorded.
We request a separation distance waiver for tank to well of 95’. The well was not drilled in the permitted
location. The current nitrate level in the aquifer on the property is 0.544 mg/L. Granting the reduced
separation distance is not likely to any impact on the Nitrate level for this source. Topography of the lot is
generally southeast to northwest. The septic tank and well casing at the approximately at the same relative
elevation. However, any effluent overflowing the tank or leaking through a potential perforation in the HDPE
tank will flow away from the well casing to the northwest.
Based on an ADEC procedure for determining the potential contamination of an aquifer, I have calculated the
following points:
Tank to Well:
Distance from sewer system bottom to groundwater 7.11
Soil sorption below sewage system 2.71
Soil permeability below the system 1.13
Water table gradient 2.90
Horizontal separation 2.80
Total Points 16.65
The sum of the above values could equate to the following conditions: Almost sure to free from any form of
contamination from household sewage.

This Grant of Ingress/Egress Easement Agreement ("Agreement's is made and entered into this

WHEREAS, Grantor is the owner of certain real property located in Anchorage, Alaska, known f

WHEREAS, part of the septic field serving the Dominant Estate is located on the Servient
Estate, and Grantee requires ingress and egress across the Servient Estate for the purpose of
accessing, maintaining, repairing, and replacing the septic field; and
WHEREAS, Grantor is willing to grant to Grantee an easement for ingress and egress over the
Servient Estate for said purposes under the terms and conditions set forth herein.
Agreement
NOW, THEREFORE, for and in consideration of the sum of Ten Dollars ($10.00) and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
Grantor does hereby grant, bargain, sell, and convey unto Grantee, its successors, and assigns, a
non-exclusive easement for ingress and egress (the "Easement") over, under, and across the
Servient Estate, as more particularly described and depicted in Exhibit C attached hereto and
incorporated herein by reference (the "Easement Area"), subject to the following terms and
conditions:
I . Purpose. The Easement granted herein is for the purpose of providing Grantee with
access to the portion of the septic field located on the Servient Estate, including the right
to enter upon the Easement Area to inspect, maintain, repair, and replace any portion of
the septic field as necessary.
2. Term. The Easement shall be perpetual, running with the land and binding upon Grantor
and Grantee and their respective successors and assigns.
3. Maintenance and Repair. Grantee shall, at its sole cost and expense, maintain the
Easement Area in a good, safe, and sanitary condition, and shall promptly repair any
damage to the Servient Estate caused by Grantee's use of the Easement.
4. Indemnification. Grantee shall indemnify, defend, and hold harmless Grantor from and
against any and all claims, damages, losses, liabilities, and expenses, including

reasonable attorneys' fees, arising out of or related to Grantee's use of the Easement
Area.
5. Non -Interference. Grantor agrees that it will not erect or place any structure, fence, or
other obstruction on or within the Easement Area that would interfere with Grantee's use
of the Easement for the purposes stated herein.
6. Governing Law. This Agreement shall be governed by and construed in accordance with
the laws of the State of Alaska.
7. Entire Agreement. This Agreement constitutes the entire agreement between the parties
with respect to the subject matter hereof, and supersedes all prior and contemporaneous
agreements and understandings, whether written or oral, relating to such subject matter.
8. Amendments. This Agreement may not be amended or modified except by a written
instrument executed by both Grantor and Grantee.
