All construction shall be in accordance with:
1. The attached approved design.
2. All requirements specified in Anchorage Municipal code Chapters 15.55 and 15.65 and the State of Alaska
Wastewater Disposal Regulations (18AAC72) and Drinking Water Regulations (18AAC80)
3. The wastewater code requires inspections during the installation. The engineer shall notify the Development
Services Department per AMC 15.65. Provide notification by calling (907) 343-7904 (24/7).
4. From October 15 to April 15, a subsurface soil absorption system under construction during freezing weather
shall be either:
a. Opened and Closed on the same day, or
b. Covered, sealed, and heated to prevent freezing
Special Provisions:

• A test hole is required prior to construction of the absorption field, in the location shown on the site plan, to
4; confirm minimum separation to impermeable soil and seasonal high groundwater, as well as percolation
rate. Construction may proceed at your own risk prior to 7 -day groundwater monitoring. If results require
a design change, construction shall stop pending approval of a change order. Please submit results with
the inspection report (or change order, if required).

RE: NEW SEPTIC SYSTEM PERMIT
LEGAL: SNOW CREST VIEW LOT 25
There may be an undocumented septic system or contaminated soils on site and any
encountered will be completely decommissioned per code. We have been requested
to obtain a septic permit for an on-site wastewater septic system to serve the above
referenced lot.
We propose to install a deep trench with an Advantex system to serve the proposed
4-bedroom residence per the attached design. The conservative design with
reduced soil application rate is based on area soils and a confirming test hole will be
conducted prior to construction of the septic system. No groundwater was observed
in any of these test holes to a depth of 21’ in these SW/SP soils – see attached.
The slopes are moderate at 3-7% at the proposed upgrade location. The lot and
adjacent lots / area are served by a private shared water well with no known
private wells within 50’ of the proposed septic system. Based on visual
observations and review of available information, the design will not impact any of
the neighboring properties. Please contact us if you have any questions.

Hello Brent,
We haven't been notified of anything to the contrary as to whether this system's classification
should be changed. If the population served is over 25 persons for 60 or more days a year, or
has 15 or more service connections, then the owner of the system should contact us to
reclassify the system.
I was able to track down the supporting information that the letter you attached responded to
(see attached SNOW CREST VIEW document). This shows the properties that were served by
the Snow Crest North (210493) and Snow Crest South (210891), which is a community water
system.
Which property/lot are you looking at for potential septic system upgrades?

Throughout the term of this Agreement, the Owner shall enter into a service agreement
with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.
It shall be the responsibility of the Owner during the term of this Agreement to pay for all
repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically $400 to $600).

or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.

repairs from the manufacturer's representative or maintenance provider.
Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be
assessed in accordance with AMC 14.60.030.
Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS. The Municipality will give at least 24-hour notice.
Owner agrees that any sale or transfer of title of the property will not occur without a new
Certificate of On -Site Systems Approval.
Owner agrees that the AWWTS installation and maintenance requirements as provided
by the AWWTS vendor/installer and approved by the Municipality are the governing
guidelines for the construction, maintenance and repair of the Owner's AWWTS.

AWWTS approval.
3. Term. The term of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any part hereof, or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.

brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the

THIS AGREEMENT, made this 2nd day of August, 2023, by and between MAKENNA C.
BORING and her heirs, administrators, and assigns, hereinafter called "PERMITTEE", and the
Municipality of Anchorage, a municipal corporation organized and existing under its Charter and the
laws of the State of Alaska, hereinafter called the "PERMITTER".
WITNESSETH:
WHEREAS, PERMITTEE is the owner of the following described real property:
SNOW CREST VIEW SUBDIVISION, LOT 25, according to the official records
thereof, on file in the office of the District Recorder, Anchorage Recording District,
Alaska, and;
WHEREAS, PERMITTER owns and/or maintains the real property more particularly
described as follows;
The TEN FOOT UTILITY EASEMENT, immediately along the west boundary of
PERMITTEES property as shown on Plat No. P-512, on file in the office of tile District
Recorder, Anchorage Recording District, Alaska, and;
WHEREAS, PERMITTEE has placed a well house upon the referenced real property which
encroaches 9.4 feet upon the PERMITTER'S I0.0 -foot Utility Easement.
NOW, THEREFORE, it is mutually agreed between the parties hereto that:
1. The PERMITTER, acting through the Director of Development Services
Department, hereby grants to the PERMITTEE the privilege of allowing well
house to encroach 9.4 feet upon the PERMITTER'S 10.0 -foot Utility Easement,
as shown on "Attachment A," included herewith.
The PERMITTEE agrees forever to indemnify, defend, save and hold harmless,
the Municipality, its officers and employees, from any and all lawsuits, claims or
actions brought to any person for or on account of damage to property or injury,
disease, illness or death of persons, including all costs and expenses incident
thereto, arising wholly or in part from or in connection with the existence of,
alterations, maintenance, repair, renewal, reconstruction, operation, use or
removal of the encroaching well house, as placed upon the PERMITTER'S 10.0 -
foot Utility Easement.
3. The PERMITTEE shall not assign or transfer any of the rights granted herein to
another individual or company without first notifying and securing the approval
of the Director of Development Services Department.
4. This Agreement and Permit grants PERMITTEE no interest in PERMITTER'S
real property whatsoever, except only the encroachment rights described herein.
5. The PERMITTER reserves the right to revoke this permit upon twenty (20) days
written notice to the PERMITTEE. The PERMITTEE agrees upon such notice
of revocation, to move said encroachment(s) from the 10.0 -foot Utility Easement
in which it is placed. Should the PERMITTEE refuse or fail to comply with said
written notice, the PERMITTER may, without further notice to the
PERMITTEE, remove or cause to be removed the encroachment(s), and the
PERMITTEE hereby agrees to reimburse the PERMITTER for all costs
incidental to the removal thereof.
In addition to the mutual promises heretofore made, the PERMITTEE has paid the
PERMITTER a one-time permit application fee of $120.00. The PERMITTER hereby waives the
annual fee of $315.00.
