NOTICE OF ZONING ACTION
This notice announces that a request to modify plat note #4 and plat note #5 from plat 2010-56
has been duly approved by the Platting Board of the Municipal Planning Department providing
for the development of the herein described property in accordance with the provisions of the
Anchorage Municipal Code of Ordinances and the terms and conditions of the plat notes
modification approval as set forth in the Municipal zoning file S 12706. Under the provisions of
the specified ordinance the subsequent development of the subject property shall be in
accordance with the terms of the approved plat notes modification or any subsequent
amendments hereto.
LEGAL: Lots 1, 2, 3 and 4, Seclusion Subdivision (Plat 2010-56), S.M., Anchorage
Recording District, Anchorage, Alaska. Generally located south of Paine
Road, west of King's Way Drive and east of Big Mountain Drive at 8470
Paine Road, Anchorage, Alaska
PETITIONER: Mike Huston, Sandy & Mark Phillips, and Joe Burnham

ANCHORAGE RECORDING DISTRICT
A RESOLUTION APPROVING THE REQUEST TO MODIFY PLAT NOTE # 4 THAT
STATES "COMMON ACCESS EASEMENT WILL BE PROVIDED FOR LOTS 1, 2,3 AND
4 OF THIS SUBDIVISION. LOTS 1, 2, 3, AND 4 SHALL ACCESS PAINE ROAD VIA THE
COMMON ACCESS EASEMENT" AND PLAT NOTE # 5 THAT STATES "LOTS 1, 2, 3
AND 4 SHALL HAVE NO VEHICULAR ACCESS TO PAINE ROAD EXCEPT VIA THE
COMMON ACCESS EASEMENT." FROM PLAT 2010-56 FOR SECLUSION
SUBDIVISION, LOTS 1-4, IN ANCHORAGE (CASE S12706).
WHEREAS, a petition has been received from Mike Huston, Sandy & Mark
Phillips, and Joe Burnham, property owners, for the modification of Plat Note # 4 that
states, "Common access easement will be provided for Lots 1, 2, 3 and 4 of this
subdivision. Lots 1, 2, 3, and 4 shall access Paine Road Via the common access
-easement." and Plat Note # 5 that states, "Lots 1, 2, 3 and 4 shall have no vehicular
access to Paine Road except via the common access easement." from Plat 2010-56 for
Seclusion Subdivision, Lots 1-4 (Case S12706), and
WHEREAS, notices were published, posted and mailed and a public hearing
was held March 1, 2023.
NOW, THEREFORE, BE IT RESOLVED by the Platting Board that:
A. The Platting Board makes the following findings of fact:
1. The approval criteria a -c for a plat note modification has been met.
2. Modification of the plat note will not have a negative impact on directly
adjacent or nearby properties.
3. The conditions that are required per the original plat notes have changed
and the need for these particular plat notes, in its original form, has
changed in the way it has been proposed by staff and the petitioner.
4. Modification of Plat Note #4 and Plat Note #5 allows for reasonable use
of the land while complying with existing code requirements.
5. The Traffic Department, Private Development, and Right -of -Way
Departments have no objection to the plat note modifications.
B. The Platting Board APPROVES the request to modify Plat Notes #4 and #5 from
Plat 2010-56 for Seclusion Subdivision, Lots 1-4 subject to:
1. Recording a resolution with the State of Alaska, Recorder's Office.

2. The following amended plat notes:
a. #4. "Common access easement will be provided for Lots 1, 2, 3
and 4 of this subdivision. Access to Lots 1, 2, 3 and 4 from Paine
Road shall be reviewed and approved by the Municipal Traffic
Engineering Department."
b. #5. "Access to Lots 1, 2, 3 and 4 of Seclusion Subdivision from
Paine Road shall be reviewed and approved by the Municipal
Traffic Engineering Department."
