All construction shall be in accordance with:
1. The attached approved design.
2. All requirements specified in Anchorage Municipal code Chapters 15.55 and 15.65 and the State of Alaska
Wastewater Disposal Regulations (18AAC72) and Drinking Water Regulations (18AAC80)
3. The wastewater code requires inspections during the installation. The engineer shall notify the Development
Services Department per AMC 15.65. Provide notification by calling (907) 343-7904 (24/7).
4. From October 15 to April 15, a subsurface soil absorption system under construction during freezing weather
shall be either:
a. Opened and Closed on the same day, or
b. Covered, sealed, and heated to prevent freezing

Well and Septic System Permit Request
This is a design narrative for a permit to install an initial well and septic system upgrade on the subject property. The
proposed installation will serve a five (5) bedroom house and a one (1) bedroom ADU. This lot will be served by a
private onsite well. The surrounding lots are served by public water systems. Due to area constraints on the property
the proposed wastewater treatment system is within the 200-foot protective radius of two (2) of the surrounding
water systems. Please see attached approved separation distance waivers from ADEC Drinking Water Program.
1. Soils: Two (2) test holes were performed on this lot by Garness Engineering Group, Ltd (GEG). The soils logs are
attached to this request. Based on the soil profile and percolation tests an application rate of 0.8 gpd/SF was
used for the design of a conventional wastewater treatment system in the area of the test hole. Groundwater
and impermeable layers were not encountered in either test pit to a depth of at least 16.5 feet.
2. Soil Absorption System Design: See design package.
3. Surface Water: There is no surface water within 100 feet of the proposed septic tank and drain field.
4. Topography: See attached site plan for area topography.
5. Drawing Markings: The Drawings are marked “For MOA Review Only”. When written notification that the
review is complete and no further comments are received from MoA On-Site Department, the note will be removed
and “For Construction” drawings will be issued.
The proposed installation will not affect the future development of this or the surrounding lots.

Mr. Robillard,
On June 10, 2025, this office received a submittal from Steven Pannone, P.E. with Pannone
Engineering Services, LLC (PES) requesting a separation distance waiver from a proposed septic
system to be located on Disco Subdivision Lot 1, located on the east side of Nickell Circle, in
Anchorage AK. A revised submittal adjusting separation distances was received on July 9, 2025.
This letter issues a Separation Distance Waiver for the requested reduction in the State’s
minimum separation distance requirement between the subject PWSs drinking water well
sources and the proposed septic system, as detailed in the submittal.
Project Description
A proposed septic system for a proposed 5-bedroom single family home and a 1-bedroom additional
dwelling unit on Disco Subdivision Lot 1 is proposed to encroach on two existing Public Water
Systems’ (PWS) drinking water source wells.
Separation Distance Waiver
The 200-foot radius of source wells for Cohoe Subdivision PWS (212924) and Hanshew Heights
Subdivision PWS (211643) are encroached upon by a proposed private septic system located on and
serving planned building works on Disco Subdivision Lot 1.
Cohoe Subdivision Source Well (WELTS ID: 10506) to Proposed Potential Contaminants
2,500-gallon septic tank: 140 feet.
Absorption field: 140 feet.
Reserve area: 175 feet.
Hanshew Heights Subdivision Source Well (WELTS ID: 11079) to Proposed Contaminants
2,500-gallon septic tank: 175 feet.
Absorption field: 165 feet.
Reserve area: 150 feet.

The separation distance encroachment was reviewed based on the following elements to maintain
public safety. This decision is based on conditions specific to this project, as described in the
submittal and as summarized below:
Well logs for both wells show that they are drawing from an aquifer approximately 235 feet
deep, separated from the surface with layers including silt, clay and hardpan gravel which will
help to protect the aquifer from potential wastewater intrusion.
Sample records from both PWSs show no recent positive total coliform results in the last 7
years, and nitrate/nitrite values far below the EPA MCL.
The Cohoe subdivision well is approximately 10 feet in elevation higher than the proposed
septic system, and—while approximately 5 feet lower in elevation—the Hanshew Heights
subdivision well is separated by Nickell Circle, which has a crown 1- to 2-feet higher than
the proposed septic system.
The proposed septic tank is made out of steel and epoxy-coated to inhibit rust and prolong
the life of the tank.
The proposed septic system and its components are designed in accordance with applicable
Municipality of Anchorage regulations.
Based on historical information, both PWSs were constructed to meet source protection
requirements in place at the time and are currently operating within DEC regulations.
Based on an evaluation of the available information and in accordance with the State’s
Drinking Water Regulations, 18 Alaska Administrative Code (AAC) 80, a Separation
Distance Waiver for the encroachment detailed is issued.
Please forward any record drawings and documentation of construction to this office once
completed. The separation distance encroachment is approved with the following conditions:
The wastewater system must be installed by a person meeting the requirements of 18 AAC 72.
The sewage system must be maintained in accordance with State of Alaska and Municipality
of Anchorage requirements and best practices for as long as the system is in operation. The
lot owner should keep all records, such as installation records, septic tank maintenance,
inspections, and pumping, and have them available on request. For additional information,
such as recommendations for pumping the septic tank on an annual basis, see the following:

Any changes, constructed or natural, may void this waiver and the sewer may be required to
be relocated.
This waiver is limited to this project and its current site conditions. Approval of this waiver does not
obligate the Department to approve future waiver requests proposing the same design. Any changes,
constructed or natural, that affect the conditions to which this waiver was granted, or if the
conditions are found to be different than described, will void this waiver. Occurrences of floods,
earthquakes, and human activity can change the geophysical, chemical, and biological conditions
under which this determination was made. This determination does not preclude the Department
from reevaluating this separation distance waiver in the event such conditions change or additional
information becomes available to the Department that would warrant further review.

Limitations and Appeal Process
This determination is not approval of omissions or oversights by this office or non-compliance with
any regulation. This does not imply the granting of additional authorizations, nor obligate any
federal, state, or local regulatory body to grant future authorizations. This determination does not
guarantee correctness of functional design or waiver the owner’s responsibility for continued
compliance with state, federal, and local regulations.
A person authorized under a provision of 18 AAC 15 may request an informal review of a contested
decision by the Division Director in accordance with 18 AAC 15.185 and/or an adjudicatory hearing
in accordance with 18 AAC 15.195 - 18 AAC 15.340. See DEC’s “Appeal a DEC Decision” web
page https://dec.alaska.gov/commish/review-guidance/ for access to the required forms and
guidance on the appeal process. Please provide a courtesy copy of the adjudicatory hearing request
in an electronic format to the parties required to be served under 18 AAC 15.200. Requests must be
submitted no later than the deadline specified in 18 AAC 15.
