Ref: Proposed Septic System Upgrade for Sand Lake #2; Lot 8, Block 3,
To whom it may concern:
The existing 3 bedroom Duplex is served by a class "C" well and a private septic system. The existing
septic system is in a state of failure and needs to be upgraded. We are proposing to install a 1000 gallon
septic tank and a deep trench type drainfield. A portion of the proposed drainfield is located on the
neighboring property (Sand Lake #2; Block 3, Lot 9) which has dual ownership between the owners of
Lot 8 & 10. The owners are in the process of subdividing Lot 9 down the middle to expand their lots (Lot
8 & 10). Because Lot 9 has not been subdivided to date, an ingress/egress easement has been provided.
One test hole was excavated on the property. The drainfield will be designed around the 30 foot radius of
this test hole. Comments regarding the design are summarized as follows:
1. SOILS: See the attached logs which show the soil classifications, groundwater monitoring, and the
percolation test results.
2. DRAINFIELD DESIGN: See attached design drawing for drainfield specifications
3. SURFACE WATERS: There are no surface water concerns.
4. TOPOGRAPHY: As can be seen on the attached site plan, the average topography around the
drainfield is less than 5% running west to east. In short, there are no slope concerns.
5. LOT LINE WAIVER: Due to site constraints, we are requesting a 0' lot line waiver from the south
lot line to the proposed drainfield. There are no septic systems within 10 feet of the south lot line.
6. WELL WAIVERS FOR SUBJECT PROPERTY: Due to site constraints, the proposed septic
system is located within 100 feet of a class "C" well (required distance must be 150 feet). Attached to this
submittal is the granted waiver from ADEC (3/12/13) approving the installation of the septic system to
within 94 feet of the class "C" well. We are proposing to put the new septic tank and drainfield 100 feet
away from the subject well.
7. PROPOSED DRAINFIELD TO EXISTING DRAINFIELD: We are proposing to install 8 feet of
effective for the proposed drainfield. The required separation distance for the proposed drainfield to any

other drainfield would be 16 feet. Due to site constraints, we are requesting a 10' waiver from the
proposed drainfield to the existing drainfield. Comments supporting the waiver request are listed below:
• There is no other viable location that a drainfield can be located.
• The two drainfields will not service the house at the same time. In short, only one drainfield will
be active at a time.
In short there is minimal risk associated with the grating of these waivers.
We are unaware f any adverse impacts this installation would have on adjacent wells or septic systems.

On November 15, 2012, this office received your request for a waiver of the State's minimum separation
distance between a drinking water source and a potential source of contamination. The intent of this letter
is to grant a waiver between the ddnidng water well located at Sand Labe Subdivision, Block 3, Lot 8
and the new septic tank and absorption field being proposed on lots 8 and 9.
For the continued health and safety of the water system's users, it is strongly recommended that the
system be routinely inspected and tested. While there is no ongoing state requirement for inspections,
visual inspection of the well and surrounding area (within approximately 200 feet) will help identify potential
risks to the system. There is also no requitement for ongoing drinking water sampling. Bet, periodic sampling
for nitrate/nitrite and total coliform (recommended at least annually) will help identify drinking water issues
that may otherwise go unnoticed.
The well located at Sand Lake Subdivision #2 (SLSD2), Block 3, Lot 8 is classified as a Class "C" Public
Drinking Water System. The system serves drinking water to SLSD2, Block 3, Lots (4, 5, 6, 7, & 8) and is
identified by PWSID 216156. The location of this well fails to meet the 150 foot separation distance,
prescribed by regulation, between a Class "C" Water System and a wastewater disposal system. According to
submitted documents and ADEC files, the well is located 94 feet, at the nearest point, from the proposed
septic tank and absorption field The well is also subject to the following encroachments in the table below:

The separation distance encroachments listed above have previously requested and received DEC waivers.
The fully cased well was installed October 3, 1982 to a depth of 397 feet The well penetrates sand, sandy
grave, and sandy day from 8 to 243 feet below ground surface (bgs). From 243 to 393 feet bgs, the well
passes through confining layers of wet day and clay/gravel. Small gravel and water was found from 393 to
397 feet bgs. Static water level in the well was recorded at 140 feet bgs and yielded 60+ gallons per minute
The following items were taken into consideration as part of this waiver
1. The ground surface at the well slopes easterly toward the septic tank and absorption field;
2. The source water was sampled and tested free of nittate/nitrite, 13 rof and total coliform on
November 7, 2012; and
3. The well accesses a presumed deep confined/semi-confined source water.
Based on evaluation of the available information, the potential for contamination due to the leaser separation
distance between the public well and the proposed septic tank and absorption field appears to be of moderate
significance due to the high density of septic systems in the immediate arem however, examination of the
system's water sampling results reveals a history of acceptable nittate/nitrite and total colifomm levels and
suggests that the well is not highly influenced by septic ex -filtration. This demonstrates that the lesser
separation distance does not appear to immediately threaten public health. Therefore a separation distance
waiver between the well and the proposed septic tank and absorption field is granted in accordance with the
State's Drinking Water Regulations, 18 AAC 80.
Any changes, constructed or natural, that affect the conditions to which these waivers were granted will void
these waivers. This approval does not imply the granting of additional authorizations, nor obligate any federal,
state, or local regulatory body to grant required authorizations. This is not an approval of omissions or
oversights by this office or noncompliance with any applicable regulation. The Department's registration of
this Class C system and separation distance waiver does not guarantee correctness of the functional design or
waive the owner's responsibility for continued compliance with State regulations.
AMA Process
Any person who disagrees with this decision may request an adjudicatory heating in accordance with 18 AAC
15.195- 18 AAC 15.340 or an informal review by the Division Director in accordance with 1S AAC 15.185.

This Agreement is entered to be effective May 18, 2014 by and between Robin Connelly,
("GRANTOR" herein) and Marilyn Rabb, ("GRANTEE" herein).
WHEREAS, GRANTOR and GRANTEE are co-owners of property described as:

WHEREAS, GRANTOR and GRANTEE are desirous of creating and maintaining an area for
easement purposes, under certain terms and conditions (referred to herein as "Easement") being
more particularly described and located as:
For purposes of installing and maintaining a new septic system and leach field on the north half of
the lot (Blk 3, lot 9, Sandlake #2, Subdivision) for the benefit of the property at Sandlake
Subdivision #2 Blk 3, lot 8, otherwise known as 8119 Seacliff street, Anchorage recording
district.
WHEREAS, the GRANTOR and GRANTEE wish to reduce to writing such terms, conditions,
and agreements pertaining to the Easement;

NOW THEREFORE, for a valuable consideration, paid by GRANTEE, receipt of which is hereby
acknowledged, has and by these presents does grant, bargain, sell and convey unto the Grantee an
easement as hereinafter described, to run with the land upon a certain parcel of land co -owned by
the Grantor, ("Robin Connelly") and Grantee, ("Marilyn Rabb"), the above premises, GRANTOR
and GRANTEE hereby agree as follows:
1. GRANTOR has GRANTED, SOLD AND CONVEYED, and by these presents does hereby
GRANT, SELL and CONVEY unto GRANTEE, a perpetual, free, continuous and
uninterrupted use, liberty, privilege and easement to use and enjoy the above described
Easement.
2. Neither GRANTOR nor GRANTEE shall erect any improvements or other facilities, except
related to septic systems and drainage; upon the Easement which may impair the flow of
traffic over and across same.
GRANTOR hereby grants to GRANTEE the right to permit the GRANTEE, GRANTEE'S
invitees, guests, and others of the general public coming on the premises to utilize the
Easement, it being the intention of the parties hereto that such persons shall have free access
to, upon, and over the Easement for ingress and egress purposes.
4. GRANTEE will maintain the Easement until such time (if any) in the future when the
Easement is released by written instrument, signed and acknowledged by the then owner(s) of
GRANTEE'S property; and any mortgagee then holding a loan secured by GRANTEE'S
property.
This Easement shall be ONLY for the limited purpose of access, ingress, egress and
maintenance to and from GRANTEE'S property.
Said Easement shall bind and inure to the respective benefit of GRANTOR and GRANTEE.
As used herein the terms GRANTOR and GRANTEE shall include the present and future
owner or owners and mortgagees, their heirs, personal representatives, successors and assigns
of GRANTOR'S property and GRANTEE'S property, respectively.

8. This is an easement, not a license. The Easement and right-of-way granted hereby is for the
benefit of the GRANTEE'S property and shall be appurtenant to and run with the
GRANTEE'S property.

Certificate of On -Site Systems Approval # 151217
A Certificate of On -Site Systems Approval inspection and test of potable
water was recently conducted on the well water supply on Block 3, Lot 8 of
Sand Lake #2 Subdivision. This inspection revealed an arsenic concentration
of 46.3 micrograms per liter (ug/L) for the property's well water sample.
The Environmental Protection Agency (EPA) has established a maximum
contaminant level (MCL) of 10.0 ug/L for public drinking water systems.
While private wells are not subject to this regulation, EPA standards are
based on existing health information and can therefore be used to gauge the
relative quality of water from private wells. Information on arsenic is
available from the On -Site Water and Wastewater Program website
(www.muni.or /og nsite) or at 343-7904.
This advisory must be attached to all copies of the subject Certificate of On -
Site Systems Approval.

Dear Susan:
This septic tank was situated at 98 feet from the Class C
Well. The waivered distance to the well was 100 feet. I
spoke to Mike Lewis, ADEC, about the possibility of a new
waiver. He was not supportive of the waiver. It would be
better to move the tank to the proper distance from the
well.
Around October 9, 1989, I inquired at DHHS about moving the
tank and was told that as it was to correct an unapproved
distance from the well, no permit was needed. However, the
tank needed to be inspected by an engineer.
The tank was moved on November 7, 1989. Per our phone
conversation here is the inspection report on the MOA forms.

TEST RESULTS: This well meets the requirements of the
Municipality of Anchorage, and the Department of Environmental
Conservation.
The Municipal requirement for well flow is 150 gallons of water
per bedroom per day. This well exceed this requirement. The
assessment of the condition of the well applies only to the
conditions as of the day tested. The flow rate may change due to
subsurface conditions that may not be observed from the surface,
and changes in the land use and other factors that may impact
the aquifer feeding the well.

The depression above the crib should be filled and the standpipe
extended to 18 inches above ground level.
When these repairs have been done and the residence converted to
a single family, three bedroom residence, a Municipal approval
can be requested.
NOTE The operational life of all septic systems depends on the
local soil conditions, groundwater levels that may fluctuate
during the year, and the water usage of the family being served
by the system. These conditions are outside the control of the
evaluator of this septic system. We can therefore not give any
estimate of how long this system will function satisfactory for
current or future occupants.

TEST PROCEDURE: System was inspected and measured. Crib was
10.5 feet deep and dry. Stand pipe to pit
was below ground. Ground had settled around crib. Sump to
trench was 20 feet deep and had 6 inches of sludge in the
bottom. The distance between the tank and the well was found to
be 98 feet.
1000 gal. of clean water was added to the trench. This caused
the water level to rise 46 inches. After 6 hours the level had
dropped 9 inches indicating that 200 gallons had been absorbed
in 6 hours.
TEST RESULT: This residence is presently a duplex with a
single family, three bedroom septic system. Under the present
septic system ordinance a septic system to serve a duplex or a
single family home with more than three bedrooms can not be
installed on this lot. The septic system is adequate for a
single family, three bedroom house.
The residence is being served by a Class C well. The separation
distances for.septic systems and Class C wells are 150 feet for
both septic tank and absorption fields. These distances was
waived by the Department of Environmental Conservation to 100
feet. The tank was measured to be :98 feet from the well, two
feet less than required. A second waiver could be requested, or
the tank exposed and moved. It is unlikely that the State will
grant the waiver, since a waiver from 150 to 100 already has
been granted.
