Box 196650 Anchorage, Alaska 99519 Subject: Sand Lake #2, Block 4, Lot 49 Septic System Upgrade Permit Request Ladies and Gentlemen: I am writing to request a permit to upgrade the septic system be issued for this property. The proposed systems will serve an existing four (4) bedroom duplex. Currently the lot is developed. Portions of the existing trench will be removed and replaced with clean fill to create the minimum separation from the trench to the property line, and to the water service line, the existing 1000 gallon septic tank will be abandoned per code, and anew 1500 gallon Advantex tank will be installed. This lot is served by a class el6•2' 'C' well that is located . feet from the proposed septic tank, and 110 feet from the proposed drain -waw field. The drain field is also located 106 feet from the private well on Lot 47 to the south, and the septic F" tank is located 112.7 feet from the same well. The class C well located on lot 50 to the North is 94 feet 'P from the proposed advantex tank and 109.7 feet from the drain field. The remaining surrounding wells are located over 150 feet from this system. All appropriate well to septic system waivers have been applied for through the ADEC and approved. See attached. 1. Soils. One test hole was excavated by Pannone Engineering Services in March of 2013, and the ground water monitored for seven days. Groundwater was not observed in the test hole monitor tube after the seven day monitoring period. Bedrock was not encountered in the test hole. Municipality of Anchorage Development Services (MOA) Regulations require accepting soils to have a 2 foot layer of filter sand where there is a percolation rate of less than 1 minute per inch unless a sieve analysis determines an adequate amount of sand exists in the native soil. It is my opinion, based on the results of the percolation tests, the soils analysis, and overall soils appearance in TH-1; an application rate of 4 gallons/day/square feet should be used for a Cat II wastewater system. The system will be removed and replaced as a reserve field. 2. Soil Absorption System Design. a. See Sheet 2 of the design package. Mailing: P.O. Surface Water: There is no surface water within 100 feet of the proposed septic tank and drain field. The proposed drain field upgrade will maintain at least 100 feet from all surface water and drainage ditches. 4. Topography: The topography is flat in the area of the proposed drain field. There are no steep slopes in the area. 5. Lot Line Waiver Request: I request a lot line waiver to zero feet (0') for the reserve system location. The existing septic system to the west is located over ten feet away from the lot line and will not adversely affect public health with this waiver being issued. 6. Drawing Markings: The Drawings are marked "For MoA Review Only". When written notification that the review is complete and that there are no further comments is received from MoA On -Site Department, the note will be removed and "Issued for Construction" drawings will be issued. The proposed installation will not affect the future development of the surrounding or existing lots. There are no wells or septic systems within 100 feet of the proposed septic location. Information was provided on the adjoining Class C wells to allow the assessment of the potential risk posed by the septic system on Lot 49. Waiver Conditions and Determination Based on an evaluation of the available information, the potential for contamination due to the lesser separation distance between the Class C wells and the proposed septic system does not appear to be significant. Separation distance waivers between the wells and proposed septic system on Lot 49 are summarized below: Waiver 1: Class C Well on Lot 49, Block 4, Sand Lake Subdivision #2 The Class C well located on Lot 49, Block 4, Sand Lake Subdivision serves a four bedroom duplex on the same lot and a single family home on the adjacent lot 4. The separation distance required by regulation is 150 feet to the proposed septic system on Lot 49. The separation distance requested and approved is 96.2 feet. The following items were taken into consideration as part of this waiver: 1. Although there was no indication of well grouting submitted for Lot 49, the information provided regarding the well shows a depth of 272 feet. 2. Water samples taken from the well on Lot 49 are free of nitrate/nitrite. 3. Lab results indicated the absence of E. coli and coliform bacteria in the water sample taken on this lot. 4. The proposed septic system on Lot 49 shall be designed and constructed to State of Alaska Standards. 5. The following items were taken into consideration as part of this waiver: 1. Although there was no indication of well grouting submitted for Lot 50, the information provided regarding the well shows a depth of 316 feet. 2. The proposed septic system on Lot 49 shall be designed and constructed to State of Alaska Standards. 3. Due to development density within the subdivision, there are few options for the placement of this septic system. Connection to public sewer is not readily accessible. Approval Limitations The purpose of this letter is to grant the requested separation distance waivers between the proposed septic system on Lot 49 and the two existing Class C wells on Lots 49 and 50. This waiver approval is for the separation distances associated with proposed septic system on Lot 49 only, and in no way constitutes approval of any other separation distances associated with these lots. The granted waivers do not address the overall development density in this area, or the long term, overlapping impact of multiple onsite septic systems on the onsite wells. The separation distance between the water service lines and adjacent septic systems is minimal, approximately 10 feet. It is highly recommended that all wells be tested regularly (a minimum of annually) for nitrates and Coliform bacteria to identify any developing issues. This approval does not imply the granting of additional authorizations, not obligate any federal, state, or local regulatory body to grant required authorizations. The waiver for the lesser separation distance is not an approval of omissions or oversights by this office or noncompliance with any applicable regulation. The Department's approval does not guarantee correctness of the functional design or waive the owner's responsibility for continued compliance with State regulations. 4ueal Process Any person who disagrees with this decision may request an adjudicatory hearing in accordance with 18 AAC 15.195- 18 AAC 15.340 or an informal review by the Division Director in accordance with 18 AAC 15.185. Municipality grants permission to Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as 11) located at (legal description). kq 2. Definitions. Alteration. Any change to the design or function of an AW WTS that includes the installation or removal of any parts, components or pieces not included in the original construction permit and design. Certificate of On -Site Systems Approval (COSA). An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with Anchorage Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. Maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AWWTS that were included in the original design which would allow the AWWTS to continue to perform as designed. Permit. An On -Site Wastewater Disposal Permit as required by AMC 15.65 to construct and operate an AWWTS. 3. Term. The term of this Maintenance and Repair Agreement shall begin on the date of approval by the Municipality to operate the installed system or issuance of a COSA, and shall continue while the AWWTS is in use or is operational or until the property is sold or title is transferred by the owner and a new COSA is issued to the new owner or transferee of the property. 4. Alterations, Installation and Removal of Additional Equipment. Prior to performing any alterations to an AWWTS, the owner agrees to obtain an On-site Wastewater Disposal Pert from the Municipality in accordance with AMC 15.65. 5. Maintenance and Repairs. A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall maintain their AWWTS in a satisfactory condition capable of producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. The owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the municipality and the manufacturer of the AWWTS for the entire term of the AWWTS. In addition, it shall be the responsibility of the Owner during the term of this Maintenance and Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules and orders for the AWWTS. C. Upon request by the Municipality, the owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system. When a record of maintenance is documented and maintained by the system vendor, the owner agrees to allow the Municipality access to this information. D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be assessed in accordance with AMC 14.60 for improper discharge. E. Owner agrees that only maintenance and repair personnel approved by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. F. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. G. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. H. Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. 6. Nonwaiver. The failure of either party at any time to enforce a provision of this Maintenance and Repair Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Maintenance and Repair Agreement or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 7. Amendment. A. This Maintenance and Repair Agreement shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality that this Maintenance and Repair Agreement was executed with, and such writing shall be attached to this Maintenance and Repair Agreement as an amendment. B. For the purposes of any amendment modification or change to the terms and conditions of this agreement, the only authorized representatives of the parties are: a. Owner: b. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Maintenance and Repair Agreement. 9. Severability. Any provisions of this Maintenance and Repair Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Maintenance and Repair Agreement.
