A single test hole was excavated and found silty sand (SM) for the entire depth at ten feet. Water was not observed, during the excavation or after the 7-day monitoring period. The perc rate was 58 minutes per inch. Due to the lot size and soil types an Advantex system has been designed for the lot. The lot slopes at 1 to 2 percent towards the northwest. This design will be slightly mounded above the existing yard. The old system will be decommissioned per code. In consideration of the mutual covenants contained herein, the parties to this Agreement agree as follows: 1. Advanced Wastewater Treatment SVstems. The Municipality grants permission to the Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as ,A-d V all � f" r located at (legal description) 2. Maintenance. Repairs and Alterations. (Owner is required to read, understand and initial each section) Throughout the term of this Agreement, the Owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. It shall be the responsibility of the Owner during the term of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to $600). 1 Owner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfield replacement. (rev. 05/18/2018) Page 1 of 3 Owner acknowledges that the Municipality may request records of maintenance and repairs from the manufacturer's representative or maintenance provider. Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be assessed in accordance with AMC 14.60.030. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS. The Municipality will give at least 24-hour notice. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. i� Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. Owner agrees to maintain remote monitoring of the AWWTS as required by the AWWTS approval. 3. Term. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any Way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement. GENERAL: The existing 4 bedroom home is served by a private septic system and well. The septic tank is collapsed and must be replaced immediately. We performed several soils test on the lot with the intent of upgrading the septic system from a 2 bedroom system to a 4 bedroom system. We were unable to identify find suitable soils on the site (copy of logs attached) and recommended the installation of a holding tank or possibly an innovative septic system. The homeowner, Carl Lemmerman, and DHHS have mutually agreed to replace the septic tank only at this time. Should the septic tank be converted to a holding tank in the future, it will only be suitable for a 3 bedroom house. In addition, the tank would have to be capped at the outlet, and an alarm installed. If a four bedroom holding tank is required, an additional 500 gallon tank would have to be added in series with it. 2. SURFACE WATER: There are no surface waters within 100 feet of the proposed upgrade. I am unaware of any negative impacts that this installation would impose on adjacent wells, or septic systems. The system consists of a septic tank with a seepage pit both having 4" C.I. standpipes above grade. There is an additional 4" C.O. approximately 6' from the house where the outfall line makes a 900 turn leading to the septic tank. The systems was found to have a significant amount of water in the tank, pit and cleanout prior to pumping. After pumping approximately 1000 gallons from the septic tank the test was begun by adding water at 6 gpm into the seepage pit. The pit was found to stabilize at a fixed depth with most water running, back into the septic tank.. The system was then left for 24 hours and approximately 18 gallons were absorbed. In the same 24 hour period the following day, 36 gallons were absorbed by the seepage pit. This is far below the required daily absorption rate of 350 gallons for even a 2 bedroom home. Consequently, based on the test data (attached), I can only conclude that the existing absorption system is not functioning adequately. If I can be of any further service, please call on me. This system was installed as a two bedroom system in 1981 and inspected by Municipal Inspectors at that time. Two bedrooms has since then been added to the residence, making it a four bedroom house. The existing tank is a two compartment Stack Steel tank. The leach field has an absorption rate of 44 gallons per hour. There is no immediate danger for the system to fail or cause a nuicance. TEST FOR COLIFORMS: WATER WAS TESTED FOR COLIFORM BACTERIA ON OCTOBER 31, 1985. TEST WAS NEGATIVE. TEST RESULT: THIS WELL MEETS THE REQUIREMENTS OF THE MUNICIPALITY OF ANCHORAGE. THE WELL HAS HOWEVER MINIMUM STORAGE AND THE YIELD IS NOT SUFFICIENT TO PROVIDE FOR LAWN WATERING OR ANY WATER USAGE REQUIRING MORE THAN 20 MINUTES OF STEADY WATER DELIVERY.
