Prior to starting the install, the contractor decided to dig a test hole on the downhill side of the drainfields to confirm groundwater levels. GEG Consultant, Jody Maus, met the excavator onsite to confirm the potential groundwater conditions. It was decided to pump all the drainfields and the septic tank, and then monitor the water levels in both this test hole and the drainfields over the next several days to confirm if there was groundwater or if the soils downhill from the failed drainfields were just saturated. After several days of groundwater, the results were inconclusive if this was groundwater or saturated soils. It was than decided to excavate a 2nd groundwater monitoring test hole uphill from the drainfield where it would not be influenced by the failed drainfields. This test hole did indicate groundwater conditions have significantly changed since 2003. Given that the existing drainfields appear to now be encroaching on groundwater, we are proposing an advanced wastewater treatment system (AWWTS) be utilized for this property and that a bed type drainfield be built over the area of the existing drainfields. Attached are revised design and detail drawings showing the specifics of the proposed design revisions. VARAINCE FFROM PROPOSED BED TO OLD DRAINFIELDS: As can be seen on the detail drawing (page 2 of 3), we are proposing to build a new bed type drainfield centered over one of the old drainfields. The bed is to be built so that it is centered over the middle existing trench. We are proposing that there will be 5+ feet of horizontal distance from the edge of the bed to the existing upper and lower trench type drainfields. The bed will be utilizing a 2+ foot sand filter and constructed to a higher elevation than the existing drainfields. Since the installation of the system, the owner has brought in fill and added it over the drainfield area (above the original grade). There are now slopes greater than 25% downhill from the drainfields. The top of the slope that is greater than 25% (approx. 2:1 slopes or less) is approximately 30 feet downhill from the proposed bed drainfield. All slopes downhill from the drainfields are well vegetated. Attached is a cross-sectional detail drawing showing the approximate slope conditions. As can be seen on this drawing, the imaginary 25% slope starting 2 feet above the top of the drainrock, does not daylight 35 feet downhill from the proposed bed. Based upon the slopes being vegetated and will not be disturbed during construction, there should be no slope concerns with this installation. The existing septic tank and drainfield were installed in 2004. The drainfields are in a state of failure and must be -upgraded: We are proposing that the drainfields be rebuilt in the same location by removing all contaminated material and rebuilding the new drainfields at the same elevations. Test holes were excavated on the property in 2003. We are also proposing the existing septic tank be excavated and the integrity verified. If the integrity is poor, a new 1500 -gallon Greer plastic septic tank will be installed. Comments regarding the design are summarized as follows: 1. SOILS: See the attached 2003 GEG test holes which show the soil classifications, percolation tests, and groundwater monitoring. 2. DRAINFIELD DESIGN: See attached design drawing for drainfield specifications. 3. SURFACE WATERS: There is a small stream north of the drainfields. The 100 -foot setback �t VA will be flagged by a registered land surveyor to ensure the separation distance will be met with the rebuilding of the drainfields. 4. TOPOGRAPHY: The slopes on the 2003 GEG design showed them to be less than 15%. Since the installation of the system, the owner has brought in fill and added it over the drainfield area (above the original grade). There are now some slopes greater than 25% downhill from the drainfields, however, since the fill was added above the original grade, this does not adversely affect the rebuilding of these drainfields. The Municipality grants permission to the Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as located at (legal description) 2. Maintenance. Retsairs and Alterations. (Owner is required to read, understand and initial each section) Throughout the term of this Agreement, the Owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. It shall be the responsibility of the Owner during the term of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to $600). Owner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfield replacement. (rev. 05!18'2018) Page I of 3 Owner acknowledges that the Municipality may request records of maintenance and repairs from the manufacturer's representative or maintenance provider. Owner acknowledges that the fine for failing to maintain and repair an AWWTS maybe assessed in accordance with AMC 14.60.030. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS. The Municipality will give at least 24-hour notice. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. Owner agrees to maintain remote monitoring of the AWWTS as required by the AWWTS approval. 3. Term. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement.
