Pruess Subdivision #3; Lot 2, Block 6,
The existing 3 bedroom house is served by a private well and new septic system. During our
HAA evaluation we utilized a Topcon GPT -1003 total station to determine the separation
distance between the well on the subject property and the adjacent septic systems. All separation
distance were found to be greater than 100 feet except to the septic system installed on Lot 1, Bk
6, Pruess Subdivision #3. The distance was shot in from the edge of the well casing to the edge
of the PVC cleanout and determined to be 99.7 feet. Given the fact that the trench is 2.5 feet
wide, it is assumed that there is approximately 1.5 feet of the drainfield in the 100 foot protective
well radius.
We request you grant a 98.5 feet separation distance waiver from the well on the referenced
property (drilled on 8/18/78) to the septic drainfield on Lot 1, Block 6, Pruess S/D #3 (installed
7/9/89). The following items are justification for the waivers:
• There is a 5%-10% slope running north to south. There is a slight mound and heavy
vegetation between the well on the subject property and the neighboring septic system. If the
septic system was to overflow, it appears that the effluent would not travel toward the well
head.
• The location of the septic system is in a very visible area so that if any effluent was to
surface, it would be noticed and the problem corrected.
The other path of contamination is subsurface migration of effluent from the drainfield.
Attached is drilling logs for five (5) wells in the immediate vicinity. It appears that two (2) of
the wells are tapped into the shallower aquifer, and three (3) of the wells are tapped into a deeper
aquifer. The well on Lot 2, Bk 6, is tapped into the shallower aquifer at 129 feet. These logs
could be used to establish the geological profile for the DEC waiver point evaluation criteria;
however, it would probably be of little value, given that it is a well established fact that most of
the shallower wells in Pruess subdivision have elevated nitrate levels. In short, a waiver is
difficult to justify using the DEC point system.

We feel that a waiver is justified for the following reason:
The nitrate levels in the subject well were sampled by AWWC, Inc. in April of 1998 and
found to be 10.2 mg/L. Recent sample 6/5/01 results indicated a nitrate level of 7.89 mg/L.
It is possible that this may be seasonal, however, it is probably also related to the fact that
some of the older septic systems in the area (that encroached upon groundwater or adjacent
wells) have been upgraded in recent years.
The septic system on Lot 1, Bk 6 was installed in July of 1989. It is assumed that the
property owners of Lot 1, Bk 6 will be responsible for paying the MOA waiver fee at some
point in the future (when they try to get a health certificate). It is unlikely that they would
willingly move the portion of drainfield that is encroaching, and it is unreasonable to
economically burden our clients with the cost of relocating a portion of the field (assuming
the property owners would even allow access to their property to perform the upgrade).
Given the time lapse (almost 12 years), it is almost certain that the engineer and contractor
involved with the septic installation on Lot I, Bk 6 , would not be receptive to correcting the
deficiency.
Given the fact that elevated nitrate levels are prevalent throughout the area, it is reasonable to
assume that the moving a portion of this drainfield 18 inches will have no real beneficial
impact to the water quality in the impacted well. This is a case where the 100 foot separation
distance is probably not adequate to ensure protection of the aquifer. If moving the field is
required, it should be the responsibility of the property owners of Lot 1, Bk 6, when they
obtain a future HAA.
If nitrate levels become excessively high in the future, the property owner always has the
option of deepening the well and accessing the better aquifer. Forcing our client to deepen
the well at this time, because of the neighbors encroachment, would be an unfair economic
burden.
Based upon the aforementioned facts, it is our recommendation that the subject separation
distance be waived to 98.5 feet. We also request that your department issue a Health Authority
Approval.

To whom it may concern:
The existing 3 bedroom house is served by a private well and septic system. The existing septic
system consists of a 1000 gallon septic tank and a trench type drainfield. The existing drainfield
is in a state of failure and must be upgraded prior to the sale of the house. A test hole was
excavated south of the existing septic system. The proposed septic upgrade will be designed
around the 30 foot radius of the test hole. We are proposing that a new 1000 gallon septic tank
and a dual five foot wide drainfields be installed. Comments regarding the proposed design are
summarized as follows:
1. SOILS: See the attached logs which shows the soil classifications, groundwater monitoring
and the percolation test results. It is our opinion that an application rate of 0.8 gallons/day/R
should be used.
2. TRENCH DESIGN:
a. Percolation Rate: 5 minutes/inch
b. Allowable Application Rate: 0.8 gallons/day/R2
c. Number of Bedrooms: 3
d. Design Flow: 450 gallons per day
e. Minimum Absorption Area: 563 R2
f. Total Depth: 8.5 feet (maximum - at any point)
g. Effective Depth: 3 feet
h. Width: 5 feet

4. TOPOGRAPHY: The area for the proposed septic upgrade is generally flat to some slopes
that range from 1 to 5 percent that run from east/northeast to west/southwest; in short, there are
no slope concerns.
5. LOT LINE WAIVER: We request that a 5 foot lot line waiver be issued for the proposed
septic upgrade to the south property line. We are unaware of any adverse impact of the

A water sample revealed a nitrate concentration of 13.5 milligrams per liter
(mg/L). The Environmental Protection Agency (EPA) has established a maximum
contaminant level (MCL) of 10.0 mg/L for public drinking water systems. While
private wells are not subject to this regulation, EPA standards are based on existing
health information and can therefore be used to gauge the relative quality of water
from private wells. Please see the attached "Nitrate Fact Sheet" for important
information regarding nitrate.
This advisory must be attached to all copies of the subject Certificate of On-Site
Systems Approval.

Nitrate Fact Sheet
From Northern Testing Laboratories, Inc.
Nitrate is a negatively charged compound of nitrogen and oxygen, which is very soluble in water. Nitrate
is not readily filtered or otherwise removed in the soil and can pass rapidly into ground water wells.
SOURCE: Nitrate is a major component of fertilizer and wastewater. Often the nitrate is in the form of
ammonia or protein first, which through contact with oxygen and certain bacteria, converts to the
oxidized form known as nitrate. Sources of nitrate from wastewater include urea, ammonia cleaners,
food solids,and bacterial cells. It may also result from the breakdown of organic matter buried in the soil.
TOXICITY: Nitrate is generally not toxic to adults or children over the age of two or three years, but is
associated with a potentially fatal infant disease called methemoglobinemia. In the digestive system of
young children, nitrate converts to nitrite, which can pass through the intestinal wall into the blood
stream. There it combines with the hemoglobin and interferes with the ability of the blood to carry
oxygen. For this reason, methemoglobinemia is referred to as "blue baby" disease. The EPA limits the
concentration of nitrate in public drinking water supplies to 10 mg/L. The standard has been lowered
from a previous level of 45 mg/L set by the US Public Health Service and the World Health Organization.
TREATMENT: due to its solubility in water and negative ionic charge, filtration and other common home
water treatment systems such as softening or iron filtration does not readily remove nitrate. The best
method for limiting nitrate in well water is source control. This can include avoiding overdosing of
fertilizer near the well and maintaining good separation distances between septic tank leach fields and
the well. A special anion exchange filter that contains a media with a strong affinity for negatively charged
ions in water, or by a reverse osmosis treatment system or distillation can remove nitrate.
TESTING: Nitrate analysis is usually done by one of the several "wet chemical" methods using a
spectrophotometer to read the final color endpoint. Specific ion electrodes also can be used to detect
the activity of nitrate in water. This laboratory uses several different wet chemical methods approved
under the public water supply laboratory certification program. They also have test kits available,which
the laboratory uses to perform an inexpensive "screening test", and with which the homeowner can
monitor the change in nitrate levels from their well. They recommend comparing the test kit results
against a certified analysis from the lab occasionally to verify the accuracy of the kit. We recommend
using a specially prepared bottle that has been rinsed in hydrochloric acid for collecting samples.

engineer registered in the State of Alaska. Certificates of Health Authority Approval are required for the transfer
of title (except between spouses) for properties served by a single family on-site wastewater disposal and/or
water supply system. DSD also issues HAAs upon request to homeowners. Certificates of Health Authority
Approval are valid for 90 days from the date of Issue for properties served by a private or Class C well and may
be reissued with new water sample results less than 30 days old. (Certificates may be reissued for a period of
up to one year with valid water samples.) Certificates are valid for one year for properties served by Class A or B

Dear Mr. Gilfilian:
Your request for a waiver of the required 100 foot
horizontal separation of a septic tank to a single family
domestic water well has been approved. The approved
separation distance is 88 feet from the well on the subject
lot to the septic tank on the subject lot.
This waiver approval applies to the existing septic tank to
well separation only. Any future upgrade to either will
require all separation distances be met or another waiver
approval from this department.
This waiver is being issued based on the following
stipulations and mitigative conditions:
1. The well tested at 8.0 mg/l nitrate nitrogen on 11/4/93
and 4.7 mg/l nitrate nitrogen on 1/12/94. These results,
although below the EPA drinking water standard of 10.0
mg/1, indicate that some well recharge is likely
occurring from on-site wastewater system discharge.
2. Relocating the well at a distance 100 feet from the
septic tank would not cause a reduction in the nitrate
nitrogen concentration.
3. Public water service is approximately 600 feet from the
subject property. Connection to public water may be
required should the nitrate nitrogen concentration of the
well exceed 10.0 mg/1.

4. The existing well is approximately 129 feet deep. Review
of area well logs indicates the presence of an adequate
producing aquifer at a depth of approximately 300 feet.
Nitrate nitrogen concentrations reported from this
aquifer are minimal or below detection limits. Drilling
a new well to access the deeper aquifer may be required
should the nitrate nitrogen concentration of the existing
well exceed 10.0 mg/1.
5. The well currently meets bacteria and nitrate nitrogen
concentrations for drinking water. However, the well
should be tested for nitrate nitrogen on an annual basis
with results forwarded to this office.

Dear Mr. Smith:
This letter is written in response to a telephone conversation between Mr. Kent
Sheets, an Environmental Technician with Gilfilian Engineering & Environmental
Testing, inc., and you on January 14, 1994. The conversation was held in regard to
obtaining the Municipality of Anchorage Health Approval for the above referenced
property. A waiver request for a separation distance less than what is called forth in
Table A of the Alaska Department of Environmental Conservation (ADEC) Drinking
Water Regulations 18 AAC 80 has been verbally denied. Our understanding is that
approval would be granted if it is ascertained that a new wall could be constructed
Into an aquifer deeper than the existing well's aquifer and Gilfilian Engineering provides
an explanation as to why the two nitrate samples collected from the well did not test
out exactly.
I will address the second condition first. Nitrate analysis used in the testing of water
for this site was by Standard Method 418C. This method allows an acceptance range
of t 10% of the true value. This may explain some of the variability between the
two sample results. The sample collection of the two tests followed our firm's Quality
Assurance/Quality Control (OA/QC) plan. Any other explanation would be purely
speculative at this time.
In regard to the condition that a new well for the property be provided if the nitrate
levels reach 10 milligrams per Liter (mg/L), we believe there are several alternatives
that would also be cost effective to review prior to the construction of a new 300 -foot
deep well.

As we stated earlier, there are treatment processes available which would cost much
less than a new deep well. However, it is our understanding that several wells located
within the subdivision are constructed to this deeper aquifer and that the deeper
aquifer has shown no evidence of elevated nitrates at this time.
The current property owner has responded to all the Municipality's requests regarding
this property, and Gilfilien Engineering believes that the waiver should be approved
with a single condition of an annual nitrate analysis be completed so that an accurate
history of the well may be established before these alternatives are Implemented.

Dear Mr. Smith:
Mr. Leonard Smith, the owner of the above referenced property located at 10229
Louis Place in Eagle River, contracted with Gilfilian Engineering, Inc. (GEI) to provide
engineering services required to obtain approval from the Municipality of Anchorage
(MOA) Health and Human Services. On November 4, 1993, representatives from GEI
visited the site to perform a septic system adequacy test and water system sanitary
survey. The septic system appears to be functioning adequately for a 3 -bedroom
single family home. However, the existing private well is 94 feet to the closest septic
tank cleanout. In researching the existing MOA records, it was noted that the closest
edge of the septic tank is 88 feet.
This letter is to request a waiver in accordance with 18 AAC 80.030 (b), for a
separation distance less than that set out in Table A of the Alaska Department of
Environmental Conservation (ADEC) Drinking Water Regulations. The justification
presented herein addresses the criteria for separation distance waivers as provided in
the Department's Well Waiver Data Sheet. Attached to this letter and made part of
this request is the ADEC Well Waiver Data Sheet (Attachment A).
BACKGROUND
Based an the three (3) well logs attached to this letter, and the three soil test holes,
the subsurface soil is predominantly silty sandy gravel to depths of 100 feet below the
ground surface. These features were verified by the use of existing information (well
logs) obtained from the MOA on-site records of Lots 1, 2 and 3, Block 6, Pruess
Subdivision. According to the well logs, potable water was encountered at two

Mr. John Smith, Municipality of Anchorage Lot 2, Block 6, Pruess Subdivision
distinctive depths between 440 feet to 460 feet (Lot 1), and 125 feet to 135 feet
(Lots 2 and 3) below the original ground surface.
WAIVER CONSIDERATIONS
Favorable consideration for the separation distance waiver should be made because
development in the surrounding area is half -acre to one -acre single family lots. Other
consideration for the separation distance waiver should be made because neighboring
wells in the area are located such that any expansion of the septic system serving
Lot 2, Block 6, Pruess Subdivision may encroach on the 100 -foot well radius of
neighboring wells. The house on this lot is also located between the well and septic
tank serving as a barrier from potential overflow of the septic tank.
Attached to this report are the satisfactory total coliform bacteria and nitrate analyses
for water samples collected by GEI on September 17, 1993, from the subject
property's water system. We believe that with the existing information regarding the
subsurface soil characteristics, i.e., absorption, permeability, and depth to potable
water, the increase in potential for well contamination by a lesser separation distance
is minimal, and probably insignificant.

This letter is written to address the concerns expressed in your January 7, 1994
waiver review letter. In that letter there were several issues for which you requested
additional information and clarification. The following responds to each item of
concern.
On January 10, 1994, a representative of Gilfilian Engineering & Environmental
Testing, Inc. completed a site visit to the above referenced location to address
concerns regarding the lesser separation distance between the domestic well and the
on-site septic tank on the above referenced single family residence. The separation
distance between the well and the closest edge of the septic tank based on
background information is 88 feet. However, during this site visit, we verified by
direct pull measurement that the distance from the well to the septic tank cleanout is
94 feet. Based on our experience, the typical Sunset septic tank has a cleanout
installed in the center of the tank. However, using a worst case scenario of the
cleanout being located at the outlet of the tank, the drainfield would still be located
outside the 100 -foot well protection radius. This statement is based on background
information found on the original installation which describes a 6 -foot section of solid
pipe exiting the tank before the drainfield. Based on our field measurements and the
existing records, the drainfield is 100 feet from the existing well.
During this same site visit, representatives of Gilfilian Engineering also probed the
septic tank to verify that the tank is structurally sound and not leaking. The liquid
level was measured at 48 inches in the morning, initially, and during a second site visit
later in the same day, the liquid level was again measured and found to be 48 inches.

The normal operating liquid level for a Sunset tank is 48 inches. Therefore, we feel
confident the tank is indeed in fair condition and does not have a substantial leak.
We also collected two water samples from the domestic well and had one sample
analyzed for nitrato-nitrogen and the other analyzed for other bacteria. The nitrate
tests result taken on January 10, 1994 was 4.7 mg/L. The test method used for
analysis of other bacteria was modified membrane filter (M -ENDO -LES). The test
result showed no bacteria present. Please refer to the attached test results.
According to the Municipality of Anchorage Water and Wastewater Water Distribution
System plan shoots, there is a public water main approximately 600 lineal feet
northwest of the subject lot. Please refer to the attached Eagle River Water
Distribution System plan sheet photocopy. As noted, It does not appear that access
to the main Is on option at this time due to the costs associated with the construction
of a water main extension. If other wells within the area reflect similar nitrate
contamination levels, the Municipality should begin planning for a water main
extension within this subdivision.
At this time, and with the concerns raised from the nitrate levels within the drinking
water, we are recommending that approval of the waiver request be based on annual
nitrate analysis being completed on the subject water system. If nitrate levels increase
to levels exceeding drinking water limits, the homeowner should consider options for
treating the potable water with an on-site treatment system or pursue having the
Municipality provide access to the public water system.
