physical access to the lot to the southwest of this site, the
means of which to be approved by the Department of
Community Planning and Development.

Approval subject to modifying the site plan and site plan
notes to reflect the final platting conditions.
Plat:
Approval of the plat subject to:
1) Resolving utility casements.
2) Clarify proposed name of new subdivision, Baxter Hill
or Baxter Heights.
3) Resolve the need to enter into a sanitary sewer
mainline extension agreement with AWWU, and the
need for a 30 -foot water easement along the south side

5) Construct interior street to Urban Interior Standards
in accordance with AMC 21.85 Table A.
6) Submitting a site grading and drainage plan for the
development to Public Works for approval, with
approved copies to be filed with Building Safety and
DCPD.
7) Resolving the following with Project Management and
Engineering:
(a) Submitting an erosion and sediment control
plan for approval.
(b) The need for footing drains and footing drain
stubouts.
8) Providing a 10 -foot buffer landscape easement along
the east property boundary and installing the buffer
landscaping when the site is developed.
9) Providing a landscape plan to DCPD for approval, and
forwarding a copy of the approved landscape plan to
Project Management and Engineering and to Land Use
Enforcement.
10) Resolve the need for a drainage impact analysis to
adequately analyze impacts in accordance with AMC
21.15.110.4.1, and investigation of the offsite receiving
system with Project Management and Engineering and
with NPDES Stormwater Review.
11) Providing documentation of the required percentages
of open space and useable open space to DCPD, and
label the open space and useable open space on the
site plan.
12) Transferring all notes -concerning open space and snow
storage from the site plan to the plat.
13) Providing as -built or other documentation acceptable
to DCPD showing the accurate location on the petition
site of the driveway serving the lot to the southwest.

14) Placing the following notes on the plat, site plan and in
the covenants:
(a) "Landscaping meeting the buffer landscape
standards of AMC 21.45.125.C.2 shall be
installed within the 10 -foot buffer landscape
easements along the east property boundary. All
required landscaping to be installed by the
owner/developer at the time of development, and
maintained by the homeowner's association for
the life of the use."
(b) "All areas of the common area not devoted to
buildings, structures, parking areas, courts,
walkways, specialized areas for sport and game
activities and driveways shall be covered by one
or more to the following: lawn grass, shrubbery,
trees or undisturbed indigenous vegetation."
(c) Address responsibilities for common areas.
(d) "This is a cluster development governed by AMC
21.50.210 and by the approved cluster site plan
on file with the Department of Community
Planning and Development."
(e) "Any fencing shall be along or within property
lines only, and shall not encroach into
designated open space."
(f) "Existing vegetation in the designated open
space areas shall remain • undisturbed, with the
exception of utility extensions and removal of
dead material only."
15) If the vacation of the south 33 -foot BLM easement is
NOT approved, place the following note on the plat:
"There shall be no access to 36th Avenue from those lots
which it directly abuts."
16) Resolving with Building Safety the need to provide
engineered foundations, and the need to place a note

covenants to this effect.
17) Establishing a homeowners association for the
ownership of the proposed common area Tract and
deeding the Tact to the homeowner's association, and
obtaining approval of the homeowners' association
documents from DCPD prior to plat recordation.
Include in documents the requirement for fencing to
be along or within property lines only, and to not
encroach into designated open space areas, as well as
the requirement to retain existing natural vegetation in
open space areas, with the exception of utility
extensions and dead vegetation removal.

sac bulbs to allow for adequate provisions of water and
sewer.
19) Verifying lot coverage calculations to ensure no more
than 50 percent allowed lot coverage.

b. S-10541 Autumn Ridge Subdivision with variance
Postponed at the request of the petitioner. A new public
hearing date not to be re -scheduled until the following
information has been submitted by an established cut-off

AMC 21.65 to DHHS for each lot of this proposed
subdivision to DHHS. The information must include,
but may not necessarily be limited to:

foot BLM easement and the south 3 feet of the 33 -foot
section line easement along the north property boundary
subject to:
a. Obtaining ADOT approval for vacation of a portion of
the section line easement along the north property
boundary, and
b. Filing a suitable replat within 18 months.
