Additionally we are requesting a waiver from the Lot 2 water well to the Lot I septic tank of 90', instead of the required 100'. The Greater Anchorage Area Borough, Department of Environmental Quality approved a waiver of the Lot 1 well to drain field of 94' on 10/19/76. The drain field appears to be operating satisfactorily. We are providing this additional information to our waiver request.On 8/25/14 the MOA approved a COSA for Lot 2. This COSA approval was given despite the Lot 2 well at a distance of 90' from the Lot I septic tank, due to engineer failing to report. On 6/29/17, portions of the septic tank were excavated. This was reported to you in an email with photos: It was a green fiberglass tank stamped"Anchorage Tank". We consulted with Anchorage Tank& determined it to be an Orenco Fiberglass tank We inspected inlet& outlet- calder couplings. No evidence of leakage.1st compartment has 4'cover. Less cover over the 2nd compartment, but is insulated with 2"Dow Blueboard. We installed monitor tube. Tank appears to be in good shape. From pump receipts& measurements, this tank was determined to be 1500 gallons. The tank could not likely be moved without damage.There does not appear to be adequate space- sheet 1. Nitrate readings in the area have been reviewed & a current sample taken for Lot 1- attached. The nitrate sample result for Lot 1 was reported @ 4.71 ppm. Arsenic was ND & no bacteria was present. On 6/2/04 Tobben Spurkland sampled for nitrate @ 8.78 ppm. This appears to indicate an improving situation. This coincides with the reduced nitrate level for Lot 2. During a COSA, the Lot 2 nitrate was reported @ 6.51 ppm (6/11/14). A 6/2/04 sample by Tobben Spurkland reported nitrate @ 7.31 ppm. Nitrate levels appear to be diminishing in this area. A drawing of nitrate levels& ground slope gradient is attached as sheet 1. The slope gradient roughly matches the phreatic aquifer slope. This slope is generally in a range of 5%-15%. This is advantageous for the Lot 1 & 2 wells,any potential contamination tends to migrate away. As can be seen from the drawing, no neighbor wells are within several hundred feet down-gradient. \CRTI—SIM ENGINEERING SteveEng.com After consultation with your office, we will request a waiver according to the State of Alaska (SOA) Memorandum on waivers, dated January 3, 1985. This Memorandum utilizes a procedure to award point values for geological conditions at the site and makes recommendations based on these point values. Point values will be computed for Lot 1; Lot 2 point values will be similar or larger since the distance is greater. Geological: No well log was discovered for geological information. Test holes previously completed in the area(attached) indicate the top 20' to be variations of silty sand with gravel. Measurements of static water levels were reviewed for neighboring lots. 1. Water Table: The distance from the bottom of the Septic tank to the highest water table is 24'. The static water table used to determine separation, coincides with previous measurements. This gives a point total of 3.0. 2. Soil Sorbtion: The soil tests indicate the soil is silty sand.The average of silt and sand equals a point total of 3.0. 3. Permeability: There is a point value for silty sand. This yields a point total of 1.7. 4. Water Table Gradient: The slope of the gradient generally parallels the surface slope @ 5% between well & septic tank. This is a positive slope value & yields a value of 4.5. 5. Horizontal Separation: The horizontal separation is 75'. This yields a value of 2. The total point total = 3.0+ 3.0 + 1.7 + 4.5 + 2 = 14.2 This point total has a value that states"No bacteriological pollution possible but chemical pollution possible but unlikely from household chemicals". The SOA Memorandum places special emphasis on"Special Construction". The 1500 gallon fiberglass tank was installed correctly & found to be in good shape from recent inspection. The fiberglass tank could be considered special construction, since it will not allow for corrosion to degrade the tank. We request the waiver due to the above arguments, attached information & previous MOA approvals of the system. If there is need for additional information or clarification please give me a call. The purpose of this letter is to: 1.) Provide further explanation of why the waiver request of the separation distance required between the wastewater disposal system (septic tank and absorption field) and the private water well serving the subject property, and the waiver request of the separation distance between the septic tank on the subject property and the private water well on Block A, --Lot 2 of Birch Hill Estate Subdivision was not granted; and 2.) Address misconceptions` regarding ,previous on-site wastewater disposal and water supply system approvals; and ' • , 3.) Explain code violations that . occurred "during the 2004'• septic tank installation and property title transfer. Waiver Request The water well on the subject property is located 77. feet from the septic tank and 95 feet from the absorption field on the subject property. The water well on Lot 2 is located 90 feet from the septic tank on the subject property. Current code and the code in place in 1976 requires a minimum separation distance of 100 feet from the private well to the septic tank and absorption field. For on-site wastewater disposal systems not meeting the minimum separation requirements, the Anchorage Municipal Code (AMC) 15.65.140(A) states, "... the department may issue waivers of the separation distances required between on-site wastewater disposal system and those areas specified in 18 AAC 72 by using criteria established by the state department of environmental conservation." The Alaska Department of Environmental Conservation (ADEC) established guidelines for issuing waivers in their January 3, 1985 memo, Alaska Department of Environmental Conservation (ADEC) Separation Distance Waiver Guidelines for SCRO. The ADEC guidelines require evaluation of five geological conditions, including distance from the septic system bottom to groundwater, soil sorbtion below the septic system, soil permeability below the septic system, water table gradient, and horizontal separation. During the waiver evaluation, number values are assigned to each of the site specific five geological conditions. The number values are derived from the standardized charts included Contnittnity, Secinity, Prosperity Birch Hill Estates Subdivision, Block A, Lot 1 January 31, 2005 Page 2 of 4 in the ADEC guidelines. The ADEC guidelines indicate that waivers should not be granted for values of 16 or less for a continuous source of contamination such as a subsurface absorption field, unless other mitigating measures are noted or special construction techniques which can mitigate some of the geological concerns are taken. During our waiver evaluation, a total value of 9.3 was obtained for the five geological conditions considered in the ADEC guidance document. According to the ADEC guidance document, a total value between 8 and 12 could equate to a condition where contamination is unlikely from bacteria, but could be possible from chemicals or virus. This conclusion was supported by the 8.78 milligrams per liter (mg/L) nitrate and 0 colonies per 100 milliliters (col/100 mL) bacteria results reported for the water sample from the well on the subject property. A nitrate result of 7.31 mg/L was reported for the water sample from the well located on Lot 2. Historical nitrate analytical sample results from other wells located on nearby properties indicate that the elevated nitrate results for the water samples from the wells located on Lot 2 and the subject property could likely be caused by the subject encroachments. No mitigating measures or special construction techniques which could mitigate some of the geological concerns were noted in Mr. Tobben Spurkland's waiver request. Although nitrate concentrations relative to the Environmental Protection Agency (EPA) Maximum Contaminant Level (MCL) of 10 milligrams per liter (mg/L) are not one of the criteria established in the ADEC guidelines for granting waivers, this department uses the results to.. support the decision to either grant or deny a waiver. While other sources for elevated nitrate levels may exist, other potential sources of nitrate contamination were not identified by your engineer. Mr. Spurkland was verbally informed on September 1, 2004 that this department would require him to provide technical evidence that the subject encroachment was not the most likely source for the elevated nitrate results. This would require collecting water well samples from upgradient wells, the Lot 2 well, and the well on the given property within a short time period of one another. If the analytical results from the upgradient wells indicate that nitrate concentrations are greater than or equal to the nitrate results for the Lot 2 well and the well on the subject property, the department may use the results to justify granting a waiver for the subject encroachments. Based on the information provided to date, the initial decision not to grant the waiver appears to be appropriate. It appears that a lesser separation distance does not meet the intent of the code requirements and would not be protective of public health. In addition, a suitable area for a replacement wastewater disposal system appears to be present on the subject property. According to the site plan submitted with the waiver request, there appears to be an adequate area on the eastern portion of the subject property for a replacement wastewater disposal system which meets the current separation distance requirements of AMC 15.65. Utilization of this portion of the property for the wastewater disposal system would likely require the installation of a lift station located outside the 100 feet protective well radius to transfer wastewater to a wastewater disposal system. This department considers the use of a lift station appropriate in order to achieve the minimum separation distances required by AMC 16.65.050(A) and 16.65.060(A)(1). . Birch Hill Estates Subdivision, Block A, Lot 1 January 31, 2005 Page 3 of 4 Prior On -Site Wastewater Disposal System and Water Supply Approvals The October 19, 1976 On -Site Sewer Disposal System Inspection Report is limited to specifications of the wastewater disposal system upgrade and a hand drawing of the wastewater disposal system components in relationship to the 4 -bedroom dwelling. The location of the private water wells on Lots 1 and 2 are not shown, and the separation distances between the private wells and the on-site wastewater disposal system were not recorded on the inspection report. Therefore, it is a misconception that approval of the subject wastewater disposal system in this situation would constitute a waiver from the minimum separation requirements. Furthermore, approval of inspection reports does not relieve the property owner from meeting the code requirements in place at the time the system was installed. As can be noted on the October 11, 1976 On -Site Sewer Permit, the minimum separation distance required between a private well and an on-site sewer disposal system is 100 feet. A Certificate of Health Authority Approval (NAA) was issued by the Municipality of Anchorage on April 17, 1984. The separation distances between private wells and wastewater disposal systems are recorded on the checklist attached to the HAA. The distance between the septic tank and the well is recorded as 65 feet, and the distance between the absorption field and the well is recorded as 94 feet. While this office was made aware in 1984 that the on-site systems did not meet the minimum separation distance requirements in effect at time of installation, the intention _ of the HAA in 1984 was not to verify code compliance with separation distances. The paragraph under Section 6 of the 1984 HAA notes that "This approval indicates that ..... the water supply and wastewater disposal system is safe and functional for the number of bedrooms and type of structure indicated." The approval does not indicate compliance with code requirements in effect at the time of the wastewater disposal system was installed, nor does it relieve the property owner from meeting the code requirements in place at the time the system was installed. 2004 Septic Tank Installation The septic tank was installed illegally in June 2004. The septic tank was installed without a permit and was installed less than 100 feet from the water well located on Lot 2 and the subject property. Our office has no record of a permit application being submitted in May or June of 2004. A letter dated September 1, 2004 from Mr. Tobben Spurkland states that a permit was not obtained for the septic tank installed in June 2004 on the subject property. Regardless of the location of the 1976 septic tank installation, current regulations require all components of a wastewater disposal system must be installed in accordance with provisions of AMC 15.65. Current code also requires that property owners obtain a Certificate of Health Authority Approval prior to title transfer. The following AMC 15.55 and 15.65 provisions were violated during the June 2004 septic tank installation on the subject property and transfer of title: • AMC 15.65.030(A), "Required. A person may not install or modify an on-site wastewater disposal system, earth privy or vault without a permit from the department, except for simple repairs such as piping or moving parts repairs. A separate permit is required for each installation or modification." • AMC 15.65.040(A), "A person may not construct, install or use an on-site wastewater disposal system except in accordance with the provisions of this chapter..." Birch Hill Estates Subdivision, Block A, Lot I January 31, 2005 Page 4 of 4 AMC 15.65.050(A), "A septic tank must be located no less than the separation distances required by 18 AAC 72 from water supply wells." AMC 15.65.033(A), "Prior to the transfer by gift, deed or contract of any ownership or use interest in a privately owned on-site wastewater disposal system, the transferor shall obtain a Certificate of Health Authority Approval." AMC 15.55.055(A), "Prior to the transfer by gift, deed or contract of any ownership or use interest in a privately owned on -water well, the transferor shall obtain a Certificate of Health Authority Approval." The current property owner, Mr. Daniel Lindsey, has been informed that the on-site wastewater disposal system does not meet code requirements and that the encroachment matter must be resolved. He has also been informed that as the current property owner it is his responsibility to resolve the encroachment matter. To resolve this matter, a waiver must be issued for the subject encroachments or the existing wastewater disposal system on the subject property must be abandoned and a new wastewater disposal system, meeting AMC 15.65 requirements, be constructed on the subject property. The information submitted to date has not contained sufficient data to justify issuance of a waiver. This office will still consider issuing a waiver for the subject encroachments, however, technical information in accordance with AMC 16.65.140 will be necessary in order to process another waiver request. It should be advised that even if additional technical information is submitted, a waiver may not be justifiable for this property - ;- and the subject encroachments. The septic tank on the subject property was installed on June 1,-2004, according to the On -Site Wastewater Disposal System and/or Well Inspection Report you submitted to this office on September 20, 2004. You also submitted a permit application for the June 2004 septic tank installation on the subject property on September 20, 2004.. The September.20, 2004 permit application was not submitted with payment of the required permit application fee of 5460. The permit application was therefore not processed at the time of submittal.. -,The required permit application fee was subsequently paid on January 7,2005. The water well on the subject property is located 77 feet from the septic tank installed in June 2004 and 95 feet from the absorption field on the subject property. The water well on Lot 2 is located 90 feet from the septic tank installed in June 2004 on the subject property. According to Anchorage Municipality Code (AMC) 15.65.050,,the required minimum separation distance from a private well to a septic tank is 100 feet. In order for the permit application for the septic tank to be approved, the minimum separation distances specified in AMC 15.65.050 is required or a waiver from the minimum separation distance requirements must be granted by this office. On September 1, 2004, you requested a waiver of the separation distance required between the wastewater disposal system (septic tank and absorption field) and the private water well serving the subject property. In addition, you requested a waiver of the separation distance between the septic tank on the subject property and the private water well on Block A, Lot 2 of Birch Hill Estate Subdivision. The Alaska Department of Environmental Conservation (ADEQ Separation Distance Waiver Guidelines for SCRO, analytical water well sample results and existing property conditions were used to evaluate the waiver request. The waiver was not granted due to the reasons specified in our September 29, 2004 letter. At this time, your request for a permit for the June 2004 septic tank installation can not be granted. Box 196650 Anchorage, AK 99519-6650 Re: Birch hills Estates Subdivision, Block A, Lot 1 Parcel ID: 050-131-09 Dear Mr. Roth: I am requesting approval of the wastewater disposal system on the above referenced property. This property is the site of a private residence which I owned and lived in from the date the house was built in 1967 until I sold it in September 2004. In the spring of 2004 I had a problem with water draining from the washing machine and backing up. In May 2004, JR's Pumping used a camera to inspect the waste system piping. They found a sag and possible broken pipe between the house cleanout and the tank, a broken joint between the tank and outflow cleanout and a blockage between the last tank cleanout and the field. In late May, Alaska Excavating began work on repairing the pipes and cleaning out the blockage. During that repair process, they found that the fiber glass septic tank was damaged. Consequently, they replaced the tank as well as the piping. There was no change to the remainder of the system. The original wastewater system on this property was replaced in 1976. The new system was approved by the Greater Anchorage Area Borough, Department of Environmental Quality on Oct. 19, 1976. In 1984 the well and septic system were inspected in order to meet requirements for a home improvement loan. A flealth Authority Approval was issued by the Municipality of Anchorage, Division of Environmental health on May 24, 1984. Attached arc copies of the 1976 and 1984 approvals. The May 2004 repairs to the septic system neither replaced nor made substantive changes to the existing system. Instead, they improved the system and removed any possible source of contamination due to the damaged tank and pipes. Tests in 1984 and 2004 show no evidence of degradation of the absorption field. When it was found that the septic tank was damaged, Lars Spurkland of Spurkland Engineering went to the On -Site office May 28, 2004 and spoke to Joe Goodall. Fie was given an emergency approval and told to submit a waiver request. A waiver request was submitted by Tobben Spurkland on Sep. 1, 2004. On Sep. 29, 2004 Julie Makela of the On -Site Water and Wastewater Program, sent a letter to Tobben Spurkland stating that the waiver had not been granted and recommending that the existing wastewater disposal system be abandoned and a new wastewater system be constructed. Prior to the repair work which was done in May 2004, this system was an MOA IIAA approved system. The repairs did not degrade the system nor constitute a change justifying denial of approval already granted. On the contrary, these repairs replaced leaking pipes and an old tank with new and safer materials. On Nov. 2, 2004, I wrote to Julie Makela explaining why I believed that the waiver should be granted. I requested that she approve the waiver request and asked her what additional information would be required to continue evaluating the waiver request. I have not received a response to my requests. However, I was copied with a Jan. 4, 2005 letter to Daniel Lindsey, the current owner of the property, restating that the waiver was not granted. Ms. Makela states that analytical water well samples indicate elevated nitrates. The DEC water quality standards specify a 10 mg/L maximum nitrate level. The nitrate levels in the two sampled wells are both less than 10 mg/L. The nitrate levels could be due to a variety of sources; the damaged on-site system (now repaired); any of the numerous septic systems uphill from the subject property; or a horse stable which is a short distance uphill and has housed many horses for decades. Ms. Makela recommends that the wastewater disposal system be abandoned and that a new wastewater system be constructed on the eastern portion of the property. Topographical problems would make relocation of the tank and field extremely difficult, if not impossible. Relocating the system to the small hill on the east side of the property would necessitate that wastewater be pumped up from the house to the system. I do not believe that the great expense and difficulty of constructing anew system is justified or necessary. In addition there is no evidence that doing so would have any effect on nitrate levels. I would like you to consider approving this waiver request because all of the problems with this system have been of a structural nature and these structural problems have been corrected. The original 1966 wastewater system was replaced in 1976 due to structural failure. The replacement system was approved as complying with the then current standards. The system was approved again in 1984 when well and septic system tests were done by S&S Engineering. In May 2004, JR's Pumping used a camera to inspect the waste system piping and found problems between the house and tank and between the tank and field start. Alaska Excavating was hired to replace the failed piping. During that repair process they found a damaged fiber glass septic tank. As the dwelling was occupied, they replaced the tank as well as the piping. There was no change to the remainder of the system. Tests in 1984 and 2004 show no evidence of degradation of the absorption field. I know of no septic system field failures in the neighborhood. Topographical problems would make relocation of the tank and field extremely difficult if not impossible. The uphill slope on the eastern portion of the property would necessitate that waste water be pumped up from the house to the system. The DEC water quality standards specify a 10 mg/L maximum nitrate level. The nitrate levels in the two sampled wells are both less than 10 mg/L. There are other sources for high nitrate levels in addition to septic systems. What additional information would you require to continue evaluating this waiver request? You requested a waiver of the separation distance required between the wastewater disposal system (septic tank and absorption field) and the private water well serving the subject property. In addition, you requested a waiver of the separation distance between the septic tank on the subject property and the private water well on Block A, Lot 2 of Birch Hill Estate Subdivision. The water well on the subject property is located 77 feet from the septic tank and 95 feet from the absorption field on the subject property. The water well on Lot 2 is located 90 feet from the septic tank on the subject property. The January 3, 1985, Alaska Department of Environmental Conservation (ADEC) Separation Distance Maiver Guidelines for SCRO, analytical water well sample results, age of wastewater disposal system and existing property conditions were used to evaluate the waiver request. A total value of 9.3 was obtained for the five geological conditions considered in the ADEC guidance document. According to the ADEC guidance document, a total value between 8 and 12 could equate to a condition where contamination is unlikely from bacteria, but could be possible from chemicals or virus. This conclusion is supported by the 8.78 milligrams per liter (mg/L) nitrate and 0 colonies per 100 milliliters (col/100 mL) bacteria results reported for the water sample from the well on the subject property. A nitrate result of 7.31 mg/L was reported for the water sample from the well located on Lot 2. Additional nitrate analytical sample results from other wells located on nearby properties indicate that the elevated nitrate results for the water samples from the wells located on Lot 2 and the subject property could likely be caused by the subject encroachments. Current site conditions and the age of the wastewater disposal system were also considered in evaluating the waiver request. The subject property is 21,150 square feet and configured in the shape of a right triangle. The current wastewater disposal system is located in the northwest portion of the subject property. A significant portion of the wastewater disposal system is located within 100 feet of the water well on the subject Community, Security, Prosperity property. The absorption field was constructed in 1976 and a portion is located under the driveway. Given the age of the absorption field, the remaining life expectancy may be limited. According to the site plan submitted with the waiver request, there appears to be an adequate area on the eastern portion of the subject property for a replacement wastewater disposal system which meets the current separation distance requirements of Anchorage Municipal Code (AMC) 15.65. At this time, your request for a waiver of the required 100 feet horizontal separation from the wastewater disposal system to the private wells has not been granted. It appears that a lesser separation distance does not meet the intent of the code requirements and would not be protective of public health. In addition, a suitable area for a replacement wastewater disposal system appears to be present on the subject property. It is recommended that the existing wastewater disposal system on the subject property be abandoned and a new wastewater disposal system, meeting AMC 15.65 requirement, be constructed on the subject property. Tank was found with four feet of cover and with a liquid level of 58 inches. Trench clean out was 3.5 feet deep and dry. Trench sump was 11 feet deep and contained 72 inches of liquid. A steel monitor was driven three feet into the trench, adjacent to the sump. 1.5 inches of water was measured in the monitor. 100 gallons of clean water were added to the monitor to verify that the water was flowing freely into the trench. 400 gallons were then added to the trench clean out. The addition of this water caused 7 inches of liquid to be measured in the monitor. No changees were observed in the sump or the tank. 5 hour later the measures water deptn in the monitor was .5 inches, indicating the water had been absorbed. The steel monitor was removed. TEST RESULT: This system meets the code requirements of the Health and Social Services Department of the Municipality of Anchorage. NOTE The operational life of all septic systems depends on the local soil conditions, groundwater levels that may fluctuate during the year, and the water usage of the family being served by the system. These conditions are outside the control of the evaluator of this septic system. We can therefore not give any estimate of how long this system will function satisfactorily for current or future occupants. All septic systems ultimately fail. The lot line in question is the Eagle River Loop Road Right of Way Line, the encroachment has no impact on the road. 3 We installed a monitor pipe in order to do the adequacy test. After the test we removed the pipe. 4 The drain field was installed under the driveway in 1976. The field is still operating satisfactory after 28 years of usage. Obviously the driveway has had no detrimental effect on the system. The system was also approved by the Municipality in 1984 with a comment that the driveway was over the trench and that this was not a recommended practice. 5 There are no requirements as to the stickup of standpipes. 6 The survey has been amended. Amended survey to follow 7 Permit has been obtained, and inspection report submitted. 8 The well has an approved sanitary seal. 9 Well logs copied from Municipal files have been compiled for your perusal. An As Built Survey shows that the separation distance between the septic tank and the well on lot 1 is 77 feet, and 90 feet to the well on lot 2. This septic tank was installed in lune 2004. It is an Anchorage Tank 1250 gallon HDEP tank. The old tank, installed prior to 1976 had collapsed and required replacement. A permit was not obtained at that at that time because the residence contained two apartments. The drain field was installed in 1976 and inspected by a Municipal Inspector.. The inspection report shows 96 feet separation between the well and the drain field. A HAA issued in 1986 repeats this number. Apparently no waivers was ever issued. .At this time we are applying for a On Site System Approval, and request that a formal waivers be granted 1 have included a site plan, showing the wells in question and the location of the septic system. The properties south of this site is on AW WU water, with no septic system within 100 feet of these two wells. Nowell logst could be located, but Muni records show the wll to be installed prior to 1970. The well is 100 felt plus deep. Water samples collected in on June 2, 2004 show no bacteria in either well. l lowever the Nitrate levels were 8.78 mg/I for lot 1 and 7.31 mg/I for lot 2. Short of replacing the complete septic system outside of the two well radia, or replacing the septic tank with a lift station and locating the lift station outside of the radia, the present location of the septic tank is the only practical location for the tank.
