(907) 694-5195 tel While performing final inspections on a septic system installed on the above referenced property, it was noticed that a waiver would be needed due to the proximity of seasonal surface water. The purpose of this letter is to request a waiver for the separation distance between the installed leachfield and the seasonal surface water seeps to the west of the installed leachfield and tank. During the years in which this septic system was permitted and installed, were some of the warmest and driest years on record, and the extent of the visible surface seeps and springs were not apparent. The distance we are requesting to be waived is from 100' to K, fr?jn leachfield and septic tank to surface water. The surface water seeps, and damp spots ap`p°�artto be seasonal, and may only occur during exceptionally damp years, and vary in extent. We offer the following points in favor of granting this waiver Any effluent from a malfunctioning leachfield would flow in a direction parallel to the seeps and springs for a distance of more than 100'. Please see site plan. _ The existing septic tank and leachfield have been in use for three years and appears to be functioning well. An adequacy test was performed by Flattop Technical Services and passed the absorption test with flying colors. Box 196650 Anchorage, AK 99519 Re: Cinerama Terrace Blk 2 Lot 13 Narrative & Septic & Well Permit Application Dear Mr. Cross: Eagle River Engineering Services (ERES) was contracted to design and permit a septic system and well for the above referenced property. This lot is very damp, and is classified as developable wetlands. The only septic site is on a steep bank within the ingress/egress easment along the northeast edge of the property along King's Way. The soil at this location is excellent. The proposed septic upgrade will have very limited impact on adjacent properties for the following reasons: 1. The surrounding lots are all very large, allowing sufficient room for septic sites. 2. Immediate neighboring septic systems are all +30' distance, and no private wells within 200'. 3. This permit is for a well and septic system. 4. Drainage will not be affected and is not a major consideration in our design. The septic site location is on a steep embankment, and significant amounts of fill will need to be imported to lessen the slope, and/or eliminate the cutbank. Leachfteld will be entirely within native GM soil. We are requesting you to allow a 35% slope below the drainfield, or to allow a 35' setback to a cut bank. I researched the platting actions and found the topographic survey data showed the contour lines parallel to the Kings Way road way. This Indicated the natural slopes wouldn't allow driveways meeting slope requirements being built In just the right of way, requiring the additional width to access the adjacent lots. From that standpoint the owner of Lot 13 cannot harm the adjacent property owners by depriving them of access to their lots through Lot 13, by placing the septic system in the easement. There are only two actions to allow the system to be placed In the easement. One is to vacate the easement allowing public hearing and therefore the concurrence of the adjacent property owners. The other Is to provide an engineering report showing the adjacent parcels can physically and economically construct their accesses in front of their own lots or starting in the right of way front of Lot 13, or that they have already built accesses. The engineering report should have the concurrence of the current owners of the adjacent lots. The Right of Way Division cannot contribute to the potential harm to the adjacent lot owners by approving the installation without one or both the above actions. It's conceivable that they could do the report with concurrence to meets this years building schedule and still pursue the vacation for a permanent fix to the access challenge. Box 196650 Anchorage, AK 99519 Re: Cinerama Terrace Block 2 Lot 13 Dear Mr. Roth and Mr. McGee, Eagle River Engineering Services (EKES) has, at the request of the landowner of the above referenced property, investigated the feasibility of installing an on-site septic system and well on the property. The land is classified as developable wetlands, and the majority of the lot is very wet with inadequate soils to support and on-site septic system. The only adequate uplands terrain, without a water table and with free -draining soils, is a strip of land immediately adjacent and parallel to King's Way. This strip of native gravels drops off steeply to the wetlands of the remainder of the lot. No other area within the lot boundary, or available technology has any likelihood of success for supporting an on-site septic system. Unfortunately, this area of free -draining soil is with a platted 50' Ingress/Egress easement adjacent to King's Way. This is the only lot within the platted subdivision that has this 50' easement, and no notes were able to be found regarding this easement. It appears that the easement was created for construction of the above lot's, and neighboring lot's driveways, due to the steep slope between King's way, and the developable portions of lots 13,Tract C, and lot 14. Tract C has already constructed a driveway entirely upon their property, and is at least 250' clear of lot 13's eastern boundary. Please see attached as -built showing this access to Tract C. Lot 14 has not been developed, but topographical maps and a site visit to the property, indicate that the lot has plenty of frontage along King's Way (+350') to construct a driveway without encroaching within lot 13's Ingress/Egress easement. Please see the attached topographic overlay where we have shown an approximately 15% slope driveway on lot 14. Legal driveway slope can be up to 17%. Utilizing the Ingress/Egress easement on lot 13 would not gain the adjacent homeowner \2003\04-052ACCeSSLETT R.00C much benefit from a lesser slope, or reduction in driveway length. A worst case scenario would be that lot 14's driveway start at a common location in the western comer of lot 13, where the owner of lot 13 has already chosen to construct their own driveway. This location would not impact the primary or replacement septic sites. In light of the fact that the adjacent properties either have, or potentially appear to have adequate access without the necessity to encroach on lot 13, we believe that siting of lot 13's septic system leachfield within this easement will not pose any future health risks due to adjacent properties encroachment and construction of driveways within this easement. It is entirely possible, but not probable, that in the future, the right to utilize this easement will be realized. In this unlikely event, and if all available septic sites within this easement have been encroached upon, the property could be legally upgraded to a holding tank. It is my understanding that the homeowner wishes to vacate this easement as soon as possible, so this may be a dying issue. In summary, EKES believes that placement and permitting of the primary and replacement leachfield within this Ingress/Egress easement will not pose a future health risk for the following reasons: 1) Sufficient legal access for the adjacent landowners has been obtained, or can be obtained and entirely constructed on their adjacent lots, 2) The landowner of lot 13 has expressed their desire to vacate this easement in the near future, 3) The soil within the easement is the only area on the lot that was found to have free -draining soil capable of supporting an on-site septic system.
