4. From October 15 to April 15, a subsurface soil absorption system under construction during freezing weather
must be either: A. Open and closed on the same day.
B. Covered, sealed, and heated to prevent freezing.
5. The following special provisions.
a.) Septic system Is being installed on Lot 138 for the existing 4 -bedroom single family dwelling on Lot 139. A 10
bedroom septic system has been designed for the existing 4 bedroom single-family dwelling on Lot 139 and a
possible future 6 -bedroom residence on Lot 138. The appropriate approvals must be obtained prior to the connection
of a second residence to the septic system.

Ref: Proposed Septic System Upgrade for Lots 138 and 139: Section 15, T12N, R3W
A design was submitted to your department on 3/10/2005. We are revising the design to include a future house
location and to show an alternate site. Two more test holes were excavated on lot 138. We are proposing to
install the drainfield around these test holes. Per the request of the owners we have designed a 10 bedroom
system for the existing 4 bedroom house on lot 139, and a possible future 6 bedroom residence on lot 138 .
This design option would include the installation of a 3000 gallon septic tank and two 5 -wide type drainfields
to be installed on lot 138. For the foreseeable future the septic system will serve only a single family residence.
Before a second residence can be connected to the septic system approval will need to be obtained from
A.D.E.C. Comments regarding the designs are summarized as follows:
I. SOILS: See the attached log, which shows the soil classifications, groundwater monitoring, and the
percolation test results.
2. DRAINFIELD DESIGN: See the attached design for the drainfield specifications.
3. SURFACE WATERS: There are no surface waters within 100 feet of the proposed septic upgrade.
4. TOPOGRAPHY: The average slope in the area of the proposed drainfield/s is approximately a 5 to 10
percent running southwest to northeast. In short, there are no slope concerns.
We are unaware of any adverse impacts this installation would have on adjacent wells or septic systems.

This Grant of Easement is intended to be appurtenant to Grantees above described land and
touches, concerns and runs with said lands. This is not intended to be an exclusive easement: The
Grantor herein expressly reserves unto themselves equal rights of ingress and egress and all other
rights as the owners as tenants in the entirety of the described premises.
Any dispute or disagreement arising under or in any way concerning this instrument shall be
submitted for resolution to the process of binding arbitration in accordance with the Alaska
statures made and provided for said arbitration. The jurisdiction of the Arbitrator shall
commence 60 days form the onset of the dispute and shall operate to toll all applicable Statutes
of Limitation.
