Box 196650, Anchorage, Ak 99519-6650 (907)343-7904 Attention: Dan Roth Ref: Revisions to the Septic System for Mountain Shadows S/D; Lot 4, Block 2, Mr. Roth: It is our understanding that the referenced property had a septic system installed on the property on 9/13/2004 and as -built documentation was submitted to your department. It is also our understanding that your department reviewed the as -built documentation and determined the installation to be deficient. We have been hired by the property owner to provide an engineering solution. A site visit and an in -office meeting were performed with one of our representatives and with two of your staff members. The deficiencies which currently prevent MOA approval are slope issues and separation to bedrock. In order to achieve the required slope setbacks, we have revised the septic system to incorporate the following items: I. We are proposing to install an approved Category III Advantex Treatment System in order to reduce the drainfield size and to obtain a vertical separation distance waiver to bedrock. 2. We are proposing to use the upper trench that is currently a 35 foot long by 5 feet wide that has an effective depth of 4 feet. We are proposing to abandon 15 feet of the southeast end of the trench. 3. We are proposing that the lower trench be completely abandoned due to the fact it does not and cannot meet the slope requirements. 4. An alternate site is shown on the design drawing uphill from the existing trench. The following is additional comments regarding the proposed installation: 1. SOILS AND WAIVER REQUEST TO BEDROCK: As you are aware, Steve Pannone has logged three test holes on this property which your department has copies of theses logs. Per your request, a confirmation test hole was excavated between the trenches in order to confirm soils and the bedrock table. On 8/22/2006, our representative, Susan Oswalt, had a test hole excavated between the two trenches. Based upon her visual evaluation, the soils classification appeared to be consistent with Pannone's soils log. However, based upon elevation taken from 3701 E. Tudor Road, Suite 101 ' Anchorage, AK 99507-1259 Ph: (907) 337-6179' Fax: (907) 338-3246' Website: www.gamcsscnginecring.com the bottom of the uphill trench and the bedrock/fractured bedrock table found in this test hole, there was only 4 foot separation. We request that your department waive the vertical separation from bedrock to 4 feet. Justification for this reduced separation distance is summarized as follows. The effluent being discharged to the drainfield is from an Advantex Treatment System, which has CBOD and TSS levels that are expected to be less than 15 mg/L. In addition, the total nitrogen levels are expected to be less than the effluent from a lined Intermittent Sand Filter (effluent from an ISF can be discharged into a drainfield that is only 4 feet from bedrock and impermeable soils) There will still be a 4 feet separation distance between the bottom of the drainfield and groundwater There will be no discernable benefit (reduced BOD, TSS, or total nitrogen) achieved by passing the effluent through 6 feet of soil vs. 4 feet of soil. It is generally agreed upon that the pathogen reduction occurs within the first 4 feet of soil; hence the 4 feet required separation distance to groundwater. It is reasonable to assume that by the time the effluent passes through 4 feet of the insitu 13.3 minute per inch soil that the BOD, TSS, and fecal coliform levels will be essentially zero (0). 2. TRENCH DESIGN CRITERIA: a. Percolation Rate: 13.3 minutes/inch b. Proposed Application Rate: 3.0 gallons/day/ftZ c. Number of Bedrooms: 3 d. Design Flow: 450 gallons per day e. TOPOGRAPHY AND WAIVER REQUEST: As you are aware, there are significant slope concerns on this property. Attached is a cross section detail which shows the existing grades and the proposed changes to be made. We are proposing that 35 feet below the primary trench be filled and graded to less than 25 percent. We request that the 50 foot separation distance be waived to 35 feet from a slope greater than 25 percent. Given the porosity of the soil, the use of the Advantex treatment system, and the system being used sporadically the last two years with no indication of surfacing effluent, it is our opinion that there is minimal risk with the granting of this waiver. E. Permit (Construction) An On -Site Wastewater Disposal System Construction Permit as defined by AMC 15.65. F. Permit (Operating) An Advanced Wastewater Treatment System Operating Permit.' An annual permit, issued by the Municipality, that allows the Owner to operate an AWWTS, upon meeting all the requirements of this agreement, the conditions of Operating Permit, the requirements of the On -Site Wastewater System Construction Permit and all relevant provisions of AMC 15.65 3. Fee. Owner shall pay to Municipality an annual fee of ZERO ($—Q! 00), payable on or before the issuance of the operating permit and annually thereafter. The annual fee is due on or before the anniversary date of the approval by the Municipality of installed system. 4. Term. The term of this Memorandum of Understanding shall be for the life of the AWWTS. The term begins on the date of approval by the Municipality of the installed system and shall continue while the AWWTS system is in use or operational or until the property is sold or title is transferred by owner and a new certificate of On -Site approval is issued to the new owner or transferee of the property. 5. Alterations, Installation and Removal of Additional F.guinment. Owner agrees not to make any alterations, removal of parts or additions to the AWWTS without a Construction Permit from the Municipality. 6. Maintenance and Repairs. A. Throughout the term of this Memorandum of Understanding, the Owner shall maintain AWWTS in good repair. In addition, it shall be the responsibility of the Owner during the term of this Memorandum of Understanding, and any extensions or renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. Further, Owner agrees to comply will all applicable ordinance, laws, regulations, rules and orders for the AWWTS. B. Owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system pursuant to the terms and conditions contained in the Owner's AWWTS Operating Permit. This schedule shall be submitted to the Municipality annually upon the renewal of the permit. The schedule of maintenance and repair contained in the Owner's AWWTS Operating Permit is: AVOUAL C. Owner acknowledges that the fine schedule for failing to maintain and repair an AWWTS are codified in AMC 14.60. D. Owner agrees that only maintenance, repair personnel certified by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. E. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. F. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. G. Owner agrees that the relevant provisions of the standard specification guidebook for AWWTS is the governing professional guidelines for the construction, maintenance and repair of the Owner's AWWTS. 7. Nonwaiver. The failure of either party at any time to enforce a provision of this Memorandum of Understanding shall in no way constitute a waiver of the provisions, nor in any way effect the validity of the Memorandum of Understanding or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 8. Amendment. A. This Memorandum of Understanding shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality of this Memorandum of Understanding was executed and such writing shall be attached to this Memorandum of Understanding as an amendment. B. Two test holes were excavated on August 5, 2002 by my company in preparation of my client purchasing the property. The soils report and a percolation tests result are attached. Ground water was monitored for two years and there was no indication of water in the monitor tubes during periods of high water. Bedrock was encountered in both test holes at a depth of 12 feet. Please note, there appears to be some confusion in the municipal website on the actual legal description of the property. I have attached a copy of the MOA tax record of the property and I am using that legal description as the correct one. The lot is approximately 18,954 square feet (0.435 acres) in size. Lot 4 slopes to the southwest at approximately 20 to 25 percent. The proposed installation will be located in the northwestern portion of the lot. The proposed well will be located in the southeastern corner of the lot, greater than 100 feet from the proposed system. The proposed location is greater than 100 feet away from existing neighboring wells and 25 feet from the water service lines. The surrounding wells are located greater than 100 feet from the proposed installation. The proposed installation will not affect the future development of the surrounding or existing lots. Due to the size of the lot and slope of the lot, the replacement system is based on the use of an Advantex advanced wastewater treatment system. There is adequate room for installing a soil absorption system sized on the use of the Advantex system. See the attached design.
