In consideration of the mutual covenants contained herein, the parties to this Memorandum of Understanding agree as follows: 1. ADVANCED WASTEWATER TREATMENT SYSTEMS. Municipality grants permission to Owner to utilize and operate an Advanced Wastewater Treatment System (A W WTS), described asf i✓Rn 1 fel A)( - Z D located at 5301 Wood%1lt�Crt,945/6 /B��Gh4W lstz,� 5(A i Ut 3 6 nchorage. Alaska. 2. Definitions. A. Alteration. Any change to the design or function of an AW WTS that Includes the installation or removal of any parts, components or pieces not included in the original construction permit and design. Prior to performing any alterations to an AW WTS the owner must obtain a Wastewater Disposal System Construction Permit from the Municipality pursuant to Anchorage Municipal Code (hereinafter, "AMC") 15.65. B. Certificate of On -Site Systems Approval. An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with AMC 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. C. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. D. Maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AW WTS that were included in the original design which would allow the AW WTS to continue to perform as designed. E. Permit (Construction) An On -Site Wastewater Disposal System Construction Permit as defined by AMC 15.65. F. Permit (Operating) An Advanced Wastewater Treatment System Operating Permit. An annual permit, issued by the Municipality, that allows the Owner to operate an AW WTS, upon meeting all the requirements of this agreement, the conditions of Operating Permit, the requirements of the On -Site Wastewater System Construction Permit and all relevant provisions of AMC 15.65 3. Fee. Owner shall pay to Municipality an annual fee of — ?X CD ($�.00), payable on or before the issuance of the operating permit and annually thereafter. The annual fee is due on or before the anniversary date of the approval by the Municipality of installed system. 4. Term. The term of this Memorandum of Understanding shall be for the life of the A W WTS. The term begins on the date of approval by the Municipality of the installed system and shall continue while the AW WTS system is in use or operational or until the property is sold or title is transferred by owner and a new certificate of On -Site approval is issued to the new owner or transferee of the property. S. Alterations. Installation and Removal of Additional F.auipment. Owner agrees not to make any alterations, removal of parts or additions to the AW WTS without a Construction Permit from the Municipality. 6. Maintenance and Repairs. A. Throughout the term of this Memorandum of Understanding, the Owner shall maintain AW WTS in good repair. In addition, it shall be the responsibility of the Owner during the term of this Memorandum of Understanding, and any extensions or renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. Further, Owner agrees to comply will all applicable ordinance, laws, regulations, rules and orders for the AW WTS. B. Owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system pursuant to the terms and conditions contained in the Owner's AW WTS Operating Permit. This schedule shall be submitted to the Municipality annually upon the renewal of the permit. The schedule of maintenance and repair contained in the Owner's AW WTS Operating Permit is: Q n n ad C. Owner acknowledges that the fine schedule for failing to maintain and repair an AW WTS are codified in AMC 14.60. D. Owner agrees that only maintenance, repair personnel certified by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. E. Owner agrees to grant the Municipality reasonable access to test and inspect the AW WTS upon 24 hours written notice. F. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. G. Owner agrees that the relevant provisions of the standard specification guidebook for AW WTS is the governing professional guidelines for the construction, maintenance and repair of the Owner's AW WTS. 7. Nonwaiver. The failure of either party at anytime to enforce a provision of this Memorandum of Understanding shall in no way constitute a waiver of the provisions, nor in any way effect the validity of the Memorandum of Understanding or any part hereof, or the right of such parry thereafter to enforce each and every provision hereof. 8. Amendment. A. This Memorandum of Understanding shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality of this Memorandum of Understanding was executed and such writing shall be attached to this Memorandum of Understanding as an amendment. B. For the purposes of any amendment modification or change to the terms and conditions of this contract, the only authorized representatives of the parties are: Owner: I 1 i5 t -')1'Q �rG Anchorage: Purchasing Officer C. Any attempt to amend, modify, or change this contract by either an unauthorized representative or unauthorized means shall be void. 9. Jurisdiction: Choice of Law. Any civil action arising from this Memorandum of Understanding shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Memorandum of Understanding. 10. Severability. Any provisions of this Memorandum of Understanding decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Memorandum of Understanding. .. & STATE OF ALASKA I ss. Box 196650 Anchorage, AK 99519-6650 RE: Birchtree Estates, Block 1, Lot 36 Septic System Upgrade Permit Application To Whom It May Concern: Attached please find the application and supporting documentation to upgrade the septic system for the referenced 3 bedroom house. The house is being sold, and it is proposed to rebuild both the primary and the alternate drainfield sites. Waivers have been approved for separation between the absorption field and the well (WR030072 and WR030070) and the property lines and for 8 ft between the two fields. The property is served by an AdvanTex AX -20 advanced wastewater treatment system, which was installed in September 2003. The primary drainfield failed in 2005, due to overloading of the system. The system was designed for 4 bedrooms, but it has been serving 10 people. There is no room on the lot for a larger drainfield. The alternate drainfield was installed in September 2005 and the maintenance schedule was increased to 4 services per year. After a period of rest, the primary drainfield was put back in use in July 2007, but it filled up within a week, and the second drainfield was put back in service. An adequacy test was performed on the second field on August 1, 2007, and it passed for 3 bedrooms. However, it was full in April 2008. Since the house is being sold, it is proposed to rebuild both drainfields. The drainfields were designed based upon Test Hole #1, dug July 9, 2003. The test hole was dug to a total depth of 15 ft. A fine grained sand was found from 3 ft to 7 ft below ground level. Water was encountered at 10.5 ft and was at 11.5 ft after 7 days of monitoring. The soil log is attached. A percolation test was run from 3.5 to 4.0 ft, with a result of 4.1 minutes per inch. A layer of silt occurs below the sand. A percolation test was also performed on this layer to ensure that it is permeable. The result was 120 min/inch. The absorption fields were installed from 3 ft to 5 ft below high original grade. It is proposed to rebuild both drainfields as originally installed. Any contaminated material will be excavated and buried on site. The trenches will be backfilled with MOA approved filter sand to 5 ft below the high original grade elevation as previously determined. The configuration is shown on the attached design. The application rate is 6 gpd/ft2 based upon a percolation rate of 4.1 minutes per inch. For 600 gallons per day, the area requirement is 100 ft2. The actual absorption area is 107 ft2, with a reduction factor of 0.70 for 2 ft effective depth in a 5 -wide. There is a creek running through the north side of the property, and the absorption systems maintain a 100 ft separation distance to it. There is no other suitable site on the lot for a septic system. The reduced separation distance between the well and the absorption field was justified by the following: Good quality effluent from the AdvanTex AX -20 Advanced Wastewater Treatment System, Good water quality tests in the past, with no bacteria and nitrates at 0.247 mg/I, as tested on 8/16/2005, even with the primary drainfield located about 80 ft from the well, Topography with the well uphill from the septic system, and The depth of the well (100 ft) and the presence of "soft wet brown clay" from 42 ft to 64 ft which provides an adequate barrier between the surface and the aquifer. A waiver for 1 ft separation to the west and south lot lines was approved. The absorption field for the adjacent lot to the west is located 18 ft from the lot line, and the south property line is adjacent to the right of way. Approval was given in 2005 for an 8 ft separation distance (end to end) between the drainfields. The drainfields are both 5 ft wide and 15 ft long with 2 it of effective depth. They are situated end to end. There is very little space available on the lot. A lot line waiver was obtained for 1 ft from the south and west lot lines. The drainfield was placed 1.4 ft from the south lot line. There is a separation distance between the two ends of the drainfields of 8 ft, instead of the required 10 ft, due to lack of space. I do not believe that this reduction will compromise the performance of the drainfields. This situation was discussed with your department during the installation, and it was agreed that this would be acceptable. Box 196650 Anchorage, AK 99519-6650 RE: Birchtree Estates, Block 1, Lot 36 Septic System Upgrade Permit Application To Whom It May Concern: Attached please find the application and supporting documentation to upgrade the septic system for the referenced 4 bedroom house. Waivers are requested for separation between the absorption field and the well and the property line. The existing drainfield is surcharged, and it is proposed to develop the alternate site. The property is served by an AdvanTex AX -20 advanced wastewater treatment system, which was installed in September 2003. The premature failure of the drainfield is believed to be caused by hydraulic overloading. Inspection reports from maintenance checks on the system indicated that the AdvanTex system was operating properly. However, during an inspection in October 2004, an excessive amount of water was noted in the drainfield. Copies of the inspection reports are attached. There have been numerous alarms related to high water levels sent over the VeriComm monitoring system. A copy of the VeriComm report is attached. The drainfield was designed based upon Test Hole #1, dug July 9, 2003. It was within a 30 ft radius of the test hole. Test Hole #1 was dug to a total depth of 15 ft. A fine grained sand was found from 3 ft to 7 ft below ground level. Water was encountered at 10.5 ft and was at 11.5 ft after 7 days of monitoring. The soil log is attached. A percolation test was run from 3.5 to 4.0 ft, with a result of 4.1 minutes per inch. A layer of silt occurs below the sand. A percolation test was also performed on this layer to ensure that it is permeable. The result was 120 min/inch. The absorption field was installed from 3 ft to 5 ft. The existing drainfield is 5 ft wide, 15 ft long, with 2 ft effective depth. The application rate was 6 gpde based upon a percolation rate of 4.1 minutes per inch. For 600 gallons per day, the area requirement is 100 fe. The actual absorption area is 107 fe, with a reduction factor of 0.70 for 2 ft effective depth in a 5 -wide. Sewer Upgrade Permit Application for Blrchtree Estates, Blk 1, Lot 36 Watkins Engineering, Inc.; August 31, 2005; page 2 The proposed drainfield is identical to the existing one. The percolation rate in the area of the proposed drainfield was confirmed on August 19, 2005, with percolation tests at 3.5 ft and at 5 ft. The percolation rates were 1 minute per inch and 3 minutes per inch, respectively, after a 4 hour presoak. There is no room on the lot for a larger drainfield. It is proposed to retain the existing drainfield for future use. Although the system was designed for a 4 bedroom house, the loading is probably beyond the design rate of 600 gpd. A family of 10 lives in the house, and all 8 of the children are home schooled. Therefore, water useage and wastewater strength are probably higher than the design rate. The family is currently conserving water and is considering moving to a larger house. The supplier of the AdvanTex system, Orenco Systems, Inc., was contacted for their recommendations. A copy of their memo is attached, which recommends installation of a new drainfield, retention of the existing one, and increased scheduled maintenance from 2 per year to 4 per year. It may be necessary to pump the tank more frequently; this will be determined by monitoring the tank. Proposed Soil Absorption System: 4 Bedrooms x 150 GPD/BR = 600 GPD Application rate used: 6 gpd/ft2 600 GPD / 6 gpd/ft2 = 100 sq. ft required System Type: Shallow trench (5 -wide) Maximum Depth: 5.0 ft Effective Depth: 2.0 ft Reduction Factor: 0.70 Length Required: 100 sq. ft / 5 ft x 0.70 = 14.0 ft Proposed Length: 15 ft Waiver Request A waiver is requested for a separation distance of 75 ft from the private well serving the lot to the absorption field. There is a creek running through the north side of the property, and the proposed absorption system will maintain a 100 ft separation distance to it. There is no other suitable site on the lot for a septic system. The reduced separation distance between the well and the absorption field is justified by the following: ➢ Good quality effluent from the AdvanTex AX -20 Advanced Wastewater Treatment System, Y Good existing water quality from the well, with no bacteria and nitrates at 0.247 mg/I, as tested on 8/16/2005, even with the existing drainfield located about 80 ft from the well, Sewer Upgrade Permit Application for Blrchtree Estates, Blk 1, Lot 36 Watkins Engineering, Inc.; August 31, 3005; page 3 ➢ Topography with the well uphill from the septic system, and ➢ The depth of the well (100 ft) and the presence of "soft wet brown clay" from 42 ft to 64 ft which provides an adequate barrier between the surface and the aquifer. Please see the attached water analysis, well log, and site plan showing potential surfaced effluent path which justify this waiver. A waiver for 1 ft separation to the west and south lot lines are requested. The absorption field for the adjacent lot to the west is located 18 ft from the lot line, as shown on the proposed design drawing. Waivers are requested for separation between the tank (AdvanTex) and absorption field to the well and to the property line. The existing system, installed in 1973 and upgraded in 1979, has failed. It is proposed to install an advanced wastewater treatment system to serve this property. The proposed design is based upon Test Hole #1, dug July 9, 2003. The proposed absorption field is within a 30 ft radius of the test hole. Test Hole #1 was dug to a total depth of 15 ft. A fine grained sand was found from 3 ft to 7 ft below ground level. Water was encountered at 10.5 ft and was at 11.5 ft after 7 days of monitoring. A soils log is attached. A percolation test was run from 3.5 to 4.0 ft, with a result of 4.1 minutes per inch. A layer of silt occurs below the sand. A percolation test was also performed on this layer to ensure that it is permeable. The result was 120 min/inch. The absorption field is proposed to be installed from 3 ft to 5 ft, to obtain 2 ft of native soils below the bottom of the trench. There is a creek running through the north side of the property, and the proposed absorption system is 100 ft from it. There is no other suitable site on the lot for a septic system. The well log is attached. Please see the attached water analysis, well logs, and site plan showing potential surfaced effluent path which justify this waiver. A waiver for 1 ft separation to the west and south lot lines are requested. The absorption field for the adjacent lot to the west is located 18 ft from the lot line, as shown on the proposed design drawing. The house has been upgraded from 3 bedrooms to 4, and a reserve site is available for the absorption field, as noted on the design drawing. The existing tank, cesspool, and absorption field are proposed to be abandoned. The seepage pit and absorption field, with depths of 11.5 ft and 9 ft, respectively, do not have adequate separation to the seasonal high ground water level. We also acquired from Mr. Sidney Self his log of your well. Mr. Self logged the well as follows: 0 - 12' 12 - 24' 24 - 42' 42 - 64' 64 - 89' 89 - 94' 94-98' Topsoil, sand & gravel with clayey base Brown clay Clay with gravel Soft wet brown clay Grey clay & gravel Grey clay with gravel Wet sand 98 - 100' Water bearing sand & gravel The 12 feet of sandy gravel topsoil is consistent with the soil encountered by Alaska Testlab on October 30, 1973, in their soils analysis for a proposed seepage pit, and with those encountered by Alaska Mineral and Materials Lab, Inc. in their report of May 12, 1973. The proposed seepage pit was apparently to be 92 feet from the well and 76 feet from a small creek in a drainage swale north of the pit. Hatch and John M. Lambe of our staff inspected your lot, the location of the proposed seepage pit relative to the well, and the surface drainage behind your home. We also acquired from Mr. Sidney Self his log of your well. Mr. Self logged the well as follows: 0 - 12' Topsoil, sand & gravel with clayey base 12 - 24' Brown clay 24 - 42' Clay with gravel 42 - 64' Soft wet brown clay 64 - 89' Grey clay & gravel 89 - 94' Grey clay with gravel 94 - 98' Wet sand 98 - 100' Water bearing sand & gravel The 12 feet of sandy gravel topsoil is consistent with the soil encountered by Alaska Testlab on October 30, 1973, in their soils analysis for a proposed seepage pit, and with those encountered by Alaska Mineral and Materials Lab, Inc. in their report of May 12, 1973. The proposed seepage pit was apparently to be 92 feet from the well and 76 feet from a small creek in a drainage swale north of the pit. State law requires a pit of this nature to be 100 feet from a well and 100 feet from the creek. MEMBER Mrs. Judy Sehm 2 ?—vember 5, 1973 Apparently there has been some misunderstanding in that both the well and the home have been constructed so that at their existing location the geometry precludes meeting State and Borough ordinances for horizontal separation. To avoid the expense of moving the well, perhaps the following based on the site soils will suffice. Frcm the well log, apparently from a depth of 12 feet to a depth of 94 feet, there exists 82 feet of essentially impermeable soil. However, the top 12 feet of soil is a relatively permeable silty, sandy gravel. Although the test hole for the seepage pit was 15.5 feet deep, the bottom of the test hole was 5.5 feet below creek level, Alaska Testlab observed no free water. Apparently there is no infiltration from the creek to the test hole. (This is consistent with the log.) Four points become apparent: 1) It would appear, then, that the probability of conta- mination of the creek is much higher than contamination of the well, for the permeability of the silty, sandy gravel may be 80 to 400 times that of the -clay. 2) The consequence of contaminating the creek and perhaps polluting a community water source is greater than that of contaminating an individual's water source by that - individual. 3) The water from the well is much more easily monitered by testing than that from the creek. 4) If the well was properly constructed with the casing being intact and adhered to the walls of the hole, there is little chance of contaminating the water bearing sand stratas through the layers of clay or along the outside of the well casing. We suggest, based on these data, that: 1) The 100 foot separation requirement from the creek to the seepage pit be maintained. 2) The 100 foot minimum separation from the well to the seep- age pit be exempted to a 50 foot minimum horizontal separ- ation (It should be noted that there would still be about 100 feet of separation between the well's source and the seepage pit, (822 x 502) 112 = 96 feet, but the distance would be through an impermeable soil.) In conclusion, it is the writer's opinion that the aforementioned recommendations reflect concern for the public health, yet provide a reasonable engineering solution to a rather unfor- tunate misunderstanding. The results were presented in a report issued the same day. It was observed that the system accepted 104 gallons surge; when projected for 24 hours it would accept 74 gallons of water per day. The adequacy test was repeated on May 24, 1983, and the system was observed to accept the 675 gallon surge. The projected 24 hour rate is 520 gallons per day. The conditions were much dryer during the repeat adequacy as evidenced by road conditions, lack of surface drainage, etc. Additional Observation` The existing system is located in the lowest area of the lot. The trench and "pit" portions have existing depressions over the leach areas, especially near the standpipes. During the inital test on May 16, 1983, however, no surface drainage was observed on the property. The proximity of the creek on the North, and possible subsurface drainage may have influenced the May 16, 1983 test. We therefore recommend that the ground be landscaped to divert surface waters from the septic system. Judkins, R.S. Director FROM: Rolf Strickland, R.S. Chief Sanitarian 11-21-73 October 31, 1973 SUBJECT: Mrs. Sehm - Lot 36, Block 1, Birch Tree Estates Subdivision A routine sewer permit was issued by this Department on the subject lot upon the receipt of a satisfactory soils test. All the necessary information was given on the permit to properly install the system. The property owner or his agent then lays out the system according to the information on the permit. In this case, it appears that a professional engineer, C. E. Overton, designed the layout for the subject lot. This was done on May 29, 1973, seven (7) days after the server permit was issued. A written inquiry is being made of the engineer to receive his reason- ing on the placement of the system in the low area near what was shown on the plat to be a creek easement. The sexier was placed on the plot plan in a different lo- cation from where the soils test was taken. This Department received a complaint concerning the seepage pit on the neighboring lot, Lot 37. Basically, the complaint stated that the pit on Lot 37 was full of water and installed illegally. This Department is in the process of handling this complaint. (See attached memo: Sue McK.echnie to Rolf Strickland, October 31, 1973.) Various personnel from this Department and Kyle Cherry from the State Department of Environmental Conservation have visited the site in an attempt to resolve the situation to mcet the State and local codes and public health standards. A number of ideas and possibilities were discussed on this problem before narrowing the choices down as will be done on most any problem. It appears that by discuss- ing all the possibilities with the property owners before all the data had been collected tended to upset and frustrate the property owners in this case instead of helping the overall situation. The data can be readily observed from the Milar on the overhead projector or on the smaller printed handout. The data listed below is necessary in determining the best solution to the problem from first a public health standpoint, second an economic standpoint and, third, from a legal standpoint. 1. The wet lot area on Lot 36 which comprises almost 1/2 of the lot which presently has running water in it and is disputed to be a creek. 5. Any and all soils tests already made on the lot. Also, tests that may be run in the future nay negate or change decisions already formulated. The soil is the one item that cannot be predicted accurately, but must be observed and classified by qualified soils engineers or geologists. At a quick glance the diagram shows a small triangular area on Lot 36 formed by the 100' well radius, the lot line, and boardered on the third side by the low wet area. This area is a possible location for the sewer if 1) the soils proves satisfactory; 2) if the area is large enough to support the sewer; and 3) approval from the State Department of Environmental Conservation. This Department's and the State's main concern is that sewage might enter the running stream of water and pollute the land area for a number of miles down stream; obviously, no one wants to live with the possibility of widespread pollution. This final determination of the likelihood of such a possibility shall be made by the State Department of Environmental Conservation. Another possibility for the location of the sewer and water systems on the lot would be as follows: the well would be re -located in the south west corner of the lot and the sewer in the south east corner of the lot. Again, soils information would be re- quired to even allow this. Assuming soils conditions would be acceptable and the sys- tem was installed in this location, the abandoned well would need to be properly re- moved to prevent pollution of the potable ground water acquafer. By re -locating the well and installing the sewer as mentioned here the proper protective well distances would be maintained. A third possibility would be locating the seepage pit where the original soil test shows the soils are satisfactory. The well would then have to be re -located 100' from this location. A fourth possibility and in the long run the most expensive would be the use of a holding tank for the sewer system. This would be the least desirable method since there are two (2) main financial arguments against it. One, it can be quite diffi- cult to obtain financing for the house with a holding tank and, secondly, they are expensive to maintain. Additional information has been provided since the memo was first written. A second soil test has been run and is included in your packet. This shows soils acceptable for sewage disposal 92' north west of the well. We again discussed this situation with Mr. K,/Ie Cherry on November 1, 1973. He ad- vised Firs. The sketch as developed by your departmental personnel quite clearly indicates that the proportions referred to above are the only acceptable locations due to the locations of systems on adjacent lots, the small size of the lot and the existence of low wet ground on approxi- mately the rear half of the lot. The system as proposed on your sketch will meet the requirements which were in effect immediately prior to the promulgation of the new Wastewater Disposal Regulations, and we will accept the system constructed to these standards. We will also require that the existing well be grouted up and sealed. We have also discussed the use of -a somewhat unconventional system with Mrs. Mary Frohne, Assembly -woman, from Section 6. As what Mrs. Frohne intends to do would involve the installa- tion of a conventional system for the gray water and requlre- ing the use of a,portabie chemical toilet for the black water, We would have no objection to this approach as the proper con- ventional wastedisposal system would be In place in the event that the non -conventional system does not function as it is proposed. However, during my last discussions with the property owners they indicated that they were not very interested in this project. We will require further data on this new system before even concept approval is given. This is supposed to be available from Sid Clarke's work at the Water Lab in Fairbanks.
