ADVANCED WASTEWATER TREATMENT SYSTEMS. Municipality grants permission to Owner to utilize and operate an Advanced Wastewater Treatment Sys tem $0Tjro MLC 55 (AWWTS), described as SR"s 60rUL- located at t2N(?�_50!_SC5,M �E.R$ $ Anchorage, Alaska. 2. Definitions. A. Alteration. Any change to the design or Tinction of an AWWTS that includes the installation or removal of any parts, components or pieces not included in the original construction permit and design. Prior to performing any alterations to an AWWTS the owner must obtain a Wastewater Disposal System Construction Permit from the Municipality pursuant to Anchorage Municipal Code (hereinafter, "AIVIC") 15.65 B. Certificate of On -Site Systems Approval. An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with AMC Pase 1 of 5 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. C. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. D. Maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AWWTS that were included in the original design which would allow the AWWTS to continue to perform as designed. E. Permit (Construction). An On -Site Wastewater Disposal System Construction Permit as def ned by AMC 15.65. F. Permit (Operating). An Advanced Wastewater Treatment System Operating Permit. An annual permit, issued by the Municipality, that allows the Owner to operate an AWWTS, upon meeting all requirements of this agreement, the conditions of the Operating Permit, the requiraments.of the On -Site Wastewater System Construction Permit and all relevant provisions of Ail IC 15.65. 3. Fee. Owner shall pay to Municipality an annual fee of 'lent (S 0 .00), payable on or before the issuance of the operating permit and annually thereafter. The annual fee is due on or before the anniversary date of the approval by the Municipality of installed system. Pase 2 of 5 4. Term. The term of this Memorandum of Understanding shall be for the life of the AWWTS. The term begins on the date of approval by the Municipality of the installed system and shall continue while the AWWTS system is in use or operational or until the property is sold or title is transferred by owner and a new certificate of on site approval is issued to the new owner or transferee of the property. ------5.—Alterations,-Installation-and Remo.val.of Additional Equipment._ Owner agrees not --- to make any alterations, removal of parts or additions to the AWWTS without a Construction Permit from the Municipality. 6. Maintenance and Repairs. A. Throughout the term of this Memorandum of Understanding, the Owner shall maintain AWWTS iri good repair. In addition, it shall be the responsibility of the Owner ` during"the term of this Memorandum of Understanding, and any extensions or renewals "thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. Further, owner agrees to comply with all applicable ordinances, laws, regulations, rules and orders for the AWWTS. B. Owner agrees to provide the Municipality 'a written schedule of routine maintenance and repairs which have been performed on the system pursuant to the terms and conditions contained in the Owner's AWWTS Operating Permit. This schedule shall be submitted to the Municipality annually upon the renewal of the permit. The schedule of maintenance and repair contained in the Owner's AWWTS Operating Permit is: Apoi tt J9 L - Page 3 of 5 C. Owner acknowledges that the fine schedule for failing to maintain and repair an AWWTS are codified in AMC 14.60. D. Owner agrees that only maintenance, repair personnel certified by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the systems. E. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. F. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. G. Owner .agrees that the relevant provisions of the standard specification guidebook for AWWTS is the governing professional guidelines for the construction, . maintenance and repair of the Owner's AWWTS. 7. Nonwaiver. The failure of either party at any time to enforce. a provision of this Memorandum of Understanding shall in no way constitute a waiver of the provisions, nor in any way affect the validity of this Memorandum of Understanding or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 8. Amendment. A. This Memorandum of Understanding shall only be amended, .modified or changed by a writing, executed by authorized representatives of the parties, with the same formality as this Memorandum of Understanding was executed and such writing shall be attached to this Memorandum of Understanding as an amendment. �' Page 4 of 5 B. Any attempt to amend, modify, or change this contract by either an unauthorized representative or unauthorized means shall be void. 9. Jurisdiction: Choice of Law. Any civil action arising from this Memorandum of Understanding shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Memorandum of Understanding. 10. Severability. Septic System Design and Permit Application Impacts to Adjacent Properties Dear Onsite Services Engineer: The existing septic system on Lot 986, T1 5N, R3W, Section 33 is near failure and must be replaced. We are therefore requesting a permit be issued for the construction of a new septic system to serve the four-bedroom home on the lot. The attached Site Plan and backup documentation identify the location and configuration of the proposed upgrade to the septic system. Also identified on the plans are the locations of the existing well location and the well and septic system locations on the adjacent properties. Drainage arrows are shown indicating the current patterns. The drainage patterns will be maintained after construction. Test holes placed on the lot indicate poorly graded silty gravel with some sand and cobbles in the area of the new absorption bed. The percolation rate for this lense is 30 minutes per inch. Organic fill was placed on the lot in the distant past to a depth of nearly 4'. This material was recently removed. Groundwater was found during placement of the test holes at approximately 9' below the surface. The water then rose to nearly 7' below the surface during the monitoring period. A subsurface drain was placed along the eastern boundary of the lot to protect the area of the new absorption bed from groundwater. Recent inspections of the monitor tubes indicate groundwater is present in the area of the new absorption bed, but at depths of 6' below original ground level. We are therefore proposing to place a new 1,500 -gallon STEP tank along with a 40' long by 15' wide intermittent bottomless sand filter. The elevation of the distribution line in the absorption bed will be 2' below the surface. The separation from the highest measured groundwater will then be 6'. A minimum of 2' of coarse graded sand will be placed to raise the bed above the groundwater elevation. Lot 98B, T15N, R3W, Section 33 August 17, 2003 Page Two The ground surface on the lot slopes at minor grades from the east to west. The new absorption bed will be constructed parallel with the slope as much as possible .in conformance with Municipal requirements. The new septic system will be constructed a minimum of 100' from the proposed well on the lot and the existing wells on the adjacent lots. It will also be constructed a minimum of 100' from any surface water in the area and 1 00'from the subdrain outlet. If the system is constructed in accordance with our design the following statements apply: The system, if constructed as designed, will have no adverse impact on the wells in the area or those to be constructed in the future. 2. The system, if constructed as designed, will have no adverse impact on existing septic systems in the area or those to be constructed in the future. 3. The system, if constructed as designed, will have no adverse impact on reserve space, either surface or subsurface, on any lots located in the area. 4. ANDERSON, CERTIFY THAT THIS TEST WAS PERFORMED IN ACCORDANCE WITH ALL STATE AND MUNICIPAL GUIDELINES ON THIS DATE: 9/3/2003 ON-SITE WASTEWATER DISPOSAL SYSTEM CONSTRUCTION AND MATERIAL SPECIFICATIONS SUBJECT: LOT 98B, T12N, R3W, SECTION 33 GENERAL: The scope of this project includes the pumping, removal and disposal in accordance with ADEC requirements of the existing septic tank on the property. It also includes the procurement and placement of a new 1,500 gallon combination septic tank and lift station and pressure distribution system. Work also includes the construction of a new 40' long x 15' wide Bottomless Intermittent Sand Filter at the location shown on the attached Site Plan. A minimum of 2' of coarse sand meeting the specification attached must be imported and placed in the filter area. The 6" of pea gravel and distribution piping must then be constructed atop the imported filter sand material in conformance with specifications furnished by the supplier. The distribution piping for the filter must be placed at the elevations shown on the Site Plan to provide a minimum of 4' separation to groundwater. All work must be completed in strict conformance with the manufacturer's requirements for installation of the intermittent sand filter. 2. Construction shall be in accordance with the approved site plan, design drawings, Municipal Permit with any special provisions or conditions, and all applicable State and Municipal Wastewater Disposal Regulations. 3. The Contactor shall be responsible for obtaining all underground utility locates and for the layout of the septic system and verification of the location of all lot lines. 4. Unless specifically agreed otherwise, the contractor shall be responsible for final grading areas subsequently depressed from soil settling. Property owner shall be responsible for revegetation of affected areas unless specifically agreed otherwise. 5. Contractors installing wastewater disposal by the Municipal Department of Health system installations. Owners installing receive prior approval from D.H.H.S. installation. SEPTIC TANKILIFT STATION INSTALLATION systems must be certified and Human Services for their own systems must before beginning system The 1,500 gallon septic tank/lift station must be constructed by a certified tank manufacturer. Construction shall include an 18" manhole to provide access to the lift station. Lot 98B, T15N, R3W, Section 33 August 17, 2003 Page 2 of 4 2. The septic tank shall be sufficiently bedded to prevent settling or shifting of the tank. 3. All standpipes on the septic tank shall extend a minimum of 12 inches above final grade. 4. Tanks installed without 4' of cover shall have a minimum of 2" of direct burial insulation. 5. A foundation cleanout shall be installed one to four feet from the building foundation. Two cleanouts are required between the tank and the drainfield. 6. Final grading over the tank/lift station shall be such that a positive slope exists away from the septic tank. ABSORPTION BED CONSTRUCTION: 1. The absorption bed shall be constructed to the dimensions shown on the design. The bottom of the bed shall be within 2" of level. 2. Distribution piping must be placed level with perforations down atop a level bed of drainfield rock. Rock should then be placed over the pipe to provide a minimum of 2" of cover. 3. A silt barrier or geotextile fabric must be placed between the drainfield rock and the natural soil backfill. 4. Monitor tubes must be 4" in diameter and installed at the locations shown on the design. The portion below ground must be perforated. 5. Contractor shall verify the septic tank and drainfield are a minimum 100' away from any private water wells in the area, 150' from a Class "C" Well or 200' from any community well. 6. Direct bury insulation must be placed over the distribution system if less than 3' of backfill depth is available. Finish grade over the trench must be mounded to prevent settlement or depressions. 7. Grade area surrounding the absorption trenches to drain away. 8. A minimum 2' of accepting soil is required below the drainfield rock for a 5' wide trench. Contractor shall verify this condition prior to placement of the rock. All pockets of unacceptable materials must be removed and replaced. 9. Lot 9813, T15N, R3W, Section 33 August 17, 2003 Page 3 of 4 MATERIAL SPECIFICATIONS: 1. The lift station must be constructed by a Municipally approved septic tank manufacturer. An Orenco 20 OSI 05 HHF-5 pump is recommended. Anchorage Tank is a recommended supplier for the materials required for this project. 2. The following pipe materials are approved for use in septic system installations in the Municipality of Anchorage: Cast Iron (perforated and solid), ASTM D3034 or P.V.C. (perforated and solid), ASTM F810 or H.D.P.E. (perforated, but not solid) and ASTM D2662 or A.B.S. (perforated and solid). 2. Insulation shall be at least 2" thick extruded direct burial polystyrene (Dow Chemical Co. Styrofoam HI or equal). 3. Septic tank inlets and outlets shall be fitted with watertight couplings (Caulder, Fernco, or equal). 4. A permeable geotextile fabric (Typar, Mirafi or equal) must be installed between the final drain rock layer and the native soil layer. 5. All drain rock shall be .5" to 2.5" in diameter with less than 3% passing the #200 sieve. EQUIPMENT SPECIFICATIONS: Air Supply Line shall be a Wasteflow Emitterline, %:" inside diameter from Anchorage Tank. Line shall be insulated with W foam pipe wrap inside a 2" Schedule 40 PVC Jacket buried a minimum 3' below the surface. 2. Air Compressor shall be a Thomas Industries Model 5070 as supplied by Anchorage Tank. Compressor shall be located in the garage or crawlspace. 3. A pressure gauge calibrated from 0 to 10 PSI shall be furnished and installed in line with the air line. The gauge shall be mounted in an area which provides easy viewing and is seen on a regular basis such as the entrance to the home. Material for Filter Sand must be classified as a masonry sand and meet the following gradation: 50% or More Passing the No. 4 Sieve 2% or Less Passing the No. 100 Sieve 1% or Less Passing the No. 200 Sieve INSPECTIONS: A minimum of two inspections are required by Municipal Ordinance. These inspections must be conducted under the supervision of a professional engineer registered in the State of Alaska. The first inspection must be conducted after the excavation of trenches, beds or pits and before the installation of any gravel. A septic tank may be set in place, but may not be backfilled. The second inspection must be conducted after the placement of the geotextile fabric, gravel, distribution piping, standpipes, cleanouts and insulation. No backfill should be in place at the time of inspection. Contractor shall provide a copy of all field survey layout and construction notes for use in preparing the certified as -built of the completed system.
