Subject: RE: Doggie Avenue creek Hi Becca, I do not have any recent records for that feature, and I don't believe I've ever set eyes on it. Stream mapping metadata does not have the date it was mapped. I see photo evidence of a channel along the two lots on the south side of Trail St. (between Stroganoff and Doggie), and it appears that the east side ditch along Doggie Ave (south of Trail St.) has had some drain rock placed in it, maybe a french drain? The drain rock indicates to me that there is a perennial flow of water there (likely a stream), as it was likely placed there to keep the channel from freezing/icing during the winter. Would this feature meet the onsite definition of surface water? My take is that it functions hydrologically the same as a surface water(conveys surface flows from an upstream open channel section to Little Campbell Creek), so should probably be considered one. Subject: RE: TRAILS END BLK 6 LT 3 Attachments: Trails End surface water.pdf Hello Becca. Attached is the MOA stream mapping. Two summers ago I personally walked the subject"stream bed" on the south side of Trail Street. It was bone dry. Just for your reference, the small section of stream that is"mapped" on the north side of Trail Street (I circled it on the drawing) does not exist. There is a Quanics system on that lot and we have been to the property many times. There is no channelized area where the stream is shown and we have never seen water there. In regards to the subject property. On the day of our adequacy test(9/27/18), Erik (my technician that did the test) noted the distance from the septic system to the drainage ditch along the road and noted that the ditch was dry. In short, based upon my experience in the area, if the subject ditch (drainage feature) does carry water, it does it for a very limited period of time, like spring break-up or a heavy rainfall event. Box 196650 Anchorage Alaska 99519-6650 Attention: John Smith Reference: 11481 and 11501 Doggie Avenue Dear Mr. Smith: My neighbor, John Drennan, has informed me that the Municipality is trying to determine whether or not the drainage ditch in front of our homes on Doggie Avenue is a "surface water," as defined by AMC 15.65.010 GG. This decision will affect whether or not we may maintain our septic systems within 100 feet of the drainage ditch. I have lived at 11501 Doggie Avenue since November 1984. Each spring, the drainage ditch receives significant amounts of water as the snow on our properties and the uphill land in Chugach state park melts and flows down hill. The ditch also will sometimes have flowing water after a rain storm. The drainage ditch was designed and built for these purposes. After 8 years observation, I am absolutely certain that the ditch does not carry water except for that generated by spring snow melt and rain fall runoff. Because we receive a large amount of snow on this part of Anchorage, our elevation is approximately 1400 feet above sea level, the snow melt will sometimes last until July. It always stops sometime in June or July and after that the ditch is dry in front of my home and Mr. Drennan's home, except for rains, until the snow flies and fills the ditch up again. The time that the water reduces in flow in the ditch and then stops flowing always correlates to the time that the snow on the uphill land dissipates. I am aware of this because i am a frequent hiker in the park above our subdivision. I strongly object to any characterization of the drainage ditch as a "surface water." The subdivision was required to have a drainage ditch. The Municipal Code recognizes the fact that subdivision drainage ditches will have flowing water as'a result of snow melt and rain fall. The Code excludes these types of water flow from the definition of "surface water," and does not require a 100 foot set back from drainage ditches that experience this type of water flow. It would be terribly unfair, and unsupported by the facts, to characterize our subdivision drainage ditch as surface water and require each property owner to spend $18,000 to tear up their lots and rearrange their well and septic system placements. I urge you to make your decision quickly. The best way to lay this issue to rest once and for all will be to inform Mr. Drennan in writing that his current septic placement is consistent with Municipal Code. Your prompt action will restore peace of mind to residents in our subdivision. If you are not able to determine tomorrow that this drainage ditch is not a "surface water," please call me so that I may arrange a meeting between you and the potentially affected property owners before a final decision is made.
