Septic System Upgrade: Holding Tank
To Whom It May Concern:
Attached please find the application and supporting documentation to install a 3000
gallon holding tank for the referenced 2 bedroom house in Bear Valley. The existing
1250 gallon holding tank is of inadequate size and will be removed. There is no suitable
location for a soil absorption system on the lot. A waiver for a separation distance of 40
ft to surface water is requested. A lot line waiver of 1 ft to the southeast property line
and a separation distance of 8 ft to a water line are also requested.
The house was built in 1966, prior to inception of a regulatory agency for onsite water
and wastewater. A 1250 gallon holding tank was installed, which is proposed to be
removed. A 3000 gallon holding tank is proposed with an audible alarm, and anchored
against flotation. Due to adverse road conditions, the tank is over -sized for a 2
bedroom house.
Test hole #1 was dug on September 26, 2005 to investigate a site for a soil absorption
system. It was dug to a total depth of 6 ft, and encountered 4 ft of peat and 2 ft of silt.
Due to the lack of accepting soils, it is unsuitable for a soil absorption system.
The southwest side of the lot is classified as a Class C wetlands, with ponded surface
water in several areas. There is a small stream along the southwest property line. The
marshy areas are noted on the attached site plan. Along the south side of Diane Drive,
there is a ditch which is currently full, but has been observed to be dry in the winter and
summer. Due to current wet conditions, it is difficult to assess whether the surface
water is seasonal. It is impossible to achieve a 100 ft separation distance between the
surface water and the proposed holding tank. Therefore, a waiver is requested to 40 ft.

Surface water in the rear of the house is 40 ft from the proposed holding tank, and the
ditch along the road is 70 ft. The holding tank is proposed to be installed in a highly
visible location, and any effluent would be noticed both by the occupants and by other
people traveling down the road. The tank is also fabricated of 3116" thick steel and
coated inside and out with coal tar pitch. I believe these factors justify the reduced
separation distance.
The water line from the well to the house was located, and it enters the building in a
location where it will be impossible to achieve a 10 ft separation distance to the tank. A
waiver is requested to 8 ft of horizontal separation distance. Again, the construction of
the tank justifies this reduction.
Finally, a lot line waiver of 1 ft to the southeast property line is requested. I do not
believe that this will adversely affect the property to the south.
I am not aware of any adverse effect that this upgrade would have on any adjacent
properties' water and wastewater treatment needs.

engineer registered In the State of Alaska. Certificates of Health Authority Approval are required for the transfer of
title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or water
supply system. DSD also Issues HAAs upon request to homeowners. Certificates of Health Authority Approval are
valid for 90 days from the date of issue for properties served by a private or Class C well and may be reissued with

ENCROACHMENT EASEMENT
This agreement entered into this August day of 23, 2005, is made
between GRANTOR, Laymen Fiori, a mimed person whose mailing
address is: 8661 Flamingo Drive , Anchorage, Alaska 99502 and
GRANTEE, Laureen Fiori, a marred person whose mailing address is
8661 Flamingo Drive. Anchorage. Alaska, 99502.
1. Recitals:
Grantor is the owner of real property described as:
Lot 5 of Rabbit Creek Heights, according to Grid No. SW3240, Plat 04-
91

Anchorage Recording District, Thins judicial District, State of Alaska.
Grantee, is the owner of real property described as:
Lot 4 of Rabbit Creek Subdivision, according to Grid No. SW3240 ,
Plat 04-91, located in
the Anchorage Recording District, Third judicial District, State of
Alaska.
The Grantor's' property is hereinafteridenti6ed as the servient estate.
Grantees' property is hereinafteridentified as the dominant estate.
The servient and dominant estates are adjacent parcels. Grantee's
waterline serving the residence on lot 4 runs across Lot 5 to the
wellhead.
It is the intent of the parties that Grantee be granted an encroachment
easement forthe waterline which encroaches upon Grantor's
properties. This encroachment casement will be recorded forthe
benefit of all present and future owners of the dominant estate.
2. GRANT.
In consideration of the promises made by each party hereto, and other
good and valuable consideration, the sufficiency of which is hereby
acknowledged, the Grantor grants and conveys to the Grantee, and
theirsuccessors in interest, heirs and assigns, an encroachment
easement, forthe purpose of domestic waterservice from the
encroaching underground waterline. This grant of casement shall
include the right of Grantees to utilize an additional five foot easement
on each side of the waterline for purposes of maintenance to the
improvements only.
3. LIMITATIONS.
Said casement is limited to and forresidential purposes only.
4. USE /MAINTENANCE.
Nothing herein contained shall be construed to imply any warranty by
Grantors as to the condition or maintenance of the casement, nor
liability forany damages caused by use or maintenance of the
easement.
5. EASEMENT RUNS WITH THE LAND.
This grant of casement shall run with the land and shall be binding on
and shall inure to the benefit of the parties to this agreement, their
respective hens, successors, and/orassigns, Should the well be
abandoned, the respective encroachment casement would
automatically terminate.
6. APPLICABLE LAW.
Itis agreed that this agreement shall be governed by, construed and
enforced in accordance with the laws of the State of Alaska.
7. ENTIRE AGREEMENT.
This agreement shall constitute the entire agreement bet%vcn the
parties and no prior understanding or representation of any kind not
expressly set forth herein shall be binding upon either party.

This encroachment easement will be recorded for the benefit of all
present and future owners of the dominant estate.
