To Whom it may concern:
This is a request for a new 4 bedroom septic permit upgrade on the above referenced lot. The lot
is currently services by a failing undocumented system and the owner wants to upgrade to the
Advantex system. After excavating for the test hole the ground water was measured at 6.5 feet
through the seasonal high water period (spring 2014). The existing soils consist of silty sandy
material with some gravel and a perc rate of 20 minutes per inch. A bed system has been designed
with an application rate of 1.0 gallon/sf/day.
The class C well on lot 14A serves all four lots 14A, 14B, IIA and 11B per the plan. The slope is
flat with a minimal slope from the east to west. This new system will not impact the surrounding
properties or limit their future development.

MAINTENANCE AND REPAIR AGREEMENT
BETWEEN MUNICIPALITY/OF ANCHORAGE
AND
THIS MAINTENANCE AND REPAIR AGREEMENT made and entered into as of this

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Maintenance and Repair Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. Municipality grants permission to
Owner to utilize and operate an Advanced Wastewater Treatment System
(AWWTS), described as

2. Definitions.
Alteration. Any change to the design or function of an AWWTS that
includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design.
Certificate of On -Site Systems Approval (COSA). An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with Anchorage
Municipal Code (hereinafter, "AMC") 15.65.`these approvals certify that
the systems are adequate for the homes that they support and meet the
codes that were in place at the time of system construction.
Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included
in the original design which would allow the AWWTS to continue to
perform as designed.
Permit. An On -Site Wastewater Disposal Permit as required by AMC
15.65 to construct and operate an AWWTS.
3. Term. The term of this Maintenance and Repair Agreement shall begin on the
date of approval by the Municipality to operate the installed system or issuance of a
COSA, and shall continue while the AWWTS is in use or is operational or until the
property is sold or title is transferred by the owner and a new COSA is issued to the
new owner or transferee of the property.
4. Alterations, Installation and Removal of Additional Equipment. Prior to
performing any alterations to an AWWTS, the owner agrees to obtain an On-site
Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65.
5. Maintenance and Repairs.
A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall
maintain their AWWTS in a satisfactory condition capable of producing treated
septic effluent in accordance with the equipment's approval for operation in the
Municipality. The owner shall enter into a service agreement with an AWWTS
service and maintenance provider approved by the municipality and the
manufacturer of the AWWTS for the entire term of the AWWTS. In addition, it
shall be the responsibility of the Owner during the term of this Maintenance and
Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay
for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement
costs, and (5) inspection costs.
B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules
and orders for the AWWTS.
C. Upon request by the Municipality, the owner agrees to provide the Municipality a
written schedule of routine maintenance and repairs which have been performed
on the system. When a record of maintenance is documented and maintained by
the system vendor, the owner agrees to allow the Municipality access to this
information.
D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS
may be assessed in accordance with AMC 14.60 for improper discharge.
E. Owner agrees that only maintenance and repair personnel approved by the
Municipality will inspect and make any necessary maintenance, repairs or
permitted alterations to the system.
F. Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS upon 24 hours written notice.
G. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On -Site Systems Approval.
H. Owner agrees that the AWWTS installation and maintenance requirements as
provided by the AWWTS vendor/installer and approved by the Municipality are
the governing guidelines for the construction, maintenance and repair of the
Owner's AWWTS.
I. Owner agrees to provide and maintain a telephone connection to the AW WTS as
required by the AWWTS approval.
6. Nonwaiver. The failure of either party at any time to enforce a provision of this
Maintenance and Repair Agreement shall in no way constitute a waiver of the
provisions, nor in any way affect the validity of the Maintenance and Repair
Agreement or any part hereof, or the right of such party thereafter to enforce each and
every provision hereof.
7. Amendment.
A. This Maintenance and Repair Agreement shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties, with
the same formality that this Maintenance and Repair Agreement was executed
with, and such writing shall be attached to this Maintenance and Repair
Agreement as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this agreement, the only authorized representatives of the parties
are:

C. Any attempt to amend, modify, or change this contract by either an unauthorized
representative or unauthorized means shall be void.
8. Jurisdiction%Choice of Law. Any civil action arising from this Maintenance
and Repair Agreement shall be brought in the Superior Court for the Third Judicial
District of the State of Alaska at Anchorage. The laws of the State of Alaska shall
govern the rights and obligations of the parties under this Maintenance and Repair
Agreement.
9. Severability. Any provisions of this Maintenance and Repair Agreement decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining
provisions of the Maintenance and Repair Agreement.

The length dimension is the length(in feet) of the trench or drainfield. The
depth of a trench or pit is the distance between the surface of the ground and
the bottom of the excavation(in feet). There is no set width for trenches.
The gravel depth is the minimum depth of gravel between the outfall pipe and
the bottom of the excavation(in feet).

Backfilling of any system without final inspection and approval by this departmer
will be subject to prosecution.
Minimum distance between a well and any on-site sewage disposal system is.100 fee
for a private well or 150 to 200 feet.from a public well depending upon the type
of public well. Minimum distance from a private well to a private sewer line
is 25 feet and to a community sewer line is 75 feet. Well logs are required
and must be returned to this department within 30 days of the well completion.
Other requirements may apply. Specifications and construction diagrams are
available to insure proper.installation.

wastes to be discharged into or disposed of in such a manner
that access will be gained to any waters of the State of Alaska,
unless such sewage or wastes are first treated in a manner
approved by the Alaska Department of Environmental
Conservation and the Anchorage Department of Health and

15.65.020 Prohibited wastewater discharges and practices.
A. General prohibition. No person shall dispose of any 1
human excreta, sewage and other wastes except in a
properly designed, constructed and maintained sanitary
sewerage system, septic tank or by other methods
approved by the Department of Health and Environmental
Protection, and in accordance with the terms of this
chapter and conditions of a written permit issued by the
department.
B. Untreated discharges. No person shall cause or permit
any sewage or other wastes to be discharged into or
disposed of in such a manner that access will be gained
to any waters of the State of Alaska, unless such sewage
or wastes are first treated in a manner approved by the
department and the Alaska Department of Environmental
Conservation.
C. Hazardous discharges. No person shall -cause or permit
any human excreta, kitchen wastes, laundry .vater, sink
water, toilet wastes, septic tank effluent, sewage or
other wastes to be discharged or flow upon the surface
of the ground or into any ditch, gutter, street,
roadway, stream, lake, underground water source or
public place, nor onto any private property so ,as to
create a nuisance or health -hazard.
D. Watershed areas. No person shall cause or permit a
sewage disposal system to be located within the drainage
of any watershed area used for or reserved for use as a
source of • public water supply without the written
approval of the department. Such sewage disposal
systems,. shall consist of an adequately , sized,
self-contained tank, a tried and proven incineration
device or other . similar methods approved by the
department. No method of sewage disposal shall be used
In any watershed drainage or any area reserved for use
as a watershed to provide a public water supply, when
such is of an experimental nature. The department shall
promulgate and enforce such regulations necessary to
prevent contamination of watershed areas. Such
regulations shall include but not be limited to tank
construction,. tank size, tank location and methods of
servicing that.• will. guarantee • adequate watershed
protection.

Definitions.
A. "Cesspool!' means a lined and 'covered excavation in the
�. ground that receives the discharge of domestic sewage
or other organic wastes from a building, io designed as
to retain the organic matter and solids but permit the
liquids to seep through the bottom and the sides.
S. "Nan -water -carried sewage disposal system" means all
devices used for the disposal of human excreta in which
water is not used as a conveyance.
C. ."Sanitary sewer" means a sewer that carries liquid and
water -carried wastes from residences, commercial
buildings, industrial plants and institutions together
with minor quantities of ground, storm and surface
waters that are not intentionally admitted.
D. "Seepage pit" means a covered pit with open -jointed
lining through which the septic tank effluent may seep
or -leach into surrounding porous soil.
E. "Septic tank" means- a watertight receptacle that receives
the d'�charge of a building sanitary drainage system or

part thereof and is designed and constructed so as to
separate solids from the liquid, digest organic matter
through a period of detention and allow the liquids to
( discharge into the soil outside of the tank through a
seepage pit or a system of open -joint or perforated
piping.
F. "Sewage" means human excreta, food wastes disposed of
through sewers, wash water, liquid wastes from
residences, institutions, business buildings and
.. industrial estabiishments and such diluting water as may
have- entered the waste disposal system, or the
_ water -carried waste products or discharge from human
beings or other wastes from residences, public or
private buildings. .
G. "Sewerage system" means all structures, conduits or
pipelines by which sewage or other waste is collected,
transported or discharged to the point of disposal, and
all devices and appurtenances that treat or were
designed to treat sewage or other wastes or any portion
of such system.
H. "Subsurface disposal field" means a system of buried
open -Jointed pipes through which septic tank effluent
may seep or leach into the surrounding parous sail.
I. "Treatment' plant" means an individual household aerobic
waste. treatment system that has been approved by the
Department of Health and Environmental Protection,
tested and certified by the National Sanitation
Foundation Testing Laboratory, Ann Arbor, Michigan,
meets or exceeds National Sanitation Foundation
Standard No. 40, and meets or exceeds Class I effluent
requirements as established under this standard or
exceeds Class 11 effluent.
J. "Wastewater" means sewage, waterborne industrial
waste, laundry liquid effluent, shower or sink water or
other wastes that are waterborne.
K. "Water -carried sewage disposal system" means all piping,
septic tanks, seepage systems, seepage pits, treatment
plants or other devices through which household wastes
are conveyed with the aid of water excluding, however,
the mains, treatment or disposal systems of publicly
owned sewer systems or the collector portion of privately

In response to a complaint received by the Department of Environmental
Protection I made an inspection on property owned by you at 12101 Gander Street
whose legal description is Lot 14A Block 1 Boyle S.D. On 6/5/85 the following
violations were noted:
15.20.020 A&B 5 b,c,e; Public Nuisances prohibited
B 6 a,f; B 7
15.40.020 F Prohibited sewage discharges
15.65.020 A,B,C Prohibited wastewater discharges and practices
16.02.01.03 and 16.02.02 Unfit dwellings
The dwelling was placarded as unfit for human habitation on 6/6/85 due to viola—
tions of 16.02.01.03 and 16.02.02 after receiving results from test on water
samples taken from the yard and basement which had extremely high bacterial
counts. On 6/6/85 you were personally served by myself with Notice of Violation
82094 which specified compliance was to be reached by 6/10/85. On 6/11/85 you
were personally served by me with a Municipality of Anchorage Uniform Summons
and Citation BM100135 since no action had been taken to correct the sewage in
the yard.
The policy of this office for correction of the violations listed above is to
request voluntary compliance within a reasonable time. Please note the A.O.
16.02.04 and 16.02.08 specifies that only a representative from this department
has the authority to remove the placard. The dwelling will have the placard
removed when the basement is sealed and waterproofed, the hole in the basement
floor along the rear wall is repaired, the entire basement floor has been sani—
tized with an anti—bacterial agent and when the yard has had all the standing
water removed and the surface treated with HTH.

The other violations can be corrected by removing the large mounds of junk, gar—
bage and litter. Junk autos and trailers in disrepair cannot be kept in public
view. This department has a free tow away program for junk autos you may uti—
lize by completing the enclosed liability release form. A permit to store a
junk vehicle in public view is available upon application at this office. The
appliances which are stored in the yard will have to be placed in the barn or
removed so that they will no longer be attractive nuisances.
The sewage problems need your continuing immediate attention. The litter, gar—
bage, junk vehicles, trailers and machinery should be removed and cleaned by
thirty days after receipt of this letter.
You have the right to appeal these decisions as specified by AO 16.18.01,
15.05.090 and 3.60. I can be reached at 264-4076 to answer any questions that
you may have.
