My permit was issued using all available data known to your office and my Engineer. Your acceptance of a later permit submission and approval of that permit has now impacted development of my property and lead to your decision to rescind my well permit. The data used in this later permit submission has been available since 2003, but withheld from your office and therefor not available to me or my Engincer. AMC 15.55.050.C. provides the basis for the Director to revoke, suspend, and restrict permits approved. 1- No false statements were made in my permit, 2- No violations of the permit terms were made, 3- No act or omission violating requirements of AMC15.55 where made, and 4- There has been no failure to comply with state or federal regulations. Your action to rescind my permit is not supported by AMC I5.55.050.C. I can fmd no other provision allowing or requiring you to rescind my permit. Test hole 04 has now beeti'certified by Brian Harten, PE and incorporated into a septic system design submitted to the Muni. I have Identified this discrepancy to Mr. Dan Roth of the Muni on-site office. He explained to me that Brian Harten, PE had certified the submission and that if you identified the discrepancy he could then act on it. I don't understand why he requites you, to make this known to his office. Mark Seward petfbrmed the survey and test holes 1,2, and 4 aro clearly on my lot, or dissected by the property line with more than balf on my side. As a side note for my reference, could the results of test holes # 1,2, and 4 be used by the for any future on site designs for Block 4, Lot 10., or is there a limit to how long ago the tests wbere performed? Mr. Dan Roth of on-site has advised me to take no action to install a well under my currently approved permits, and to expect a stop work notice In the mail. I contest the stop work notice and the grounds used to take this action. The submission for Blk 4, Lot 11, arrived We and long after my approved permits. The submission for Blk 4, Lot I I is based in part on the performance of my soils and must not be accepted as usable for permitting. I have had an approved permit for some time Dow and had to this point delayed implementation for convenience. I desire to install the well at this time, without Auther delay. This letter will serve as your notice that you do not have a valid permit to drill the water well in the proposed location. Anchorage Municipal Code (AMC) 15.55 does not allow a water well to be constructed on a property in such a way that it AU prohibit the future development of an adjoining property with a conventional 'wastewater disposal system. The engineer, Brian Harten, PE, has been hired to design a wastewater disposal system to serve Lot 11, the property adjoining yours. He has determined through soils testing that the only practical location of a wastewater system will be in an area that is within the 100 foot radius of the proposed water well location on your property. Reinstating the water well portion of your permit will require you to authorize your engineer to resubmit a design plan of your property. This design plan should show a new location for a water well to be constructed on your property that will not preclude the proposed wastewater disposal system site on the adjoining Lot 11. The proposed septic system will have very limited impact on adjacent properties for the following reasons: 1. The surrounding lots are all relatively large, so there is ample room for wells, septic systems and alternate sites. 2. Immediate neighboring septic systems are all +20' distance, and no private (or community) wells within 200' of the proposed septic system. 3. This permit is for a well and septic system. 4. Drainage will not be affected and is not a major consideration in our design. Development of this lot will not adversely affect the wells or septic systems or reserve areas on adjacent developed lots, or prohibit development on large, adjacent undeveloped lots. The well and septic plan is for a 3 bedroom single family residence only. 2. The drawing and or site plan shall be a part of this specification. 3. All materials and workmanship shall meet the Anchorage Department of Health and State Department of Environmental Conservation requirements. 4. All soil tests are advisory to the design and are to be verified or modified in the field by the engineer. 5. All excavations and depths are advisory and are to be verified in the field by the contractor to meet Municipality of Anchorage, Department of Environmental Conservation requirements. 6. It is the responsibility of the owner to obtain all necessary permits or easements and to locate any adjacent multi -family wells. 7. The excavation is to be exactly in the area shown on the site plan, any deviation requires engineer approval. 8. Any remaining open test hole excavations shall be filled and monitor tube removed. B. SEPTIC TANK 1. The sewer piping from the house shall be 4" PVC 3034 laid at 2% grade maximum — 1% minimum and insulated with 2" of burial foam if shallower than 3 R., with 2 fl. minimum. A foundation cleanout shall be installed within 4' of the house foundation. 2. The septic tank shall be an Anchorage Tank 1,000 gallon 2 chambered septic tank. Contractor may submit alternate tank and for approval, as long as it meets MOA requirements. Two opposing after - tank cleanouts shall be installed. C. DRAWFIELD TRENCH 1. The drainfield is to be located as shown on the site plan. 2. The total depth of the initial drainfield excavation is to be 9' max. relative to existing ground elevation at ground water monitor tube. The bottom of the drainfield shall be level, plus or minus 1.5". 3. A 4 foot layer of sewer rock is to be placed over the native sand and gravel. The 4" effluent piping is to be laid on top of the gravel layer with, with 6" additional gravel added as follows: 4" along sides of effluent pipe, and 2" of gravel cover over the piping. 4. The completed drainfield gravel and piping is to be covered with lypar fabric material. 5. Soil or combination of soil and extruded board insulation to a depth of +3' or equivalent is to be placed over the leachfield. Soil shall be mounded over the trench to prevent runoff from ponding.
