Ladies and Gentlemen:
At the request of the property owner I am submitting the As -built inspection report for Rabbit Creek Heights Block 1111
Lot 14A. The septic system was installed in November of 2006 by Glacier Excavating and the Inspections were
conducted by Ted Moore of Flat Top Technical Services at my request. The system was installed per permit
requirement. Several items must be completed before final approval should be granted.
Final grading of the foundation has not yet been completed. Approximately a 10' long section of
sewer piping, between the foundation clean out and Advantex unit is not buried. As a temporary
measure, this line has been heat taped and insulated.
The existing well has not been properly abandoned. The well has been filled with bentonite
slurry. The casing will be cut below grade and capped.
The sewer line from the shop is not connected to the Advantex unit and the line is not buried. The
sewer line to the shop needs to be connected to the Advantex unit and buried.
As the owner is trying to receive a conditional Certificate of Occupancy and these issues can not be addressed until atter
break up we request that the On-site Water and Wastewater Program grant conditional approval on the septic system,
with final approval to be granted upon the completion of this work this summer.

Ladies and Gentlemen:
1 am writing to request a permit for the construction of new septic system for this property. The proposed system will
serve a 4 -bedroom single-family residence. It is my understanding that one of those bedrooms will be in an auxiliary
dwelling unit. The lot was developed at an unknown date. There is an existing well on the property. The would like to
utilize this well and is determining if it will meet current municipal code. Ifa new well needs to be installed, the existing
well will be properly abandoned and a new well will be drilled in the south west comer of the property. There are no
documented septic systems within 100 feet of either the existing or proposed well locations.
Soils: Two testholes were excavated on February 25, 2006 under the supervision of Steve Pannone. See the attached
soil logs. Groundwater was monitored for February 25" through May 20'", 2006. Groundwater was measured at a
depth of 12.3 feet below ground surface on May 14'", 2006 in Testhole # 1, while Testhole #2 remained dry during the
water monitoring period. Bedrock was encountered in both tcstholes (13' TI 11, and 10.5 T) 12).
Surface Water: There is a drainage ditch along Nickleen Street. Flow is observed each spring during break up and
during periods of heavy precipitation. A waiver of the 100 foot separation distance between the septic system and this
ditch is being requested.
Topography: The average topography in the area of the septic system slopes to the north at approximately 15 %.
The installation of this septic system will not prevent wells and septic systems from being installed on the adjacent
lots. The proposed septic system will not change the general slope of the area. Ponding and/or concentration of
surface runoff will not result from this installation.

Ladies and Gentlemen:
We are applying for a waiver of the separation distances required between the proposed septic system and a drainage
ditch paralleling the west edge of Nickleen Drive. The proposed septic system for Lot 14A Block 1111 Rabbit creek
Heights does not pose a contamination risk to surface water that periodically flows along Nickleen Drive.
The new septic system will consist of a 1500 gallon S.T.E.P. tank with an AX 20 pod followed by 30 feet of shallow
trench. The proposed Advantex treatment system discharges a highly clarified effluent. Effluent from the AX 20
pod is routinely above advanced wastewater treatment standards. In addition, further protection will be provided by
the Advantex Vericom Monitoring System, which notifies Anchorage Tank & Welding of any high water conditions
or operational problems. This maintenance and monitoring program virtually insures that septic system overflow
will be immediately recognized properly dealt with.
The ditch along Nickleen Drive (in the vicinity of the proposed septic system) is typically dry. Flow is observed
each spring during break up and during periods of heavy precipitation. The ground surface between the proposed
septic system and the ditch slopes to the north at an average grade of 15 %. Nickleen Drive provides an effective
barrier preventing overland flow from the septic system to the ditch. Overflow from the septic system would travel
to the north, paralleling the road side ditch.
Waiver Request: 60 feet from absorption field to drainage ditch.

THIS MEMORANDUM OF UNDERSTANDING made and entered into as of this

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Memorandum of Understanding agree as follows:
1. ADVANCED WASTEWATER TREATATENT SYSTEMS. Municipality

2. Definitions.
A. Alteration. Any change to the design or function of an AW WfS that
includes the installation or removal of any parts, components or pieces
not included in the original construction permit and design. Prior to
performing any alterations to an A%V%VCS the owner must obtain a
Wastewater Disposal System Construction Permit from the Municipality
pursuant to Anchorage Municipal Code (hereinar. er, "AMC")15.65.
B. Certificate of On -Site Systems Approval. An approval by the
Municipality of existing water and wastewater disposal systems given of
the time of property sale and title transfer in accordance with AMC 15.65.

These approvals certify that the systems arc adequate for the homes that
they support and meet the codes that were in place at the time of system
construction.
C. Damage. Any mar. -made or natural change in a system that would inhibit
the system from perfcrrning as desigtcd.
D. Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AW%V TS that were included in
the original design which would allow the AW WTS to continue to
perform as designed.
E. Permit (Construction) An On -Site Wastewater Disposal System
Construction Permit as defined by AMC 15.65.
F. Permit (Operating) An Advanced Wastewater Treatment System
Operating Perth An annual permit, issued by the Municipality, that
allows the Owner to operate an AWWVTS, upon meeting all the
requirements of this agreement, the conditions of Operating Permit, the
requirements of the On -Site Wastewater System Construction Permit and
all relevant provisions of AMC 15.65
3. f=. Owner shall pay to Municipality an annual fee of
(3—.00). payable on or before the issuance of the operating permit and annually
therealter. The annual fee is due on or before the anniversary date of the approval by the
Municipality of installed system.
4. Tcrm. The term of this Memorandum of Understanding shall be for the life of the

The tern begins on the date of approval by the Municipality of the installed system and
shall continue while the A%VWTS system is in use or operational or until the property is
sold or title is transferred by owner and a new certificate of On -Site approval is issued to
the new owner or transferee of the property.
S.ltltrrwions, Installation and Removal of Additional Equipment. Owner agrees
not to make any alterations, removal of parts or additions to the AW'%VrS without a
Construction Permit from the Municipality.
6. 1ltatntenanee and Reoalm.
A. Throughout the term of this Memorandum of Understanding, the Owner shall
maintain A3V137S in good repair. In addition, it shall be the mponsibility of the
Owner during the term of this Memorandum of Understanding, and any extensions or
renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s). (2)
r nterunce. (3) adjustment(s), (4) replacement costs, and (5) inspection costs.
Further, Owner agrees to comply will all applicable erdinance.laws, regulations,
rules and orders for the AV VTS.
B. Owner agrees to provide the Municipality a written schedule of routine
maintenance and repairs which have been performed on the system pursuant to the
terms wid conditions contained in the Owners A%%V TS Operating Permit. This
schedule shall be submitted to the Municipality annually upon the renewal of the
permit The schedule of maintenance and repair contained in the 0%mer's AW1V7S

A\VWTS are codified in AMC 14.60.

D. Owncr agrees that only maintenance, repair personnel certified by the
Municipality will inspect sad make any necessary maintenance, repairs or permitted
alterations to the system.
E. Owner agrees to grant the Municipality reasonable access to test and inspect the
A%VWfS upon 24 hours written notice.
F. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On -Site Systems Approval.
0. Owner agrees that the relevant provisions of the standard specification guidebook
for A\VWl'S is the governing professional guidelines for the construction,
maintenance and repair of the Owners AW WfS.
7. Nonwsiver. n.c failure of either party at anytime to enforce a provision of this
Memorandum of Understanding shall in noway constitute a waiver of the provisions,
nor in anyway effect the validity of the Memorandum of Understanding or any part
hereof, or the right of such party thereafter to enforce each and every provision
hereof.
8. C mendme-M.
A. This Memorandum of Understanding shall only be amended, modified or changed
by a writing, executed by authorized representatives of the parties, with the same
formality of this Memorandum of Understanding was executed and such writing shall
be attached to this Memorandum of Understanding as an amendment.
D. For the purposes of any amendment modification or change to the tenns and
conditions of this contract, the only authorized representatives of the parties arc:

Understanding shall be brought in the Superior Court for the Third Judicial District of the
State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and
obligations of the parties under this Memorandum of Understanding.

invalid by a court of competent Jurisdiction shall not invalidate the remaining provisions
of the Memorandum of Understanding.
