An On -Site Water/Wastewater Permit, number S W060228 issued by this office for a single-family
system, will expire on 26 Jul 07. Permits are valid for 365 calendar days from date of issue.
If this was a well permit and the well has been drilled, a well log and a pump install log must be sent
to this office for documentation of the installation and to close the permit.
If this permit was for a wastewater disposal system, an original as -built inspection report must be
sent to this office for review, approval and documentation. This as -built inspection report must be
signed by the licensed Professional Engineer who inspected the installation of the system. As -built
inspection reports are required to be submitted within 30 days of the completion of the system.
If no system was installed under this permit, and you are still planning to install a well or wastewater
disposal system, a new permit must be obtained from this office. A one-time renewal fee for a
second year may be issued for a $115.00 if the renewal application is received on or before the
expiration date of the original permit. When applying for a new permit, the fees are $460.00 for a
wastewater permit and $175.00 for a well permit.

Ref: Proposed Well and Septic System for Trials End Subdivision; Lot 4A, Block 2,
To whom it may concern:
The proposed 3 bedroom house is to be served by a private well and septic system. Test holes
were excavated on this property on 8/22/2005. Groundwater was found to be shallow in the test
holes. Per our recommendation, a curtain drain was installed this past winter in order to divert
surface and groundwater. On 4/18/2006, we returned to the property to excavate an additional
test hole and to reinstall a new monitoring tube for test hole #1. Groundwater monitoring was
performed during the month of May and found 2+ feet of unsaturated receiving soils for a
proposed septic system and an alternate site. Given the limited area for a septic system, we are
proposing that a SCATT"t Aerocell treatment system with 5 -wide trench type drainfield be
installed. The drainfield will be designed around the 30 foot radius of test hole #1. Comments
regarding the design are summarized as follows:
SOILS: See the attached logs that show the soil classifications, groundwater monitoring, and
the percolation test results. The highest groundwater reading in test hole #1 was found to be at 8
feet during the month of May. Test hole #3 had a monitoring tube installed for the test hole, but
the monitoring tube became non-functional due to the tube sloughing of soil into the monitoring
tube. However, we performed groundwater monitoring in the 4 feet deep bench next to the test
hole which has always remained dry during our May site visits. Basically, there is 2 feet of
unsaturated receiving soils for test hole #3. It is our opinion that an application rate of 3.0
gallons/day/ft2 should be used with the utilization of the SCATIm Aerocell treatment system..
SURFACE WATERS: There are no surface waters within 100 feet of the proposed septic
system. All areas on property where ponding may occur will be required to be filled and graded
to prevent any surface water from occurring during snowmelt and rainfall periods.
TOPOGRAPHY: As can be seen on the attached topography site plan the average slope in the
proposed septic area is a 15f percent running approximately northeast to southwest. The 5 -wide
drainfield is to be installed slightly into to the side slope in order to maintain the 20 foot setback

from the curtain drain. See the attached design profile for more details regarding the specifics of
construction.
LOT LINE WAIVER: We are request a I foot line waiver be granted from the west lot line to
the proposed septic system. We are unaware of any adverse impacts with the granting of this
waiver would have on adjacent wells or septic systems.

REPAIR AGREEMENT
MEMORANDUM OF UNDERSTANDING

THIS MEMORANDUM OF UNDERSTANDING made and entered into as of this

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Memorandum of Understanding agree as follows:
1. ADVANCED WASTEWATER TREATMENT SYSTEMS. Municipality
grants permission to Owner to utilize and operate an Advanced Wastewater
Treatment System (AWWTS), described as S 1'c- A— located

2. Definitions.
A. Alteration. Any change to the design or function of an AWWTS that
Includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design. Prior to
performing any alterations to an AWWTS the owner must obtain a
Wastewater Disposal System Construction Permit from the Municipality
pursuant to Anchorage Municipal Code (hereinafter, "AMC") 15.65.
B. Certificate of On -Site Systems Approval. An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with AMC 15.65.
These approvals certify that the systems are adequate for the homes that
they support and meet the codes that were in place at the time of system
construction.
C. Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
D. Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AW WTS that were included in
the original design which would allow the AW WTS to continue to
perform as designed.
E. Permit (Construction) An On -Site Wastewater Disposal System
Construction Permit as defined by AMC 15.65.
F. Permit (Operating) An Advanced Wastewater Treatment System
Operating Permit. An annual permit, issued by the Municipality, that
allows the Owner to operate an AW WTS, upon meeting all the
requirements of this agreement, the conditions of Operating Permit, the
requirements of the On -Site Wastewater System Construction Permit and
all relevant provisions of AMC 15.65
3. Fee. Owner shall pay to Municipality an annual fee of
($—a.00), payable on or before the issuance of the operating permit and annually
thereafter. The annual fee is due on or before the anniversary date of the approval by the
Municipality of installed system.
4. Term. The term of this Memorandum of Understanding shall be for the life of the
A W WTS.
The term begins on the date of approval by the Municipality of the installed system and
shall continue while the AWWTS system is in use or operational or until the property is
sold or title is transferred by owner and a new certificate of On -Site approval is issued to
the new owner or transferee of the property.
5. Alterations, installation and Removal of Additional Equipment. Owner agrees
not to make any alterations, removal of parts or additions to the AWWTS without a
Construction Permit from the Municipality.
6. Maintenance and Repairs.
A. Throughout the term of this Memorandum of Understanding, the Owner shall
maintain AWWTS in good repair. In addition, it shall be the responsibility of the
Owner during the term of this Memorandum of Understanding, and any extensions or
renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2)
maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs.
Further, Owner agrees to comply will all applicable ordinance, laws, regulations,
rules and orders for the AWNVTS.
B. Owner agrees to provide the Municipality a written schedule of routine
maintenance and repairs which have been performed on the system pursuant to the
terms and conditions contained in the Owner's AWNVTS Operating Permit. This
schedule shall be submitted to the Municipality annually upon the renewal of the
permit. The schedule of maintenance and repair contained in the Owrier's AWWTS
Operating Permit is:
C. Owner acknowledges that the fine schedule for failing to maintain and repair an
AWWTS are codified in AMC 14.60.
D. Owner agrees that only maintenance, repair personnel certified by the
Municipality will inspect and make any necessary maintenance, repairs or permitted
alterations to the system.
E. Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS upon 24 hours written notice.
F. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On -Site Systems Approval.
G. Owner agrees that the relevant provisions of the standard specification guidebook
for AW WTS is the governing professional guidelines for the construction,
maintenance and repair of the Owner's AW WTS.
7. Nonw•aiver. The failure of either party at any time to enforce a provision of this
Memorandum of Understanding shall in no way constitute a waiver of the provisions,
nor in any way effect the validity of the Memorandum of Understanding or any part
hereof, or the right of such parry thereafter to enforce each and every provision
hereof.
8. Amendment.
A. This Memorandum of Understanding shall only be amended, modified or changed
by a writing, executed by authorized representatives of the parties, with the same
formality of this Memorandum of Understanding Iwas executed and such writing shall
be attached to this Memorandum of Understanding as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this contract, the only authorized representatives of the parties are:

C. Any attempt to amend, modify, or change this contract by either an
unauthorized representative or unauthorized means shall be void.
9. Jurisdiction: Choice of Law. Any civil action arising from this Memorandum of
Understanding shall be brought in the Superior Court for the Third Judicial District of the
State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and
obligations of the parties under this Memorandum of Understanding.
10. Severability. Any provisions of this Memorandum of Understanding decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining provisions
of the Memorandum of Understanding.

Dear Mr. Pawlak:
This is in response to your April 6, 2006, application for a Department of
the Army (DA) permit, to retain curtain drains already installed on the south
and east property lines and to place fill into approximately 0.38 acres. It
has been assigned file number POA -2003-845-D, which should be referred to in
all future correspondence with this office. The proposed project is located
within section 24, Township 12 N., Range 3 W., Seward Meridian, Latitude
61.1183, Longitude: -149.7282; Trails End, Block 2, Lot 4A; in Anchorage,
Alaska.
DA permit authorization is necessary because your project would involve
placement of fill material into waters of the U.S. under our regulatory
jurisdiction.
Based upon the information and plans you provided, we hereby verify that
the work described above, which would be performed in accordance with the
enclosed plan (sheets 1-2), dated April 6, 2006, is authorized by Nationwide
Permit (NWP) No. # 39, Residential, Commercial, Institutional Development.
NWP No. 39 and its associated Regional and General Conditions can be accessed
at our website at www.poa.usace.army.mil/reg and are attached to this letter.
Please take special note of Regional Conditions A, D, E, N, 0, and V as they
apply to your project:
D. Project limits shall be clearly identified in the field prior to
construction to ensure impacts do not extend beyond project footprint.
E. Avoidance and minimization of impacts to waters of the United States
and revegetation of disturbed areas with native species are required.
N. Specific requirements are identified in Regional Condition N to
prevent suspended sediment and turbidity from affecting waters beyond the
immediate work area.
O. Mitigation required by special condition must be completed before or
concurrent with project construction, if practicable_. Where project
mitigation involves the use of a mitigation bank or fee -in -lieu, payment must
be made to the bank or fee -in -lieu program before commencing construction of
the permitted activity, if practicable.' Note special condition #1 below.
V. On-site sewage system design plan must be approved prior to fill
placement and the installation of any wastewater treatment system (including
mounded systems or package plants) within the fill site (the fill or
contiguous wetlands). The Municipality of Anchorage, rather than the Alaska

Department of Environmental Conservation, has approval authority for on-site
systems placed within the Municipality.
You must comply with all terms and conditions associated with NWP No. 39,
as well as with the following special condition:
1. Side slopes of fill that face or abut unfilled wetlands shall be no
steeper than 2.5:1. Slope blankets may be necessary to prevent erosion.
2. Fill of 0.11 acres of REV 2 and 0.27 acres of REV 3 wetlands
authorized for this project incurs debits equal to 0.39 REV 2 debits and 0.04
REV 3 debits. Mitigation can be achieved either through a fee -in -lieu of
mitigation submitted to the Great Land Trust (at this point they are the only
non-profit with whom we have an agreement) or by preserving and/or enhancing
an area with a comparable number of REV 2 and REV 3 credits to offset the
debits. As we discussed during our telephone conversation on June 1, 2006,
the value of the REV 2 debits is $54,785 per debit and the value of REV 3.
debits is $13,878 per debit; the exact figure is determined by the Great Land
Trust. Mitigation shall be completed before or concurrent with project
construction.
Further, please note General Condition 14 requires that you submit a
signed certification to us once any work and required mitigation are
completed. Enclosure 1 is the form for you to complete and return to us.
This verification is valid until the NWP is modified, reissued, or
revoked. All of the existing NWPs are scheduled to be modified, reissued, or
revoked prior to March 18, 2007. It is incumbent upon you to remain informed
of changes to the NWPs. We will issue a public notice when the NWPs are
reissued. Furthermore, if you commence or are under contract to commence
this activity before the date that the relevant nationwide permit is modified
or revoked, you will have twelve (12) months from the date of the
modification or revocation of the NWP to complete the activity under the
present terms and conditions of this nationwide permit.
Nothing in this letter shall be construed as excusing you from compliance
with other Federal, State, or local statutes, ordinances, or regulations
which may affect this work. Please be advised the Municipality of Anchorage
approvals and permits required for your project include, but are not limited
to, Right -of -Way, fill/grading, building, on-site septic, and storm water.
