We are requesting a waiver for the distance from the house to the septic tank, per your review
comments. A sketch has been added to this letter, with a cross section of the tank and foundation. Using
a I to 1 back slope for the foundation support, the new septic tank is not within the critical bearing soils
area of the house foundation.

of the Northeast portion of Lot 12, Block 2, Elmore Subdivision. Known as (4825
Shoshoni Avc., Anchorage, AK. 99516) in city grid # 3036.

This letter of non -objection in no way precludes GCI Cable from full use and enjoyment
of any rights it may have within any portion of the utility casement and or the right -of.
way, including unlimited access for servicing its facilities. Also any additional and
extraordinary costs incurred during any future required construction, repair or-- • • . , ..
reconstruction of GCI's facilities to accommodate any or all of the encroachments shall
be paid by the property owner.
By signing below, you agree to indemnify and hold GCI Cable harmless, now and

ACS has no objection to the encroachment of the water well into a platted easement located on
Lot 12, Blk 2, Elmore Subdivision, as depicted on the as -built drawing submitted.
Acceptance and use of this letter of non -objection by yourself, your heirs, your assigns, or your
successors, will constitute agreement to the following stipulations:
1. ACS will be held harmless, now and forever; for any damages or injury to any
person or property as a result of this encroachment.
2. Any AbS facility damaged or destroyed as a result of this encroachment will be
repaired at no cost to ACS.
3. Any costs incurred by ACS for special construction necessitated by this
encroachment will be bome by the property owner.
4. All applicable safety code regulations will be observed and maintained.

This permit is between Chugach Electric Association, Inc., an Alaska non-profit electric
cooperative, (herein "Chugach"), whose address is P. O. Box 196300, Anchorage, Alaska 99519 and
Steven and Brenda Nobel, (herein "Permittee"), whose address is 13621 Windward Circle,
Anchorage, AK 99516.
1. Easement. Chugach is the grantee or user of an easement for the construction and
maintenance of electrical facilities, as follows:
Dedicated by the plat of the subdivision known as Elmore Subdivision, according to Plat
Number P-635, recorded on the 15th day of November 1961, on file in the office of the
District Recorder, Anchorage Recording District, Seward Meridian, Alaska,
Described in that certain written instrument recorded on the 15th day of September 1953, in
Volume 96, Page 34, on file in the office of the District Recorder, Anchorage Recording
District, Seward Meridian, Alaska,
(herein "Easement") which pertains to the following described real property:
The East Ten Feet (E 10') of Lot Twelve (12), Block Two (2), Elmore Subdivision,
according to Plat Number P-635, recorded on the 15th day ofNovember 1961, on file in the
office of the District Recorder, Anchorage Recording District, Seward Meridian, Alaska,
Permittee acknowledges the validity of the Easement. Permittee warrants and represents that
Permittee is the owner of the fee simple interest in the land subject to the Easement and the
following described real property to which the Easement is adjacent:
Lot Twelve (12), Block Two (2), Elmore Subdivision, according to Plat Number P-635,
recorded on the 15th day of November 1961, on file in the office of the District Recorder,
Anchorage Recording District, Seward Meridian, Alaska,
(herein "Parcel").

2. Encroachment. Permittee has proposed to construct the following improvements on
or within the real property subject to said Easement:
A water well that encroaches approximately Two Feet (2') into said Easement for a
distance of approximately One Foot (1'),
(herein "Encroachment").
3. Permit. Chugach hereby authorizes Permittee to construct and to continue the
existence of the Encroachment in its location subject to the covenants set forth in this permit.
4. Indemnification. Permittee shall indemnify and hold Chugach harmless from any
claims for personal injury, property damage or other loss arising in any way from the continuation of
the encroachment.
5. No Expansion or Increase. Permittee shall not in any way expand or increase the
extent to which the Encroachment occupies any of the real property encumbered by the Easement
without the prior written consent of Chugach. Chugach has no obligation to provide such consent.
6. No Interest in Real Estate Acquired. Permittee hereby acknowledges that the
Encroachment and any additions thereto, even if in violation of this permit, has not and shall not in
the future give rise to any interest or estate in the real property subject to the Easement or any other
real property. Without in any way limiting the foregoing, Permittee acknowledges that the
Encroachment is not adverse to any interest of Chugach and its continuation is entirely with the
permission of Chugach for purposes of the common law doctrine of adverse possession. This permit
creates no interest in the real property subject to the easement.
7. Modification of Utility Facilities. If the electric utility facilities located within the
Easement are upgraded, added to, replaced or reconstructed, Permittee shall pay that portion of
Chugach's total costs for such modification which is reasonably attributable to accommodating or
preserving the Encroachment. If such payment is not made within thirty (30) days of written demand
for same, Chugach may terminate this permit in accordance with paragraph 9, below.
8. Covenants Running with the Land. The obligations of the Permittee arising from this
permit shall be covenants running with the land which shall burden the Parcel and the Permittee's
interest in the land subject to the Easement and shall benefit the Easement.

9. Termination. Chugach may terminate this permit after the giving of thirty (30)
days written notice of such termination if:
a. The Encroachment is enlarged, increased or extended within the real property
affected by the Easement.
b. The Encroachment is damaged by any means to an extent of more than thirty percent
(30%) of its replacement cost at the time of destruction.
C. Permittee fails to make the payment described in paragraph 7, above.
10. Term. This permit shall, if not sooner terminated by Chugach, expire forty (40) years
from the date hereof.
11. Entire Agreement. This written permit constitutes the entire agreement between the
parties with respect to the subject matter hereof and supersedes all other prior or contemporaneous
agreements, oral or written, between the parties. No modifications, amendments, deletions, additions
or alterations of the permit shall be effective unless in writing and signed by all of the parties hereto.

THE ENTIRE SUBSURFACE DISPOSAL FIELD IS NOT WITHIN A 30 FOOT RADIUS OF A TEST HOLE. THE
ENGINEER NEEDS TO DO AN ADDITIONAL TEST HOLE DURING THE CONSTRUCTION OF THE SEPTIC
FIELD. PLEASE SUBMIT STAMPED AND SIGNED RESULTS WITH THE AS -BUILT INSPECTION REPORT. IF
THE RESULTS REQUIRE A DESIGN CHANGE, CONSTRUCTION OF THE SYSTEM WILL STOP PENDING
ON-SITE REVIEW AND APPROVAL.

This is a request for a new septic and well permit. The test hole excavation was completed near the
northwest corner of the property, the soils consisted of poorly graded gravel for the top 11 feet then some
gray silty gravel below from I 1 feet to the bottom of the hole at 15 feet. Water was not observed after
the 7 day monitoring period however over the high water period in May of 05 some water was observed
at 14 feet. The perc rate was 2 minutes per inch. A new 5 wide trench will be utilized for the leach field
with an effective depth of 4 feet. The application rate of 1.2 gallons per day per square foot has been
used for the 5 wide trench for a total length of 75 feet. A reserve system has been shown on the plan.
Another pere test will be completed during the installation precess to verify the soils with a pre-soak.
We are also requesting a lot line waiver per your review comment. We are also requesting a waiver of
35' to steep slope on the west side, detail attached for your review.
The driveway has an 8 foot drop on the north side but using a 2:1 slope from the end of the trench will not
daylight at the slope. All the of leach field will be more than 35 feet from this area otherwise the'lot has a
very gentle slope to the north. The neighboring lots will NOT be impacted by this new construction.
