In consideration of the mutual covenants contained herein, the parties to this Agreement agree as follows: 1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as _Quanics Aerocell located at (legal description) _13520 Sunshine Loop Anchorage, AK Loop 99516 2. Maintenance, Repairs and Alterations. (Owner is required to read, understand and initial each section) C Throughout the term of this Agreement, the Owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. 'It shall be the responsibility of the Owner during the term of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to $600). . Owner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfield replacement. Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be assessed in accordance with AMC 14.60.030. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS. The Municipality will give at least 24-hour notice. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. Owner agrees to maintain remote monitoring of the AWWTS as required by the AWWTS approval. 3. Term. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any pArt hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement. Dear Sirs: By means of this letter we are requesting a HAA certificate and a waiver of the normally required 100 foot separation distance between a soil absorption system and surface water down to 53 feet for the subject lot. A site plan and other relevant backup documents along with a description of our adequacy test procedure and results are included to assist you in your review. According to the driller's log, the well serving the residence on this lot was completed in June of 1974 and has a total depth of 75 feet and a yield of 10 gpm. On June 1, 1993 we conducted a yield test of the well. At the start of our test the static water level stood at 14 feet below the top of the casing. Steady pumping of 782 gallons of water from the well at the maximum pump output of 7.8 gpm caused the water level inside the casing to be drawn down to 28 feet, but no further. Based on our test data we determined that the total yield of the well is in excess of 7.8 gpm, which exceeds Municipal requirements for a single family residence and also exceeds the FHA lending criteria that a well be able to supply 720 gallons of water within a 4 hour period. Water samples collected on June 1 were satisfactory, showing no coliform or other bacteria and 1.5 mg/1 of nitrate -N. According to inspection documents on file at DHHS, the original wastewater disposal system serving this residence was installed in 1974 and consisted of a 1000 gallon septic tank followed by a single 48 foot long soil absorption trench. In 1973 the original soil absorption trench was abandoned and replaced by two parallel 3 foot wide drainfields with a total length of 155 feet having 6 inches of gravel beneath the horizontal distribution pipes. The installation was inspected by a municipal inspector. In February of 1986 the system was tested by AECS and found to be adequate for a three bedroom residence, however the well was found to be 90 feet from the drainfield. On 3/11/86 DHHS issued a waiver allowing the existing drainfield to be 90 feet from the well. The records do not give any indication that surface water was observed within 100 feet of the system. On June 1, we conducted an adequacy test of the wastewater disposal system. Measured quantities of water were added, first into the septic tank and later into the standpipe at the east end of the upper drainfield, while fluid levels were monitored in the septic tank and soil absorption system standpipes before, during and after the flow of water was stopped. The line between the septic tank and the upper drainfield was found to be obstructed, but the line has since been repaired by Carl's Excavating and a double cleanout installed. The standpipes in the upper drainfield initially had 6 and 7 inches of fluid in them, and these levels rose only 1 inch during the course of the test before the fluid overflowed into the lower drainfield. The standpipes in the lower drainfield initially had 0 and 3 inches of fluid in them, and these increased to 11 and 8 inches, respectively as water was being added. A total of 782 gallons of water were added to the system, and within 1 hour after the flow of water was stopped all the fluid levels were back within 1/2 inch of their original position. Based on this observed behavior, we concluded that the system continues to be able to accept water at an adequate rate for a 3 bedroom residence. In conjunction with our adequacy test we noted the presence of a small stream flowing in the approximate location shown on the site plan. We measured the surface water to be 55 feet from the standpipe at the east end of the lower drainfield at its closest point. The requested waiver distance of 53 feet is to allow for slope correction and/or possible underground protrusion of the drainfield gravel a little closer to the stream. The stream had an estimated flow rate of 5 gpm in the area where it is closest to the drainfield, with a somewhat higher flow rate further upstream. All surface flow of this stream ended within approximately 20 feet downstream of the point of it's closest approach to the drainfield, and surface flow did not reappear within the next couple of hundred feet further down the swale. The elevation of the steam at it's closest point to the drainfield is approximately 10 feet lower than the ground elevation at the standpipe at the east end of the lower drainfield. The slope of the topography in the area, however, is such that surface flow of effluent, which might conceivably daylight from the drainfield, would never reach the stream, as it would have to cut obliquely across the slope to do so. The fact that the surface flow disappears below ground and remains there should eliminate concern as to the possibility that surface water contamination could pollute other receiving water bodies. Due to the slope of the topography, no residential development exists or is likely to br built in the near future for approximately 1/2 mile downhill of the subject lot. Surface water separation distance waivers do not lend themselves to the quantitative application of DEC waiver analysis points, as is done for well waivers, so it is necessary to make a qualitative assessment of the potential public health hazard associated with granting the waiver. In this case, particularly considering the small volume of the stream and the fact that the system was inspected and tested several years ago without concern as to surface water proximity, it is our opinion that issuance of the requested waiver will not result in surface water contamination.
