Waiver requests are included for reduction in the separation distance between both groundwater and surface water. We have also provided a new soils log and percolation test for the proposed location of the new absorption trenches. Groundwater has stabilized at 3.5' below the surface in this area. In addition, the pond near the west end of the property is shown on the Site Plan. Some surface water may be encountered during further development of the lot. Grading will be accomplished during the landscaping and final phases of the project to control the drainage and insure it is more than 100' from all septic systems on this and adjacent lots. Any standing water currently found within 100' of the new septic system other than that noted in the separation distance waiver will require immediate grading and filling to insure the 100' buffer is met. Box 196650 Anchorage, AK 99519-6650 Attention: On Site Services Engineer Subject: Lot 2, Tract D, Ceark Subdivision Separation Distance Waiver Absorption Trench to Groundwater Dear On Site Services Engineer: Surface area available on the subject lot for placement of a septic system is severely limited by the presence of a stream at the northeast corner and surface water in many other locations. The groundwater elevation on the lot was recently measured at 3.5' below the surface of the cleared and grubbed area designated for the septic system absorption trench. Heavy rains have plagued the area over the past month and the groundwater level is probably at or near its highest level. Monitoring of the groundwater in late June of 2004 indicated the groundwater was at 6' below the surface. Over the majority of the year the groundwater will probably be more than 4' below the bottom of the proposed absorption trench. An Advantex Treatment System has been designed for placement on the lot to reduce the size of the absorption area required to treat effluent generated in the house. We are also requesting the distance to groundwater between the bottom of the absorption trench and the groundwater be waived to 2' to further limit the size requirements for the absorption area. The effluent treatment provided by the Advantex system reduces significantly the chance of contamination to the groundwater. In addition, the lot is 130,811 square feet in surface area and composed of tight silty soils which will provide additional treatment to the effluent before discharge to the groundwater. Wells in the area, with the exception of the well on this lot are more than 200' from the septic system providing an additional factor from contamination of groundwater. A subdrain has been placed along the south property line to collect surface and subsurface water and channel it away from the septic system location. The outlet of the drain is more than 100' from the septic system on this and adjacent lots. The flow from the drain is directed to the existing drainage ditch along King's Way at the west end of the property. The drain is composed of clean washed rock which fills the ditch along the south side of the driveway on the property. It is essential the drain have a porous surface to allow water to easily access the transportation pipe. Some free surface water has been noted in the slope along the south side of the drain and flowing toward the drain. A waiver is therefore necessary to allow the new septic system to be constructed within 100' of this surface water. The drain is located approximately 26' from the southeast corner of the proposed absorption trench. It is also nearly 3' higher in elevation. The possibility of effluent flowing toward the drain and the surface water is impossible. In addition, soil strata between the drain and the absorption trench is composed of dense silt with some gravel, which is only slightly pervious. The presence of the tight silt further prevents flow from the absorption trench toward the drain. Lot 2, Tract D, Ceark Subdivision October 26, 2006 Page Two The vegetation on the slope on the south side of the drain will eventually reestablish itself and absorb much of the surface water currently seen in the area. Heavy rains in the past month have increased the amount of surface water in the area. During the drier months of the year and through the winter very little surface water should be noted in this area. Two test holes were excavated on June 19, 2004 by my company in preparation of designing a new septic system. The soils report and a percolation tests result are attached. Ground water was monitored three weeks and the water fluctuated between six and eight feet below the ground surface. Bedrock was not encountered in either test hole. The owner had another engineer perform four test pits in august of last year. Two pits were logged, percolated and water monitored. I am attaching his report as part of my design submittal. The lot is 130,811 square feet (3.003 acres) in size. Lot 2 slopes to the northwest at approximately 10 to 15 percent. The proposed installation will be located in the south center portion of the lot, along the south property line. The proposed well will be located in the southeastern corner of the lot, greater than 100 feet from the proposed system and from the neighboring septic systems. The proposed location of the septic system is greater than 100 feet away from surface water, existing neighboring wells, and 25 feet from the water service lines. The surrounding wells are located greater than 100 feet from the proposed installation. The proposed installation will not affect the future development of the surrounding or existing lots. The primary and reserve systems are based on the use of an Advantex advanced wastewater treatment system. There is adequate room for installing a soil absorption system sized on the use of the Advantex system. See the attached design. Municipality grants pennission to Owner to utilize and operate an Advanced Wastewater Treatment System (AVWVTS), described as �..Z�`ri'La e!M2k located at Anchorage, Alaska. 2. Definitions. A. Alteration. Any change to the design or function of an AWWTS that includes the installation or removal of any parts, components or pieces not included in the original construction permit and design. Prior to c performing any alterations to an AWWTS the owner must obtain a Wastewater Disposal System Construction Permit from the Municipality pursuant to Anchorage Municipal Code (hereinafter, "AMC') 15.65 B. Certificate of On -Site Systems Approval. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. C. Damage. The scheduled and as needed replacement of existing parts, components and pieces of an AWWTS that were included in the original design which would allow the AWWTS to continue to perform as designed. E. Permit (Construction). An On -Site Wastewater Disposal System Construction Permit as defined by AMC 15.65. F. Permit (Operating). An Advanced Wastewater Treatment System Operating Permit. An annual permit, issued by the Municipality, that allows the Owner to operate an AWWTS, upon meeting all requirements of this agreement, the conditions of the Operating Permit, the requirements of the On -Site Wastewater System Construction Permit and All relevant provisions of AMC 15.65. 3. Fee. Owner shall pay to Municipality an annual fee of -- 6� ($ —.00), payable on or before the issuance of the operating permit and annually thereafter. The annual fee is due on or before the anniversary date of the approval by the Municipality of installed system. The term begins on the date of approval by the Municipality of the installed system and shall continue while the AWWTS system is in use or operational or until the property is sold or title is transferred by owner and a new certificate of on site approval is issued to the new owner or transferee of the property. 5. Alterations, Installation and Removal of Additional Equipment. Owner agrees not to make any alterations, removal of parts or additions to the AWWTS Without a Construction Permit from the Municipality. 6. Rlalntenance and Repairs. A. Throughout the term of this Memorandum of Understanding, the Owner shall maintain AWWTS in good repair. In addition, it shall be the responsibility of the Owner during the term of this Memorandum of Understanding, and any extensions or renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustrnent(s), (4) replacement costs, and (5) inspection costs. Further, owner agrees to comply with all applicable ordinances, laws, regulations, rules and orders for the AWWTS. B. Owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system pursuant to the terms and conditions contained in the Owner's AWNVTS Operating Permit. This schedule shall be submitted to the Municipality annually upon the renewal of the permit. Owner acknowledges that the fine schedule for failing to maintain and repair an AWWTS are codified in AMC 14.60. D. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. F. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. G. Owner agrees that the relevant provisions of the standard specification guidebook for AWWTS is the governing professional guidelines for the construction, maintenance and repair of the Owner's AWWTS. 7. Nonwalver. The failure of either party at any time to enforce a provision of this Memorandum of Understanding shall in no way constitute a waiver of tide provisions, nor in any way affect the validity of this Memorandum of Understanding or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 8. Amendment. A. This Memorandum of Understanding shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality as this Memorandum of Understanding was executed and such writing shall be attached to this Memorandum of Understanding as an amendment. L&S Services has been able to clean the filter, inspect the electrical panel and all appears fine. However, the area around the filter pod is frozen and cannot be accessed to complete servicing. Due to the low use, current inspection, etc… Larry Betts of L&S Services does not expect any major issues or additional actions needed. The new owner is and has been working on improving the property and the AWWTS servicing will be completed in the spring of 2026 once conditions improve. Also, the other field septic pipe will be found & installed if needed once these conditions improve as well. The system has been working for the occupants and granting of this Conditional COSA (CCOSA) will not impact any of the neighboring properties or pose a public health risk. Maintenance Repairs and Alterations. (Owner is required to read, understand and initial each section) Throughout the term of this Agreement, the Owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. It shall be the responsibility of the Owner during the term of this Agreement to pay for all i/ repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to $600). ip Owner agrees that only maintenance and repair personnel approved by the Municipality �or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfield replacement. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. S. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement. The average life of an asphalt coated steel septic tank is 20 years. Typical replacement costs are $15,000 or more, not including engineering, surveying, MOA permitting fees or site restoration. Steel septic tanks utilizing "Coal Tar Pitch" coatings are subject to corrosion as the steel reacts to water and rusts. These tanks have a finite lifespan buried in the ground.
