Please copy for our meeting tomorrow It has come to our attention that there is an active wetland violation on Block IV, Lot 3A, Rabbit Creek View Subdivision. We have reviewed pictures of the site work and we concur that the work done to date would have required a wetland permit, in this case a General Permit from Planning. Both the earth work and the drainage swales that have been done on site are Jurisdictional activities and require a wetland permit. It Is possible that there was originally a creek on this parcel, which should be determined, and which would affect the wetland authorization. I recommend that Watershed Management make this creek determination. The Corps has opened a violation file on this site but I don't know what actions they have taken otherwise. It should be noted that this site has been mapped as wetlands since 1982, and the landowner may well have received notification of wetland permit requirements this year when the Corps reauthorized Anchorage's General Permits. Until the Corps violation, the wetland permit, and the determination of whether this site includes a creek are resolved, we should not Issue Municipal authorizations. Since the Corps actions might restrict, or lead to design changes to the landowner's plans, we should withhold Municipal permit reviews. M040741JPG (763�A040742JPG (846 KB) KB) We (Joe Goodall, Jeff Poet, and myself) have actually been assisting Ted Forsi, P.E. (engineer), Roger San Juan (property owner), and Eddie ByFord (excavating contractor) for the past year with permit requirements for a property they are trying to develop. The legal description of the property is Rabbit Creek View subdivision, Block 1V, Lot 3A. The adjacent properties are undeveloped. Lots 7 and 8 to the east of the subject property have holding tanks. Last fall they had 18 inches to groundwater from original grade. As you know this does not meet the code requirement of 24 inches. A permit application was submitted to the On -Site Water & Wastewater Program on Friday, September 30, 2005. I reviewed the permit application, conducted a site visit, and issued a "Comment Sheet" on Tuesday, October 4, 2005. I also informed Ted Forsi, P.E. of my comments on the same day. Pictures taken during the site visit are attached. My comments to the permit application based on code requirements are listed below. 1.) Need Class C wetlands permit 2.) The wastewater disposal system must be a minimum of 100 feet from all surface water 3.) Test holes must be soaked a minimum of 4 hours prior to percolation test 4.) Additional test holes required 5.) Please indicate initial groundwater depth 6.) Please show location of groundwater monitoring tubes on site plan 7.) Maximum allowed width of disposal field is 15 feet 8.) Please indicate scale on site plan 9.) Lot width inconsistent with plat 10.) Need narrative on impacts to surrounding lots 11.) Please use MOA soil log 12.) Need to conduct monthly groundwater monitoring through May 15, 2006 13.) Need to show all on-site water and wastewater disposal systems within 200 feet of property 14.) The nearest edge of the septic tank must be a minimum of 100 feet from the nearest edge of the well 15.) Please see Watershed Management Division regarding natural drainage pathway running through property On the morning of Tuesday, October 11, 2005, Mr. Forsi left me a message requesting a meeting for 1:15 pm that same day. I called Mr. Forsi back on his cell phone number that he provided and said I was unavailable at 1:15 pm but could meet with him at 2:30 pm. That afternoon Mr. Forsi called me back and said he had a meeting at 3:00 pm. We scheduled a tentative meeting at 1:30 pm on Thursday, October 13, 2005. Mr. Forsi called on Thursday afternoon and requested a meeting for Friday, October 14, 2005 at 11:00 am instead. I meet with Mr. Forsi and Mr. San Juan on Friday as scheduled. Mr. ByFord was not at the meeting (reason unknown). Mr. ByFord and Mr. Forsi are from Soldotna, where septic systems are under the jurisdiction of the ADEC. Per ADEC regulations, a permit is not required for single- family homes. As Joe, Jeff, and Kathy can support, it has been rather challenging educating Mr. Forsi, Mr. San Juan, and Mr. ByFord on the MOA wastewater disposal permit requirements. As you can see from the list of comments, a significant amount of work must be completed in order to meet the minimum requirements in order to obtain an on-site water and wastewater disposal system permit. I can understand the frustration of the property owner and excavating contractor, but at no time did I make any of the comments that they allege I made. -----Original Message ----- From: Thompson, Ron J. Both individuals are very unhappy with the way Julie Makela has been dealing with them for the past two months. They have done all that she has asked for and more but to no avail. They want to talk to the Mayor TODAY to ask for assistance and request that Julie be taken off their case because they believe she's not being fair. Just an example of their frustration, the engineer, Ted Forsi, who also lives in Soldotna was supposed to meet with Julie last Tuesday. Mr. Forsi was already on the plane to Anchorage when she made a last minute phone call to cancel the meeting. Mr. Forsi did other business and went back to Soldotna. A rescheduled meeting was planned for Thursday which was also cancelled. Finally, they met Friday but still the permit was not issued because she has not gone to the property to check on the monitor tubes which she asked to be placed wo weeks ago. The contractor wanted to be part of the meeting but Julie refused to let him and wanted the homeowner to be present instead. Mr. Buyford told her that "I am the contractor" but it did not make any difference. They have asked her to have her supervisor present which she said she will but when she met with them she was alone and said that "I'm the acting supervisor." Mr. Buyford said that Julie told him "if you don't like the way I'm doing, I have the authority to let you wait 12 months." He asked her to show him in black and white a copy of that ordinance but she did not produce the paper. Julie allegedly is very unhelpful and purposely hold things until the last day. Another sample is the perk pipes. The MOA requires only one but the contractor put two but she asked for a third one. Mr. San Juan mentioned that she has given them false, misleading information. Julie made a comment to him, "you might as well forget it, just walk away from that lot." Mr. SJ does not understand, because of Julie's comment, why he cannot build his home when there are houses on either side of his property. Another instance, when Mr. SJ was with his engineer, Julie point blank asked him "are you going to live here or sell it?" He and the engineer looked at one another because both thought the question was irrelevant but he answered "I will live on the property." During the meeting last Friday, Julie showed them an aerial map and told them "there's a creek behind the property." Mr. SJ and Mr. Forsi proceeded to the individual who knows about the maps and was told there is/was no creek behind the property and that he told Julie that beforehand. Ron, this is just one side of the story. As you can see, they are just so frustrated with the way she's dealing with them and the comments she made to either one of them. Please copy for our meeting tomorrow It has come to our attention that there is an active wetland violation on Block IV, Lot 3A, Rabbit Creek View Subdivision. We have reviewed pictures of the site work and we concur that the work done to date would have required a wetland permit, In this case a General Permit from Planning. Both the earth work and the drainage swales that have been done on site are jurisdictional activities and require a wetland permit. It is possible that there was originally a creek on this parcel, which should be determined, and which would affect the wetland authorization. I recommend that Watershed Management make this creek determination. The Corps has opened a violation file on this site but 1 don't know what actions they have taken otherwise. It should be noted that this site has been mapped as wetlands since 1982, and the landowner may well have received notification of wetland permit requirements this year when the Corps reauthorized Anchorage's General Permits. Until the Corps violation, the wetland permit, and the determination of whether this site Includes a creek are resolved, we should not issue Municipal authorizations. Since the Corps actions might restrict, or lead to design changes to the landowner's plans, we should withhold Municipal permit reviews. Karen and I are available to work with the landowner once the Corps determines how to proceed. I will update you as necessary. The soils log show 18 inches of vegetative/organic/peat over approximately 18 inches of gravelly clay and then several feet of hard packed silty clay gravel mixture. Ground water was encountered at 5 and one-half feet. Last fall we completed an earlier test hole that showed water at a depth of 18 inches. At that time we met with you to discuss the installation of a septic system and you advised us that no system would be permitted unless the lot showed at least 24 inches of soil that was not impacted by ground water. We completed a percolation test for this second test hole and have calculated a pert rate of 107 minutes per inch. With groundwater at 5 and one-half feet and a pert rate of 107 minutes per inch we have completed the design for a septic system using a 2500 -gallon Advantex system with a 36 foot by 42 -foot mound system for the effluent. The 2500 - gallon tank is sized for a 5 -bedroom home or 750 gpd. The mound system is designed using an application rate of 0.5 gallons/day/112 resulting in a 1500 ft2 sized basal area. This Advantex system along with the lift station would be supplied by Anchorage Tank and Welding. Additional information will be provided for the lift station if this system is approved for installation. As part of the development of this lot, the owner is also proposing to construct a surface drainage ditch along the east side of the lot to facilitate the drainage of surface water to the ditch along Jamie Avenue. In our conversations you have advised me that this area may not be suitable for an on-site system based on your experience with other systems failing in the area and the fluctuation of the ground water levels. We would appreciate any advice or direction for the design of this system as we acknowledge that the property soils are at a minimal for the construction of an on-site system. The absorption area required for an absorption bed must be computed by multiplying the number of bedrooms by 150 gallons per day per bedroom and dividing by the bed application rate In gallons per day per square foot derived from table 1 of subsection CA of this section. In calculating the absorption area required for an absorption bed. only the bottom area of the absorption bed may be considered as absorption area. The unsaturated accepting stratum must be a minimum of 24 Inches thick; 3. The absorption area required for a mound system must be computed In the same way as for an absorption bed. except that the percolation rate used for calculating the absorption area needed for an elevated mound system must be the percolation rate of the accepting stratum of natural soil or the percolation rate of the filtering sand, whichever requires the larger area; 4. The side slope of the top layer of the mound system exclusive of topsoil must not be steeper than 33 percent; 5. A mound system must function so as to ensure that all treated effluent Is contained within the mound area and absorbed Into the intended accepting sol stratum; 6. The upper six Inches of a mound system must consist of top soil; and 7. The mound must be vegetated sufficiently to prevent erosion.
