B. Certificate of On•Sitc Systems Approval. An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with AMC 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. C. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. D. Tlaintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AWWTS that were included in the original design which would allow the AWWTS to continue to perform as designed. E. Permit (Construction) An On -Site Wastewater Disposal System Construction Permit as defined by AMC 15.65. F. Permit (Operating) An Advanced Wastewater Treatment System Operating Permit. An annual permit, issued by the Municipality, that allows the Owner to operate an AWWTS, upon meeting all the requirements of this agreement, the conditions of Operating Permit, the requirements of the On -Site Wastewater System Construction Permit and all relevant provisions of AMC 15.65 3. Fee. Owner shall pay to Municipality an annual fee of 7s. (s �%i .00), payable on or before the issuance of the operating permit and annually thereafter. The annual fee is due on or before the anniversary date of the approval by the Municipality of installed system. 4. Term. The term of this Memorandum of Understanding shall be for the life of the AWWTS. The term begins on the date of approval by the Municipality of the installed system and shall continue while the AWWTS system is in use or operational or until the property is sold or title is transferred by owner and a new certificate of On -Site approval is issued to the new owner or transferee of the property. 5. Alteration% Installation and Removal of Additional Enuinment. Owner agrees not to make any alterations, removal of parts or additions to the AWWTS without a Construction Permit from the Municipality. 6. Maintenance and Repairs. A. Throughout the term of this Memorandum of Understanding, the Owner shall maintain AWWTS in good repair. In addition, it shall be the responsibility of the Owner during the term of this Memorandum of Understanding, and any extensions or renewals thereof, at the owner's sole expense, to pay for any and all: (1)'repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. Further, Owner agrees to comply will all applicable ordinance, laws, regulations, rules and orders for the AWWTS. B. Owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system pursuant to the terms and conditions contained in the Owner's AWWTS Operating Permit. This schedule shall be submitted to the Municipality annually upon the renewal of the permit. The schedule of maintenance and repair contained in the Owner's AWWTS Operating Permit is: C. Owner acknowledges that the fine schedule for failing to maintain and repair an AWWTS are codified in AMC 14.60. D. Owner agrees that only maintenance, repair personnel certified by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. E. Owner agrees to grant the Municipality reasonable access to test and inspect the AW WTS upon 24 hours written notice. F. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. G. Owner agrees that the relevant provisions of the standard specification guidebook for AW WTS is the governing professional guidelines for the construction, maintenance and repair of the Owner's AWVW7S. Nomvaiver. The failure of either party at any time to enforce a provision of this Memorandum of Understanding shall in no way constitute a waiver of the provisions, nor in any way effect the validity of the Memorandum of Understanding or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 8. Amendment. A. This Memorandum of Understanding shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality of this Memorandum of Understanding was executed and such writing shall be attached to this Memorandum of Understanding as an amendment. SUBJECT: Tract 13B, The Villages Subdivision Well and Septic System Construction Permit Several revisions have been made to the design for the septic system to serve the proposed three bedroom home for Tract 138, The Villages Subdivision. The septic tank and absorption trench will b e constructed in the existing easement along the south property line. The attached letter of non -objection from the City allows placement of the septic system in this easement. We have also moved the primary septic system site onto the adjacent property to allow additional room for the alternate site. An easement is currently being created and recorded allowing the placement of the absorption trench on this property. The final recorded easement will be forwarded you upon completion. Cross sections were recently completed on the existing slope of the property. These sections show the new absorption trench will meet the 35' setback from the slope with a burial depth of 5.5' to the flow line of the distribution pipe in the primary site and 7.5' to flow line in the alternate site. The well location has also been moved from the stream easement in accordance with your suggestions. The absorption trench will be placed on a trench greater than 25%. The location of the distribution line will be placed at 7.5' below the surface and the 25% slope line when extended from 2' atop the distribution line will not daylight until it is at least 35' from the trench. Additional grading will be provided on the ground surface to insure this condition is met. The percolation rate of the soils and the use of the Advantex Treatment System assure the majority of the septic effluent will be absorbed vertically into the ground and should not migrate horizontally. The driveway serving the home will be less than 10% in grade. The existing ground elevations shown on the site plan as provided by a registered surveyor indicate the top of the cut bank at the driveways edge is less than 10%. Several attempts have been made to site a septic system on the tract, which comply with the Municipal ordinance. The steep slope on the surface of the lot, the stream passing through the property, the driveway providing access to the house and the actual house location create problems, which limit the area available for a system. We have therefore decided to place an Advantex Treatment System on the lot to provide the most effective treatment of the septic effluent currently available prior to discharge into the surrounding soil strata. The locations of the absorption trench along with the alternate site are shown on the attached Site Plan. Additional documentation is furnished which identifies the absorption trench in relation to the steep slope, driveway, utility easement and existing stream. All setbacks are met with the Advantex system. The test holes placed on this lot revealed silty gravel with some sand. The percolation rate in the materials encountered ranged from 4.5 minutes to 37 minutes per inch. No groundwater was found during the excavation of any of the test holes. We are therefore proposing to place a three-bedroom Advantex Treatment System. The terrain of the lot is such that gravity flow from the filter to the absorption trenches is possible and a second lift station will not be required. The absorption trench will be 25' long x 3' wide with a 6' effective depth. The trench has been designed for the slower percolation rate, which requires an application rate of 2 gallons per day per square foot. The trench however is conservatively sized for a rate of 1.5 gallons per day per square foot with a total absorption area of 300 square feet. The distribution line in the bed will be placed 7.5' below the existing ground level. The total depth of the trench will be 17.5' below the ground. This depth is required to insure a separation distance of 35' from the absorption trench to the face of the existing slope. Additional grading will be completed Tract 13B, The Villages August 21, 2005 Page Two on the existing slope to insure a 25% slope from 2' above the distribution line will not daylight closer than 35' from the edge of the trench. A ground surface profile of the lot surface is attached for your review. The absorption trench will be constructed parallel with the slope as much as possible in conformance with Municipal requirements. All components of the new septic system will be constructed a minimum of 100' from any surface water and 100' from the well proposed for this lot. It will also be constructed a minimum of 100' from the well on the adjacent lot. If the system is constructed in accordance with our design the following statements apply: 1. The system, if constructed as designed, will have no adverse impact on the wells in the area or those to be constructed in the future. 2. The system, if constructed as designed, will have no adverse impact on existing septic systems in the area or those to be constructed in the future. The system, if constructed as designed, will have no adverse impact on reserve space, either surface or subsurface, on any lots located in the area. 4. A new test hole was recently placed in the area of the absorption trench and alternate site which indicated similar materials from the previous test holes. The percolation rate of the materials was determined to be 4.5 minutes per inch. A rate of 37 minutes per inch was noted in Test Hole No. 2 at deeper levels. This layer was not visible in the recent test hole. No groundwater was found during the placement of the test holes and none was noted during the monitoring period. We are proposing to place a new 1,000 - gallon septic tank and a 40' long by 3' wide by 6' effective depth absorption trench to treat and dispose the effluent generated in the house. The application rate for this design was determined to be .95 gallons per day per square foot. The elevation of the distribution line in the absorption trench will be 7.5' below the surface and the total depth will be 13.5'. This depth is required to insure the 35' separation from the greater than 25% natural slope on the property. A minimum of 3' of fill will be placed over the absorption trenches and 4' over the septic tank. Tract 13B, The Villages August 15, 2005 Page Two The ground surface on the lot in the area of the septic system slopes at varying grades from east to west, but primarily greater than 25%. The new trench will be constructed parallel with the slope as much as possible in conformance with Municipal requirements. The new septic system will be constructed a minimum of 100' from the existing wells and any surface water in the area. If the system is constructed in accordance with our design the following statements apply: 1. The system, if constructed as designed, will have no adverse impact on the wells in the area or those to be constructed in the future. 2. The system, if constructed as designed, will have no adverse impact on existing septic systems in the area or those to be constructed in the future. 3. The system, if constructed as designed, will have no adverse impact on reserve space, either surface or subsurface, on any lots located in the area. 4. On the site plan the test hole location appears to be approximately 45 feet uphill of test hole #1 (2) At a location 60 feet uphill from test hole #1, the stream in the middle of the lot is barely 100 feet away from the staked location of the south property line, leaving no room whatsoever for a septic system in this area (3) The reported perc rate for the soils below 4 feet in test hole #2 is 37 minutes per inch. The wastewater code requires an 84 -foot long trench with 6 feet effective gravel depth in material of this type; not a 40 -foot trench as designed_ (4) The proposed driveway location shown on the site plan is either unusably steep or would undercut the proposed soil absorption trenches. On June 181 made a visit to the site, after reviewing copies provided by him of documents filed in 2002 and 2003 by Anderson Engineering. Based on my inspection, the proposed construction contains numerous significant violations of the wastewater disposal code, the most serious of which pertain to proximity of the proposed trench to a cut bank. I will enclose a sketch illustrating the approximate cross-section of the site at the north end of the proposed trench alignment, as staked. I recommend that you inspect the site yourself to determine code compliance prior to any reissuance of the permit. The major discrepancies that 1 observed are as follows: (l) The proposed trench, as staked, is on a steep natural slope within approximately 20 feet of'a very steep cut bank. A 25% slope line commencing 2 feet above the top of the sewer gravel would daylight in approximately 21 feet. (2) The trench alignment, as staked, is not level — it slopes downward at approximately 15% from south to north. (3) The proposed well location, as staked, is only 86 feet (measured on the slope) from the staked north end of the trench. This is a very different location than is shown on the site plan. (4) The site plan does not accurately depict the location of the house and well on Lot 13A. (5) The contour plan submitted to your office in 2002 by Mr. Anderson does not accurately depict the relevant slopes and curt bank. The elevation at the edge of the bluff is 110'. The elevation at the toe of the bluff is 100'. Extending the 4:1 slope from 2' above the distribution line for a horizontal distance of 30' results in an elevation of 104.5'. The 4:1 slope will daylight near the toe of the bluff at approximately 33' from the extreme end of the alternate site. The vast majority of the alternate site is more than 35' from the face of the bluff. The alternate site could also have an effective depth of 8' which would shorten the length to 30'. At 30' the extreme end of the trench is more than 35' from the edge of the bluff. With a 10' effective depth the trench length becomes 24' and the separation distance from the bluff edge is at least 40'. We hereby apply for a tot line waiver to allow the new absorption trench on Tract 136, The Villages Subdivision to be constructed within 3' of the existing lot line. A stream currently crosses the property near its midpoint severely decreasing the area available on the lot for the absorption trench as it must be located a minimum of 100' from the stream. In addition, the surface of the lot slopes at approximately 20% in a westerly direction with a steep cut slope near the property line. It is imperative the trench be placed as far up the slope as possible and as far as possible from any severe cut slope. Placement of the absorption trench close to the lot line will allow its construction further up the slope and provide required separation from the stream. The driveway to serve the new home also impacts the placement of the absorption trench. We have discussed the current design with the owners architect and will construct the new driveway 'as far as possible from the absorption trench with a cut slope that will not interfere with the trench. If necessary, the garage will be relocated to provide a modified driveway access. The lot to the south is very large and currently undeveloped. In addition, soils found in the area of the absorption trench are good with percolation rates between 2 and 37 minutes per inch. Placement of the trench within 3' of the lot line will not have an adverse impact on any septic system to be constructed on the adjacent lot in the future. We also found the lot comers to the property which indicate the cut slope along the property is constructed right at the property line. The toe of the slope is approximately 3' outside the property line. The top of the cut slope is 10' above the toe and 3' inside the property line. The ground surface from the top of the cut bank to the location of Test Hole No. 1 was measured at 20% to 22% and not the 35% as calculated from the surveyors contour map. The contour map was apparently prepared from aerial surveys or other inexact data. A drawing showing the location of the cut bank, Test Hole No. 1 and the proposed absorption trench is attached. This drawing shows the elevations and distances at strategic points on the slope. This data further implies that it is possible to construct the absorption trench as designed and still maintain a separation distance of 50' from any 25% break in grade. We are therefore confident the absorption trench meets all the requirements of the Municipal ordinance. We have left the total depth of the absorption trench at 12' as measured from the uphill side of the trench. The ground surface at the top of the trench will be approximately 9" lower on the downhill side of the trench and the total depth on that side will be 11.25'. This depth will more than satisfy the requirements for separation from a break in grade greater than 25%. We are therefore requesting a permit be issued for the construction of a new well and septic system to serve the proposed home. The attached Site Plan and backup documentation identify the location and configuration of the new well and septic system and the parameters used in the design. Also identified on the plans are the location of the well on the lot and the test hole locations. Only the lot to the west of this property is developed, but the well and septic system do not conflict with the improvements planned for this lot. Existing drainage patterns are shown and will not be altered by the development of the lot. The test holes placed near the location of the proposed absorption trench indicate clean gravel and sand with varying amounts of silt. The percolation tests completed in the material resulted in rates of 2 minutes per inch in the upper layer and 37 minutes per inch in the lower siltier layer. The absorption trench will be placed primarily in the upper cleaner material so we have used a blended application rate of .95 gallons per square foot per day. No groundwater was found during the placement of the test holes and none was noted during the monitoring period. We are therefore proposing to place a 3' wide deep absorption trench system with 6' of gravel beneath the distribution pipe. The total depth of the trench will be 12'. The distribution pipe will be placed at 6' below the ground surface to provide sufficient drop from the septic tank to the absorption trench. The ground surface on the lot slopes as shown on the attached Site Plan with an approximate 35% slope from north to south. It is necessa, therefore, to place the distribution pipe 6' below the surface. Extending the 2500 line from 2' above the distribution pipe it will not daylight with less than 40' of clearance from the trench. The new absorption trench will be constructed in conformance with Municipal requirements and parallel to ground contours where possible. All components of the new septic system will be constructed a minimum of 100' from the well on the lot and 10' from the Lot 138, The Villages Subdivision April 24, 2002 Page Two service line from the well to the house. If the system is constructed in accordance with our design the following statements apply: The system, if constructed as designed, will have no adverse impact on the wells In the area or those to be constructed In the future. 2. SUBJECT: Tract 13B, The Villages Subdivision Septic System As-Built/COSA We inspected the septic system recently constructed on Lot 1313, The Villages and verified the damaged cleanout at the south end of the absorption trench has been replaced. In addition, a fence has been constructed between the driveway and the absorption trench to prevent traffic from driving over the system. Alpine Drilling has placed a tag on the well casing with all pertinent information required by the Municipality.
