A Category III Advantex w/ shallow trench has been serving this residence. The owner desires to rebuild the existing trench and add the replacement trench at the original approved sites. A design is submitted for a new trench & rebuilt trench. The neighboring lots are developed as indicated in the drawing; no adverse impacts to these properties will occur from this development. The easements are located on the drawing and are not encroached upon. A Category III application rate of 6 GPD/FT². Trench Length = 100 FT²/5 = 20 ; 1 line @ 20 . Previous design used with previous test holes. Shallow Trenches @ 1 depth. Specification Requirements: All components and work must comply with the Municipality of Anchorage Specifications (AMC) & State of Alaska Drinking Water Regulations and Wastewater Regulations. Thank you for expressing your concerns on the development of Broadwater Heights Subdivision, Block 3, Lot 14, which is next door to your property. The Municipality of Anchorage welcomes your input for the construction and development of land. The Development Services Department, On -Site Water & Wastewater Program (OW WP) issued a renewal permit last spring to construct a wastewater disposal system in its current location. The original permit for this location was issued in 2005. When this permit was issued, the surface water was not known about. Two separate surveyors making plot plans of the property did not find any surface water. After the exposure of the surface water, the Watershed Management Section of the Municipality of Anchorage mapped three gravel bed channels in the summer of 2007 running across the ground. There was no surface water in them at the time and they said that they appeared to carry intermittent flows of water during snowmelt or rainstorm events. This type of intermittent surface drainage does not require the 100 -foot setback requirement from septic systems. It was described to us by the builder and the engineer that it was not until the land was cleared of vegetation that the water began flowing on the ground surface. Construction of the home and wastewater system was stopped until a solution to satisfactorily protect the surface water was in place. The ability to waive separation requirements to surface waters in certain cases such as this was granted in 1985 to the Municipality of Anchorage by the State of Alaska Department of Environmental Conservation (ADEC). The ADEC has done a second review and supported time City's decision to grant this waiver. As with all advanced wastewater systems in the Municipality of Anchorage, there is a requirement to have audible and visual alarms installed inside the house. In a recent phone call to Community, Security, Prosperity David and Jane Hewko June 19, 2009 Page 2 ort the wastewater system manufacturer (Anchorage Tank & Welding) we were told that the last alarm from the junction box on the exterior of the home was January 9, 2008. This information was obtained from their computer log of alarms telephonically relayed to them by their advanced wastewater systems. A copy of this log is attached. In this case the alarm on the outside of the house has been disabled and the alarm within the house notifies the owners of a problem. During the phone call, the manufacturer noted that one alarm sounded on April 25 because of excessive water usage. The matter was corrected and no alarms have sounded since. The system is currently operating as designed and constructed. At this time the Municipality is waiting for the Corp of Engineers (COE) to decide if the subject drainage is within their jurisdiction and if so, is it eligible to obtain an `after the fact permit' to remain in the pipe as it is now or if the water needs to be rerouted to the drainage channel. If the water is required to be rerouted, special landscaping measures have already been put in place to protect the drainage channel from wastewater in the unlikely event the system were to malfunction or fail. The excavator, Saunders & Saunders went to install the septic system and found springs within 100 feet of the proposed septic site. It our understanding that the springs were not platted as creeks, nor identified as wetlands. We notified your department of the condition and proposed capturing the closest spring in a solid pipe and daylighting it 100 feet from the proposed septic system. With your department's concurrence, the general contractor's excavator performed this work. The diversion drain effectively dried-up the closest spring. There are still two springs closer than 100 feet to the proposed drainficld site. There is a possibility that the Corps of Engineers may direct our client to restore the spring back to its original drainage pattern and abandoned the diversion drain. If this is the case, the proposed drainfield will be slightly over 50 feet from the "stream channel"; therefore, we are requesting a 50 foot waiver to any surface water from the proposed tank and dminfields (both primary and alternate). The following are mitigating factors for this waiver: • We are proposing that a berm be constructed downhill from the drainficld so that is any effluent was to surface, it have to travel over 100 feet to reach any surface waters. • The springs originate uphill from the proposed septic system and travel away from the proposed drainficld. It is our opinion that it would be physically impossible for any surfacing effluent to reach the springs due the topography. • The area between the proposed drainfield and the existing springs are heavily vegetated. • The drainfield site is in a very visible arca and will be in close proximity to the house. If effluent was to surface, the problem would be easily noticeable and would be remedied quickly. • We are proposing to use a Category III nitrogen removing wastewater system for this installation. The effluent is highly treated and this system is monitored 24 hours a day, 7 days a week. This insures the system will operate and be maintained as needed to insure the quality of effluent. Based upon these items, it is our opinion that there is minimal risk with the granting of this waiver. As stated previously, we are proposing to use a Category Ill Advantex treatment system. Attached is a site plan, design drawing and detail drawings showing these revisions to the design. We request the permit be revised to use this type of system. Based upon the variations of bedrock in the area, we are requesting that a 4 foot separation distance from the bottom of the proposed drainficld to bedrock table be 3701 E. The following are justification for this waiver: • We are proposing to use a Category 111 nitrogen removing wastewater system for this installation. The effluent is highly treated and this system is monitored 24 hours a day, 7 days a week. This insures the system will operate and be maintained as needed to insure the quality of effluent. • We are proposing to use a sand filter in the drainfield to insure effluent quality. • The closest well downhill of the proposed drainfield is 200+ feet away. Mr. Roth: Out of curiosity, I sent one of my staff out to walk the old drainage swale that the now diverted spring used to run in. It was completely dry. When the wetlands folks were out there mapping it, it was only about a week after the spring had been diverted; therefore, the old stream channel was still damp. In short, the diversion was a complete "success ........ and given the current situation............ I use the term "success" very loosely. When my staff member was on site, he walked an estimated 400 feet down the drainage swale ("stream feature"?) below the Broadwater pond "discharge" culvert. There was no water at all. He didn't walk any further downhill because it seemed moot. As stated previously, according to the neighbor that lives next door to the pond, the culvert only has running water in it about 2-3 weeks in the Spring. I talked to my client, Mike Schrock and he said he never noticed any water flowing out of the culvert this spring. I have never seen water running from it. To be conservative, let's assume it overflows 4 weeks per year, slightly lagging spring break-up. Per the recent "Rapaonos decision", the fact that the flow is "not relatively permanent" is of significance. According to COE guidelines post Rapanos, "a water body is "relatively permanent" if its flow is year round or its flow is continuous at least "seasonally." (e.g., typically 3 months)." It is my understanding that ........... if the COE determines somehow that the Eagle River storm drainage system ties into navigable water, the Broadwater wetland, which is adjacent (non -abutting) to a "not relatively permanent" tributary (the normally dry drainage swale below the Broadwater culvert), will likely be subject to a "significant nexus" determination. It is my understanding that they will need to establish that the Broadwater wetland has significant affect on the chemical, physical, and biological integrity of a downstream traditional navigable water. Per Justice Kennedy, "The impact must be more than speculative or insubstantial". I think it will take some extreme desire and very creative writing skills to establish that the subject wetland (Broadwater Pond) has a substantial impact on the chemical, physical, and biological integrity of Eagle River. On July 11 David obtained a copy of the June 1 wastewater permit and noted an attachment stating, "no surface waters within 100 feet of the proposed septic system.- June ystem" June 11: Excavator located stream across SE corner of Lot 14. June 21: Stream was diverted into a buried pipe as Gayness Engineering Group, Ltd. and On -Site had concurred, as stated in the June 27 revision letter to On -Site, without the U.S. Army Corps of Engineers' knowledge or typical MOA requirements and oversight, such as a hydrology study. June 25: Jane learned of the diverted stream from conversation with the excavator and S u RI C'Yob notified On -Site. On -Site reported no knowledge of surface water in thep/n Nd T- PICk u SE corner. Jane reported a stream flows in the SE corner. w T R, SuRFpL� June 27: A stop work order was issued by MOA Watershed Management Division for working inside the 25 foot stream protection set back and concern regarding separation distance between the disposal system and the stream. July 11: Dan Roth told David a meeting was held July 6 and the stop work order was lifted. Work could continue on the house; work on the septic system was waiting on a determination from the Corps of Engineers. The stop work order was lifted July 6 because the "Army Corps of Engineers issued the owner a permit allowing owner to keep stream piped" To our knowledge, the Corps has not yet issued this'permit. July 17: We learned a second waiver for surface water separation and a third for bedrock A separation distance were requested in a June 27 letter of revisions to the proposed septic system. Ron Thompson's July 12 email stated no waiver is needed for the proposed wastewater disposal site. July 24: Meeting on Lot 14 including Denis LeBlanc, Dan Roth, Jeff Gayness, Tracy DeGering, Kristi Cada, Holly Kent, Clair Shirey, David and Jane Hewko. - Regardless of the Corps'of Engineers' determination, Mr. Roth would issue the requested waivers for the 100 foot separation from surface water. - Mr. Shirey, owner of the adjacent property, stated that he had not given, nor would he give, permission to enter onto his land to divert the stream on his property. - Trespassing occurred at the time of diversion. According to Mr. LeBlanc, this was a civil matter and of no consequence to the permitting issue. August 1, 2005 Julie Makela PE of On -Site stated the 100 foot set back from surface water requirement was "cast in concrete," no exceptions. Information on Gamess Engineering Group, Ltd.'s website as of July 1, 2007 states, "The septic system must be at least 100 feet away from surface water. The MOA will not waive this requirement for new construction." MOA's policy has been one of no waivers for new construction but granting, usually with conditions, when upgrading existing systems to ensure a better system. MOA has no reason to neglect the protection of the streams. Though it would probably require a waiver for bedrock separation, the initially identified wastewater site would not impact the streams. The 100 foot separation requirement could have been met without compromising the stream or potential development. A study of these streams should be completed similar to others required by MOA and in coordination with the Corps of Engineers. An engineer and hydrologist who visited the site raised the concern that the pipe may be too small and may not contain the stream at high flow levels, resulting in a "break-out" of the stream with a consequent violation of the separation distance requirement. A conflict of interest is apparent in that the Development Services department is granting waivers to the protection of surface waters. The question has been raised, "Is the department servicing the developers or the resource?" The Watershed Management Division and the Environmental Planning Department along with the Corps of Engineers need to be an integral part of this process to allow development to proceed while protecting the watershed. We request that the 100 foot separation between a wastewater disposal site and surface waters be respected without diverting the stream to ensure protection of the stream, wetlands, and all downstream resources. In an area without city water and sewer it is even more critical that we be vigilant to protect the watershed. Section 329.4 - General definition Navigable waters of the tJnited States are those waters that are subject to the ebb and flow of the tide and/or are presently used, or have been used in the past, or may he susceptible for use to transport interstate or foreign commerce. A determination of navigability, once made, applies laterally over the entire surface of the waterbody, and is not extinguished by later actions or events which impede or destroy navigable capacity. Section 329.5 General scope of determination The several factors which must be examined when making a determination whether a waterbody is a navigable water of the tJnited States are discussed in detail below. Generally, the following conditions must be satisfied: I. a. Past, present, or potential presence of interstate or foreign commerce; Physical capabilities for use by commerce as in paragraph (a) of this section; and c. Defined geographic limits of the waterbody. Section 329.6 - Interstate or foreign commerce a. Nature of commerce: type, means, and extent of use. The types of commercial use of a waterway are extremely varied and will depend an the character of the region, its products, and the difficulties or dangers of navigation. It is the waterbody's capability of use by the public for purposes of transportation of commerce which is the determinative factor, and not the time, extent or manner of that use. As discussed in Section 329.9 of this Part, it is sufficient to establish the potential for commercial use at any past, present, or future time. Thus, sufficient commerce may be shown by historical use of canoes, bateaux, or other frontier craft, as long as that type of boat was common or well-suited to the place and period. Similarly, the particular items ot'commerce may vary widely, depending again on the region and period. The goods involved might be grain, furs, or other commerce of the time. Logs are a common example; transportation of logs has been a substantial and well-recognized commercial use of many navigable waters of the United States. Note, however, that the mere presence of floating logs will not of itself make the river "navigable"; the logs must have been related to a commercial venture. Similarly, the presence of recreational craft may indicate that a waterbody is capable of hearing some forms of commerce, either presently, in the future, or at a past point in time. b. Nature -of commerce: interstate and intrastate. Interstate commerce may of course be existent on an intrastate voyage which occurs only between places within the same state. It is only necessary that goods may be brought from, or eventually be -destined to go to, another state. (For purposes of this regulation, the term "interstate commerce" hereinafter includes "foreign commerce" as well.) This is especially clear when it physically connects with a generally acknowledged avenue of interstate commerce, such as the ocean or one of the Great Lakes, and is yet wholly within one state. Nor is it necessary that there be a physically navigable connection across a state boundary. Where a waterbody extends through one or more states, but substantial portions, which are capable of bearing interstate commerce, are located in only one of the states, the cntirety of the waterway up to the head (upper limit) of navigation is subject to Federal jurisdiction. Section 329.8 - Improved or natural conditions of the waterbody Determinations are not limited to the natural or original condition of the waterbody. Navigability may also be found where artificial aids have been or may be used to make the waterbody suitable fir use in navigation. it. Existing improvements: artificial waterbodies. 1. An artificial channel may often constitute a navigable water of the United States, even though it has been privately developed and maintained, or passes through private property. The test is generally as developed above, that is, whether the waterbody is capable of use to transport interstate commerce. Canals which connect two navigable waters of the United States and which are used for commerce clearly fall within the test, and themselves become navigable. A canal open to navigable waters of the United States on only one end is itself navigable where it in fact supports interstate commerce. A canal or other artificial waterbody that is subject to ebb and flow or the tide is also a navigable water of the United States. 2. 'ilic artificial waterbody maybe a major portion of a river or harbor area or merely a minor backwash, slip, or turning area (see paragraph 329.12(b) of this Part). 3. Private ownership of the lands underlying the waterbody, or of the lands through which it. runs, does not preclude a finding of navigability. Ownership does become a controlling factor il'a privately constructed and operated canal is not used to transport interstate commerce nor used by the public; it is then not considered to be a navigable water of' the United States. However, a private waterbody, even though not itself navigable, may so affect the navigable capacity of nearby waters as to nevertheless be subject to certain regulatory authorities. b. Non -existing improvements, past or potential. A waterbody may also be considered navigable depending on the feasibility of use to transport interstate commerce after the construction of whatever "reasonable" improvements may potentially be made. The improvement need not exist, be planned, nor even authorized; it is enough that potentially they could be made. What is a "reasonable" improvement is always a matter of degree; there must be a balance between cost and need at a time when the improvement would be (or would have been) useful. 'Thus, if an improvement were "reasonable" at a time of past use, the water was therefore navigable in law from that time forward. The changes in engineering practices or the coming or new industries with varying classes of freight may alTect the type of the improvement; those which may be entirely reasonable in a thickly populated, highly developed industrial region may have been entirely too costly for the same region in the days of the pioneers. A watcrbody which was navigable in its natural or improved state, or which was susceptible ofreasonable improvement (as discussed in paragraph 329.8(b) of this Part) retains its character as "navigable in law" even though it is not presently used for commerce, or is presently incapable of such use because of changed conditions or the presence of obstructions. Nor does absence of use because of changed economic conditions affect the legal character of the waterbody. Once having attained the character of "navigable in law," the Federal authority remains in existence, and cannot be abandoned by administrative officers or court action. Nor is mere inattention or ambiguous action by Congress an abandotunent of federal control. However, express statutory declarations by Congress that described portions of a waterbody are non - navigable, or have been abandoned, are binding upon the Department of the Army. F.ach statute must be carefully examined, since Congress often reserves the power to amend the Act, or assigns special duties of supervision and control to the Secretary of the Army or Chief of Engineers. b. Future or potential use. Navigability may also be found in a waterbody's susceptibility for use in its ordinary condition or by reasonable improvement to transport interstate commerce. This may be either in its natural or improved condition, and may thus be existent although there has been no actual use to date. Non-use in the past therefore does not prevent recognition or the potential for future use. Section 329.10 - Existence of obstructions A stream may be navigable despite the existence of falls, rapids, sand bars, bridges, portages, shifting currents, or similar obstructions. Thus, a waterway in its original condition might have had substantial obstructions which were overcome by frontier boats and/or portages, and nevertheless be a "channel" of commerce, even though boats had to be removed from the Aater in some stretches, or logs be brought around an obstruction by means of artificial chutes. However, the question is ultimately a matter of degree, and it must be recognized that there is some point beyond which navigability could not be established. Section 329.11 - Geographic and jurisdictional limits of rivers and lakes a. Jurisdiction over entire bed. Federal regulatory jurisdiction, and powers of improvement for navigation, extend laterally to the entire water surface and bed of a navigable waterbody, which includes all the land and waters below the ordinary high water mark. Jurisdiction thus extends to the edge (as determined above) of all such waterbodis, even though portions of the waterbody may be extremely shallow, or obstructed by shoals, vegetation or other barriers. Marshlands and similar areas are thus considered navigable in law, but only so far as the area is subject to inundation by the ordinary high waters. 1. Ownership of a river or lake bed or of the lands between high and low water marks will vary according to state law; however, private ownership of the underlying lands has no bearing on the existence or extent of the dominant Federal jurisdiction over a navigable r' waterbody. b. Upper limit of navigability. The character of a river will, at some point along its length, change from navigable to non-navicable. Very often that point will be at a major fall or rapids, or other place where there it a marked decrease in the navigable capacity of the river. The upper limit will therefore often be the same point traditionally recognized as the head of navigation, but may, under some of the tests described above, be at some point yet farther upstream. Section 329.12 - Geographic and jurisdictional limits of oceanic and tidal waters a. Ocean and coastal waters. The navigable waters of the United States over which Corps of Engineers regulatory jurisdiction extends include all ocean and coastal waters within a zone three geographic (nautical) miles seaward From the baseline (The Territorial Seas). Wider sones are recognized for special regulatory powers exercised over the outer continental shelf. (See 33 CPR 322.3(b)). 1. Baseline defined. Generally, where the shore directly contacts the open sea, the line on the shore reached by the ordinary low tides comprises the baseline from which the distance of three geographic miles is measured. The baseline has significance for both domestic and international law and is subject to precise definitions. Special problems arise when offshore rocks, islands, or other bodies exist, and the baseline may have to be drawn seaward of such bodies. 2. Shoreward limit of jurisdiction. Regulatory jurisdiction in coastal areas extends to the lune on th.e shore reached by the plane of the mean (average) high water. Where precise determination of the actual location of the line becomes necessary, it must be established by survey with reference to the available tidal datum, preferably averaged over a period of"! 8.6 years. Less precise methods, such as observation of the "apparent shoreline" which is determined by reference to physical markings, lines of vegetation, or changes in type of vegetation, may be used only where an estimate is needed of the line reached by the mean high water. b. Bays and estuaries. regulatory jurisdiction extends to the entire surface and bed of all waterbodics subject to tidal action. Jurisdiction thus extends to the edge (as determined by paragraph (a)(2) of this section) of all such waterbodies, even though portions of the waterbody may he extremely shallow, or obstructed by shoals, vegetation, or other barriers. Thus, gradual changes which are due to natural causes and are perceptible only over some period or time constitute changes in the bed of a waterbody which also change the shoreline boundaries of the navigable waters of the United States. however, an area will remain "navigable in law," even though no longer covered with water, whenever the change has occurred suddenly, or was caused by artificial farces intended to produce that change. For example, shifting sand bars within a river or estuary remain part of the navigable water of the United States, regardless that they may be dry at a particular point in time. Section 329.14 - Determination of navigability a. Effect on determinations. Although conclusive determinations of navigability can be made only by federal Courts, those made by federal agencies are nevertheless accorded substantial weight by the courts. It is therefore necessary that when jurisdictional questions arise, district personnel carefully investigate those waters which may be subject to Federal regulatory. jurisdiction under guidelines set out above, as the resulting determination may have substantial impacvt upon a judicial body. Official determinations by an agency made in the past can be revised or reversed as necessary to reflect changed rules or interpretations of the law. b. Procedures of detcrmination. A determination whether a waterbody is a navigable water of the United States will be made by the division engineer, and will be based on a report of findings prepared at the district level in accordance with the criteria set out in this regulation. Each report of findings will be prepared by the district engineer, accompanied by an opinion of the district counsel, and lorwarded to the division engineer for final determination. In consideration of the mutual covenants contained herein, the parties to this Memorandum of Understanding agree as follows: 1. ADVANCED WASTEWATER TREATMENT SYSTEMS. Definitions. A. Alteration. Any change to the design or function of an AWWTS that Includes the installation or removal of any parts, components or pieces not included in the original construction permit and design. Prior to performing any alterations to an AWWTS the owner must obtain a Wastewater Disposal System Constiuction Permit from the Municipality pursuant to Anchorage Municipal Code (hereinafter, "AMC") 15.65. B. Certificate of On -Site Systems Approval. An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with AMC 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. C. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. D. Maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AWWTS that were included in the original design which would allow the AWWTS to continue to perform as designed. E. Permit (Construction) An On -Site Wastewater Disposal System Construction Permit as defined by AMC 15.65. F. Permit (Operating) An Advanced Wastewater Treatment System Operating Permit. An annual permit, issued by the Municipality, that allows the Owner to operate an AWWTS, upon meeting all the requirements of this agreement, the conditions of Operating Permit, the requirements of the On -Site Wastewater System Construction Permit and all relevant provisions of AMC 15.65 3. Fee. Owner shall pay to Municipality an annual fee of _ 0 (54.00), payable on or before the issuance of the operating permit and annually thereafter. The annual fee is due on or before the anniversary date of the approval by the Municipality of installed system. 4. Term. The term of this Memorandum of Understanding shall be for the life of the AWWTS. The term begins on the date of approval by the Municipality of the installed system and shall continue while the AWWTS system is in use or operational or until the property is sold or title is transferred by owner and a new certificate of On -Site approval is issued to the new owner or transferee of the property. 5. Alterations. Installation and Removal of Additional Equipment. Owner agrees not to make any alterations, removal of parts or additions to the AWWTS without a Construction Permit from the Municipality. 6. Maintenance and Repairs. A. Throughout the term of this Memorandum of Understanding, the Owner shall maintain AWWTS in good repair. In addition, it shall be the responsibility of the Owner during the term of this Memorandum of Understanding, and any extensions or renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. Further, Owner agrees to comply will all applicable ordinance, laws, regulations, rules and orders for the AWWTS. B. Owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system pursuant to the terms and conditions contained in the Owner's AWNVTS Operating Permit. This schedule shall be submitted to the Municipality annually upon the renewal of the permit. The schedule of maintenance and repair contained in the Owner's AWWTS Operating Permit is: 'Bi- Arn num C. Owner acknowledges that the fine schedule for failing to maintain and repair an AWWTS are codified in AMC 14.60. D. Owner agrees that only maintenance, repair personnel certified by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. E. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. F. Owner agrees that any sale or transfer of title of the property will not occur %without a new Certificate of On -Site Systems Approval. G. Owner agrees that the relevant provisions of the standard specification guidebook for AWWTS is the governing professional guidelines for the construction, maintenance and repair of the Owner's AWWTS. 7. Nomvaiver. The failure of either party at any time to enforce a provision of this Memorandum of Understanding shall in no way constitute a waiver of the provisions, nor in any way effect the validity of the Memorandum of Understanding or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 8. Amendment. A. This Memorandum of Understanding shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality of this Memorandum of Understanding was executed and such ATiting shall be attached to this Memorandum of Understanding as an amendment. B. Any civil action arising from this Memorandum of Understanding shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Memorandum of Understanding. 10. Severability.
