Dear Chad. n -)Do -10,S L l ese-n er
For the reasons listed below I am requesting that you pay me a refund of S 10.000. If the
payment is not received within 30 days I will be
small claims court. presenting this same information to the
1. On 10'27/06 a check for $6.692 was written to Mohawk Drilling (MOA Permit
I'SW060316)for the first well drilled at Lot 7, Block 3 Schroeder East Sub (17144
Charity Circle. Eagle River. AK 99577). The log (dated 11/14,'06) included the
liol lowing information: Depth of hole 206'. Static water 106'. Development method -
Air. GPM = I.S. Casing 6" down to 42'. Comments: "May want to hydro -Frac, well
was disinfected." Sand &: gravel 042': Bed rock 42'-206'.
2. As the owner/contractor of a new single family home to be built on the lot, I of course
was concerned that we would have water. I was assured by Mohawk Drilling that the
well would work and the project continued.
3. Excavation, concrete work and Gaming were completed a 1215/06.
4. Basic electric and plumbing were completed by the end of February and the project
continued.
5. however, some time in May or June when the well was to be connected to the house
by Mohawk Drilling it was discovered that the I" well was not usable. No PVC pipe
had been installed and stuff had sloughed into the well. Mohawk attempted to redrill
but claimed that he ran into coal and methane and that a small explosion occurred.
Mohawk then gave up on the first well and said we would have to drill a second well.
6. In the meantime we were unable to get a loan from a bank until it could be proven
that we would have our own source of usable water. This delay in getting a loan
resulted in additional interest expenses on the credit cards &other loan sources being
used to help finance our expenses.
7. Around the beginning of July Mohawk began drilling a second well 114' from the
home. On July 9 the drilling was completed. A bill for $10.850 was immediately
received for the 30l' well. $5,000 was immediately paid with the balance to be paid
within a set time.
8. 1 instructed Mohawk Drilling to call Artie Pump &: Well immediately after the drill-
ing was completed in order to put in the PVC pipe and avoid the problem we had with
the first well. I anticipated APW would want details about the drilling and I did not
want to be the middle man. I asked for direct contact. The day atter the drilling was
completed I noticed that APNV had not arrived to put in the PVC pipe. I called APW
and they informed me that Mohawk Drilling had not contacted them. They promptly
came. inspected the well and found that stuff had already sloughed into the well.
9. I attempted to contact Mohawk Drilling and could get no answer for my calls. I
finally had to stop out at Chad Wiltfong's (owner/operator) home and talked to his
wife. She informed me that he was drilling in the valley and had poor phone
reception. Chad finally did call me back and refused to come and redrill the well.
10. Please note that back in October of 2006 we were assured that we had a well that
would provide usable water. $11,692 had been paid to Mohawk Drilling plus pump
installation expenses for the first well and we had nothing to show for it — nothing.
I 1. APW then suggested we get a reputable well driller, M -W Drilling. They were very
busy and were unable to come until @ September 25, 2007. They proceeded to video
the hole, redrill it and install the necessary PVC pipe.
12. APW and M -W Drilling can both verify that the well was not useable. We had no
useable well or water after our expenses with Mohawk Drilling.
13. The Inspection agency did allow us to move in about the middle ofJuly. 2007. We
had to find an alternate source of water and purchase drinking eater.
14. We then had to wait for the excavator to dig and bury the connection from the second
well 114' to the house.
15. APW had to install the second well pump.
16. Note again the delay in 1) getting a loan, 2) our own supply of water (living in home
since 7/15/07).
17. The water from the second well turned out to be a problem. It did not clean up by
itself. There was a considerable length of time when we were not sure the water from
the second well would work. Our only alternative would then be to spend $50-70,000
to hook up to city water. Imagine the headache and heartache we were going through.
18. Alaska Pure Water took a sample of the water, was about to give up on it but then
remembered a treatment previously used. This has resulted in another expense of
512,500. This system wasn't useable until @ the first part of Dec. We had moved into
the home 7/15/07.
19. Remember we were told we had a well that worked back in Oct. 2006.
20. Here is a list of expenses related to our wells as of 2/17/08:
a. 1" well drilled by Mohawk Drilling -
$6.692.00
b. Pump installation—APW
1.407.00
(since assured all was well, we assumed total
Well/water expense including pump installation
would be under 510.000 and continued with project)
591099.00
c. Additional expenses:
i. Drilling of second well — Mohawk (no log &
first well not decommissioned. billed $10.850)
$5.000.00
[well sloughed in. Mohawk refused to redrill
and I did not pay rest of bill. cf lien listed below]
ii. Level pad for M -W well driller— DL Enterprises
600.00
iii. Well redrilled—M-W Drilling
$3.817.50
iv. PVC pipe expenses
791.92
v. Excavation & water line connection — DL Ent.
3,307.60
vi. Pump connection—APW
2,040.00
vii. Analytica water test
201.00
viii. Engineering test on well — Gamess Eng. Grp.
887.50
ix. First well decommissioned —M -W Drilling
470.24
x. Water filtering system (Mohawk can not be
held accountable for water quality in second well
but I was told first well was OK)
12,250.00
xi. Mohawk Lien against loan from Ak USA Bank
5.850.00
Total: (excluding interest on loans from credit cards etc.) $35,215.76
Both M -W Drilling and Alaska Pump and Well are willing to substantiate the claims
made about the second well. So please refund the $10,000 by March 20 or the
information in this letter will be presented to the Small Claims Court.
Sincerely,
Tom . a- ZI AZ' 40t

Certificate of On -Site Systems Approval (COSA) # 151352
During a recent COSA on-site inspection and test of the potable water
supply well on Block 3, Lot 7 of Schroeder East subdivision, the well's
productivity was determined to be 0.22 gallons per minute. The minimum
well productivity required by this Department (AMC 15.55) for a 2 -bedroom
residence is 0.2 gallons per minute. Although the subject well currently
exceeds this minimum requirement, all parties concerned are advised that the
production capacity of the well may fluctuate. Restriction of non-critical
water uses such as washing cars and watering lawns and gardens may be
required.

Engineers Comments:
In conducting this evaluation, GEG, VD. attempted to provide a thorough,
conscientious engineering analysis of the system in accordance with ADEC and MOA
DSD Guidelines & Regulations. The reported results described the performance of the
system under the conditions encountered at the time of the test, and separation
distances measured to readily Identifiable features. The operational life of all wells and
septic systems depend on the local soils condition, groundwater levels that may
fluctuate during the year, and the water usage of the family being served by the system.
These conditions are outside the control of the evaluator of the system. Satisfactory test
results do not guarantee future performance of the system, nor do they guarantee that
there are no hidden defects or encroachments. GEG, LTD. can therefore not provide
any warranty or future estimate of how long the system will continue to meet the
operational requirements of the ADEC or MOA DSD. The content of this report is for
the sole benefit of the owner listed above. Any reliance upon or use of this report by any
other person or party is not authorized, nor will It confer any legal right whatsoever.
