2. ]~ncroachraent. Permtttee has constxucted or purchased the following improvements
on or within the real property subject to said Easement:
A water well that encroaches approximately Three Feet O') into said Easement for a
distance ofappro×im~tely One Foot (1'),
(herein "Encroachment").
3. Permit. Chugach hereby authorizes Permittee to continue the existence of the
Encroachment in its existing location subject to the covenants set forth in this permit.
4. Indemnification. Permittee sh~1! inde~,~ify and hold Chuga~h harmless from any
claims for personal injury, propeay damage or other loss arising in any way fzom the continuation of
the Encroachment.
5. ]% Expansion or Increase. Permtttee shall not in any way expand ox increase the
extent to which the Encroachment occupies any of the real property encumbered by the Easement
without the prior written consent ofChugach. Chugachhas no obligationto provide such consent.
6. No Interest in Real E~tate Acquired. Pemaittee hereby acknowledges that the
Encroachment and any additions thereto, even if in violation of this permit, has not and shall not in
the future give rise to any interest or estate in the real property subject to the Easement or any other
real property. Without in any way limiting the foregoing, Permittee acknowledges that the
Encroachment is not adverse to any interest of Chugach and its enntinuation is entirely with the
· l~ermission of Chugaeh for purposes of the common law doctrine of adverse possession~ This p4~'mit
creates no interest in the real property subject to the easement.
7. Modification of Utility Facilities. If the electric utility facilities located withi,~ the
Easement arc upgraded, added to, .repla.ced or.recons~cted, Permittee shall pay that portion of'
Chugach's total costs for such modificaUon which is reasonably attributable to accora~odating or
preserving the Encroachment. If such payment is not made within thirty (30) days of written demand
for same, Chugach may terminate this permit in accordance with paragraph 9, below.
8. Covenants R, nnlng with !he Land.. The obligations of the Permktee arising from this
permit shall be covenants running with the land which shall burden the Parcel mad the Permittcc'a
interest in the land subject to the Easement and shall benefit the Easement.
9. Termination. Chugach may termlnate this permit after the giving of thirty (3 0) days
written notice of such termination if:
a. The Encroach,neat is enlarged, increased or emended within the teal property
affected by the Easement.

b. The Encroachment is damaged by any means to an extent of more th~n thirty percent
(30%) of i~s rcplaccmcnt cost at thc time of destruction.
c. Permittee fails to make tho payment described in paragraph 7, above.
10. Term. This pem-d~ shall, if not sooner terminated by Chugach, expire forty (40) years
from thc date hereof.
11. Entire A~reemcnt. This written permit constitutes thc entire agreement between thc
parties with respect to thc subject matter hereof and supersedes all other prior or contemporaneous
egreements, oral or written, between the parties. No modifications, amendments, deletions, additions
or alterations of thc pcrmit shallbc effective unless in writing and signed by all of thc parties hereto.

Revised Septic System Location
The developer of Lot 9 has requested the location of the absorption trench be moved
further to the south and deepened 2' to allow for construction of a daylight basement.
A test hole was recently placed to a depth of 19' and no bedrock or groundwater was
encountered. A percolation test performed on the soils encountered revealed an
absorption rate of 1.2 minutes per inch. This rate is slightly faster than the rate (5
minutes per inch) achieved by Gamess Engineering Group at Test Hole No. 40 on the
lot. We are therefore using an application rate of .8 gallons per day per square foot to
design the trenches at the new location. The alternate site will remain at the same
location.
Please review the attached documentation and revise the septic system permit
accordingly.

Septic System Design and Permit Application
Impacts to Adjacent Properties
Dear Onsite Services Engineer.
The owner of Lot 9, Block 2, Cross View Estates Subdivision intends to construct a new
six-bedroom home on the lot. We are therefore requesting a permit be issued for the
construction of a new septic system to accommodate the home. A well was placed on
the lot during the subdivision phase and will be used to serve the new home. The
attached Site Plan and backup documentation identify the location and configuration of
the existing well and the proposed septic system along with the alternate site. Also
identified on the plans are the existing well on the lot and in the area and septic
systems on surrounding lots. No conflicts exist between the proposed septic system
and well or septic systems and wells on adjacent lots. Drainage arrows are shown on
the site plan showing the grade and direction of flow on the lot. The drainage pattern
will not be changed as a result of this project.
The test hole placed on the lot in the area of the absorption trenches and alternate site
indicate silty sand with gravel (SM/ML). The percolation rate of the soil was determined
to be 5 minutes per inch. No groundwater was found dudng the placement of the test
holes and none was noted during the monitoring period. An application rate of .6
gallons per day per square foot was used in the design of the absorption system. We
are proposing to place a new 2,000-cjallon septic tank and 2-47' long by 3' wide by 8'
effective depth absorption trenches to treat and dispose of the effluent generated in the
house. The elevation of the distribution line in the absorption trench will be 3' below the
surface and the total depth will be 11 '. A flow splitter valve will be placed to insure even
flow to each trench. A minimum of 3' of fill or 2" of insulation and 2' of fill will be placed
over the absorption trench and 4' over the septic tank.
Only one test hole was placed on the lot during the subdivision process. The City

approved the subdivision based on the single hole to a depth of 17'. None of the test
holes in the subdivision indicate the presence of bedrock nor do any of the well logs of
deep water wells placed to date. Both the primary absorption system and the alternate
site fall within the 30' radius of the single test hole.
The ground surface on the lot in the area of the septic system slopes to the west at a
shallow grade with some cross sloping from the east. The new trenches will be
constructed parallel with the slope as much as possible in conformance with Municipal
requirements. The new septic system will be constructed a minimum of 100' from all
wells and any surface water and 10' the proposed and existing water services in the
area.
If the system is constructed in accordance with our design the following statements
apply:

The system, if constructed as designed, will have no adverse impact on the wells

I am providing you this plan on behalf of the owners pf the proposed Heritage F}ills Subdivision
to accompany well permit applications for the drilling wo additional test wells at heritage Hills
Subdivision near the corner of Birch and Huffman Roads in Anchorage. Please see my letter to
you dated September 15 and the map provided to you on this project.
Subsequent to the testing and approval phase for this project we anticipate converting the wells
to private domestic wells and they will be located and constructed to meet municipal standards
for residential wells.
At this time we are only requesting permits for drilling wells. Subsequent hydrologic test plans
need to await the results of the drilling and we will be inform you as the program develops.
