THIS EASEMENT AGREEMENT is made by and between MM&M
Contracting, Inc., an Alaska corporation, as owners of the Servient Parcel (hereafter
"Grantors"), whose address is P. O. Box 670495 Chugiak, AK. 99567 and BRENDA
ELLIOTT BOWLER, an individual, as owner of the Dominant Parcel (hereafter
"Grantee", whose address is P. O. Box 772828 Eagle River, AK 99577
1. The parties recite that:
A. The Grantors own real property located at Lot 7 Denali Vue Subdivision.
Chugiak, Alaska, and legally described as:
Lot 7, DENALI VUE SUBDIVISION, according to
Plat No. 205-152, records of the Anchorage Recording District,
Third Judicial District, State of Alaska.
The MM&M'S property as so described is hereafter referred to as the "Servient Parcel."
B. Grantees own real property in Chugiak, Alaska, located adjacent to the
Grantors. Grantees adjacent property is legally described as:
Lot 4, DENALI VIDE SUBDIVISION, according to Plat No.
205-152, records of the Anchorage Recording District,
Third Judicial District, State of Alaska.
Grantees property as so described is hereafter referred to as the "Dominant Parcel."
C. Grantees desires to obtain from the Grantors, and the Grantors desires to
grant to the Grantees a water Ime easement on the Grantors property.
NOW, THEREFORE, in consideration of the mutual promises made herein, and for other
good and valuable consideration, the receipt and sufficiency of which is acknowledged,
the parties agree as follows:
2. Grant of Water Line Area Easement on Serviant Parcel:
The Grantors, hereby grant and convey to the Grantees, and to its successors and assigns,
an easement in and on the Servient Parcel for a water line easement which is particularly
described as:
An area 20 feet wide and approximately 257.55 feet long as set forth and
described on the attached Appendix I Description/sketch, by Gastaldi
Land Survey dated Aug. 25, 2010.
This water line easement shall be for the purposes of installing, repairing and maintaining
a water line from the shared well located on Lot 7 to Lot 4 as noted on the attached
description and survey. This easement shall not in any manner be dedicated for. or
subject to, use by the public.
With the exception of the limitations described above. Grantor shall retain the
right to use the water line easement area for any purpose, not otherwise prohibited
by law or the covenants, conditions and restrictions applicable to the property,
provided that no action by Grantor or use of the waterline easement area shall
result in any obstruction being placed in this area that would prevent the
Dominate Parcel from being able to repair, replace, maintain the water line
servicing the Dominate Parcel.
3 Run With Land: The easements granted and created by this
Agreement are intended to and shall run with the land, with the benefit of
the easement appurtenant to the respective Dominant Parcel and the
burden of the easement appurtenant to the respective Servient Parcel.
4. Duration of Easement: The easement granted and created by this
Agreement shall be perpetual, except that this easement shall terminate if the Dominant
Parcel is connected to a private or public water system bringing in water from other than
the well on Lot 7 or a shared well from Lot 5, 5, or 8 Denali Vue Subdivision.
IN WITNESS WHEREOF, the parties have executed the Easement on the dates
indicated below.

NON -OBJECTION TO EASEMENT ENCROACHMENT DOCUMENT
By this document Matanuska Telephone Association, Inc. (MTA) declares that it has no objection to the
encroachment of a water (service) line within the 20' telecommunications and electric easement located upon
Lot 4, Denali Vue Subdivision, Plat No. 2005-145, Anchorage Recording District, Third Judicial District,
State of Alaska.
Please be advised that MTA through the issuance of this document does not forfeit any of its rights to the use
of the area cited. In the exercise of these rights MTA will, if needed, upgrade, maintain, repair, and/or replace
buried or aerial telecommunications facilities within the easement. Any repairs that may be required to the
encroachment as a result of utility construction will be borne by the property owner of record. This document
does not authorize the placement of any additional encroachments within the easement area. Property owners
are required to obtain utility locates before doing any kind of work in the utility easements and will be liable
for any damages caused by their construction work in the easements.
This document is in no way an agreement to vacate any portion of the utility easement and should not be
interpreted as such.

Dear Troy Davis Homes:
MEA has no objection to the encroachment of a copper water line buried at least ten feet deep located in
the utility easement as depicted on the attached as -built survey drawing, subject to the following conditions:
1. The improvement will in no way restrict or limit the current or future ability of MEA to fully enjoy the
benefits of the easement for any and all utility purposes that it presently enjoys under the easement.
2. MEA will be held harmless by the landowner from liability for any and all damages or injury to any
person or property that may result from the existing and future use of the easement by MEA, its
contractors, or assigns.
3. MEA will be held harmless by the landowner for any and all liability arising out of or relating to any use
of the easement by others under a Letter of Non -Objection.
4. The landowner will be liable for any damages caused to MEA facilities by the improvement in the
easement.
5. The landowner will be responsible for any special construction costs incurred by MEA due to the
improvement in the easement.
6. The landowner will assure compliance with all applicable safety codes relating to the improvement in
the easement.
7. Use of this letter by the landowner, their successors or assigns will constitute acceptance of these
conditions.
8. Alteration of these conditions shall invalidate this letter.
9. This letter is not effective unless it is recorded in the Anchorage Recording District before ownership of
the referenced property is changed from the above named landowner.

All construction must be in accordance with:
1. The attached approved design.
2. All requirements specified in Anchorage Municipal code Chapters 15.55 and 15.65 and the State of Alaska Wastewater
Disposal Regulations (18AAC72) and Drinking Water Regulations (18AAC80).
3. The wastewater code requires inspections during the installation. The engineer must notify the Development Services
Department at least 2 hours prior to each inspection. Provide notification by calling (907) 343-7904 (24 hours).
4. From October 15 to April 15, a subsurface soil absorption system under construction during freezing weather must either:
A. Open and Close on the same day.
B. Covered, sealed, and heated to prevent freezing.
1. The entire subsurface disposal field and/or alternate is not within a 30 foot radius of a
percolation test. The Engineer needs to do an additional percolation test prior to the construction
of the septic field. Please submit stamped and signed results with the As -built Inspection Report.
If the results require a design change, construction of the system will stop pending On -Site review
and approval. AMC 15.65.060.B.3 Two percolation tests needed.
2. The Inspection Report will not be approved without letters of non objection for the waterline in
the T&E easement.
3. The Inspection Report will not be approved until a copy of the community well easement for lot 7
is submitted.

Septic System Design and Permit Application
Impacts to Adjacent Properties
Dear Onsite Services Engineer
The owner of Lot 4, Denali Vue Subdivision intends to construct a new three-bedroom
home on the lot. We are therefore requesting a permit be issued for the construction of
a new septic system to accommodate the home. The attached Site Plan and backup
documentation identify the location and configuration of the proposed septic system
along with the alternate site. No existing wells or septic systems are closer than 150'
from the proposed septic system. Drainage arrows are shown on the site plan showing
the grade and direction of flow on the lot. The drainage pattern will not be changed as
a result of this project.
The test holes placed on the lot in the area of the absorption trench and alternate site
indicated sand and gravelly sand (GM/SM) with some silt. The percolation rate of the
soil was determined to be 8 minutes per inch. No groundwater was found and none
was noted during the monitoring period. An application rate of .8 gallons per day per
square foot was used in the design of the absorption system. We are proposing to
place a new 1,000 -gallon septic tank and a 57' long by 5' wide by 4' effective depth
absorption trench to treat and dispose of the effluent generated in the house. The
elevation of the distribution line in the absorption trench will be 4' below the surface and
the total depth will be 8'. A minimum of 3' of fill or 2" of insulation and 2' of fill will be
placed over the absorption trench and 4' over the septic tank.
The ground surface on the lot in the area of the absorption trench slopes to the
northwest at a grade approximating 22%. The new trench will be constructed parallel
with the slope as much as possible in conformance with Municipal requirements. The
new septic system will be constructed a minimum of 150' from the Class C well in the
area and 100' from any surface water and 10'.

If the system is constructed in accordance with our design the following statements
apply:
1. The system, if constructed as designed, will have no adverse impact on the wells
in the area or those to be constructed in the future.
2. The system, if constructed as designed, will have no adverse impact on existing
septic systems in the area or those to be constructed in the future.
3. The system, if constructed as designed, will have no adverse impact on reserve
space, either surface or subsurface, on any lots located in the area.
4. The system, if constructed as designed, will have no adverse impact on drainage
patterns in the area. The current drainage pattern will be maintained.

Dear Onsite Services Engineer:
Lot 4, Denali Vue Subdivision has limited area for construction of a septic system due
to a steep slope to the west and the placement of the large house on the lot. We have
located an area with acceptable soils, but it is situated slightly more than 14' from a
break in grade greater than 25%. The alternate site is 42' from a break in grade greater
than 25% and is included in the waiver. We are therefore applying for a waiver allowing
placement of the absorption trenches at the location shown.
The imaginary line placed 2.5' above the distribution line and extended down at a 25%
grade does not daylight at a distance less than 50' from the edge of the absorption
trench. No migration of septic effluent
soils. In addition, no development is
recommend the waiver be issued.

Septic System Design and Permit Application
Impacts to Adjacent Properties
Dear Onsite Services Engineer:
The owner of the subject property intends to construct a new four-bedroom home on
the lot. We are therefore requesting a permit be issued for the construction of a new
septic system to serve the home. Water will be furnished to the lot from the
neighboring Class C Well and water system. The proposed water service line is shown
on the attached Site Plan. No conflicts exist with adjacent septic systems or wells and
the proposed septic system on this lot. The attached Site Plan and backup
documentation identify the location and configuration of the proposed water service
line, septic system and alternate site. The current drainage pattern is identified on the
Site Plan. The drainage pattern will be maintained after development of this lot is
complete.
Test holes were placed on the lot during the subdivision phase of the project. These
holes indicated silty, sandy gravel (S1) in the area of the absorption trench and
alternate site. The accepting soils were tested and found to have a percolation rate of
between 1 and 5 minutes per inch. Groundwater was not encountered during the
original test hole placement, and none was noted on April 30, 1997. Our design
includes the placement of a new 1,250 -gallon septic tank along with a 50' long by 5'
wide by 4' effective depth absorption trench to collect and treat the sewage generated
in the house. The bottom of the trench will be 8' below the surface. The distribution
pipe will be 4' below the surface. A minimum of 3' of cover will be placed atop the
trench and a minimum of 4' of cover will be placed atop the new septic tank.
The ground surface on the lot slopes at varying grades toward the southeast. The
ground slope in the area of the absorption trench is approximately 15%. The
absorption trench will be constructed parallel with the slope of the ground surface as

much as possible in conformance with Municipal requirements. The new septic system
will be constructed a minimum of 100' from the well on this and on the adjacent lots. It
will also be constructed a minimum of 100' from any surface water in the area.
If the system is constructed in accordance with our design the following statements
apply:
The system, if constructed as designed, will have no adverse impact on the wells
in the area or those to be constructed in the future.
2. The system, if constructed as designed, will have no adverse impact on existing
septic systems in the area or those to be constructed in the future.
The system, if constructed as designed, will have no adverse impact on reserve
space, either surface or subsurface, on any lots located in the area.
4. The system, if constructed as designed, will have no adverse impact on drainage
patterns in the area. The current drainage pattern will be maintained.

ON-SITE WASTEWATER DISPOSAL SYSTEM
CONSTRUCTION AND MATERIAL SPECIFICATIONS
SUBJECT: LOT 4, DENALI VUE SUBDIVISION
GENERAL:
1. The scope of this project includes the procurement and placement of a new
1,250 -gallon septic tank at the location shown on the Site Plan. Work also
includes the construction of a new 50' long X 5' wide X 4' effective depth
absorption trench at the location also shown on the Site Plan. The
distribution line in the trench will be placed at 4' below the existing ground
surface. Total depth of the trench will be 8' below the existing ground
surface. A separation distance of 100' from all wells on adjacent lots and
100' between the septic tank and absorption trench and any surface water
must also be maintained. In addition, a separation distance of 10' between
components of the septic system and any water service line is required. A
minimum of 3' of fill is required over the absorption trench and 4' over the
septic tank. In lieu of the required fill 2" of insulation and 2' of fill may be
placed.
2. Construction shall be in accordance with the approved site plan, design
drawings, Municipal Permit with any special provisions or conditions, and all
applicable State and Municipal Wastewater Disposal Regulations.
3. The Contractor shall be responsible for obtaining all underground utility
locates and for the layout of the septic system and verification of the location
of all lot lines. The Contractor must also verify the location of wells in the
area and assure that the separation distances are met.
4. Unless specifically agreed otherwise, the contractor shall be responsible for
final grading areas subsequently depressed from soil settling. Property
owner shall be responsible for revegetation of affected areas unless
specifically agreed otherwise.
5. Contractors installing wastewater disposal systems must be certified by the
Municipal Department of Health and Human Services for system installations.
Owners installing their own systems must receive prior approval from
D.H.H.S. before beginning system installation.
SEPTIC TANK INSTALLATION
1. A new 1,250 -gallon septic tank must be procured from an approved source
and installed at the location shown.
2. A septic tank is to be constructed by a certified septic tank manufacturer.
Construction shall include two 4" cleanouts for pumping access.

3. The septic tank shall be sufficiently bedded to prevent settling or shifting of
the tank.
4. All standpipes on the septic tank shall extend a minimum of 12 inches above
final grade.
5. Tanks installed without 4' of cover shall have a minimum of 2" of direct burial
insulation.
6. A foundation cleanout shall be installed one to four feet from the building
foundation. Two cleanouts are required between the tank and the drainfield.
7. Final grading over the tank shall be such that a positive slope exists away
from the septic tank.
DRAINFIELD CONSTRUCTION:
1. The drainfield shall be constructed to the dimensions shown on the design.
The bottom of the trench shall be within 2" of level.
2. Distribution piping must be placed level with perforations down atop a level
bed of drainfield rock. Rock should then be placed over the pipe to provide a
minimum of 2" of cover.
3. A silt barrier or geotextile fabric must be placed between the drainfield rock
and the natural soil backfill.
4. Monitor tubes must be 4" in diameter and installed at the locations shown on
the design. The portion below ground must be perforated.
5. Contractor shall verify the septic tank and drainfield are a minimum 100' away
from any private water wells in the area, 150' from a Class "C" Well or 200'
from any community well.
6. Direct bury insulation must be placed over the distribution system if less than
3' of backfill depth is available. Finish grade over the trench must be
mounded to prevent settlement or depressions.
7. Grade area surrounding the absorption trench to drain away.
8. A minimum 2' of accepting soil is required below the drainfield rock for a 5'
wide trench. Contractor shall verify this condition prior to placement of the
rock. All pockets of unacceptable materials must be removed and replaced.

MATERIAL SPECIFICATIONS:
1. Septic tanks must be constructed by a Municipally approved septic tank
manufacturer.
2. The following pipe materials are approved for use in septic system
installations in the Municipality of Anchorage:
Cast Iron (perforated and solid), ASTM D3034 or P.V.C. (perforated and
solid), ASTM F810 or H.D.P.E. (perforated, but not solid) and ASTM D2662
or A.B.S. (perforated and solid).
3. Insulation shall be at least 2" thick extruded direct burial polystyrene (Dow
Chemical Co. Styrofoam HI or equal).
4. Septic tank inlets and outlets shall be fitted with watertight couplings
(Caulder, Fernco, or equal).
5. A permeable geotextile fabric (Typar, Mirafi or equal) must be installed
between the final drain rock layer and the native soil layer.
6. All drain rock shall be .5' to 2.5' in diameter with less than 3% passing the
#200 sieve.
INSPECTIONS:
Municipal Ordinance requires a minimum of two inspections. These inspections
must be conducted under the supervision of a professional engineer registered
in the State of Alaska. The first inspection must be conducted after the
excavation of trenches, beds or pits and before the installation of any gravel. A
septic tank may be set in place, but may not be backfilled.
The second inspection must be conducted after the placement of the geotextile
fabric, gravel, distribution piping, standpipes, cleanouts and insulation. No
backfill should be in place at the time of inspection.
Contractor shall provide a copy of all field survey layout and construction notes
for use in preparing the certified as -built of the completed system.
