Septic System Design and Permit Application
Impacts to Adjacent Properties
Dear Onsite Services Engineer:
The septic system on Lot 26A, Block 1H, Rabbit Creek Heights Subdivision has failed
and must be upgraded to obtain a Certificate of On Site System Approval (COSA) to
allow the sale of the house. We are therefore requesting a permit be issued for a new
septic system to serve the home. The available area for the new septic system is limited
by the presence of ground water close to the surface which makes it difficult to place a
conventional septic system. We therefore propose to place an Advantex Treatment
System on the lot to provide the most effective treatment of the septic effluent prior to
discharge into the surrounding soil strata. The location of the absorption system is
shown on the attached Site Plan. Drainage patterns are also shown on the plan and
will be modified somewhat as a result of the proposed construction. The ditch on the
south side of Marino Drive flows nearly year round with surface water always present.
Several septic systems on the street are currently closer than 100' from the ditch and
no waivers could be found in the Municipal archives. Apparently the water in the ditch
was considered seasonal in the past. A waiver request is attached to decrease the
separation distance from the ditch to the absorption bed to 39'.
Several test holes were placed on the lot, but only Test Hole No. 5 was found to be
workable. Ground water was found at a depth of 6' below the surface. The percolation
rate in the materials encountered was 60 minutes per inch. Our design provides for the
bottom of the absorption bed to be at 1' above the ground surface. The absorption bed
will be 50' long x 9' wide for a total of 450 square feet of absorption area. The
distribution line in the trench will be placed at 1.5' above the existing ground level. 2' of
fill and 2" of insulation will be placed above the bed and 4' over the septic tank to meet
Municipal Code and prevent freezing. The side slopes of the mound will be at 3:1 on
the south side and 2:1 on the north side. Extensive landscaping and fill will be required
to insure positive drainage away from the finished mound.

The ground surface of the lot slopes from the southwest to the northeast at a 5% slope.
The bed will be constructed parallel with the contours of the slope as much as possible
in conformance with Municipal requirements. All components of the new septic
system will be constructed a minimum of 150' from the Class C Well serving the lot and
100' from private wells in the area. No conflicts exist between the proposed septic
system and wells in the area.
If the system is constructed in accordance with our design the following statements
apply:
The system, if constructed as designed, will have no adverse impact on the wells
in the area or those to be constructed in the future.
The system, if constructed as designed, will have no adverse impact on existing
septic systems in the area or those to be constructed in the future.
The system, if constructed as designed, will have no adverse impact on reserve
space, either surface or subsurface, on any lots located in the area.
The system, if constructed as designed, will have no adverse impact on drainage
patterns in the area. The current drainage pattern will be maintained.

Dear Onsite Services Engineer:
Very little area is available for an absorption system on Lot 26A, Block 1H, Rabbit
Creek Heights Subdivision. The new system has been designed to be placed at the
front of the lot close to a slope greater than 4:1. We hereby request a waiver be issued
allowing the bed to be placed at this location. A polyethylene liner will be placed along
the edge of the bed to prevent effluent flow toward the slope and force the flow down
into the underlying soil.

Absorption Trench to Lot Line
Dear On Site Services Engineer:
Lot 26A, Block 1H, Rabbit Creek Heights Subdivision is plagued by groundwater at
shallow depths which restricts the area available for an absorption bed. Test holes
recently placed at the front of the lot indicate the groundwater is at sufficient depth to
support an absorption system. The system will be placed to encroach 5' into the right
of way and past the south property line. Soils at this location are gravel with silt which
is normally effective in the absorption and treatment of septic effluent. Placement of
the absorption trench 5' south of the southern lot line will not adversely affect
neighboring lots. The lot to the south is currently vacant and no area has yet been
found which will support an on site septic system. We hereby recommend a lot line
waiver be issued allowing placement of the absorption system 5' past the southern lot
line and into the Marino Drive Right of Way.

Absorption Bed to Surface Water Waiver
Dear Onsite Services Engineer:
Very little surface area is available for construction of a septic system on Lot 26A, Block
1H, Rabbit Creek Heights Subdivision due to high groundwater and dense subsurface
soils. We have located an area in the front of the lot which is located directly north of a
flowing ditch on the south side of Marino Drive. The proposed absorption bed will be
39' from the ditch. Several septic systems along Marino Drive are within 100' of this
ditch. In the past the ditch has apparently been classified as seasonal water. The
ditchline has been flowing all summer and a waiver is therefore necessary from the 100'
setback required by ordinance.
An Advantex Treatment System will be constructed on the lot which provides additional
treatment to the septic effluent. In addition, the surface drainage path is away from the
ditch at a 5% to 10% grade. If the system should ever overflow the effluent would
follow the natural drainage path away from the ditch. In addition, the elevation of the
ditch is now higher than the existing ground in the proposed area of the new absorption
bed.
The soils underlying the absorption bed are good. The likelihood of a failed septic
system and overflowing effluent are very Iow. Should the situation occur the flow is to
the northwest away from the surface water. We therefore recommend the waiver be
issued allowing the septic system to remain in its proposed location at 39' from the
surface drainage.

Backslope Waiver
Dear Onsite Services Engineer:
Very little area is available on the subject lot for placement of a septic system. The
area identified at the south end of the property is the only location found during a recent
field investigation. The backslope of the bed to the north must be 2:1 to prevent the toe
of slope from encroaching on the building and parking area. A polyethylene liner will be
placed along the edge of the north side of the bed to prevent effluent from migrating to
the north. In addition, jute mesh will be placed on the slope to the north to stabilize the
slope. Similar slopes in the area are much steeper and are now well stabilized with
only grass on the backslopes. We hereby request a waiver allowing the backslope to
be 2:1 rather than the required 3:1.

area identified at the south end of the property is the only location found during a recent
field investigation. The raised bed will be placed slightly askew from parallel to surface
contours. All organic material will be removed however and the bed leveled with coarse
sand or gravel. The entire bed will remain in the percolation zone. We therefore
request a waiver be issued to allow the bed to remain in its designed location.

The Municipality of Anchorage Development Services Department (DSD) issues Certificates of On-Site Systems
Approval (COSA) based only upon the representations given in paragraph 4 by an independent professional civil
engineer registered in the State of Alaska. Certificates of On-Site Systems Approval are required for the transfer of
title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or water
supply system. DSD also issues COSAs upon request to homeowners. Certificates of On-Site Systems Approval
are valid for 90 days from the date of issue for properties served by a private or Class C well and may be reissued
with new water sample results. (Certificates may be reissued for a period of up to one year with valid water
samples.) Certificates are valid for one year for properties served by Class A or B wells or a public water system.
The Municipality of Anchorage is not responsible for errors or omissions in the professional engineer's work.

ADVANCED WASTEWATER TREATMENT SYSTEM MAINTENANCE AND
REPAIR AGREEMENT
MEMORANDUM OF UNDERSTANDING
BETWEEN MUNICIPALITY OF ANCHORAGE
AND
THIS MEMORANDUM OF UNDERSTANDING made and entered into as of this

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Memorandum of Understanding agree as follows:
1. ADVANCED WASTEWATER TREATMENT SYSTEMS. Municipality
grants permission to Owner to utilize and operate an Advanced Wastewater
Treatment System (AWWTS), described as/~oJl/~ '~ ~, ~cce~+n,e~'~ -s'f3~edocated

2. Definitions.
A. Alteration. Any change to the design or function of an AWWTS that
Includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design. Prior to
performing any alterations to an AWWTS the owner must obtain a
Wastewater Disposal System Construction Permit from the Municipality
pursuant to Anchorage Municipal Code (hereinafter, "AMC") 15.65.
B. Certificate of On-Site Systems Approval. An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with AMC 15.65.
These approvals certify that the systems are adequate for the homes that
they support and meet the codes that were in place at the time of system
construction.
C. Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
D. Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included in
the original design which would allow the AWWTS to continue to
perform as designed.
E. Permit (Construction) An On-Site Wastewater Disposal System
Construction Permit as defined by AMC 15.65.
F. Permit (Operating) An Advanced Wastewater Treatment System
Operating Permit. An annual permit, issued by the Municipality, that
allows the Owner to operate an AWWTS, upon meeting all the
requirements of this agreement, the conditions of Operating Permit, the
requirements of the On-Site Wastewater System Construction Permit and
all relevant provisions of AMC 15.65
3. Fee. Owner shall pay to Municipality an annual fee of Z-ere
($ ~, c) .00), payable on or before the issuance of the operating permit and annually
thereafter. The annual fee is due on or before the anniversary date of the approval by the
Mtmicipality of installed system.
4. Term. The term of this Memorandum of Understanding shall be for the life of the
AWWTS.
The term begins on the date of approval by the Municipality of the installed system and
shall continue while the AWWTS system is in use or operational or until the property is
sold or title is transferred by owner and a new certificate of On-Site approval is issued to
the new owner or transferee of the property.
5. Alterations~ Installation and Removal of Additional Equipment. Owner agrees
not to make any alterations, removal of parts or additions to the AWWTS without a
Construction Permit from the Municipality.
6. Maintenance and Repairs.
A. Throughout the term of this Memorandum of Understanding, the Owner shall
maintain AWWTS in good repair. In addition, it shall be the responsibility of the
Owner during the term of this Memorandum of Understanding, and any extensions or
renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2)
maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs.
Further, Owner agrees to comply will all applicable ordinance, laws, regulations,
rules and orders for the AWWTS.
B. Owner agrees to provide the Municipality a written schedule of routine
maintenance and repairs which have been performed on the system pursuant to the
terms and conditions contained in the Owner's AWWTS Operating Permit. This
schedule shall be submitted to the Municipality annually upon the renewal of the
permit. The schedule of maintenance and repair contained in the Owner's AWWTS
Operating Permit is:
C. Owner acknowledges that the fine schedule for failing to maintain and repair an
AWWTS are codified in AMC 14.60.
D. Owner agrees that only maintenance, repair personnel certified by the
Municipality will inspect and make any necessary maintenance, repairs or permitted
alterations to the system.
E. Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS upon 24 hours written notice.
F. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On-Site Systems Approval.
G. Owner agrees that the relevant provisions of the standard specification guidebook
for AWWTS is the governing professional guidelines for the construction,
maintenance and repair of the Owner's AWWTS.
7. Nonwaiver. The failure of either party at any time to enforce a provision of this
Memorandum of Understanding shall in no way constitute a waiver of the provisions,
nor in any way effect the validity of the Memorandum of Understanding or any part
hereof, or the right of such party thereafter to enforce each and every provision
hereof.
8. Amendment.
A. This Memorandum of Understanding shall only be amended, modified or changed
by a writing, executed by authorized representatives of the parties, with the same
formality of this Memorandum of Understanding was executed and such writing shall
be attached to this Memorandum of Understanding as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this contract, the only authorized representatives of the parties are:

C. Any attempt to amend, modify, or change this contract by either an
unauthorized representative or unauthorized means shall be void.
9. Jurisdiction: Choice of Law. Any civil action arising from this Memorandum of
Understanding shall be brought in the Superior Court for the Third Judicial District of the
State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and
obligations of the parties under this Memorandum of Understanding.
10. Severabilit3,. Any provisions of this Memorandum of Understanding decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining provisions
of the Memorandum of Understanding.
