Box 196650, Anchorage, Ak 99519-6650 (907) 343-7904 Ref: Request for Well Waiver Amendment for Paradise Valley, Block 2, Lot 25, To Deb Wockenfuss: The referenced lot has many challenges and constraints due to the topography. The area we proposed to have the well drilled was found to be virtually impossible to drill at. The owner of the property is doing everything reasonable within his power to drill as far away from the proposed septic location as possible. This includes, moving material around and constructing a retaining wall that would allow the drill rig to get further back of the property. We are requesting you amend the well waiver already approved for 75 feet fi'om the proposed well to the proposed drainfield reserve site area to 75 feet to include the proposed drainfield reserve site area and the proposed primary drainfield and STEP tank. The following are mitigating factors for the justification of the waiver: We are proposing to use a MOA category III Nitrogen reducing Quanics Aerocell unit that will produce an effluent meeting State of Alaska DEC secondary standards. The system is an advanced treatment system which requires regular maintenance inspections. The downhill slope will be inspected during each site visit. Attached are two surrounding well logs. The well logs indicate that there is no shallow bedrock and the soil strata consist of sand, gravel, & clays. We were able to locate one water sample pulled in 1991 for Paradise Valley Block 2, Lot 27 and its nitrates level was 1 o3 mg/Lo A 75 foot waiver was already granted from the proposed well to the proposed drainfield reserve site area. I believe there is minimal risk associated with the grating of this waiver. See attached cross section drawing. The owner has requested that we revise the design for the following reasons; · The owner of the referenced property has recently re-graded his lot pushing the cutbank back. · The house and its location have been re-platted. · It was requested that we re-locate the proposed well location. The home owner informed us that he had met with you and you advised him that because of the challenges he faces with steep slopes that he could apply for a 75' waiver from the proposed well to the proposed septic system and/or proposed reserve site, so that he could place his well in a more reasonable location° The proposed 4 bedroom house is to be served by a private well and septic system. The topography of the lot dictates that the new drainfield be installed on the south end of the property. We are proposing to install a 1500 gallon SoT.E.P. tank with Quanics control/floats, a 650 Aerocell unit, and a bed type drainfieldo Two test holes were excavated on the property. The drainfield will be designed around the 30 foot radius of test hole #1. Depending on the elevation of the plumbing from the house, a pump vault may be necessary to transfer wastewater from the house to the STEP tank. Comments regarding the design are summarized as follows: 1. SOILS: See the attached logs which show the soil classifications, groundwater monitoring, and the percolation test results° 2. DRAINFIELD DESIGN: See attached design drawing for drainfield specifications. 3. SURFACE WATERS: There are no surface waters within 100 feet of the proposed septic system. 4. TOPOGRAPHY AND WAIVER REQUEST: As can be seen on the attached design drawing, the average topography below the drainfield is a 60+ percent slope, running approximately south to north. The proposed drainfield is currently residing 32' away from the top of the cutbank. We are requesting a 32' waiver be granted from the drainfield to the cutbank. As can be seen on the attached drawing, at a 25% slope (starting 2 feet above the invert of the drainfield) the potential point of daylighting is greater than 50' horizontally from the bed. The following are mitigating factors for the justification of these waivers: · We are proposing to use a MOA category III Nitrogen reducing Quanics Aerocell unit that will produce an effluent meeting State of Alaska DEC secondary standards in regards to BODS/TSS. Consequently, if effluent were to daylight, there is less potential for environmental impact~ · The system is an advanced treatment system which requires regular maintenance inspections. In short there is minimal risk associated with the grating of this waiver. See attached cross section drawing. 5. LOT LINE WAIVER REQUEST: We are requesting a 5 foot lot line waiver from both the proposed drainfield to the south lot line and the reserve drainfield from the south & west lot lines°. Due to the limited space and steep topography, placing the beds in the specified locations is the only viable optionsa The following are mitigating factors for the justification of the waiver: · We are proposing to use a MOA category III Nitrogen reducing Quanics Aerocell unit that will produce an effluent meeting State of Alaska DEC secondary standards in regards to BODS/TSSo Consequently, if effluent were to daylight, there is less potential for environmental impact° · The system is an advanced treatment system which requires regular maintenance inspections. The downhill slope will be inspected during each site visit. · Given the porosity of the soil, there should be rapid downward migration and minimal lateral migration of the effluent. · There are no existing septic systems within 50 feet of the proposed drainfield or reserve site. 6. 75' WELL WAIVER REQUEST TO RESERVE SITE: Due to site constraints and the difficulties of accessing areas where the well can meet the separation of both the proposed septic system and the reserve drainfield site, we are requesting a 75' waiver be granted from the proposed well to the proposed reserve drainfield site area. The following are mitigating factors for the justification of the waiver: · We are proposing to use a MOA category III Nitrogen reducing Quanics Aerocell unit that will produce an effluent meeting State of Alaska DEC secondary standards in regards to BODS/TSS nitrate levels averaging less than 30 mg/L and fecal coliform levels averaging less than 20,000 Col/100 mL. · The system is an advanced treatment system which requires regular maintenance inspections. The downhill slope will be inspected during each site visit. · Attached are two surrounding well logs. The well logs indicate that there is no shallow bedrock and the soil strata consist of sand, gravel, & clays. · We were able to locate one water sample pulled in 1991 for Paradise Valley Block 2, Lot 27 and its nitrates level was 1~3 m~L. Maintenance, Repairs and Alterations. (Owner is required to read, understand and initial each section) Throughout the term of this Agreement, the Owner shall enter into a service agreement PW with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. It shall be the responsibility of the Owner during the term of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to $600). Owner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfield replacement. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability.
