SUBJECT: Lot 7, Block 4, Drake Subdivision Septic System Permit The proposed design for the septic system on Lot 7, Block 4, Drake Subdivision has not been affected by development in the area since it was originally issued. All conditions pertaining to the original design and permit remain in effect today. The subsurface soil conditions on the lot indicate a slow percolation rate. The original design and approved permit allowed a 24' wide absorption bed. The width was expanded from 15' to 24' to minimize the length required and to 'allow the entire bed to remain within the 30' radius of the test hole. Since the bed is pressurized and an Advantex Treatment System is being installed the width of the bed is appropriate for this application. The new owner of the property has executed a maintenance agreement and the original Wetlands Permit for the lot has been extended. We therefore recommend the septic system construction permit be renewed. MEMORANDUM DATE: September 19, 2006 TO: Deb Wockenfuss FROM: Mike Anderson, P.E. SUBJECT: Lot 7, Block 4, Drake Subdivision Well and Septic System Construction Permit We attempted to locate the wells adjacent to Lot 7 as accurately as possible and have added a note to the Site Plan stating the wells must be located along with their respective 100' protective radii prior to construction of the new septic system. In addition, the absorption beds can be moved 10' to the east and not conflict with the proposed driveway on the lot. If the well locations are found to conflict to the point requiring a design change, construction of the system will stop pending On Site review and approval. Additional percolation testing will also be accomplished during construction of the septic system. Again, if the results require a design change, construction of the system will stop pending On Site review and approval. MEMORANDUM DATE: September 8, 2006 TO: Deb Wockenfuss FROM: Mike Anderson, P.E. SUBJECT: Lot 7, Block 4, Drake Subdivision Well and Septic System Construction Permit Attached is a revised Site Plan for the subject lot. We have changed the orientation of the lots to the west and added wells on each lot. The well on Lot 8B was constructed this summer. No permit could be found to provide further information. The absorption beds have been moved to be outside the protective radii for these wells. A wetlands permit has been procured for the lot and is provided for your use. In addition an Advanced Wastewater Treatment System Maintenance and Repair Agreement has also been signed and is attached. Groundwater levels have remained stable since our monitoring in July. An Advantex Treatment System has been designed for the lot which can be placed within 2' of the groundwater level if necessary. Based on our observations we are confident the bottom of the absorption bed will not encroach closer than 2' to the groundwater. April 18, 2006 Municipality of Anchorage Development Services Department On-Site Water and Wastewater Program 4700 South Bragaw Street Anchorage, AK 99519-6650 Subject: Lot 7, Block 4, Drake Subdivision Septic System Design and Permit Application Impacts to Adjacent Properties Dear Onsite Services Engineer: The owner of Lot 7 Block 4, Drake Subdivision intends to construct a four-bedroom home on the lot. We are therefore requesting a permit be issued for a septic system to serve the new home. The soil conditions on the lot are marginal with percolation rates varying up to 120 minutes per inch. We have therefore decided to place an Advantex Treatment System on the lot to provide the most effective treatment of the septic effluent prior to discharge into the surrounding soil strata. The location of the absorption system is shown on the attached Site Plan. Drainage patterns are also shown on the plan and will not be modified as a result of the proposed construction. The test holes placed on this lot revealed peat and fill material to depths of 4' to 6' underlain by silty sand and gravel. The percolation rate in the materials encountered was less than 1 minute per inch in the SP strata of Test Hole No. I to 120 minutes per inch in the silt strata of Test Hole No. 2. Groundwater was found during the excavation at 8' below the surface and has risen slightly during monitoring. We have chosen to construct the absorption bed in the silty material near Test Hole No. 2 where the groundwater elevations have stabilized at lower levels. We are therefore proposing to place a four-bedroom Advantex Treatment System. The absorption bed will be 50' long x 24' wide. The distribution line in the trenches will be placed at 1.5' below the existing ground level. Approximately 2' of coarse sand will be required to replace the peat and fill material and to raise the bed to at least 4' above the groundwater. A minimum of 3' of fill will be placed over the bed and 4' over the septic tank to meet Municipal Code and prevent freezing. The grOund surface of the lot is basically flat near the location of the primary absorption bed with only a slight slope to the east. The bed will be constructed parallel with the slope as much as possible in conformance with Municipal requirements. If the system is constructed in accordance with our design the following statements apply: o The system, if constructed as designed, will have no adverse impact on the wells in the area or those to be constructed in the future. The system, if constructed as designed, will have no adverse impact on existing septic systems in the area or those to be constructed in the future. The system, if constructed as designed, will have no adverse impact on reserve space, either surface or subsurface, on any lots located in the area. Current As-Built attached (updated Nov, 2009). Anchorage General Permit Conditions: General conditions: Water Quality Certification. You must comply with all conditions specified as part of the Alaska Department of Environmental Conservation Water Quality Certification, which is part of these General Permits (GPs). Historic and Archaeological Sites. These GPs do not authorize activities, including the use of material borrow sites, in or that adversely affect known historic properties listed or potentially eligible for the National Register of Historic Places, nor any such sites listed or found to be potentially eligible in the future. The permittee shall stop work when cultural resources are inadvertently discovered during the course of work and notify the Corps. The Corps will enter into consultation with the Alaska State Historic Preservation Office to determine if historic properties will be affected by the permitted work. Work shall resume after cultural resources have been evaluated pursuant to Section 106 of the National Historic Preservation Act. Inspections. You must permit the District Engineer, or his designated representatives, to inspect the authorized activity at any time deemed necessary to ensure that it is being, or has been accomplished in accordance with the terms and conditions of these GPs. Maintenance. You must maintain the authorized activity in good state, and in conformance with the terms and conditions of these GPs. You are not relieved of this requirement even if you abandon the authorized activity, although you may make a good faith or legal transfer to a third party, as described below. Should you wish to cease to maintain the activity or abandon it without a good faith transfer, you must obtain a modification of the GP authorization from the Corps Regulatory Branch either directly, or through Municipal Planning Staff. Such modification may require restoration of the area. Sale or Transfer of Property. If you sell or transfer the property associated with the authorized activity, you must obtain the signature of the new property owner as the transferee in the space provided on this document and submit a copy of that page to the Municipal Planning Department and/or Corps Regulatory Branch, along with appropriate documentation of the transaction. Project site restrictions and design criteria: Construction Timing Window. To protect nesting migratory birds, as required by the Migratory Bird Treaty Act, no work (i.e., clearing, grading, excavation, stockpiling, or placing of fill) may occur on the site between April 15 and July 15, unless: a) the site is sufficiently disturbed prior to April 15 to eliminate suitable nesting habitat; and, b) construction activity will occur continuously through June 15. Note: Clearing or other disturbance of the site prior to April 15 may require Corps or other authorization. Local Flooding. The project shall incorporate design and construction features/methods necessary to ensure that the proposed project will not cause flooding of adjacent properties or public infrastructure. Stormwater Functions. The applicant shall demonstrate that the project plans include sufficient measures to effectively replace the site's pre-project stormwater retention and filtration capacity. The measures shall be sufficient to approximate zero net runoff increase for storms with 2-year frequency and no more than two times net runoff increase for storms with a 10-year frequency, including flows from subdrains. Verification that the project's stormwater design meets this criterion must be obtained from the Municipal Wetland Management Section or its designee, and must be included with the GP application package. Project-specific conditions: Time Limit. GP authorization of this project expires on: November 2, 2011. If you need more time to complete the authorized activity, submit a request for extension under these GPs to the Municipal Planning Department prior to the expiration date. You may not continue work beyond the expiration date until receiving notification to that effect from the Municipal Planning Department or the Corps Regulatory Branch. Definitions. A. Alteration. Any change to the design or function of an AWWTS that Includes the installation or removal of any parts, components or pieces not included in the original construction permit and design. Prior to performing any alterations to an AWWTS the owner must obtain a Wastewater Disposal System Construction Permit from the Municipality pursuant to Anchorage Municipal Code (hereinafter, "AMC") 15.65. B. Certificate of On-Site Systems Approval. An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with AMC 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. C. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. D. Maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AWWTS that were included in the original design which would allow the AWWTS to continue to perform as designed. E. Permit (Construction) An On-Site Wastewater Disposal System Construction Permit as defined by AMC 15.65. F. Permit (Operating) An Advanced Wastewater Treatment System Operating Permit. An annual permit, issued by the Municipality, that allows the Owner to operate an AWWTS, upon meeting all the requirements of this agreement, the conditions of Operating Permit, the requirements of the On-Site Wastewater System Construction Permit and all relevant provisions of AMC 15.65 3. Fee. Owner shall pay to Municipality an annual fee of 75_~c6; ($ ~/ .00), payable on or before the issuance of the operating permit and annually thereafter. The annual fee is due on or before the anniversary date of the approval by the Municipality of installed system. 4. Term. The term of this Memorandum of Understanding shall be for the life of the AWWTS. The term begins on the date of approval by the Municipality of the installed system and shall continue while the AWWTS system is in use or operational or until the property is sold or title is transferred by owner and a new certificate of On-Site approval is issued to the new owner or transferee of the property. 5. Alterations~ Installation and Removal of Additional Equipment. Owner agrees not to make any alterations, removal of parts or additions to the AWWTS without a Construction Permit from the Municipality. 6. Maintenance and Repairs. A. Tl~oughout the term of this Memorandum of Understanding, the Owner shall maintain AWWTS in good repair. In addition, it shall be the responsibility of the Owner during the term of this Memorandum of Understanding, and any extensions or renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. Further, Owner agrees to comply will all applicable ordinance, laws, regulations, rules and orders for the AWWTS. B. Owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system pursuant to the terms and conditions contained in the Owner's AWWTS Operating Permit. This schedule shall be submitted to the Municipality annually upon the renewal of the permit. The schedule of maintenance and repair contained in the Owner's AWWTS Operating Permit is: x//~a ( I¥ C. Owner acknowledges that the f'me schedule for failing to maintain and repair an AWWTS are codified in AMC 14.60. D. Owner agrees that only maintenance, repair personnel certified by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. E. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. F. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On-Site Systems Approval. G. Owner agrees that the relevant provisions of the standard specification guidebook for AWWTS is the governing professional guidelines for the construction, maintenance and repair of the Owner's AWWTS. 7. Nonwaiver. The failure of either party at any time to enforce a provision of this Memorandum of Understanding shall in no way constitute a waiver of the provisions, nor in any way effect the validity of the Memorandum of Understanding or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 8. Amendment. A. This Memorandum of Understanding shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality of this Memorandum of Understanding was executed and such writing shall be attached to this Memorandum of Understanding as an amendment. B. For the purposes o.f any amendment modification or change to the terms and conditions of this contract, the only authorized representatives of the parties are: Anchorage: Purchasing Officer C. Any attempt to amend, modify, or change this contract by either an unauthorized representative or unauthorized means shall be void. 9. Jurisdiction: Choice of Law. Any civil action arising from this Memorandum of Understanding shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Memorandum of Understanding. 10. Severability. Any provisions of this Memorandum of Understanding decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Memorandum of Understanding.
