Ref: Separation Variance for Hunter Heights; Lot 1,
To whom it may concern:
We are requesting a 5.5 foot variance from the bottom of test hole to the bottom of system. The
following are mitigating factors:
• A MOA category III Nitrogen reducing Advantex unit that will produce an
effluent meeting State of Alaska DEC secondary standards in regards to
BODS/TSS is being used
The effluent will pass through 3 feet of imported sand before reaching the insitu
soil, which should remove all bacteria.
• The system is monitored 24/7
In short we do not see any concerns with granting this waiver. We are unaware of any adverse
impacts this waiver would have on adjacent wells or septic systems. If you have any questions,

1. Easement. Chugach is the grantee or user of an easement for the construction and
maintenance of electrical facilities, as f0ll0v,5:
Dedicated by the plat of the subdivision known as Hunter Heights Subdivision, according
to Plat Number 2007-63, recorded on the 21 st day of June 2007, on file in the office of the
District Recorder, Anchorage Recording District, Seward Meridian, Alaska,

herein "Easement") which pertains to the following described real property:
The North Ten Feet (N 10') of Lot One (1), Hunter Heights Subdivision, according to Plat

Recorder, Anchorage Recording District, Seward Meridian, Alaska.
Permittee acknowledges the validity of the Easement. Permittee warrants and represents that

2. Encroachment. Permittee has purchased or constructed the following improvements

A water well, that encroaches into said Easement a distance of approximately Four Peet
(4') for a distance of approximately One Foot (1'),
(herein "Encroachment").
3. permit. Chugach hereby authorizes Permittee to continue the existence of the
Encroachment in its existing location subject to the covenants set forth in this permit.
4. bndemnification. Permittee shall indemnify and hold Chugach harmless from any
claims for personal injury, property damage or other loss arising in any way from the continuation of
the Encroachment.
5. No E mansion or. Increase. Permittee shall not in any way expand or increase the
extent to which the Encroachment occupies any of the real property encumbered by the Easement
without the prior written consent of Chugach. Chugach has no obligation to provide such consent.
6. No Interest in Real Estate Acquired. Permittee hereby acknowledges that the
Encroachment and any additions thereto, even if in violation of this permit, has not and shall not in
the future give rise to any interest or estate in the real property subject to the Easement or any other
read. property. Without in any way limiting the foregoing, Permittee acknowledges that the
Encroachment is not adverse to any interest of Chugach and its continuation is entirely with the
permission of Chugach for purposes of the common law doctrine of adverse possession. This permit
creates no interest in the real property subject to the easement.
7. Mod leation of Utility Facilities. If the electric utility facilities located within the
Easement axe upgraded, added to, replaced or reconstructed, Permittee shall pay that portion of
Chugach's total costs for such modification which is reasonably attributable to accommodating or
preserving the Encroachment. If such payment is not made within thirty (3 0) days of written demand

well that encroaches into the platted Telecommunications & Electric easement on the north
10 feet of Lot 1, Hunter Heights Subdivision. The location of the well (approximately six
feet (6') south of the north property line) bisects the easement, and limits the ability of
Chugach to use the easement and maintain code clearance requirements for underground
electric cable.
Chugach will provide an Encroachment Permit subject to your completion of the following
requirement:
1. An additional. 10 -foot wide easement must be granted adjoining the south side of
the existing 10 -foot wide platted T & E easement on the north side of Lot 1, Hunter

discussions between yourself, Deb Wockenfuss and Susan Oswalt on '.Thursday, October
14, 2007.
We are requesting to utili7,e the platted bed area to the south of testhole #4 (S&S
Engineering 5/22/2007). Since this testhole has a 60 minute/inch percolation rate, we
have increased the application rate to 1 gallon/day/ft2 and reduced the amount of bed area
from 60 feet in length to 40 feet; the width remains 15 feet. The groundwater monitoring
ibr TH#4 shows no water to 4 feet_ Our plan is to excavate to a maximum depth of 2
feet, add a minimum of 2 feet of sand, and build the bed on the sand filter. The perimeter
of any sand filter or absorption field constructed above the top of the existing receiving
soils will be lined with an impervious material so no lateral flow of effluent occurs prior
to the native soils.

Hi, Susan. I visited your Bear Valley property this morning, with Thede Tobish, of the
Municipality. We met Dan & your son there. Thede & I looked around the property to
ascertain the accuracy of the wetland & stream mapping conducted for the property by a
consultant for Mr. David D'P.mato, the former owner. We confirmed the presence of a
portion of the wetlands mapped by the consultant (Travis -Peterson) & delineated those with
pink tape labelled "wetlands." This small area is in the north part of your property,
right on the line between the two lots.
There are seven delineation points, located on birch, alder or spruce trees or shrubs. We
did not find any streams crossing your property.
As I conveyed to Dan before I left, so long as your homebuilding activities do not involve
any disturbance of the soil surface (including mechanized landclearing) within the small
area of wetlands, EPA does not have any concerns with your proceeding with work on Lot 1.
The soil surface in the westernmost part of the wetlands has already been disturbed. I
advised Dan not to do any more work in that area, including grading. When we get to the
point of having Mr. D'P.mato reseed the disturbed areas on his property, we will assess
whether your plans can, as it appear, avoid the wetlands altogether, in which case we will
have you (or him) reseed them. If you find you need to disturb some of them for
construction of either home, please let me know.

The hunter heights subdivision is complete and the plat has been registered. Dan and I
now own Lot 1 and Lot 2 of hunter heights subdivision. Dan Rothe of the Municipality of
Anchorage has mapped the lots for streams and has found no significant water on either of
the lots in question.
S and S Engineering has designed septic systems for both lots that are acceptable to the
MOA.
As per our previous emails we understood that we need your permission to use machinery on
these lots. We are anxious to start construction upon your approval.
We would like to
request a confirmed statement from you as an approval for excavation.

In conducting this evaluation, GEG, LtD. attempted to provide a thorough,
conscientious engineering analysis of the system in accordance with ADEC and MOA
DSD Guidelines & Regulations. The reported results described the performance ofthe
system under the conditions encountered at the lime of the test, and separation
distances measured to readily identifiable features. The operational life of all wells and
septic systems depend on the local soils condition, groundwater levels that may
fluctuate during the year, and the water usage of the family being served by the system.
These conditions are outside the control of the evaluator of the system. Satisfactory test
results do not guarantee future performance of the system, nor do they guarantee that
there are no hidden defects or encroachments. GEG, LTD. can therefore not provide
any warranty or future estimate of how long the system will continue to meet the

ADVANCED WASTEWATER TREATMENT SYSTEM
MAINTENANCE AND REPAIR AGREEMENT
BETWEEN MUNICIPALITY OF ANCHORAGE

THIS MAINTENANCE AND REPAIR AGREEMENT made and entered into as of this

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Maintenance and Repair Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. Municipality grants permission to
Owner to utilize and operate an Advanced Wastewater Treatment System
(A W WTS), described as

2. Definitions. V
Alteration. Any change to the design or function of an A W WTS that
includes the installation or removal of any parts, components or pieces not
included io the original construction permit and design.
Certificate of On -Site Systems Approval (COSA). An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with Anchorage
Municipal Code (hereinafter, `'AMC") 15.65. These approvals certify that
the systems are adequate for the homes that they support and meet the
codes that were in place at the time of system construction.
Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included
in the original design which would allow the AWWTS to continue to
perform as designed.
Permit. An On -Site Wastewater Disposal Permit as required by AMC
15.65 to construct and operate an AWWTS,
3. Term. The term of this Maintenance and Repair Agreement shall begin on the
date of approval by the Municipality to operate the installed system or issuance of a
COSA, and shall continue while the AWWTS is in use or is operational or until the
proper .. is sold or title is transferred b� the owner and a new COSA is issuccl to the
new owner or transferee of the property.
4. Alterations Installation and Removal of Additional Equipment. Prior to
performing any alterations to an AW WTS, the owner agrees to obtain an On-site
Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65.
5. Maintenance and Repairs.
A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall
maintain their A WW"I'S in a satisfactory condition capable of producing treated
septic effluent in accordance with the equipments approval for operation in the
Municipality. The owner shall enter into a service aereementwith an AW W I S
service and maintenance provider approved by the municipality and the
manufacturer of the AW WTS for the entire term of the AW W rS. In addition, it
shall be the responsibility of the Owner during the term ofthis Maintenance and
Repair Agreement, and any renewals thereof, at the owners sole expense, to pay
for any and all: (I) repair(s), (2) maintenance. (3) adjusnneM(s), (4) replacement
costs, and (5) inspection costs.
B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules
and orders for the A W WTS.
C. Upon request by the Municipality, the owner agrees to provide the Municipality a
written schedule of routine maintenance and repairs which have been performed
on the system. When a record of maintenance is documented and maintained by
the system vendor, the owner agrees to allow the Municipality access to this
information.
D. Owner ackno+%led,_eS that the fine for failing to maintain and repair an AWNVI'S
may be assessed in accordance with AMC 14.60 for improper discharge.
E. Owner agrees that only maintenance and repair personnel approved by the
Municipality will inspect and make any necessary maintenance, repairs or
permitted alterations to the system.
E Owner agrees to grant the Municipality reasonable access to test and inspect the
AW WTS upon 24 hours written notice.
G. Owner agrees that any sale or transfer of title ofthe property will not occur
without a new Certificate of On-Site Systems Approval.
If. Owner agrees that the AW WTS installation and maintenance requirements as
provided by the AW WTS vendor/installer and approved by the Municipality arc
the governing guidelines for the construction, maintenance and repair of the
Owner's AW WTS.
6. Nonwaiver. The failure of either party at any time to enforce a provision of this
Maintenance and Repair Agreement shall in no way constitute a waiver of the
provisions, nor in any way affect the validity of the Maintenance and Repair
Agreement or any part hereof, or the right of such party thereafter to enforce each and
every provision hereof.
7. Amendment.
A. This Maintenance and Repair Agreement shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties, with
the same formality that this Maintenance and Repair Agreement was executed

B. For the purpose, of any amendment modification or change to the terms and
conditions of this agreement. the only authorized representatives of the parties
are:

C. Any attempt to amend, modify, or change this contract by either an unauthorized
representative or unauthorized means shall he void.
8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance
and Repair Agreement shall be brought in the Superior Court for the Third Judicial
District of the State of Alaska at Anchorage. The laws of the State of Alaska shall
govern the rights and obligations of the parties under this Maintenance and Repair
Agreement.
9. Severabilitv. Any provisions of this Maintenance and Repair Agreement decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining
provisions of the Maintenance and Repair Agreement.
