This permit is between Chugach Electric Association, Inc., an Alaska non-profit electric
cooperative, (herein"Chugach"), whose address is P. O. Box 196300, Anchorage, Alaska 99519 and
Merit Homes, LLC, (herein "Permittee'), whose address is 1920 W. Dimond Boulevard, Suite F,
Anchorage, Alaska 99515.
1. Easement. Chugach is the grantee or user of an easement for the construction and
maintenance of electrical facilities, as follows:
Described in that certain written instrument recorded on the 18th day of March 2011, at
Serial No. 2011-013334-0, on file in the office of the District 'Recorder, Anchorage
Recording District, Seward Meridian, Alaska,

(herein "Easement") which pertains to the following described real property:
The Southeasterly Twenty Feet (SE'ly 20') of Lot Thirty-one A (3lA), Block Nine (9),
Paradise Valley Subdivision, according to Plat Number 2011-25, recorded on the 19m day
of April 2011, on file in the office of the District Recorder, Anchorage Recording District,
Seward Meridian, Alaska,
Permittee acknowledges the validity of the Easement. Permittee warrants and represents that
Permittee is the owner of the fee simple interest in the land subject to the Easement and the
following described real property to which the Easement is adjacent:
Lot Thirty-one A (3lA), Block Nine (9), Paradise Valley Subdivision, according to Plat
Number 2011-25, recorded on the 19~h day of April 2011, on file in the office of the District
Recorder, Anchorage Recording District, Seward Meridian, Alaska,
(herein "Parcel").

2. Encroachment. Permittee has constructed or purchased the following
improvements on or within the real property subject to said Easement:
A septic system that encroaches approximately Three Feet (3') into said Easement for a
distance of approximately Fit~een Feet (15'), as shown on the As-Built by Gastaldi Land
Surveying, LLC dated November 7, 2011,
(herein "Encroachment").
3. Permit. Chugach hereby authorizes Permittee to continue the existence of the
Encroachment in its existing location subject to the covenants set forth in this permit.
4. Indemnification. Permittee shall indemnify and hold Chugach harmless from any
claims for personal injury, property damage or other loss arising in any way from the continuation of
the Encroachment.
5. No Expansion or Increase. Permittee shall not in any way expand or increase the
extent to which the Encroachment occupies any of the real property encumbered by the Easement
without the prior written consent of Chugach. Chugach has no obligation to provide such consent.
6. No Interest in Real Estate Acquired. Permittee hereby acknowledges that the
Encroachment and any additions thereto, even if in violation of this permit, has not and shall not in
the future give rise to .any interest or estate in the real property subject to the Easement or any other
real property. Without in any way limiting the foregoing, Permittee acknowledges that the
Encroachment is not adverse to any interest of Chugach and its continuation is entirely with the
.~:permission of Chugachfor.purposes of the common law doctrine of adverse possession.. This permit
creates no interest in the real property subject to the easement.
7. Modification of Utility_ Facilities. If the electric .utility facilities located within the
Easement are upgraded, added to, replaced or reconstructed, Permittee shall pay that portion of
Chugach's total costs for such modifcafion which is reasonably attributable to accommodating or
preserving the Encroachment. If such payment is not made within thirty 00) days of written demand
for same, Chugach may terminate this permit in accordance with paragraph 9, below.
8. Covenants Running with the Land. The obligations ofthe Permittee arising from this
permit shall be covenants running with the land which shall burden the Parcel and the Permittee's
interest in the land subject to the Easement and shall benefit the Easement.
9. Termination. Chugach may terminate this permit after the giving of thirty (30) days
written notice of such termination if:
a. The Encroachment is enlarged, increased or extended within the real property
affected by the Easement.

b. The Encroachmem is damaged by any means to an extent of more than thirty percent
(30%) of its replacement cost at the time of destruction.
c. Permittee fails to make the payment described in paragraph 7, above.
10. Term. This permit shall, if not sooner terminated by Chugach, expire forty (40) years
from the date hereof.
11. Entixe Agreement. This written permit constitutes the entire agreement between the
parties with respect to the subject matter hereof and supersedes all other prior or contemporaneous
agreements, oral or written, between the parties. No modifications, amendments, deletions, additions
or alterations of the permit shall be effective unless in writing and signed by all of the parties hereto.

Septic System Design and Permit Application
Impacts to Adjacent Properties
Dear Onsite Services Engineer:
The owner of Lot 31A, Block 9, Paradise Valley Subdivision intends to construct a new
three-bedroom home on the lot. We are therefore requesting a permit be issued for the
construction of a new well and septic system to accommodate the home. The attached
Site Plan and backup documentation identify the location and configuration of the
proposed septic system along with the alternate site. No existing wells or septic
systems are closer than 100' from the proposed well or septic system. Drainage arrows
are shown on the site plan showing the grade and direction of flow on the lot. The
drainage pattern will not be changed as a result of this project.
The test holes placed on the lot in the area of the absorption bed and alternate site
indicated gravel with sand and silt (GM/GP/GW). The percolation rate of the soil was
determined to be between 1 and 5 minutes per inch. Groundwater was found during the
placement of the test holes at 4.5' below the surface and remained at that elevation
during the monitoring period. An application rate of .7 gallons per day per square foot
was used in the design of the absorption system as filter sand or clean gravel will be
required to replace the organic material above the in situ soil. We are proposing to
place a new 1,250-gallon STEP tank and a 43' Long by 5' wide absorption bed to treat
and dispose of the effluent generated in the house. The elevation of the distribution
line in the absorption bed will be at the surface and the total depth will be 2'. A
minimum of 3' of fill or 2" of insulation and 2' of fill will be placed over the absorption
trenches and 4' over the STEP tank.
The ground surface on the lot in the area of the absorption bed slopes to the west at a
grade approximating 5%. The slope increases further to the west and south of the new
bed. The new bed will be constructed parallel with the contours of the slope as much

as possible in conformance with Municipal requirements. The new septic system will be
constructed a minimum of 100' from all wells and any surface water and 10' from the
proposed and existing water services in the area. The house and STEP tank will be
lower than the absorption bed with the septic effluent pumped to the absorption area
through a 1.25" PVC line.
If the system is constructed in accordance with our design the following statements
apply:
The system, if constructed as designed, will have no adverse impact on the wells
in the area or those to be constructed in the future.
The system, if constructed as designed, will have no adverse impact on existing
septic systems in the area or those to be constructed in the future.
The system, if constructed as designed, will have no adverse impact on reserve
space, either surface or subsurface, on any lots located in the area.
The system, if constructed as designed, will have no adverse impact on drainage
patterns in the area. The current drainage pattern will be maintained.

ON-SITE WASTEWATER DISPOSAL SYSTEM
CONSTRUCTION AND MATERIAL SPECIFICATIONS
SUBJECT: LOT 31A, BLOCK 9, PARADISE VALLEY SUBDIVISION
GENERAL:
The scope of this project includes furnishing and installing a new 1,250
gallon STEP Tank at the location shown on the Site Plan. Work also
includes the construction of a new 43' long by 15' wide absorption bed
also shown on the Site Plan. A 1.25" PVC line must be placed
between the lift station and the new absorption bed. The distribution
pipe for the bed will be placed at the ground surface. The total depth
of the bed will be 2'. A minimum of 3' of cover must be placed atop
the bed. A minimum of 4' of cover is required over the Septic Tank and
Lift Station. All disturbed areas must be revegetated after construction
is complete. A minimum of 1.5' of coarse sand or gravel must be
imported to replace the organic layer above the in situ gravel in the
bed area.
Construction shall be in accordance with the approved site plan,
design drawings, Municipal Permit with any special provisions or
conditions, and all applicable State and Municipal Wastewater
Disposal Regulations.
The Contractor shall be responsible for obtaining all underground utility
locates and for the layout of the septic system and verification of the
location of all lot lines. Contractor is also responsible to verify the
separation distance from the well on this and adjacent lots and from
surface water and streams in the area.
Unless specifically agreed otherwise, the contractor shall be
responsible for final grading areas subsequently depressed from soil
settling. Property owner shall be responsible for revegetation of
affected areas unless specifically agreed otherwise.
Contractors installing wastewater disposal systems must be certified
by the Development Services Department Building Safety Division On-
Site Water and Wastewater Program for system installations. Owners
installing their own systems must receive prior approval from the On-
Site Water and Wastewater Program before beginning system
installation.
SEPTIC TANK/LIFT STATION INSTALLATION
1. The 1,250-gallon STEP Tank must be obtained from a Municipally
approved septic tank manufacturer.

2. The septic tank shall be sufficiently bedded to prevent settling or
shifting of the tank.
3. All standpipes on the septic tank shall extend a minimum of 12 inches
above final grade.
4. Tanks installed without 4' of cover shall have a minimum of 2" of direct
burial insulation.
A foundation cleanout shall be installed one to four feet from the
building foundation. Two cleanouts are required between the tank and
the drain field.
6. Final grading over the tank shall be such that a positive slope exists
away from the septic tank.
DRAIN FIELD CONSTRUCTION:
1. The drain field shall be constructed to the dimensions shown on the
design. The bottom of the bed shall be within 2" of level.
Distribution piping must be placed level with perforations down atop a
level bed of drain field rock. Rock should then be placed over the pipe
to provide a minimum of 2" of cover.
3. A silt barrier or geotextile fabric must be placed between the drain field
rock and the natural soil backfill.
Monitor tubes must be 4" in diameter and installed at the locations
shown on the design. The portion below the distribution line must be
perforated.
Contractor shall verify the septic tank and drain field are a minimum
100' away from any private water wells in the area, 150' from a Class
"C" Well or 200' from any community well.
Direct bury insulation must be placed over the distribution system if
less than 3' of backfill depth is available. Finish grade over the trench
must be mounded to prevent settlement or depressions.
7. Grade area surrounding the absorption trenches to drain away.
A minimum 2' of accepting soil is required below the drain field rock for
a 5' wide trench. All pockets of unacceptable materials must be
removed and replaced.

MATERIAL SPECIFICATIONS:
The lift station must be constructed by a municipally approved septic
tank manufacturer. An Orenco 20 OSI 05 HHF-5 pump is
recommended. The tank must be equipped with an approved high
level alarm system meeting the requirements of AMC 15.65.030.
2. The following pipe materials are approved for use in septic system
installations in the Municipality of Anchorage:
Cast Iron (perforated and solid), ASTM D3034 or P.V.C. (perforated
and solid), ASTM F810 or H.D.P.E. (perforated, but not solid) and
ASTM D2662 or A.B.S. (perforated and solid).
3. Insulation shall be at least 2" thick extruded direct burial polystyrene
(Dow Chemical Co. Styrofoam HI or equal).
4. Septic tank inlets and outlets shall be fitted with watertight couplings
(Caulder, Fernco, or equal).
5. A permeable geotextile fabric (Typar, Mirafi or equal) must be installed
between the final drain rock layer and the native soil layer.
6. All drain rock shall be .5" to 2.5" in diameter with less than 3% passing
the #200 sieve.
FILTER SAND SPECIFICATION:
1. Material for Filter Sand must be classified as a masonry sand and
meet the following gradation:
50% or More Passing the No. 4 Sieve
2% or Less Passing the No. 100 Sieve
1% or Less Passing the No. 200 Sieve
INSPECTIONS:
Municipal Ordinance requires a minimum of two inspections. These
inspections must be conducted under the supervision of a professional
engineer registered in the State of Alaska. The first inspection must be
conducted after the excavation of trenches, beds or pits and before the
installation of any gravel. A septic tank may be set in place, but may not
be backfilled.
The second inspection must be conducted after the placement of the
geotextile fabric, gravel, distribution piping, standpipes, cleanouts and
insulation. No backfill should be in place at the time of inspection.

Septic System Feasibility Study
Dear Debbie:
The owner of Lots 31, 32 and 33, Block 9, Paradise Valley Subdivision intends to vacate
the interior lot lines and create one lot identified as Lot 31A, Block 9, Paradise Valley
Subdivision. The lots front along Bulgaria Drive and are accessed by driveway off of
Bulgaria Drive. The total area of the combined lots and the new Lot 31A is nearly
90,500 square feet.
The ground surface of the lots slopes from northeast to southwest at varying grades but
typically between 10% and 15%. A steeper slope of nearly 50% is located in the
southeast corner of the new lot. The septic system absorption trenches proposed for
the lot will be placed in areas where the surface slope is less than 15%. The separation
distance from the steep slope, however, will be less than 50' and closer to 40'. A
Category III Nitrate Reducing System is required for the lot and a separation distance
waiver to the steep slope may be required during the septic system permitting phase for
Lot 31A.
Test holes were placed on the proposed lot by S & S Engineering in October of 1995.
Water monitoring was completed through October 15 of that year and resulted in only
one area suitable for the construction of an absorption system. Water monitoring
completed on Februan/ 9, 2011 indicated the water levels were at levels lower than
those shown on the tests performed by S & S Engineering. The test hole utilized for
the reserve area was placed to a depth of 7' where bedrock was encountered. A
percolation cavity was prepared to determine the absorptive characteristics of the soils
encountered. The cavity was presoaked in accordance with Municipal requirements
and a percolation test performed. The results of the test are included in the attached

documentation. Groundwater as of this date is lower than 4' below the surface.
The proximity of groundwater to the surface will not allow the use of conventional gravity
flow septic systems on the lot. We therefore required the use of the Category 3 Nitrate
Reducing septic system like the Advantex Treatment System. In addition, any home to
be constructed on the lot will be limited to four (4) bedrooms through a plat note. An
application rate of 2 gallons per day per bedroom is allowed for the Category III System
for the percolation rates achieved. This compares with a .45 gallon per day per square
foot (GPD/SF) for a standard septic system. The reserve area required for a standard
septic system with an application rate of .45 GPD/SF is 16,000 Square Feet (SF). We
are proposing a reserve area of 8,000 SF which is half that required for a standard
system even though the application rate is 4 times greater which would justify a reserve
area of 4,000 SF. A note will be added to the plat concerning protection of the reserve
area from placement of driveways, parking areas or structures.
A study of the lots completed on February 9, 2011 indicated no groundwater in the area.
None of the ditches were flowing and no runoff was evident. Conversations with the
current owner of the lot indicate no surface water has ever been seen in the area with
the exception of minor runoff in the ditch line along the road after heavy storm events
and during spring runoff. This area is more than 100' from the reserve area proposed
for the lot.
Based on our field study and water monitoring completed to date it appears Lot 31A is
capable of supporting an onsite septic system and well. The size of the home to be
constructed on the lot must be limited to four (4) bedrooms. Additional test holes and
percolation testing will be completed during the permitting phase for development of the
lot. We are confident a suitable absorption area will be found on the lot if the area
shown is not utilized.
Copies of the test hole log, percolation tests, test hole location map and the contour
map showing the surface topography of the property are included for your use. We
hereby request your approval of Lot 31A, Block 9 Paradise Valley Subdivision as
designed with the septic system reserve area at the location shown.

Water Availability Study
Dear Debbie:
We have collected information on several wells in the area of the proposed Lot 31A,
Block 9, Paradise Valley Subdivision to estimate the possible depths and production
rates of wells to be constructed in the future. Field investigations indicate a combination
of wells constructed without the presence of bedrock and others indicating bedrock at
depths from 5' below the surface. In most cases the wells are shallow in comparison to
most wells in the Anchorage area with the deepest at 349' and the shallowest at 80'.
The wells located on Lots 1 and 35 to the northwest are 305' and 349' deep
respectively. In both cases bedrock was encountered at very shallow depths (5' and 7').
Water production rates in these wells are between .5 and .88 gallons per minute. The
wells on lots to the east are much shallower and produce greater volumes of water.
Bedrock is typically encountered at closer to 20' below the surface. Production rates
vary from 2.5 to 10 gallons per minute.

No development has yet occurred to the immediate east of Lot 31A.
Surface water in the form of Potter Creek runs through the area to the south of Lot 31A.
The presence of Potter Creek and the watershed area surrounding the Bear Valley area
contributes to the shallow aquifer apparently serving the area. Runoff from the
mountains surrounding the area is noted year round constantly replenishing the aquifer.
It is obvious from our study that the well to be constructed on Lot 31A in the future will
be placed to depths of less than 200' and will probably be founded in bedrock. The
depth of the bedrock is unknown, but may be less than 40'. The production rates will be
sufficient to support a four bedroom home and can be expected to be between 2 and 5
gallons per minute.
