S & S Engineering 17034 Eagle River Loop, Suite 204 Eagle River, Ak 99577 June 30, 1993 RE: Lots 38 & 39, Block 5, Rabbit Creek Heights Subdivision; Anchorage, Alaska ADEC Project Numbers 9321-DW-154-110 and 9321-VWV-154-098, Review Dear Mr. Shafer: This letter is in response to your submittal of June 3, 1993 which requested this Department to issue an approval for a holding tank to accept the domestic wastewate[ from two single family structures with two studio apartments. We have reviewed the submitted information, the EPA Design Manual entitled "Onsite Wastewater Treatment and Disposal System," the State Wastewater Disposal Regulations, and the Municipality of Anchorage Ordinances covering onsite wastewatbr disposal; and have discussed the submittal with staff of this Department and other agencies. This proposal, as submitted, can not be approved for the following reasons. First, MuniciPal Code, 15,65.070, as you know, prohibits new construction of single family structures where holding tanks would be the only means of sewage disposal. The Department of Environmental Conservation is obligated to recognize and comply with local municipal codes and be assured that any proposed system can and will be effectively maintained. Second, the holding tank proposed has all the attributes of a single family unit but with all the handicaps of a community system where no existing government authority or any other entity exists to assure continuous operation and maintenance. The State Wastewater Disposal Regulations, 18 AAC 72.220 (b) (5) states: "...for a wastewater system serving more than a single-family or duplex dwelling, documentation showing the existence, or formation before beginning construction of the system, of a local government organization, a homeowner's association, a private utility, a commercial entity; or other entity, the purpose of which is, or will be, to operate and maintain the system." This documentation was not included in the submittal. Robert A. Shafer 2 June 30,1993 Third, in completing a review of this project, it appears that the information is not'sufficient to exclude the possibility of onsite disposal. Under the Wastewater Disposal Regulations, 18 AAC 72.020, all means of onsite disposal.must be exhausted before a holding tank can be approved. As examples, the EPA design manual referenced above shows that if there is a useable soil strata 16 to t8 inches in depth with a groundwater problem as noted, the use of a curtain drain and a mound could be a solution to onsite subsurface disposal. In addition, the fact that in the deeper soil borings, another silty gravel strata was encounterd below nine feet that with the use of curtain drains could be used for the onsite treatment and disposal of wastewater. The analysis provided suggests that you and your client have limited the choice to either what is commonly known as a conventional onsite wastewater disposal system or a holding tank. This is a very limited view of the referenced regulations since it does not include the use of other subsurface domestic wastewater disposal systems. From the EPA Design Manual and data from a workshop in Seattle, Washington during September of 1992, it appears that other systems potentially are available for use. In regards to the proposed Class C Public Water System Source Well, until an acceptable solution to the wastewater disposal issue is reached, I do not believe that it is possible to approve the location. One item to be concerned with regarding the proposed well site is .the fact that the source could be classified as groundwater under the direct influence of surface water. If this occurs, additional treatment will be required. Thank you for your coordination with this Department. If you have any questions, please do not hesitate to contact me. Your permit expired on the date of issue basis by authority of Municipal Ordinance existing at that time. A new permit must be obtained from this Department for any well and/or on-site sewer system not installed by the expiration date. The new permit will come under the calendar expiration date ~s per the new Wastewater Ordinance (effective May 20, 1986). If you have drilled the well, a well log needs to be sent to this Department for documentation of the installation and to close the permit. If a private engineer inspected the installation of the on-site sewer system the orisinal as-built inspection report (three part form) must be sent to this office for review and approval, and for documentation. Ail septic systems constructed after the effective date of this ordinance are subject to the provisions of this ordinance. Our records ~how that you currently hold a permit for the installation of a septic system. We strongly urge that you contact this office prior to constructing your system. Any changes in the code that could impact the construction requirements of your septic system will be identified and brought to your attention.
