The Municipality grants permission to the Owner to utilize and operate an Advanced «'astewater Treatment System (AWWTS), described as14 located at (legal description) 2. Maintenance. Repairs and Alterations. Owner is required to read, understand and initial each section) f r Throughout the term of this Agreement, the Owner shall enter into a service agreement 4.Pn with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. It shall be the responsibility of the Owner during the term of this Agreement to pay for all ° repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to S600). ;,�?f Otivner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, /� repairs or permitted alterations to the system. _ Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or draintield replacement. Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. �- Owner agrees to maintain remote monitoring of the AWWTS as required by the t. AWWTS approval. 3. Term. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof'. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent. jurisdiction shall not invalidate the remaining provisions of the Agreement. We are proposing to install a 1500 gallon S.T.E.P. tank with Quanics control/floats, a 650 Aerocell unit, and a deep trench type drainfield. One test hole was excavated on the property. The dralnfield will be designed around the 30 foot radius of the test hole. Comments regarding the design are summarized as follows: 1. SOILS: See the attached logs which show the soil classifications, groundwater monitoring, and the percolation test results. 2. DRAINFIELD DESIGN: See attached design drawing for drainfield specifications. 3. SURFACE WATERS: There are no surface waters within 100 feet of the proposed septic system. 4. TOPOGRAPHY AND WAIVER REQEST: As can be seen on the attached design drawing, the average topography in the area of the proposed drainfield is relatively flat. However, two major cutbanks exist within 50' of the proposed drainfield.. The proposed drainfield will reside 25' from a 30% cutbank, and 35' from a 53% (at steepest point) cutbank. As can be seen on the attached profile drawings, there is no potential point of daylighting within 50' of the proposed dralnfield. The following are mitigating factors for the justification of these waivers: · We are proposing to use a MOA category III Nitrogen reducing Quanics Aerocell unit that will produce an effluent meeting State of Alaska DEC secondary standards in regards to BODS/TSS. Consequently, if effluent ~vere to daylight, there is less potential for environmental impact. · The system is an advanced treatment system which requires regular maintenance inspections. The downhill slope will be inspected during each site visit. · Given the porosity of the soil, there should be rapid downward migration and minimal lateral migration of the effluent. · The slope is highly vegetated which will prevent erosion and inhibit surface daylighting. In short there is minimal risk associated with the grating of this waiver. See attached cross section drawing. 3701 E. REQUEST FOR 50' WELL RADIUS WAIVER: Due to site constraints, we are requesting a 50 foot waiver from the existing well to the proposed drainfield. The following items are justification for granting this waiver: · We are proposing to use a MOA category III Nitrogen reducing Quanics Aerocell unit that will produce an effluent meeting State of Alaska DEC secondary standards in regards to BODS/TSS. · The well casing was recently inspected via camera and found to have no perforations. · A recent water sample indicates no presence of bacteria, and non-detectable levels of nitrates. · Attached are several well logs from surrounding properties. There appears to be a consistent layer of hardpan or clay approximately from 10 to 40 feet below the surface in the immediate area. Also, it appears that further north, the layer of hardpan and imperbeable clay becomes deeper. This indicates the underground impermeable layers slope downward to the north, which is away from the well. Based on these facts, we believe there is minimal risk in granting this waiver. 6. REQUEST FOR VARIANCE IN PROCESS: Part of the proposed trench absorption area will lie in an un-perc'ed soil strata. As can be seen on the soil log, the layer that was not tested is a layer of very well graded sand beginning at 7 feet below the surface. The only way to create an accessible perc bench that would not pose a life threatening hazard, would be to make the testhole approximately as wide as it would be deep. This would disturb the native soils in the limited area where the trench is intended to be placed. A soil sample was taken from this strata and visually analyzed. We believe this layer of soil will accept water at an equivalent or faster rate of the strata above it. 7. LOT LINE WAIVER REQUEST: The proposed reserve site will be approximately three feet from the property line. We are requesting a one foot lot line waiver from the proposed reserve site to the west lot line. We are unaware of any adverse impacts this would create for neighboring wells or septic systems. In consideration of the mutual covenants contained herein, the parties to this Agreement agree as follows: 1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as vr,{..,,,,c ' `>,,,1 located at (legal description) 2. Maintenance, Repairs and Alterations. (Owner is required to read, understand and initial each section) Throughout the term of this Agreement, the Owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. It shall be the responsibility of the Owner during the term of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to $600). Owner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfield replacement. (rev. 05/18/2018) Pagel of 3 Owner acknowledges that the Municipality may request records of maintenance and repairs from the manufacturer's representative or maintenance provider. Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be assessed in accordance with AMC 14.60.030. �> Owner agrees to grant the Municipality reasonable access to test and inspect the f AWWTS. The Municipality will give at least 24-hour notice. Owner agrees that any sale or transfer of title of the property wilt not occur without a new Certificate of On -Site Systems Approval. Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. Owner agues to maintain remote monitoring of the AWWTS as required by the AWWTS approval. 3. Term. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement.
