Septic system design
Dear On-Site Services Engineer:
The owner of the above lot has a 4-bedroom system that has reached end of life. The attached site
plan identifies the location of the home as well as the new septic location. Due to separation to
wells the new system will need to be advanced treatment. No conflicts exist between this proposed
system and any other well or septic system, whether on this lot or adjacent lots.
The ground surface on the lot is generally mild, sloping towards the street. There is a flat grassy
area just before the street, it is in this area that the new septic system is located. There is a short
section of slope exceeding 25% within about 15 feet downslope of proposed design, but it is only
5’ high and the attached slopes analysis shows that it will not cause daylighting. Contours are
shown on the site plan showing the grade and direction of flow. Stormwater drainage will not
impact this septic system. The new trench will be constructed parallel to the slope as much as
possible.
Wells on this and adjacent lots are shown. The new system will be a minimum of 50’ from all
wells and surface water, and more than 5’ away from the septic tank. Please refer to the attached
test hole logs, plan and profile pages for the septic design. If this design is followed, there will be
no adverse impacts to adjacent properties.

ADVANCED WASTEWATER TREATMENT SYSTEM
MAINTENANCE AND REPAIR AGREEMENT
THIS MAINTENANCE AND REPAIR AGREEMENT, herein the "AGREEMENT" made and
entered into as of this -9 Day of Ay G of 20 P, V , by and between
// /X R S rA. I-' Ar , herein the "OWNER," and the Municipality of
Anchorage, herein the "MUNICIPALITY", in accordance with Anchorage Municipal Code
(AMC) 15.65.365. In consideration of the mutual covenants contained herein, the parties to this
Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS),

2. Maintenance, Repairs and Alterations.
(Owner is required to read, understand and initial each section)
Throughout the term of this Agreement, the Owner shall enter into a service agreement
with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.
It shall be the responsibility of the Owner during the term of this Agreement to pay for all
repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically $400 to $600).
,A;`� Owner agrees that only maintenance and repair personnel approved by the Municipality
or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.
Owner acknowledges that regular maintenance of an AWWTS reduces the potential
failure of the system, which could include sewage backup and costly repairs or drainfield
replacement.

Owner acknowledges that the Municipality may request records of maintenance and
repairs from the manufacturer's representative or maintenance provider.
Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be
assessed in accordance with AMC 14.60.030.
Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS. The Municipality will give at least 24-hour notice.
i�� Owner agrees that any sale or transfer of title of the property will not occur without a new
Certificate of On -Site Systems Approval.
Owner agrees that the AWWTS installation and maintenance requirements as provided
by the AWWTS vendor/installer and approved by the Municipality are the governing
guidelines for the construction, maintenance and repair of the Owner's AWWTS.
Owner agrees to maintain remote monitoring of the AWWTS as required by the
AWWTS approval.
3. Term. The term of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any part hereof, or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be
brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the
parties under this Agreement.
7. Severability. Any provisions of this Agreement decreed invalid by a court of competent
jurisdiction shall not invalidate the remaining provisions of the Agreement.

Subject: Timberlux Subdivision #2, Block H Lot 7 – 15001 Longbow Drive
Neighboring Well to Septic System Waiver
Dear On-Site Services Engineer:
The existing absorption tank on Lot 7, Timberlux Subdivision #2 is located 93’ from the existing
well on Lot 6 at its closest point. Additionally, the center of the existing absorption trench may be
as close as 85’, although there are no standpipes to mark the trench’s exact location. The septic
system on Lot 7 was originally constructed in 1983 and has been in constant operation since that
time. However, the well on Lot 6 was placed two years earlier, in 1981. A waiver is therefore
required to allow the absorption trench on Lot 7 to remain in its constructed location less than 100’
from the well.
The trench is downslope from the well with drainage to the southwest toward Longbow Drive.
Septic effluent that might surface from the trench would flow away from the well at a surface grade
of more than 10%. The well log indicates a depth of 137’ deep and the static water level of 38.5’
below the surface, and clayey gravel from 0’ to 134’. The well log for Lot 7 shows similar material.
This material is typically impermeable. We are confident based on the aforementioned
characteristics of the lot surface along with the well construction through clayey material that the
reduction in the protective radius of the well to 85’ will not impact the quality of water from the
water system.
Additionally, a water sample taken from the well on Lot 6 in 1999 records a nitrate content of 0.24
milligrams per liter, which would indicate that even after 16 years the well is not influenced or
contaminated by the tank or absorption trench on Lot 7. We therefore request a waiver to reduce
the separation distance from the well on Lot 6 to 85’.

Dear Mr. & Mrs. Matthews:
During a recent evaluation of the wastewater system and water well on Lot 6 Block H
Timberlux #2 Subdivision, the engineer performing the evaluation discovered that the
well serving the home on this property is being encroached upon by the wastewater
system serving the home on lot 7. According to our records you are the owner of lot 7.
The separation distance is 95 feet. The required separation distance is a minimum of
100 feet for a private well to a wastewater system. This is in violation of Chapter 15.65,
The Municipality of Anchorage On-Site Wastewater Disposal Ordinance.
The existing well on lot 6 was constructed in October 28, 1981 and the wastewater
system on lot 7 was constructed in December 7, 1983. Because the well on lot 6 was
place at the time the wastewater system on lot 7 was constructed, makes the
responsibility of resolving this encroachment matter the property owner of lot 7.

MAINTENANCE AND REPAIR AGREEMENT
THIS MAINTENANCE AND REPAIR AGREEMENT, herein the "AGREEMENT" made and
entered into as of this Day of 000 -of 20, by and between
herein the "OWNER," and the Municipality of
Anchorage, herein the "MUNICIPALITY", in accordance with Anchorage Municipal Code
(AMC) 15.65.365. In consideration of the mutual covenants contained herein, the parties to this
Agreement agree as follows:
1. .Advanced Wastewater Treatment S stems. The Municipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS),
described as Advantex System
located at (legal description)
Timberlux #2, Block H Lot 7
2. Maintenance, Repairs and Alterations.
(Owner is required to read, understand and initial each section)
Throughout the term of this Agreement, the Owner shall enter into a service agreement
with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.
Id It shall be the responsibility of the Owner during the term of this Agreement to pay for all
repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically $400 to $600).
40 Owner agrees that only maintenance and repair personnel approved by the Municipality
or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.
Owner acknowledges that regular maintenance of an AWWTS reduces the potential
failure of the system, which could include sewage backup and costly repairs or drainfield
replacement.

40 Owner acknowledges that the Municipality may request records of maintenance and
repairs from the manufacturer's representative or maintenance provider.
16 Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be
assessed in accordance with AMC 14.60.030.
Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS. The Municipality will give at least 24-hour notice.
Owner agrees that any sale or transfer of title of the property will not occur without a new
Certificate of On -Site Systems Approval.
Owner agrees that the AWWTS installation and maintenance requirements as provided
by the AWWTS vendor/installer and approved by the Municipality are the governing
guidelines for the construction, maintenance and repair of the Owner's AWWTS.
Owner agrees to maintain remote monitoring of the AWWTS as required by the
AWWTS approval.
3. Term. The term of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any part hereof, or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be
brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the
parties under this Agreement.
7. Sevcrahilih% Any provisions of this Agreement decreed invalid by a court of competent
jurisdiction shall not invalidate the remaining provisions of the Agreement.

Dear Mr. Matthews:
Pursuant to your request, I have performed a cursory inspection
of the on-site septic system for the above-referenced property.
It is my understanding that the need for this inspection arises
from the fact your lending institution requires a health
authority approval for your new home be current within six
months. Even though the Municipality considers the 'health
authority approval for a new septic system to be valid for two
years, they will not issue a new health authority approval
without a new inspection. It is noted that the Municipality's
current Health Authority Approval for the above-referenced
property was issued July 9, 1984.
On Wednesday January 9, 1985, I accompanied you to the site and
performed an inspection of the septic system. The following
observations are made:
all required standpipes, as shown on the as-built survey,
dated 6-15-84, are in-place, extend 1-foot or more above
ground, and are capped.
visual inspection indicates that standpipe locations (5)
and location of existing well are as shown on the as-built
survey, dated 6-15-84.
- distance between septic tank and end-of-trench standpipes
is approximately 68 feet.
- distance between septic tank standpipe and existing well
is approximately 105 feet.

- as noted on the Health Authority Approval, dated July 9,
1984, the driveway crosses over the drainfield, however,
the driveway appears to be 2 or more feet above the
original ground in this location.
- there is no depression over the septic tank or the
drainfield at the time of this inspection and there is
positive surface drainage away from these components.
During the course of this inspection, I have reviewed the
following documents which you furnished:
- MOA DHEP Health Authority Approval Certificate, dated July
9, 1984.
- MOA DHEP On-site Sewage Disposal System Inspection Report,
dated December 7, 1983.
- MOA DHEP letter, dated November 22, 1983, Subject: Lot 7,
Block H, Timberlux #2 As-built.
- MOA DHEP On-site Sewer Permit #830404, issued 5-18-83, and
revised 9-19-83.
Based on this cursory site inspection and review of these
documents, there appears to be no conflict between the on-site
septic system and the above documents.
It should be noted that no inspection was made of the below
ground conditions, including the septic tank and the drainfield
trench, and no conclusion or certification extends to the
condition, size or integrity of these components of the septic
system. No conclusion extends to any component of the system not
specifically reported above.

Subject: Insulation Requirements for On-site Sewer Systems
This will confirm our recent telephone conversation regarding
the recent revision to our proceedure of on-site wastewater
disposal facilities. In the 1983 revised proceedure, it is
now the policy of the Department of Health and Environmental
Protection to require that all septic tanks be insulated with
a top cover or sheet of insulation prior to the placement of
the final fill. It will also be required that all connecting
lines and disposal trenches/drainfields/beds with less than
three(3) feet of top cover be similarly insulated.
The insulating material must be:
Two(2) inches thick high density burial type styrofoam,
or rigid polystyrene, or equivilant. All insulation
must have a water absorption of not greater than 1% by
volume,, and with a compressive strength of not less than
35 PSI.
This information is being availed so that you may decide whether
or not to have the insulation in stock during this coming
construction season.
