The proposed septic system is designed to serve a proposed 1-bedroom home. The design specifies advanced wastewater treatment using a BioMicrobics BioBarrier 0.5 Membrane Bio-Reactor(BB-MBR). The lot is steep with a creek running through it. Due to the steep slopes, creek setback and location of both the proposed house and existing private well, a septic tank to well waiver is required (requested below). The design calls for a gravity sewage line exiting the house above the basement/garage floor elevation. There will be a lift pump inside the house to lift any sewage generated in the basement/garage up to the aforementioned gravity sewage line. The septic tanks are located less than 5 feet from the south side of the house and 30 feet from the private well. A waiver is requested below. The septic system's subsurface drain is located east of the house and meets all separation distance requirements. The proposed design is based on recently completed onsite soils testing(see the plan view and soils log for TH1). Design criteria for the proposed subsurface drain are shown on the Site Plan. Given the very limited available space to locate a septic system on the lot, the design was not able to satisfy all of the code required separation distances. However, the proposed design does provide an environmentally safe and reliable method of septic treatment for the owner. The following separation distance waivers are requested and justified: 1. In the unlikely event that the plastic septic tanks begin leaking,and in conjunction with their close proximity to the house footing drain, which in turn is approximately 5' to 10' from the private well at the northwest building corner, the footing drain is required to be graded to drain to the southwest building corner and out away from the building and well (see design Plan for details). 2. The well has been drilled and its location is shown on the revised design (attached). In the new onsite water and wastewater code section 15.65.210, Paragraph B, Section 4 it states "(a deep trench) may be installed on a slope greater than 25%, but less than 46% if it complies with the following conditions...:". The proposed drainfield (in the original permitted design) meets all but two of the requirements. Downgradient of the proposed drainfield (approximately 70 feet) there is a driveway with a cut approximately 3-6 feet of elevation change. Due to this fact, we are requesting a variance to the proposed code in allowing the drainfield to be installed within 50 feet of slopes greater than 46%. The existing permit was issued with the driveway cut, however, fill had to be added within 35 feet of the proposed drainfield to reduce the existing slope below 25% (currently 28-33%). However, under the new code, we are requesting that this requirement (on the proposed design with this letter) be waived and allow the drainfield to be installed without the addition of fill. Justification for granting this variance are as follows: • The existing design was approved with the driveway cut. Based upon the existing code at the time of design, a cut greater than 50 feet away was not addressed. • The percolation rate was 7 min/inch. It is reasonable to assume the effluent will move faster vertically vs horizontally. • A theoretical line drawn 2 feet above the top of rock at 46% slope does not intersect the driveway until approximately 70 feet. • The design was modified so that the top of the drainrock would be a minimum of 36" below grade, meeting MOA code requirements (see attached design). The lot owner is planning to build a 3 bedroom house on the property that will be served by a private well and septic system. Due to surface waters on the property, the 100 foot setbacks from these surface waters, and slopes in the area greater than 25%; the only available area to install a septic system is on Lot 2, which is owned by a different person, Suzanne Doolen. Because of these conditions, we are also proposing that a Quanics~'~system be installed to minimize the drainfield size. Two test holes were excavated on Lot 2 in 2007 for the purpose of developing Lot 1. The drainfield will be designed around the 30 foot radius of test hole #2. In order to develop Lot 1, ingress/egress easement on Lot 2 as shown on the attached site plan and design drawings must be granted and recorded with the State of Alaska. A sewage pump basin also must be installed in the house and must be sized accordingly to pump all wastewater from the house up to the proposed sewer system that will be located on Lot 2. Comments regarding the design are summarized as follows: 1. SOILS: See the attached log which shows the soil classifications, groundwater monitoring, and the percolation test results. 2. DRAINFIELD DESIGN: See attached design drawing for drainfield specifications. 3. SURFACE WATERS: There is a surface stream located on Lot 1 that runs East to West through the middle of the property. Based upon the MOA wetlands mapping, there is also a stream feature that supposedly exists in the road right-of-way for the undeveloped Shelli Drive. We made several site visits to the property and found this "stream feature" (i.e. swale) to not have any visible water in it. In order to insure separation distance are met to surface waters, the 100 foot setbacks to surface waters must be staked/flagged by a registered land surveyor prior to any construction. 4. TOPOGRAPHY AND SLOPE WAIVER: Based upon the topographical information provided S4 Group, the slopes for the proposed drainfield ranges from 28 to 33 percent running approximately East to West. Permitted Users of the Easement shall have the non-exclusive right to use the easement, free of charge, for purposes of (a) installing and maintaining a private septic system in the area depicted on the drawing attached hereto ~as Exhibit A and marked "Proposed Septic System," (b) utilizing for ingress and egress to the Proposed Septic System approximately 235 feet of the driveway for Lot 2 in the area depicted on Exhibit A and marked "Driveway for Lot 2," and (c) constructing and maintaining for ingress and egress to the Proposed Septic System a road access in the area depicted on Exhibit A and marked "Potential Road Access for Proposed Septic System." These uses shall be referred to herein as the "Permitted Use." 4. Conditions Concerning the Easement and the Permitted Use. (a) All work shall take place within the three (3) areas of the Easement. (c) Grantee shall timely pay all contractors performing work on the easement so that no liens are filed against Lot 2. (d) All work on installing the Septic System and consla'ucting the Access Road shall only occur during the months of April through September to limit the impact on the Driveway for Lot 2 during winter conditions. (e) All work on the Septic System and the Access Road shall be done at all ..... times- si> as not t6- damage Lot 2 and the improvements thereon, including but not limited to the Driveway for Lot 2 and the culvert that runs under the driveway. Grantee shall be responsible to repair any such damage including but not limited to returning the driveway to its condition before the commencement of work, and /ncluding repair and maintenance work performed after the Septic System is installed and'the g-ccess Road is completed. (f) All work on the Septic System and the Access Road shall be done so that any water draining from these areas is channeled to the culvert that runs under the Driveway for Lot 2. (g) All work on the Septic System and the' Access Road shall be done so that Grantor shall at all times have the ability to utilize the Driveway for Lot 2. (h) All trees, if any, cut down during the installation of the Septic System and the construction of the Access Road that can be utilized for firewood shall be neatly stacked for use by Grantor in an area close to the Easement to be mutually agreed upon by Grantor and Grantee. All other trees, alters, tree stumps and other debris generated during the installation of the Septic System and the Access Road shall be removed from the Easement and Lot 2. (i) The area reserved for the Septic System shall be reseeded to prevent erosion and shall be returned as much as possible to its original state. (j) The private septic system shall comply with all Municipality of Anchorage regulations and ordinances and with the Sta~e of Alaska Grant of Easement and Agreement -Page 3 Page 3 of ? 201§- 055902-0 Department of Environmental Conservation requirements, shall be kept and maintained by Grantee in code compliant and good working order, and shall not contaminate or damage Lot 2, water wells and aquifers in the area. (k) The Access Road shall not exceed 25' in width, and shall be maintained by Grantee in a safe and good condition suitable for its purpose. (I) Grantor shall have the right to place locked gates on the Driveway to Lot 2 provided Grantor makes the driveway available to the Permitted Users. (m) The Easement shall be used so as not to disturb Grantor's quiet enjoyment of Lot 2, including blocking Grantor's views. 5. Indemnification of Grantor. Grantee shall indemnify, defend and hold Grantor harmless against any and all claims, including claims for injury to person or property which occurs, or is alleged to have occurred, as a result of the existence or use of the Easement, or anything in, on or under the Easement. · 6. Tertnination. (a) The Easement and the Permitted Use of (a) utilizing for ingress and egress to the Proposed Septic System approximately 235 feet of the driveway for Lot 2 in the area depicted on Exhibit A and marked "Driveway for Lot 2," and (b) constructing and maintaining for ingress and egress to the Proposed Septic System a road access in the area depicted on Exhibit A and marked "Potential Road Access for Proposed Septic System" that is outside the area marked Proposed Septic System, shall terminate if Shelli Drive is completed to the extent that it will provide access to the Septic System. Grantee shall cooperate with Grantor in the preparation and recording of any documents.necessary to aecomp_l_ish the foregging termination. (b) Grantor may terminate this Agreement upon sixty (60) days written notice, if Grantee materially defaults in Grantee's obligations hereunder and such default is not cured to the reasonable satisfaction of Grantor within sixty (60) days after giving the notice. By way of example only, the failure to maintain the Easement or the Septic System in the manner required hereunder, in a material respect, shall constitute a material default. 7. Covenants Running with the Land, Subject to the termination fights as herein provided, the Easement granted, the restrictions imposed, and the agreements contained herein shall be an easement, restrictions, and covenants running with the Grant of Easement and Agreement- Page 4 Page 4 of 7 2015-055902-0 land and, shall inure tO the benefit of, and be binding upon, the parties hereto and their respective successors and assigns, including, without limitation, ail subsequent owners of Lot 2 and Lot 1, and all persons claiming by, through or under them. 8. Sale or Transfer and Release From Liability. In the event of a sale or transfer of Lot 1 or Lot 2, the former owner of the property sold or transferred shall be relieved from any and all obligations and liabilities associated with said property under this Agreement, except such obligations and liabilities as shall have arisen during such owner's ownership of the property. The successor owner or transferee shall have all of the rights and all of the obligations and liabilities granted under this Agreement. 9. Entire Agreement. This Agreement supersedes all agreements previously m.hde between the ~artifig r~lat~g to its ~ubject matter; There are no other understandings or agreements between them except as set forth herein. No amendments to this Agreement shall be enforced unless in writing signed by all owners of Lot 2 and Lot 1 at the time of the amendment. t0. Notices~ Ali notices under this Agreement shall be in writing and delivered personally or mailed by certified mail, postage prepaid, addressed to the parties at the addresses set forth above, or at such other address as a party may designate in writing, and shall be deemed given when personally served or the third day following mailing. 11. Non-waiver. Costs and Attorneys~ Fees. The prevailing party shall be entitled to recover its costs and attorneys' fees in any action to enforce this Agreement or rights granted hereunder. 13o Counterparts. In consideration of the mutual covenants contained herein, the parties to this Agreement agree as follows: 1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as BioBarrier 0.5 located at (legal description) Echo Hills #1, Block 3, Lot 1 2. Maintenance, Repairs and Alterations. (Owner is required to read, understand and initial each section) .T Throughout the term of this Agreement, the Owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. It shall be the responsibility of the Owner during the term of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to $600). �'"C Owner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. �'C Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfreld replacement. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement.
