We are therefore requesting a permit be issued for a well and septic system to serve the new home. The surface are of the lot is small and the available area for the septic system is limited by the presence of ground water close to the surface which makes it difficult to place a conventional septic system. We therefore propose to place an Advantex Treatment System on the lot to provide the most effective treatment of the septic effluent prior to discharge into the surrounding soil strata. The location of the absorption system is shown on the attached Site Plan. Drainage patterns are also shown on the plan and will be modified somewhat as a result of the proposed construction. The ditch on the south side of Diane Drive flows nearly year round. A waiver request is attached to decrease the separation distance from the ditch to the absorption bed to 37'. Two test holes were placed on the lot in the area of the new absorption bed and alternate site. Ground water was found at a depth of 4' below the surface. The percolation rate in the materials encountered was 60 minutes per inch. Our design provides for the bottom of the absorption bed to be at 2' above the ground surface. We are therefore proposing to place a three-bedroom Advantex Treatment System. The absorption bed will be 30' long x 15' wide for a total of 450 square feet of absorption area. The distribution line in the trench will be placed at 2' above the existing ground level. A minimum of 2' of existing material will be removed beneath the bed area and replaced with clean gravel meeting the Municipal Specification for Type IIA Select Backfill. The bed will be covered with 2' of fill and 2" of insulation and 4' of fill will be placed over the septic tank to meet Municipal Code and prevent freezing. The side slopes of the mound will be at 3:1 and extensive landscaping and fill will be required to insure positive drainage away from the finished mound. Lot 1, Sherwood Heights Subdivision July 8, 2015 Page Two The ground surface of the lot slopes from the southeast to the northwest at a 10% slope. The bed will be constructed parallel with the contours of the slope as much as possible in conformance with Municipal requirements. All components of the new septic system will be constructed a minimum of 100' from the well proposed for this lot. No conflicts exist between the proposed well and septic system and those in the area. If the system is constructed in accordance with our design the following statements apply: The system, if constructed as designed, will have no adverse impact on the wells in the area or those to be constructed in the future. 2. The system, if constructed as designed, will have no adverse impact on existing septic systems in the area or those to be constructed in the future. 3. The system, if constructed as designed, will have no adverse impact on reserve space, either surface or subsurface, on any lots located in the area. 4. The new absorption bed is designed for placement near the southern lot line which is located directly north of a flowing ditch along Robin Hood Drive. The southwest corner of the new absorption bed site is 37' from the ditch. A waiver is therefore necessary from the 100' setback required by ordinance. An Advantex Treatment System is proposed for construction on the lot which provides additional treatment to the septic effluent. In addition, the surface drainage path is away from the ditch at a slight grade. A berm will be placed along the property line to protect the ditch. If the system should ever overflow the effluent would follow the natural drainage path away from the ditch. The elevation of the ditch is currently higher than the existing ground in the area of the new absorption bed. The most suitable area to place the new bed is approximately 22' from the southern lot line. The total height of the fill for the absorption bed will be approximately 5' above existing ground. The 3:1 side slope will encroach onto the berm protecting possible overflow of effluent from encountering the flowing ditch to the south. We therefore request a waiver allowing the slope to be 2:1. The slope will be covered with topsoil and seeded with grass. Maintenance will be provided until a flourishing stand of grass is achieved. In consideration of the mutual covenants contained herein, the parties to this Maintenance and Repair Agreement agree as follows: 1. Advanced Wastewater Treatment Systems. Municipality grants permission to Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as Advantex Treatment System located at (legal description). Lot 1, Sherwood Heights Subdivision 2. Definitions. Alteration. Any change to the design or function of an AW WTS that includes the installation or removal of any parts, components or pieces not included in the original construction permit and design. Certificate of On -Site Systems Approval (COSA). An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with Anchorage Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. Maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AW WTS that were included in the original design which would allow the AW WTS to continue to perform as designed. Permit. An On -Site Wastewater Disposal Permit as required by AMC 15.65 to construct and operate an AW WTS. 3. Term. The term of this Maintenance and Repair Agreement shall begin on the date of approval by the Municipality to operate the installed system or issuance of a COSA, and shall continue while the AW WTS is in use or is operational or until the property is sold or title is transferred by the owner and a new COSA is issued to the new owner or transferee of the property. 4. Alterations, Installation and Removal of Additional Equipment. Prior to performing any alterations to an AW WTS, the owner agrees to obtain an On-site Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65. 5. Maintenance and Repairs. A. Throughout the tern of this Maintenance and Repair Agreement, the Owner shall maintain their AW WTS in a satisfactory condition capable of producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. The owner shall enter into a service agreement with an AW WTS service and maintenance provider approved by the municipality and the manufacturer of the AW WTS for the entire term of the AW WTS. In addition, it shall be the responsibility of the Owner during the term of this Maintenance and Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules and orders for the AW WTS. C. Upon request by the Municipality, the owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system. When a record of maintenance is documented and maintained by the system vendor, the owner agrees to allow the Municipality access to this information. D. Owner acknowledges that the fine for failing to maintain and repair an AW WTS may be assessed in accordance with AMC 14.60 for improper discharge. E. Owner agrees that only maintenance and repair personnel approved by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. F. Owner agrees to grant the Municipality reasonable access to test and inspect the AW WTS upon 24 hours written notice. G. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. H. Owner agrees that the AWWTS installation and maintenance requirements as provided by the AW WTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. 6. Nonwaiver. The failure of either party at any time to enforce a provision of this Maintenance and Repair Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Maintenance and Repair Agreement or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 7. Amendment. A. This Maintenance and Repair Agreement shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality that this Maintenance and Repair Agreement was executed with, and such writing shall be attached to this Maintenance and Repair Agreement as an amendment. Also, while at your lot, I discovered the tank you are presently using as a holding tank is located approximately 20 feet from the stream flowing along Robin Hood Drive. This also violates the Wastewater Disposal Regulations. As we discussed at your office on June 15, 1988, the method of wastewater disposal on your lot needs to be permitted, engineered and inspected by an engineer to comply with the ordinance. We agreed that you.would complete this by July 15, 1988. Today I spoke to Stan Hoofard, of the Department, and he informed me that your application for assistance to pay for the required upgrade appeared good. There is from 1 to 4 feet of peat. One former owner attempted to installed a ditch to collect the water and route it off of the lot.. It was only slightly successful. There is a ditch of flowing water on the south. East 156th Avenue is not .built and water is flowing off of it. The well location is shown on the attached sketch. It's location severely limits the use of this lot. The lot would support a peat mound system. Personally, I am optimistic that a peat system would work for him. This site would be a good research site for another system. You may want to discuss this with Lee and Jewell. However, until the research is finished and the MOA decides what it wants to do with peat systems this alternative is probably out of the question. Right now his only apparant option is a holding tank. I would also recommend that he limit his water' use to reduce the costs for pumping maintenance.
