This agreement is made for the purpose of maintaining an on-site wastewater disposal
system on the subject property.
The property owners agree to the following:
Submit to the Municipality of Anchorage, on an annual basis, an inspection and
operation statement from a registered professional engineer. This inspection and
operation statement shall verify that the engineer has inspected all effluent and air
pumps, timers, and alarms, and that any deficiencies have been repaired and that the
system is functioning as designed.

Ref: Sewer Upgrade for Lot 3, Borealis Subdivision
To whom it may concern:
The existing 4 bedroom house is served by an onsite septic system, and a community well. The
existing drainfield is still functional, however, the homeowner wants to upgrade the system.
Comments regarding the proposed upgrade are summarized as follows:
1. GENERAL: There are a number of site restrictions which limit the available spots to put the
new drainfield. These restrictions are summarized as follows:
• The location of the existing septic system/s
• The location of the community well
• The presence of impermeable soils at a depth of approximately 10 feet dictate that a shallow
type system be installed.
Given these restrictions, there is limited space on the lot to put the new drainfield; therefore, we
are proposing to install a bottomless, Intermittent Sand Filter (ISF). We also, request you issue a
3 foot lot line waiver from the east property line to the proposed sand filter.
2. SOILS: On May 7, 1998 a test hole was excavated and percolation test performed at the
area of the proposed septic upgrade. As can be seen from the attached soils log, there was an 18
inch organic layer. The soils below the organic layer was a SM layer with light gravel to a depth
of 6 feet, and then transition to a SM/ML layer to a depth of 16 feet (bottom of hole). At a depth
of 10 feet the soils became very dense with sidewalls smearing which we visually deemed as
impermeable. No ground water was encountered at the time of excavation.
3. TRENCH DESIGN: Bottomless Intermittent Sand Filter (ISF)
a. Percolation Rate: 40 minutes/inch
b. Allowable Application Rate for ISF: 2 gallons/day/ft2
c. Number of Bedrooms: 4
d. Design Flow: 600 gallons per day
e. Minimum Absorption Area: 300 ft2
f. Effective Depth below pressure pipes: 2.5+ inches
g. Width: 10 feet
h. Length: 36 feet.
i. Effective absorption area = 360 ft2 (>225 ft2 OK)
j. Air Supply: Thomas Industries, Model 5070, "Anchorage Tank".
k. Air Supply Line: "Wasteflow" emitterline, 1/2 inch I.D, "Anchorage Tank".
1. Sand Material: Central Paving Products "Winter Road Sand"
m. Pea Gravel: 100% passing 3/8" sieve, less than 20% passing the 1/4" sieve, and
less than 1% passing the #8 sieve.
We are proposing to excavate down to a depth of 3.5 feet to 6 feet (maximum), place a minimum
of 6 inches of sand, install the air supply line, and cover it with 1.5 feet of sand. On top of the
sand, we will place 6 inches of 3/8 inch pea gravel, with the pressure laterals midway in the layer.
We will use a conventional lift station (Anchorage Tank), equipped with a programmable timer so
that flow can be intermittently dosed to the ISF.
4. SURFACE WATERS: There are no surface waters within 100 feet of the proposed septic
system.
5. TOPOGRAPHY: The lot slopes gently from south to north, and from east to west at less
than 15%. Approximately 30 feet to the north of the test hole MT pipe there is a 4 foot cutbank
which drops down to the road. The slope from the bottom of the new ISF to the bottom of the
cutbank is less than 25%. The ISF will be excavated into the side of a moderate hill. The
excavation depth at the deepest point will be 6 feet or less. In short, there are no concerns.
6. MATERIALS AND CONSTRUCTION PRACTICES: The materials used, and the
construction practices will comply with DHHS' "Intermittent Sand Filter Design, Installation &
Maintenance Manual". The contractor should read this document prior to construction. Copies
are available at the Municipal Onsite Services office (5th floor, 9th & L St.).
7. CLOSING: Given the site restriction, I think the ISF is the most viable option for this lot,
short of install a Recirculating Upflow Filter, which would be more expensive. I am open to any
suggestions from your department, which would be an improvement to the proposed design. I am
unaware of any adverse impacts this installation would have on adjacent wells or septic systems.

system in accordance with the guidelines and regulations established by the Municipality of
Anchorage and industry oractices. The reported results describe the condition of the system/s on the
dates of the evaluation. Seoaration distances were measured to readily identifiable features.
Hidden defects or encroachments may exist that were not identified during the evaluation. The
ooerational life of all wells and septic systems deoend on a variety of variables including, but not
limited to, soil conditions, groundwater levels (that may fluctuate during the year), quality of
construction (materials and workmanshio), and the water usage of the family utilizing the systems.
These conditions can vary, and are outside the control of GEG. Satisfactory test results do not
guarantee future oerformance of the systems,; therefore, GEG makes no warranty (express or

MAINTENANCE AND REPAIR AGREEMENT
BETWEEN MUNICIPALITY OF ANCHORAGE

THIS MAINTENANCE AND REPAIR AGREEMENT made and entered into as of this

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Maintenance and Repair Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. Municipality grants permission to
Owner to utilize and operate an Advanced Wastewater Treatment System
(AWWTS), described as
located at (legal description).

2. Definitions.
Alteration. Any change to the design or function of an AWWTS that
includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design.
Certificate of On -Site Systems Approval (COSA). An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with Anchorage
Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that
the systems are adequate for the homes that they support and meet the
codes that were in place at the time of system construction.
Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included
in the original design which would allow the AWWTS to continue to
perform as designed.
Permit. An On -Site Wastewater Disposal Permit as required by AMC
15.65 to construct and operate an AWWTS.
3. Term. The term of this Maintenance and Repair Agreement shall begin on the
date of approval by the Municipality to operate the installed system or issuance of a
COSA, and shall continue while the AWWTS is in use or is operational or until the
property is sold or title is transferred by the owner and a new COSA is issued to the
new owner or transferee of the property.
4. Alterations, Installation and Removal of Additional Eauioment. Prior to
performing any alterations to an AWWTS, the owner agrees to obtain an On-site
Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65.
5. Maintenance and Repairs.
A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall
maintain their AWWTS in a satisfactory condition capable of producing treated
septic effluent in accordance with the equipment's approval for operation in the
Municipality. The owner shall enter into a service agreement with an AWWTS
service and maintenance provider approved by the municipality and the
manufacturer of the A W WTS for the entire term of the AWWTS. In addition, it
shall be the responsibility of the Owner during the term of this Maintenance and
Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay
for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement
costs, and (5) inspection costs.
B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules
and orders for the AWWTS.
C. Upon request by the Municipality, the owner agrees to provide the Municipality a
written schedule of routine maintenance and repairs which have been performed
on the system. When a record of maintenance is documented and maintained by
the system vendor, the owner agrees to allow the Municipality access to this
information.
D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS
may be assessed in accordance with AMC 14.60 for improper discharge.
E. Owner agrees that only maintenance and repair personnel approved by the
Municipality will inspect and make any necessary maintenance, repairs or
permitted alterations to the system.
F. Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS upon 24 hours written notice.
G. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On -Site Systems Approval.
H. Owner agrees that the AWWTS installation and maintenance requirements as
provided by the AWWTS vendor/installer and approved by the Municipality are
the governing guidelines for the construction, maintenance and repair of the
Owner's AWWTS.
6. Nonwaiver. The failure of either party at any time to enforce a provision of this
Maintenance and Repair Agreement shall in no way constitute a waiver of the
provisions, nor in any way affect the validity of the Maintenance and Repair
Agreement or any part hereof, or the right of such party thereafter to enforce each and
every provision hereof.
7. Amendment.
A. This Maintenance and Repair Agreement shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties, with
the same formality that this Maintenance and Repair Agreement was executed
with, and such writing shall be attached to this Maintenance and Repair
Agreement as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this agreement, the only authorized representatives of the parties
are:

b. Municipality: Director. Community Development or designated authority
C. Any attempt to amend, modify, or change this contract by either an unauthorized
representative or unauthorized means shall be void.
8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance
and Repair Agreement shall be brought in the Superior Court for the Third Judicial
District of the State of Alaska at Anchorage. The laws of the State of Alaska shall
govern the rights and obligations of the parties under this Maintenance and Repair
Agreement.
9. Severabilitv. Any provisions of this Maintenance and Repair Agreement decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining
provisions of the Maintenance and Repair Agreement.

Approval (COSA) based only upon the representations given In paragraph 4 by an independent professional civil
engineer registered In the State of Alaska. Certificates of On -Site Systems Approval are required for the transfer
of title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or
water supply system. DSD also Issues COSAs upon request to homeowners. Certificates of Onsite Systems
Approval are valid for 90 days from the date of issue for properties served by a private or Class C well and may
be reissued with new water samples. (Certificates may be reissued for a period of up to one year with valid water
samples.) Certificates are valid for one year for properties served by Class A or B wells or a public water system.
The Municipality of Anchorage Is not responsible for errors or omissions in the professional engineer's work.

In conducting this evaluation, GEG, LtD. attempted to provide a thorough,
conscientious engineering analysis of the system In accordance with ADEC and MOA
DSD Guidelines & Regulations. The reported results described the performance of the
system under the conditions encountered at the time of the test, and separation
distances measured to readilyldentiflable features. The operational life of all wells and
septic systems depend on the local soils condition, groundwater levels that may
fluctuate during the year, and the water usage of the family being served by the system.
These conditions are outside the control of the evaluator of the system. Satisfactory test
results do not guarantee future performance of the system, nor do they guarantee that
there are no hidden defects or encroachments. GEG, LTD. can therefore not provide
any warranty or future estimate of how long the system will continue to meet the
operational requirements of the ADEC or MOA DSD. The content of this report Is for

Subject: HAA for Private Septic System. Lot 3, Borealis S/D.
To whom it may concern:
The subject lot has a 4 bedroom house on it which is served by a private septic system and a class
"A" community well. The results of the field investigation and adequacy tests are summarized as
follows:
A. SEPTIC TANK: The existing septic tank was installed in September of 1974 (approx. 23.5
years old). According to the M.O.A records, it is 1250 gallons, has two compartments and is
made of steel. Most tanks of this type typically have a structural life of approximately 20 years.
No warrantee is made regarding the future life of the septic tank.
B. SEPTIC SYSTEM ADEQUACY TEST: There are 2 septic systems on the lot. The first
system was installed in September of 1974. It is a 4 foot wide trench, 156 feet long (total length
of 4 segments), and has an effective depth of 18 inches. According to the homeowner, there are
no visible standpipes for this system. The second drainfield was installed around 1980 (there is
no date on the M.O.A inspection report). It is 3 feet wide, 53 feet long, and has an effective
depth of 8 feet. The only pipe for this system is a 4 inch sump at the end of the trench. Based
upon our field measurements it appears that the sump only extends about 69.5 inches below the
drainpipe invert (effective depth is 96 inches per the M.O.A inspection report). An adequacy test
was performed on this trench.
On 1/13/98 the liquid level in the trench was 20.5 inches deep. Nine -hundred gallons was
introduced into the sump over a period of 167 minutes. This caused the liquid level in the sump
to rise 44.5 inches, to a total depth of 65 inches (approximately 4.5 inches below the .drainpipe
invert). This corresponds to 20.2 gallons/inch. Nineteen hours and 41 minutes later the level had
dropped 19 inches, indicating an absorption of 384 gallons. This corresponds to an absorption of
468 gallons/day, which is less than 600 gpd as required for a 4 bedroom house. We decided to
retest the system using a less conservative approach.
On 1/15/98 the liquid level in the sump was 39 inches deep (30.8 inches below the drainpipe
invert). Five -hundred and fifty-three (553) gallons of water was introduced over a period of 97
minutes. This rose the level 30 inches (.8 inches below the drainpipe invert), which corresponds
to 18.4 gallons per inch. Sixty minutes later the level had dropped 1.8 inches, indicating that
approximately 33 gallons had been absorbed. This corresponds to an absorption of 795 gallon per
day. Based upon this data the system was deemed to be adequate for a 4 bedroom house (600
gallons per day).
NOTE: The adequacy of a septic system is influenced by numerous factors, including, but not
limited to, seasonal surface water infiltration, groundwater variations, septic system
maintenance (frequency of septic tank pumping, usage of biological additives), condition of
drain pipe and pipe joints (which can be damaged by seismic activity and deteriorate with age),
type of substances deposited in septic system (cigarette butts, sanitary napkins, misc. objects),
and the amount of water being introduced on a continual basis. Consequently, the results of this
adequacy test are only valid for the specific day of the test. Furthermore, because of the limited
nature of this investigation, it is possible that there are hidden defects which may not have been
detected. No warrantee is made regarding the future performance of this septic system
C. SEPARATION DISTANCE FROM ABSORPTION SYSTEM TO THE PROPERTY
LINE: According to the 1980 (?) inspection report, the separation distance from the trench to
the property line is 16 feet. Attached is a site plan which shows the actual location of the sump
(per field swing ties, and a survey which did not show the sump). Based upon our field
measurement, it appear that the trench is only about 6.5 feet from the lot line. To be
conservative, I am going to assume that the trench is 5 feet from the lot line. The current
situation has existed for approximately 17 years, with no known adverse impact. Given these
facts, we are requesting that the subject separation distance be waived to 5 feet. The $115.00
waiver fee was submitted with this package.
D. SEPARATION DISTANCE FROM 1980 TRENCH TO THE CLASS A WELL
WHICH SERVES BOREALIS S/D, ALPHA CIRCLE: The trench installed in 1980 (?) is
only 159 feet from the subject well. The required separation distance at that time was 200 feet.
Was this reduced separation distance approved by the M.O.A at that time, or was the need for a
waiver overlooked? Please provide direction from your department.

Existing Septic System on Lot 3, Borealis S/D.
To whom it may concern:
The subject property has a single family residence on it that is served by a class "A" public well
(PWS#211708). The owner of the property, Jim Hunt, retained Alaska Water & Wastewater to
perform the engineering services to obtain a Municipality of Anchorage Health Authority
Approval (HAA) for the septic system. During our investigation of the system, and the M.O.A
records, it was determined that the drainfield (installed in 1980) was less than 200 feet from the
community well. Based upon the M.O.A records, and our field measurements, the septic system
is about 159 feet away from the well. We have reviewed the ADEC and M.O.A files and were
unable to find any documentation indicating that a waiver was ever granted for this encroachment.
The M.O.A onsite services office (Dan Roth, 343-4744) informed us that an ADEC waiver will
need to be obtained before their department will issue a HAA for the septic system.
The standard approach for evaluating the contamination potential for a hypothetical
encroachment is to use the ADEC point system. Due to the fact that we are not dealing with a
hypothetical case, but rather a real world scenario in which the encroachment has existed for
almost 18 years, it seems pointless to evaluate the contamination potential based upon a
hypothetical point system. In short, the fact that the groundwater quality has yet to be effected ,
after 18 years, is proof that there is virtually no contamination potential. The groundwater
source for Borealis subdivision is a confined aquifer that is protected by tight overlying soils.
Attached is a 100 scale site plan which shows the location of the well. It is impossible to put a
septic system on lots 4, 5, 6, or 7 of Borealis subdivision and maintain the required 200 foot
separation distance; consequently, waivers have been granted in the past for the septic system
upgrades on lots 4, and 6. In the case for Lot 6, Borealis, a waiver was previously issued for a
separation distance of 122 feet to the crib system. If your department determines that a point
evaluation is necessary, please contact us and we will do whatever is necessary to satisfy your
requirements. Based upon the aforementioned facts we are requesting that the separation distance
from the subject well, to the septic system on Lot 3, Borealis subdivision be waived to 155 feet.

Dear Mr. Reith:
I received the correspondence you sent, dated 2/18/98. Per our conversations which followed I
am providing information on the Borealis subdivision well log, recent nitrate/bacteria water
sample results, and soils/groundwater data in the vicinity of the septic system. This information is
summarized as follows:
1. WELL LOG: Per our review of the ADEC file for Borealis S/D, there is no drilling
log for the well located in Alpha Circle. Therefore, we are using the log for the well located in
Omega Circle and assuming that the geological profile is similar (a reasonable. assumption). The
driller's log states that water was not encountered until a depth of 101 feet, but that the static
water level was measured at 75 feet. This is an indication that the aquifer is confined. According
to the log, there is a strata of silt/clay from 37-71 feet, and a strata of gravel/clay from 71-101
feet. These soil layers will hinder the migration of pollutants into the confined aquifer which lies
below them. Over twenty years of exposure to the effluent discharged by the surrounding septic
systems has yet to impact the groundwater source. A number of these septic systems are closer
than the one on Lot 3, Borealis S/D.
2. WATER QUALITY: Per your direction, we pulled samples (from the hose bibb at
Lot 3, Borealis S/D) and had them analyzed for nitrates and bacteria. A copy of the results are
attached. No bacteria was encountered, and the nitrate level was 0.675 mg/l, well below the
allowable level of 10 mg/l.
3. SOIL/GROUNDWATER CONDITIONS ON LOTS 3 & 4, BOREALIS S/D:
Based upon our review of the records for Lot 3, at the M.O.A onsite services office, it appears
that the 1980 septic system upgrade was based upon the soils log performed in August of 1974
(copy of log attached). This test hole was excavated to a depth of 14 feet. No groundwater was
encountered, and tight ML soils were noted at 13-14 feet. The soils was rated for 225 square feet
per bedroom. The existing system is installed to a total depth of 15 feet per the M.O.A inspection
report. The tight soils should (have for the last 20+ years) prevented the migration of untreated
effluent from reaching the subject aquifer. It is uncertain whether the system is in compliance in
regards to the separation distance to groundwater, or impermeable soils. Regardless, the
installation was approved by the M.O.A in 1980.
When the septic system on the adjacent property, Lot 4, Borealis S/D, was upgraded, a waiver
was obtained from ADEC for a reduce separation distance to the subject class "A" well. The test
hole for this upgrade was excavated to depth of 15 feet (copy of log attached). Groundwater was
encountered at a depth of 12.75 feet on 5/8/93. Whether this test hole is representative for Lot 3
is uncertain.
CLOSING: Based upon the aforementioned data, and the fact that over twenty years of septic
system encroachment on this well have yet to adversely effect the groundwater quality, it is
reasonable to assume that there is virtually no potential for subsurface contamination of the well
by the existing septic system on Lot 3. The only other path of contamination would be over the
ground surface (daylighting sewage flowing towards the well). Due to the fact that the house (on
Lot 3) has a daylight basement, it is highly unlikely that the septic system could overflow and
migrate towards the well, since such an event would first require that the basement be flooded
with approximately four (4) feet of wastewater, an event unlikely to go unnoticed.
Based upon the aforementioned facts, and the information provided in our letter to ADEC, dated
2/10/98, we are requesting that the separation distance from the subject well, to the septic system
on Lot 3, Borealis subdivision be waived to 155 feet. If you have any questions, or require

Dear Mr. Hull:
On April 29, 1977, at your request, our office conducted a percolation
test on the septic system located on the above described lot.
The following table represents the level of the liquid in the drainfield.
The depth of liquid in the drainfield was initially 4.4 feet above the
bottom of the stand pipe. For the test, the liquid level was measured
from the bottom of the stand pipe.

The meter used during the test was a Rockwell 5/8" standard water meter.
The meter had previously been calibrated by R&M Consultants, Inc.
Since the house on the lot concerned was occupied, it can be assumed
that the leachfield in question was at its normal degree of saturation.
If it is assumed that the existing four bedroom residence will house
eight people, the average daily load on the disposal system can be
expected to be 600 gallons per day, or 0.42 gpm.
Since the existing disposal system accepted 125.1 gallons in 0:55 minutes
or 2.27 gpm, I would conclude that the leachfield is presently perform-
ing in a satisfactory manner for the attached residence.
