Ref: Proposed Septic Tank Upgrade for Mile Hi Subdivision; Block 2, Lot 3
To whom it may concern:
The existing 3 bedroom house is served by a private well and septic system. The existing
septic system consists of a 1000 gallon septic tank and a crib type septic system that
were installed in 1970. We have been contacted by the owners who has stated to us that
the septic tank is starting to fail (collapsing) based upon information they have received
from their local septic tank pumper (rocks in tank). We are proposing that the existing
1,000 gallon septic tank be decommissioned and a new 1,000 gallon septic tank installed
as shown on the attached site plan and design drawings. Attached is a copy of a letter
dated May 13, 2008 from Dan Roth to Steve Pannone, P.E. that addresses this type of
permitting/installation. According to this letter, a collapsing tank due to age and corrosion
can be replaced and is only required to meet the minimum requirements of the code that
the original tank was constructed under. Prior to 1973, septic tanks were allowed to be
50 feet from a well and according to the 1970 inspection report, the existing septic tank
was 56 feet away from the well. As can be seen on the design, we are proposing that the
new septic tank be placed 88 feet from the well to maximize the distance from the well
and to not have the septic tank under the deck (per the request of the owner). It is our
opinion that based upon this 2008 MOA letter, a waiver is not required and that this
installation meets the code of the original installation (prior to 1973). Per your request, we
did pull water samples for the well and will submit them as soon as they are available.
We are unaware of any adverse impacts this installation would have on adjacent wells or

Thank you for your inquiry and questions regarding our discussions and the requirement to
upgrade a wastewater system what the tank is located within the wall radius. In fomatlating my
response I would also like to assure you it is always my intent to objectively and fairly apply the
applicable code sections to a given situation regardless of the project scope or who the applicant
is. I feel this is an opportunity to not only clarify the application of Anchorage Municipal Code
(AMC) 15.65 but to work forward from here with you in the spirit of cooperation and mutual
respect.
Your request prompted me to ronamirle AMC 15.65, Wastewater Disposal, and specifically
AMC 15.65.120, Nonconforming on-site disposal systems, and our application of the code
section.
In a cooperative effort, the municipality's role as the regulatory agency and yours as the
engineer, we share the on goals. As AMC 15.65.05 identifies, "On-site wastewater disposal
systema provide an important eoonomically efficient, and relatively clean and healthful method
of wastewater disposal in areas of the municipality not served by an integrated sewage collection
and disposal system-" Collectively we accomplish the intent and l appreciate the opportunity to

For the purpose of discussion 1 am including the nonconforming section of the code, below.
15.65.120 Nonconforming on-site disposal systems.
A. Except as provided in this section, any on-site wastewater disposal system installed pursuant
to a construction permit before September 25, 1990, must operate in compliance with the
installation and design standards for that system which were in effect when the permit for the
installation of the system was issued.
B. Repair of broken pipes, moving Parts or perforations of a tank may be accomplished in
accordance.with original or curmntdesign standards.
C. If a component of an on site wastewater disposal system malfunctions and is replaced, its
replacement must be in compliance with this chapter.

D. Cesspools may not be installed or operated.
(AO No. 86-21; AO No. 90-48(S-1))
Historically, the On -Site section has viewed tank collapse or similar situations as "system
malfunctions." Applying AMC 15.65.120 C would require the "replacement mast be in
compliance with this chapter; meaning the tank or system must be redesigned and located in a
manner compliant with current code. Your inquiry provided the impetus for us to review our code
application and processes. in short, we feel your question is valid and AMC 15.6S.1 20 B is the
correct code section in the event of broken pipes, moving parts or perforations of a tank and
repair may be accomplished in accordance with original or current design standards. That would
not be the case if the system malf1mcdoned, i.e. did not function because of inaccurate design,
improper application, etc. However, in the type of situation you questioned here, 15.65.120 B is
the applicable section and will be applied from this data forward.
