Ref: Proposed Septic Tank Upgrade and Waiver Request for Sun Valley; Block 3, Lot 5
To whom it may concern:
The existing 3 bedroom house is served by a private well and septic system. The
homeowner would like to have his septic tank and pump vault upgraded. We are
proposing to install a new 1,500 gallon STEP tank and decommission the old tank and
pump vault.
During our design process it was discovered that the existing drainfields and well have a
separation distance of 85 feet. We request that your department grant a waiver of 85
feet between the three (3) existing drainfields and well. Justification for this waiver is as
follows;
• Encroachment has existed for 31 years.
• Per the drillers log the soil strata in the area consist of mainly silty sand and
some gravel.
• A water sample was pulled on May 14th and the lab results will be forwarded to
you as soon as we get them. The water quality has no bearing on where the new
septic tank will be located.
We are unaware of any adverse impacts this installation or issuance of this waiver
would have on adjacent wells or septic systems. If you have any questions, please

The subject property has established a well near the
house. The 100 foot separation distance limits the available
area for installation of the septic system. The usable portion
of the lot restricts the design to a "step-down" five wide
drainfield (depicted in attached sheets). Slope and ground-
water further restricted the usable area and design.
The undeveloped lot to the south is approximately 1.5
acres, and would have sufficient area to establish house,
well and septic system.

Last year we issued a citation and a stipulated agreement to allow you to wait until this
summer to correct problems with your septic system. The engineering firm of KND has
applied and received a waiver to zero feet from the property line for your septic system.
In the application for the waiver it was stated that you ran a line between the two property
comers and the cleanouts were on your side of the property line. While you may be
correct, your property was surveyed by a Registered Professional Land Surveyor (RPLS),
licensed by the State of Alaska and this survey shows the cleanouts to be on your
neighbors property. We cannot accept your measurements over the survey of a RPLS.
You must provide us with a new as -built survey by a RPLS showing the cleanouts on
your side of the property line before we can close this complaint. You do not need to
have the whole property resurveyed. The surveyor may just update the area containing
the septic system cleanouts in question.
We are sending this to you as a polite reminder of the up coming deadline. If you have
any questions at all, please call me at 343-7912.

Dear Dan,
The owner of the referenced property spoke with you this past week with
regards to the encroaching septic field to the lot line. The owner located both
corners and ran string from each. The property line is slightly to the left of the
string on the attached photo. The property corner closest in the picture is
actually left of the string next to the stake with the yellow clamps.
We do not expect there to be any adverse effect on adjacent lots by the location of
this system. We are requesting that the previous waiver to lot line of 5' be
amended to 0' to lot line.

property line of not less than five (5) feet as approved per AMC 15.65.140, and a
compliance order under AMC 14.50.010(A) directing defendant not to conduct, permit, or
allow others to conduct any similar violations on the property for a period of three (3) years.
Pursuant to AMC 14.50.030, should the defendant fail to corrected the violations within the
fifteen (15) days of the Hearing Officer's decision, the plaintiff, Municipality of Anchorage,
requests an order to enter on the subject property to remove said structure, and charge
defendant the cost of doing so.

Notice of Rights and Procedures
Before the Municipal Administrative Hearings Officer
1. The Administrative Hearings Officer is an employee of the Municipality of Anchorage appointed by the Mayor
and confirmed by the Assembly and derives his/her authority from the provisions of Title 14 of the Anchorage
Municipal Code. The Administrative Hearings Officer is empowered to determine whether violations of the
Municipal Code have occurred and, if so, to order appropriate remedial action to correct the violation and/or
impose civil penalties.
2. The Administrative Hearings procedure is a quasi-judicial proceeding although generally less formal and more
flexible than court proceedings.
All testimony is under oath or affirmation. You will have the right to cross examine adverse witnesses.
The burden of proof and of going forward with the evidence will usually be on the Municipality.
3. A request for a hearing must contain:
a) Your full name and address;
b) The name and address of your attorney should you choose to hire an attorney;
c) A statement that you admit, deny or do not have, and are unable to obtain, sufficient information to
admit or deny the allegations in the Complaint. Failure to respond to an allegation shall be treated as an
admission; and
d) A statement of your defense or basis for denying the facts alleged in this Complaint and the facts
supporting your defense.
4. The procedure used at hearing is in the discretion and control of the Hearings Officer. However, you will be
given an opportunity to make an opening statement, present witnesses and evidence on your own behalf, and to
cross examine the Municipality's witnesses. Prior to or in the course of the hearing, the Hearings Officer may
encourage an off-the-record discussion between the parties for the purposes of defining or limiting the issues
and/or exploring the possibilities of a stipulated settlement.
5. A taped record will be made of all hearings. A copy of such record will be available to you upon request and
prepayment of the cost of copying or transcribing the same.
6. Generally speaking, all evidence of the sort commonly relied upon by reasonable persons in the conduct of their
serious affairs is admissible and may be considered by the Hearings officer. Irrelevant, immaterial, or unduly
repetitious evidence may be excluded. You are expected to have all relevant evidence available at the time set
for hearing.
7. An attorney will not normally represent the Municipality in hearings, although the Municipality may be
represented by counsel if it so desires.
You may be represented by an attorney in these proceedings if you wish.
8. If you are not represented by an attorney, you may, during the course of the proceedings, request a recess to
obtain an attorney if you determine that representation by an attorney is necessary to protect your rights. Such
request is, however, addressed to the sound discretion of the Hearings Officer and willnot ordinarily be granted
without good cause shown.
9. If you are aggrieved by any final order of the Hearings Officer, you may appeal such order to the Superior

Come now the parties, the Municipality of Anchorage, Plaintiff, (hereinafter
"plaintiff') through its designated Code Enforcement Officer, and Richard Metzger and Neva
A. Metzger, (hereinafter "defendant(s)") stipulate and agree that the Complaint of Municipal
Code Violations filed in the above -referenced matter on, August 6, 2002, regarding Sun
Valley Subdivision, Block 3, Lot 5, a lot zoned R-6, Suburban Residential District (Large lot),
(hereinafter "subject property") shall be and is hereby resolved upon the terms set forth below:
Background and Introduction
1. Defendant(s) admit to allowing: Violation #1) Allowing a previously
constructed subsurface disposal field to exist across the property line in violation of AMC
15.65.060 and in violation of a waiver approved under AMC 15.65.140 to construct a
subsurface disposal field not less than five (5) feet from the property line.
2. Defendant(s) understand that in executing this Stipulated Order he has given up
his right to an administrative hearing on the merits of the above described complaint, and in so
doing has waived his rights to having the complaint proven by a preponderance of the
evidence. The defendant acknowledges he has read and fully understands the provisions of
this Stipulated Order and has entered into this agreement willingly and without coercion of
any kind.

1. Defendant(s) will reconstruct the subsurface disposal field in accordance with
AMC 15.65.060 and provide a separation distance of not less than five (5) feet as approved
per AMC 15.65.140 on the subject property by August 1, 2003.
2. Defendant(s) will record this stipulated agreement and the charging document
against the title of the subject property at the District Recorders Office and provide proof of
doing so to this office by September 11, 2002.
3. Defendant(s) heirs or assigns will not sell or transfer ownership of the subject
property until this violation is corrected.
4. Defendant(s) shall pay to the Municipality of Anchorage a civil penalty in the
sum of $300.00 to Account 9210-101-7542-0000-000-2002-754200. Defendant(s) shall be
personally liable for this penalty and if not paid, the penalty may be enforced pursuant to
Anchorage Municipal Code 14.20.030. PROVIDED, HOWEVER, the penalty shall be
suspended, in it's entirety, on the condition that the defendant(s) complies with the provisions
of paragraphs 1 and 2 by the dates specified in the respective paragraphs.
5. The parties further stipulate that the defendant(s) not conduct, permit or allow
others to permit or conduct any similar violations on the subject property for a period of three
(3) years.
6. Upon request filed with the Administrative Hearing Officer by plaintiff
pursuant to AMC 14.50.010(C), the Administrative Hearing Officer may impose a fine
payable to the Municipality of Anchorage (Account 9210-101-7542-0000-000-2002-754200)
in the amount of $250.00 for each day the violations adjudicated herein exist after August 1,
2003. Interest on fines and assessments not paid within thirty (30) days of the decision shall
accrue at the rate of eight percent (8%) per year pursuant to AMC 14.50.040(D).
7. The Administrative Hearing Officer retains jurisdiction in this matter for the
purpose of monitoring compliance and ordering additional relief and/or assessing additional
penalties, if appropriate. This matter may be reset for further hearing and/or imposition of
penalties referred to in this Order upon the motion of either party or of the Hearing Officer's
own motion.
8. Pursuant to AMC 14.50.030, plaintiff or it's designee may enter upon the
subject property and bring it into compliance and charge the defendant(s) with the cost of
doing so, if the property is not in compliance with paragraph 1 of this Order, by said date.
Plaintiff and defendant(s) having resolved the claims asserted in the Complaint of
Municipal Code Violations filed in the above -captioned case, under the terms stated, and the
undersigned finding said terms to be fair and reasonable;
