Dear Reviewer,
The above referenced property has recently had a new Advantex system installed to replace a failed crib.
As you are aware, a permit was issued for another engineer's design which was contingent on additional
soils exploration during construction. C&M Engineering was hired by the owner to inspect the construction
of the system. On 7/8/2016, a test hole was excavated revealing the effluent accepting soils to be a SW
material with some gravel. Percolation test results put the soils into a 1.2 gpd/sgft category. Groundwater
was encountered at approximately 8' below grade. A clayey sandy material was encountered between 8
and 9 feet of depth. On 7/11/16, the Municipality commissioned an additional test hole to a depth of
approximately 7 feet deep, to observe the soil materials, groundwater was not encountered.
The design was modified to remove the sand liner which was required due to the unknown soil conditions,
and the leach field was raised in the soil strata to ensure 6' separation between the bottom of the
excavation and the groundwater table.
We are requesting a change order to approve the removal of the sand liner, change the leach field
elevation, and to accept the as -built separation distances which vary somewhat from the waiver request.
Requested: As- Built Waiver Separation Distances
1. 57 feet: Abandoned well on David Lee Lot 1 to Advantex Tank and Pod
2. 65 feet: Abandoned well on David Lee Lot 1 to absorption field.
3. 81 feet: Well on Subject lot to Advantex tank and pod
4. 95 feet: Well on subject lot to absorption field
5. 40 feet: Well on subject lot to sewer main
6. 80 feet: Surface water to Advantex Tank and Pod
7. 85 feet: Surface Water to absorption field
8. 5 feet Advantex Tank and Pod to foundation.
9. 4 feet Advantex Tank to Absorption Field
10. 4.5 feet Absorption field to crib.
11. 5.5 feet foundation to foundation cleanout.
Waiver request items 1 through 8 are principally the same as approved, with the exception that items 6
and 7 appear to be switched on the original waiver request. Note that the system is installed slightly
differently than the original design.
Waiver request 9. 4 feet tank to absorption field. The tank and absorption field are separated by only 4
feet from the end of the field to the tank. We do not believe this will have an adverse impact on the
drainage of the field as the soils are free draining, and the leach field design relies on only bottom area.
The tank will not be impacted by the field, as the field is effectively above the tank.
The original design showed an encroachment between the absorption field and crib of 6.5 feet, but no
waiver was requested. We believe the reduced separation distance should be approved due to the free
draining nature of the soils, and since the crib is abandoned, any bio -matted soils that may effect the
absorption system, will eventually heal. It is also important to note that the absorption field design relies
on solely the bottom area of the field, and disposed effluent would tend to flow straight down through the
soils.
Included with this letter is an inspection report, drawing, and soil log.

THIS MAINTENANCE AND REPAIR AGREEMENT made and entered into as of this

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Maintenance and Repair Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. Municipality grants permission to
Owner to utilize and operate an Advanced Wastewater Treatment System
(AWWTS), described as
ADVANTEX
located at (legal description).

2. Definitions.
Alteration. Any change to the design or function of an AWWTS that
includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design.
Certificate of On -Site Systems Approval (COSA). An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with Anchorage
Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that
the systems are adequate for the homes that they support and meet the
codes that were in place at the time of system construction.
Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included
in the original design which would allow the AW WTS to continue to
perform as designed.
Permit. An On -Site Wastewater Disposal Permit as required by AMC
15.65 to construct and operate an AWWTS.
3. Term. The term of this Maintenance and Repair Agreement shall begin on the
date of approval by the Municipality to operate the installed system or issuance of a
COSA, and shall continue while the AWWTS is in use or is operational or until the
property is sold or title is transferred by the owner and a new COSA is issued to the
new owner or transferee of the property.
4. Alterations, Installation and Removal of Additional Equipment. Prior to
performing any alterations to an AWWTS, the owner agrees to obtain an On-site
Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65.
5. Maintenance and Repairs.
A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall
maintain their AWWTS in a satisfactory condition capable of producing treated
septic effluent in accordance with the equipment's approval for operation in the
Municipality. The owner shall enter into a service agreement with an AWWTS

service and maintenance provider avvroved by the municipality and the
manufacturer of the AWWTS for the entire term of the AWWTS. In addition, it
shall be the responsibility of the Owner during the term of this Maintenance and
Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay
for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement
costs, and (5) inspection costs.
B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules
and orders for the AWWTS.
C. Upon request by the Municipality, the owner agrees to provide the Municipality a
written schedule of routine maintenance and repairs which have been performed
on the system. When a record of maintenance is documented and maintained by
the system vendor, the owner agrees to allow the Municipality access to this
information.
D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS
may be assessed in accordance with AMC 14.60 for improper discharge.
E. Owner agrees that only maintenance and repair personnel approved by the
Municipality will inspect and make any necessary maintenance, repairs or
permitted alterations to the system.
F. Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS upon 24 hours written notice.
G. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On -Site Systems Approval.

H. Owner agrees that the AWWTS installation and maintenance requirements as
provided by the AWWTS vendor/installer and approved by the Municipality are
the governing guidelines for the construction, maintenance and repair of the
Owner's AWWTS.
I. Owner agrees to provide and maintain a telephone connection to the AWWTS as
required by the AWWTS approval.
6. Nonwaiver. The failure of either party at any time to enforce a provision of this
Maintenance and Repair Agreement shall in no way constitute a waiver of the
provisions, nor in any way affect the validity of the Maintenance and Repair
Agreement or any part hereof, or the right of such party thereafter to enforce each and
every provision hereof.
7. Amendment.
A. This Maintenance and Repair Agreement shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties, with
the same formality that this Maintenance and Repair Agreement was executed
with, and such writing shall be attached to this Maintenance and Repair
Agreement as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this agreement, the only authorized representatives of the parties
are:

C. Any attempt to amend, modify, or change this contract by either an unauthorized

8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance
and Repair Agreement shall be brought in the Superior Court for the Third Judicial
District of the State of Alaska at Anchorage. The laws of the State of Alaska shall
govern the rights and obligations of the parties under this Maintenance and Repair
Agreement.
9. Severability. Any provisions of this Maintenance and Repair Agreement decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining
provisions of the Maintenance and Repair Agreement.

drainfield design is code compliant. If design revisions arerequired, an approved change order
shall be obtained prior to construction. The soils test results shall be submitted with the

Subject: Wastewater Permit & Waiver Request — Design Narrative (Revised June 27, 2016)
Dear Mr. Crewdson:
The home on the subject lot is a two bedroom single family constructed in 1976, with a basement. The
subject property is served by a private well and a septic system. During the process of completing a
COSA on the existing septic system, the septic system was found to be in a failed condition. This design
narrative is to provide you with the information required for the replacement septic system and to
request for separation waivers is summarized as follows:

This is a replacement and betterment for this onsite septic system.
TOPOGRAPHY
The property slopes at 8%-10% toward the southwest, away from the on-site well, the adjacent well and
toward Meadow Creek. The wells are to the north of the septic system and Meadow Creek is to the
west.
SOIL CONDITIONS
Previous approvals and waivers for the subject lot indicated the receiving soils are well graded sands
and gravels. Additionally, the surrounding property onsite soil logs were researched and indicate similar
soils. For the purpose of this submittal we have assumed the same. In the essence of time and money
we are requesting to conduct a test hole and percolation test while the excavator is on site installing the

AdvanTex system. We would submit our findings with our inspection report. If deviations were
required we would request a change order per MOA code.
With well graded sands and gravels there is a possibility that the receiving soils could percolate faster
than one minute per inch. Our design consider this possibility and our field design allows for a 2 -foot
sand liner to be placed under an absorption bed.
Wastewater System
DESIGN FLOWS
Based on a two bedrooms double occupancy the design flow is 300 gallons per day (GPD). The
minimum tanks size within the Municipality of Anchorage (MOA) is 1,000 gallon, two compartment
tank. In the basement, there is submersible grinder pump that pumps the basements wastewater up to
the first floor prior to exiting the dwelling.
PROPOSED TANK AND FIELD REPLACEMENT
The existing tank is reported to be concrete and will be replaced. We a proposing an integral 1,500
gallon AX 20 — AdvanTex tank with an AX 20 Pod. This serves two purposes; first it reduces the foot
print of the tank and AX 20 Pod and subsequent drainage field. Secondly, the advance treatment helps
reduce the impact of the septic system on the environment.
DRAIN FIELD DESIGN
The proposed dwelling is two bedrooms, with a daily flow of 300 gallons. The prescribed application

SUBJECT LOT
The subject lot T14N R2W Section 11, Lot 66 (Remainder) is served by a private well. The well log
for T14N R2W Section 11, Lot 66 (Remainder) is attached. On May 11, 2016, a water sample was
collected and submitted to SGS for analysis of Coliform, Total Nitrates and Arsenic. The results were
compared to test results from April 27, 2012. The table below show the results.

It would appear that the water quality has been improved over time, (it needs to be noted that both tests
are a snap shot in time and do not necessarily indicted future test results). In all cases minimum
allowable limits were not exceeded. It would appears that the existing septic system had no effect on
the total nitrates.

Well Perforation Discussion and Variance/Waiver Request
We have reviewed the well log for the subject lot and concur with the department response. Contrary
to the report presented by others the well is perforated between 24-25 feet below ground surface.
Nevertheless, in spirit of all fairness and public health, welfare and safety, this well has been providing
safe drinking water for the past 40 -plus years. The Municipality has had numerous opportunities on
previous COSA and Health Authority approvals to make some form or change or alteration.
With document I would like to formally request a variance/waiver to the 40' perforation requirement.
I make this request based on a historic water sample results and current sampling; the current sampling
indicates clean water with no detectable Nitrates.
As a mitigating solution we propose the original well drillers recommendation of periodic tests. I would
offer that water samples for bacteria and total nitrate be collected at a minimum of annually and kept
with the wastewater service records; and made available at the Municipality request. In requesting this
variance/wavier it is not to create a new standard or precedence but to formally acknowledge this well
status for future owners, reviewers and engineers.
SURROUNDING PROPERTIES - LOT 1, 2 AND 3 DAVID LEE SUBDIVISION
Attached is the available well logs and well information obtained from the MOA data base log for Lot
1, 2 and 3 David Lee Subdivision.
Lot 1, No water samples were taken on this neighboring lot. This well, which is no longer in use, see
attached photo does not have any information in the database. Though not in use the lot is occupied
and has a single family residence on it.
Lot 2, No water samples were taken on this neighboring lot. This well, which is reported to be drilled
to 100 -feet on paperwork found in the data base. No well log was found.
Lot 3, No water samples were taken on this neighboring lot. This well, which is a Class C well serving
Lots 3 and Lot 6, is reported to be drilled to a depth of 76 -feet, with a static water level of 17 -feet. No
well log was found.
Both wells are identified on the attached site plan.
Waiver and Separation Distances
The proposed separation distance waivers being sought for are:
• 58 — feet Abandoned well to AdvanTex Tank and Pod for Lot 1 David Lee Subdivision
• 60 — feet Abandoned well to absorption field for Lot 1 David Lee Subdivision

Based on this submitted information, it is our opinion that the lesser separation distance has not and will
not have an adverse effect on the groundwater or the public health, welfare or safety. We further add
that no mitigation is required, in light of the historical use of this onsite septic system.
• Any leaks from the septic tank would need travel through sandy and gravel prior to reaching the ground
water. EPA states the within 2 -feet of a leach field there is significant water quality improvement.
• Should the untreated septic effluent reach the groundwater is would be carried southwesterly away from the
drinking water sources.
• The topography of the parcels indicate surface and ground water flow is away from the wells
• The existing system has been operating under the same existing waivers and the test results from water
sampling show negative impacts.
We do not anticipate any adverse effects on the neighboring, septic systems, reserve areas or drainage
patterns by the installation of the proposed replacement septic system. This subdivision is served by a
private wells.

You have requested additional information regarding the separation distance from the tank and
absorption field to the foundation. That portion of the house east of the porch is a full basement and the
portion of the porch and westward is on piers typical of post and beam construction, therefore the
potential for undermining the footing/foundation is minimal. We have provided a drawing to help
illustrates how the lesser distance is mitigated
Furthermore due to the postage size lot, the waiver is being requested to stay within the available space
this lot has.
We do not anticipate any adverse effects with the lesser separation distance on the tank, field or the
house and its inhabitants.

a.) The proposed well shall be cased to a minimum of 40 feet below the ground surface. The outer annular space for
the entire length of the well casing shall be grouted with bentonite slurry or granules.
b.) The existing well shall be permanently decommissioned in accordance with AMC 15.55.

Well Permit and Waiver Request from on-site well to seepage pit and sewer main, and
seepage pit to surface water and adjacent property inactive well.
Dear Mr. Roth:
Eagle River Engineering Services (ERES) is applying for a waiver of separation distance to 98'
(allowing for several feet from the standpipe to edge of seepage pit) from the proposed new
onsite well for the above referenced property, to the edge of the seepage pit installed on this same
property in September, 1971, and the on-site septic tank 88'away from the proposed new well.
There is a current Health Authority Approval in the works for this lot awaiting the result of this
Well permit and new well, and Waiver Request. Additionally, we are requesting waivers for
seepage pit to surface water of 85'(Meadow Creek), and from the property's seepage pit to the
neighbor's inactive well on Lot 1 David Lee Subdivision, installed in 1956, for a distance of 67'.
Finally, we are requesting a waiver from the on-site well to the sewer main running up VFW
Road. To our best knowledge, the distance from the on-site well to the sewer main is 40'+/-.
We list the following factors and characteristics in support of this waiver:
Soil Characteristics: The original inspection report indicated that the soil was well graded gravel
and sand -type material, which is consistent with the well log detailed below.
Well Characteristics: A well log was found on the DNR website identified as "Lot 66 and 67".
The well log indicates sandy gravel from 0-15 feet below ground surface, with silty/clayey
material from 16-24 feet. Twenty-four to 28 feet is water bearing gravel layer. Deeper than 28
feet is silty gravel then clay to 90'. The well is cased to 40+ feet below ground surface. It is
unknown at what depth the casing is perforated, but to our best assessment, it is deeper than 40'.
We have also included a well log from Lot 3, David Lee Subd., which is approximately 150' to
the North. ERES believes that the silt and clay create a barrier, filtering and/or stopping septic
effluent from reaching the water supply.

Surface Slope: Surface Slope is at 8%-10% toward the Southeast, away from the on-site well
casing, away from the adjacent well, and away from Meadow Creek. The wells are to the North
of the seepage pit, and Meadow Creek is to the West of the seepage pit.
Other Factors: There is a 30+ year history of continuing use of this well and septic system.
Current water samples indicated no fecal coliform or other bacteria, and 0.419 mg/L nitrate, well
below the allowable limit of 10 mgt.
AWWU Sewer main characteristics: The AWWU sewer main was installed in 1995, and is
approximately 40' from the property's well. The sewer lines consist of dual 10" polyethylene
pipes at approximately 10' of burial. The nearest manhole is over 100' from the subject
property's well.
No other area exists on the lot in which to install a new water well meeting all of the MOA water
well code requirements. The area to the north of the fencline on this property has been deeded to
the owner of Lot 2 in exchange for Lot 66's house, deck, and fence encroachments onto their lot.
By drilling a new well 5' to the north, we are maximizing the distance from the on-site septic
system to the new proposed well. The granting of this well permit and waivers is crucial to
providing this residence with a potable water source, and we cannot see any adverse impact on
human health or future development if this waiver is granted.
The existing well shall be abandoned per the new MOA Water Well Code.

29' is quite a bit different than the well Tog's static water level of 11'. Additionally, the static
water level that we encountered is below the level of the perforations indicated on the well log
(24-25'). The well log indicates sandy gravel from 0-15 feet below ground surface, with
silty/clayey material from 16-24 feet. Twenty-four to 28 feet is water bearing gravel layer.

General
1. Total coliform and other bacteria were not detected for the water sample collected from the well on the subject lot.
A nitrate concentration of 0.419 mg/L was reported for the water sample. The well on David Lee, Lot 2 is out -of -
service. A water sample could not be collected from the David Lee, Lot 2 well.
2. The existing well on the subject property was installed on April 16, 1974 at a total depth of 90 feet. The well is
cased to a depth of 90 feet with perforations from 24 to 25 feet. The existing well is to be properly decommissioned.
The proposed well is to be installed a minimum of 40 feet into the unconsolidated material. The outer annular space
for the entire length of the well casing shall be grouted during construction. The well log for this property identifies a
silt/clay layer from 16 to 24 feet.
3. The existing wastewater disposal system on the subject property was installed on September 8, 1971. The septic
tank is constructed of concrete. The seepage pit consists of 2 precast 3 foot height concrete rings.
4. Due to lot size and location of septic systems and water wells on surrounding properties, there does not appear to
be an area on the subject property to meet the current minimum separation requirements for a wastewater disposal
system or water well.

MAINTENANCE AND REPAIR AGREEMENT
THIS MAINTENANCE AND REPAIR AGREEMENT, herein the "AGREEMENT" made and

Anchorage, herein the "MUNICIPALITY", in accordance with Anchorage Municipal Code
(AMC) 15.65.365. In consideration of the mutual covenants contained herein, the parties to this
Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS),
described as Orenco Advantex
located at (legal description)

2. Maintenance Repairs and Alterations.
(Owner is required to read, understand and initial each section)
Throughout the term of this Agreement, the Owner shall enter into a service agreement
with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.
It shall be the responsibility of the Owner during the term of this Agreement to pay for all
repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically $400 to $600).
Pim Owner agrees that only maintenance and repair personnel approved by the Municipality
or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.
11i Owner acknowledges that regular maintenance of an AWWTS reduces the potential
failure of the system, which could include sewage backup and costly repairs or drainfeld
replacement.

-� Owner acknowledges that the Municipality may request records of maintenance and
repairs from the manufacturer's representative or maintenance provider.
Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be
assessed in accordance with AMC 14.60.030.
AIA Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS. The Municipality will give at least 24-hour notice.
Owner agrees that any sale or transfer of title of the property will not occur without a new
Certificate of On -Site Systems Approval.
AAN Owner agrees that the AW WTS installation and maintenance requirements as provided
by the AWWTS vendor/installer and approved by the Municipality are the governing
guidelines for the construction, maintenance and repair of the Owner's AWWTS.
M Owner agrees to maintain remote monitoring of the AWWTS as required by the
AWWTS approval.
3. Term. The term of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any part hereof, or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6, Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be
brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the
parties under this Agreement.
7. Severability. Any provisions of this Agreement decreed invalid by a court of competent
jurisdiction shall not invalidate the remaining provisions of the Agreement.

The Municipality of Anchorage Development Services Department (DSD) Issues Certificates of Onsite Systems
Approval (COSA) based only upon the representations given in paragraph 4 by an independent professional civil
engineer registered in the State of Alaska. Certificates of On -Site Systems Approval are required for the transfer of
title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or water
supply system. DSD also Issues COSAs upon request to homeowners. Certificates of Onsite Systems Approval
are valid for 90 days from the date of issue for properties served by a private or Class C well and may be reissued
with new water sample results. (Certificates may be reissued for a period of up to one year with valid water
samples.) Certificates are valid for one year for properties served by Class A or B wells or a public water system.
The Municipality of Anchorage Is not responsible for errors or omissions in the professional engineer's work.
4. STATEMENT OF INSPECTION BY ENGINEER
As certified by my seal affixed hereto and as of the validation date shown below, I verify that my Investigation,
based on procedures outlined In the Certificate of On -Site Systems Approval Guidelines for this application,
shows that the on-site water supply and/or wastewater disposal system is (are) safe, functional and adequate
for the number of bedrooms and type of structure Indicated herein. I further verify that based on the Information
obtained from the Municipality of Anchorage files and from my investigation and Inspection, the on-site water
supply and/or wastewater disposal system is(are) In compliance with all applicable Municipal and State codes,
ordinances, and regulations In effect at the time of installation.
