RE: OSP221210 - SEPTIC SYSTEM UPGRADE PERMIT

In lieu of removing and replacing the existing absorption bed as previously permitted, Mike N.
Anderson, PE has conducted soils excavation (MNA #1 TH) as attached and the design has been
modified to install the proposed deep trench with a diverter to have two absorption fields. Also, as
MOA requested, attached is the MOA AWWTS of the new owner. The installation of this
Advantex septic system was delayed due to supply chain and weather issues. Mike N. Anderson
would like to install the septic system next week.
The lot and area are served by private wells. The design is based on the existing soils, slopes, and
available documents. The separations will be staked prior to construction and a new as -built survey
completed after installation. The design will not impact any of the neighboring properties.

Rot: Application for leachfield replacement. Lot: 3, Block
1, Rovier Subdivision.
To whom it may concern:
Attached is the application, site plan, and design/drawings
for the subject loach'fiold replacement. Comments regarding
the proposed work are itemized as follows.
1. The proposed bed system is located on a ridge - which runs
in the east/west direction._ Approximately .10 feet north of
the bed, the property drops off at a slope of .55% down to
Rabbit Creek Road, and approximately 10 tool, youth of the
bed, the property drops off at slope of 25%_ Installation
of the bed at this location does not comply with the 50 too(..
setback required by requlation. However, duo to the fact.
that this is the only suitable site on the property for the
bed, we are requesting a waiver. Further justification for
this waiver can be based upon the fact that the soil layer
below the bod is very porous. Consequently, wastewater
should percolate downward rather rapidly, minimizing the
possibility of wastowater Leaching out the side of the hill
2. The design is based on a percolation rage of ..7
UPD/saq.ft., For the nand f.i.l.tnr layer. A sand falter was
required because the gravel soil layer, below the bed,
„perked" faster than I minutes per inch. Since the home has
three bedrooms, it has a daily design flow of 450 GPD. The
required bed area 450/.-7 = 643 sq.ft.. The bed dimensions
arca 18'-0" X 36'-0", for a total area of 648 sq. fit.

Anchorage, herein the "MUNICIPALITY", in accordance with Anchorage Municipal Code
(AMC) 15.65.365. In consideration of the mutual covenants contained herein, the parties to this
Agreement agree as follows:
1. Advanced Wastewater Treatment_ Systems. The Municipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS),
described as AN ADVANTEX SYSTEM
located at (legal description) J
2. Maintenance, Repairs and Alterations.
(Owner is required to read, understand and initial each section)
'�A Throughout the term of this Agreement, the Owner shall enter into a service agreement
with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.
It shall be the responsibility of the Owner during the term of this Agreement to pay for all
repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically $400 to $600).
Owner agrees that only maintenance and repair personnel approved by the Municipality
or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.

Owner acknowledges that regular maintenance of an AWWTS reduces the potential
failure of the system, which could include sewage backup and costly repairs or drainfield
replacement.

Owner acknowledges that the Municipality may request records of maintenance and
repairs from the manufacturer's representative or maintenance provider.
Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be
lassessed in accordance with AMC 14.60.030.
Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS. The Municipality will give at least 24-hour notice.
Owner agrees that any sale or transfer of title of the property will not occur without a new
Certificate of On -Site Systems Approval,
M Owner agrees that the AWWTS installation and maintenance requirements as provided
by the AWWTS vendor/installer and approved by the Municipality are the governing
guidelines for the construction, maintenance and repair of the Owner's AWWTS.
Owner agrees to maintain remote monitoring of the AWWTS as required by the
AWWTS approval.
3. Term. The terrn of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any pari hereof, or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be
brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the
parties under this Agreement.
7. Severability. Any provisions of this Agreement decreed invalid by a court of competent
jurisdiction shall not invalidate the remaining provisions of the Agreement.

The Right -of -Way Division has reviewed a request for a letter of non -objection to an existing water well ,
which encroaches one foot into the 5' Utility Easement on the eastern property boundary. On the
as -built survey dated April 14, 2000, submitted with the request, the petitioner has shown the existing
water well.
This letter of nonobjection is issued with stipulations, and by using it the petitioner is agreeing to the
following:
I. Municipality of Anchorage (MOA) will be held harmless, now and forever, for any damages or
injury to any person as a result of the encroachments.
2. All applicable codes and regulations will be observed and maintained within the easement.
3. This letter of nonobjection will in no way preclude MOA from full use and enjoyment of its rights
within any portion of the easement.
4. Additional and extraordinary costs incurred during any future required construction, repair or
reconstruction of MOA improvements to accommodate any or all of the encroachments shall be paid
by the property owner.

The property described as Lot 3 Block 1 Rovier Subdivision recently had the on-site
wastewater disposal system and water well evaluated to obtain a Certificate of Health
Authority Approval. The engineer performing the evaluation discovered that the well
serving the home on this property is being encroached upon by the wastewater system
serving the home on Lot 4 Block 1 Rovier Subdivision. According to our records you
are the owners of lot 4. The separation is 95 feet from your septic tank to lot 3's water
well. The required separation distance is 100 feet. This is a violation of Chapter 15.65
of the Anchorage Municipal Code for On -Site Wastewater Disposal Systems.
The well on lot 3 was constructed on June 30, 1976 and the septic tank serving the
home on lot 4 was constructed on October 6, 1977. It is the responsibility of the
property owner of lot 4 to resolve this encroachment matter because the well on lot 3
was in place at the time the septic tank on lot 4 was constructed.
Anchorage Municipal Code chapter 15.65.033 requires that all single family homes
within the Municipality of Anchorage served by a wastewater disposal system and/or a
water well shall obtain a Certificate of Health Authority Approval from the Department of
Health & Human Services prior to the title transferring. Your property is not eligible to
obtain this Certificate of Health Authority Approval until the separation encroachment
between your septic tank and lot 3's water well has been resolved.

Ref: Waiver Request for Well Separation to Adjacent Septic Tank for HAA
Rovier S/D, Lot 3 Block 1
WELL AND SEPTIC TESTING: The existing referenced 3 bedroom house is served by a
private well and septic system. On April 10, 2000, we performed a well flow test and a septic
adequacy test at the subject property. As per MOA records, the septic system consists of a 1000
gal tank installed in September 1976, and a 42 ft x 20 ft bed -type drainfield, installed in August
1991. A total of 532 gallons of water were introduced into the cleanout in the drainfield, with no
fluid measured in the monitoring tube. Elevations of the bottom of the monitoring tube and
cleanouts were verified with a transit. During the well flow test, the well produced an average of
5.32 gallons over 100 minutes. These results are sufficient for a 3 bedroom house.
WAM,',R REQUEST: The well on the subject property is located 95.1 ft from the septic tank
on the adjacent property at Rovier S/D, Lot 4 Block 1. This distance was measured with a
Topcon GPT -1003 surveying instrument. The well on the subject property was completed on
June 30, 1976. The septic system on Lot 4 was installed in October 1977. No waiver was
obtained at that time.
Attached are a site plan, a detail drawing, and a topography site plan showing the encroachment
that exists. As can be seen on the detail drawing, the well encroaches upon the adjacent septic
system at Rovier S/D Lot 4 Block 1. We request that your department issue a 93 foot separation
distance waiver from the well on Rovier S/D Lot 3 Block I to the adjacent septic system at
Rovier S/D Lot 4 Block 1. Justification for the waiver is as follows:
• As can be seen on the topography site plan, the ground surface elevation in the area of the
septic system is lower than the ground surface elevation at the well, so that if any effluent
were to surface, it would flow away from the well.
• The location of the septic system is in a very visible area so that if any effluent was to
surface, it would be noticed and the problem corrected.
