Dear Mr. Hardee:
We are subrnittin{~ herewith the test boring results and our comments regard-
ing so~l conditions encountered at the subject site. This investigation was
performed in accordance with your request of May 9, 1973 and those procedures
outlined in a letter dated September 13, 1971 by 1V[r. Rol~ Strickland o~ the
Greater Anchorage Area Borough~ Department of Environmental Quality.
A sip~le test hole was put down within the Lot 55]- area for the purpose of
defining general subsurface soil conditions ~or the proposed sanitary system.
Excavation was accomplished.with a tractor-mounted backhoe and the test hole
was extended to a total depth o~ ll feet below ground surface. The ~inal log
prepared for the test hole has been included in Drawing A-01.
Ground water was not encountered in the test hole.

In conducing this evaluation, AWWC, In~ altempted to prm4de a thorough,
conscientious engineering analyals of the system In accordance w/ih ADEC and MOA
DSD Guidelines & Regulations. The reported results desedbed the performance of the
system under the conditions encountered at the time of the fas~ and separation
distances measured to readi~/ identifiable features. The operational fife of all wells and
septic systems depend on the Iocal sells c~3dition, groundwater levels that may
fluctuate durlng thereat, and the v,-ater usage of the family being sen/ed by the system.
These conditions are outside the contel of the evalual~r of the system. ~ab'sfactory test
results do not guarantee fulure performance of the system, nor do they gusrantoe that
lhere are no hidden defects or enc~achmonts. AWWC, Inc. can therefoce not provide
any wan'anty or future eslimate of how long the system wfli continue to meet the
operational roqulraments of the ADEC or MOA DSD. The content of this report Is for

Your request for a waiver of the required 10 feet horizontal separation of the on-site wastewater
disposal system to the lot line has been approved. The approved separation distance is 5 feet.
This waiver approval applies to the current on-site wastewater disposal system and lot line
separation only. Any future upgrade to the on-site wastewater disposal system and lot line will
require all separation distances to be met or another waiver approval from this department.

ACS has no objection to the encroachment of the septic system 4.5' into
a platted easement located on T13N, R3W, Sec. 33, Lot 55J, as depicted
on the as-built drawing submitted.
Acceptance and use of this letter of non-objection by yourself, your
heirs, your assigns, or your successors, will constitute agreement to
the following stipulations:
1. ACS will be held harmless, now and forever, for any damages
or injury to any person or property as a result of this
encroachment.
2. Any ACS facility damaged or destroyed as a result of this
encroachment will be repaired at no cost to ACS.
3. Any costs incurred by ACS for special construction
necessitated by this encroachment will be borne by the
property owner.
All applicable safety code regulations will be observed and
maintained.

Encroachment into Utility Easement
Dear Property Owner:
The Anchorage Water ~ Wastewater Utility received a written request from Alaska Water
&r Wastewater Consultants, Inc., on May 31, 2001, for a letter addressing AWWU's
position regarding existing septic system that is encroaching approximately 4.5 feet tnto
the utility easement located on the west 10' of the referenced lot. Submitted with the
request was a drawing dated Play 16, 2001, Indicating the location of the utility easement
and the existing encroachment.
AWWU water and sanitary sewer mains are not available to the referenced lot.
AWWU issues this letter with stipulations to allow the septic system within the easement
and by using It the property owner is agreeing to the following:
1. AWWU will be held harmless, now and forever, for any damages or injury to any
person as a result of the encroachment;
2. All applicable codes and regulations will be observed and maintained within the
easement;
3. This letter of non-objection will in no way preclude AWWU from full use and
enjoyment of its rights within any portion of the easement; and,
4. Additional and extraordinary costs Incurred during any future required construction,
repair or reconstruction of AWWU facilities to accommodate the encroachment shall
be paid by the property owner.

cooperative, (herein"Chugach'), whose address is P. O. Box 196300, Anchorage, Alaska 99519
and Winfred D. Brandon of Anchorage (herein"Permittee"), whose address is 4900 Chuck
Drive, Anchorage, Alaska 99507. '
1. Easem~t. Chugach is the grantee or user of an easement for the construction nad
maintenance of elech'ical facilities as follows:
Dedicated by the plat of thc subdivision known az Lot Fifty-five 'T' (55J),
Section Lot 55, a Subdivision bf Section Lot 55, according to Plat Nmnber
69-107, recorded on the 1st day ofAugust, 1969, on file in the office of thc
District Recorder, Anchorage Recording District, Sew~ Meridien, Alaska,
(hereto Easement ) which pertains to the following described real property.
The West Ten Feet (W I 0') of Lot Fifty-five "J" (550, 5ec~on Lot 55, a Subdivision
of Section Lot 55, according to Plat Number 69-107, on file in the office of the
District Recorder, Anchorage Recording District, Seward Meridian, Alaska.
Permittee acknowledges the 'validity of the Easement. Permittee warrants and ~-presents that
Pcrmittee is the owner of the fee simple interest in the land subject to the Easement and the
following described real property to which the Ea.~ment is adjacent:
Lot Fifty-five "J" (550, Section Lot 55, a subdivisloh of Section Lot 55,
according to Pht Number 69-107, on file in the office of the District Recorder,
Anchorage Recording District, Seward Meridian, Alazka,
(herein "Parcel").
2. Encroachment. Permittee has purchased or cons~ucted the following
improvements on or udlhln the real pwpen'y subject to the Easement:
A septic system crib that encroaches approximately Five Feet (5') into the
~ent for a distance of approximately Twelve Feet (12'),
(herein "Encroachment").

Permit. Chugach hereby authorizes Permillee to continue the existence of the
Encroachment in ils current location subject to the covcoaats set forth in this permit.
4. ~. Permittee shall indcnmify and hold Chugach harmless from any
claims for personal injury, property damage or other loss arising in any way fiom the
construction or continuation of the EncroachmenL
5. Bio Expansion or lncrea.m. Permittee shall not in any way expand or increase the
extent to which the Encroachment occupies any of the real property encumbered by the Easement
without the prior w~ittcn consent of Chugach. Chugach has no obligation to provide such
consent
6. Ho Interest in Real Estate Acouired. Pctmittec hereby acknowledges that the
Encroachment and any additions thereto, even if in violation ofthis permit, has not and shall not
in the future give rise to any interest or eslate in the real propen'y subject to the Easement or any
other real prope~y. Without in any way limiting the foregoing, Permittee acknowledges that the
Encroachment is not adverse to any interest of Chugach and its continuation is entirely with the
permission of Chugach for purposes of the common law doctrine of adverse possession. This
permit creates no interest in the real pwperty subject to the easement.
7. · Modification of Utility Facilities. If the electric utility facilities located within the
Easen~nt are upgraded, added to, replaced or reconstructed. Permittee shall pay that portion of
· Chugach's total costs for such modification which is reasonably attributable to accommodating
· or pre~'rving the Encroachment. lfsuch payment is not made within thirty (30) days of written
demand for same, Chugach may terminate this i~,.,it in accordance with paragraph 9. below.
8. Covenants Runnin~ with the Land. The obligations of the Permittec arising f~om
this permit shall be covenants rtmn;ng with the land which shall burden the Parcel and the
Permittee's interest in thc land subject to the Easement and shall benefit the Easement.
9. ~. Chugach may lerminate this permit after the giving of thlrty (30)
days written .notice of such termination if:

b. Thc Encroachment is damaged by any means to an extont of more
than thirty percent (30%) of its replacement cost at the time of destruction.

of Alaska has no objection to the septic system encroaching into the 10' utility easement
on the west property line of Lot 55J, BLM Lot 55. Known as 4900 Chuck Drive in city
grid 1834.
This letter of non-objection in no way precludes GCI Cable from full use and enjoyment
of any rights it may have within any portion of the utility easement and or the right-of-
way, including unlimited access for servicing its facilities. Also any additional and
extraordinary costs incurred during any future required construction, repair or
reconstruction of GCI's facilities to accommodate any or all of the encroachments shall
be paid by the property owner.
By signing below, you agree to indemnify and hold GCI Cable harmless, now and
forever, for any damage, costs, expense (including reasonable attorney's fees), liabilities

Dear Sir:
The Department has reviewed the above waiver request. A temporary three
year approval is given with the stipulations that:
1. Applicant shall initiate a request for a Lateral Improvement
District (LID) in the manner prescribed by AWWU.
2. Property owner shall hook up to new sewer line when constructed,
and
3. Property owner shall conduct approvable revisions to on-lot
water and/or sewerage facilities after three years if com~mnity water
is not available by that time.
